On 10 March 2023, John Vervaele retired as professor of Economic and European criminal law at Utrecht University. On the occasion of that farewell, this liber amicorum was presented to him. It comprises 85 contributions, written in a variety of languages by friends, colleagues and former colleagues from all over the world.In keeping with the tradition of the Willem Pompe Institute for Criminal Law and Criminology, the contributions are arranged around the following themes, which have also been central to John's work: criminal justice, core values and human rights; crime, criminology and criminal justice; criminal justice and European integration; corporate crime and the enforcement of socio-economic law; and conflicts and transitional justice.The contributions are very worthwhile for an academic audience, as well as for legal practitioners.

La importancia del Derecho Internacional de los Derechos Humanos y de la integración del mismo, dentro del Derecho interno de los diversos Estados, como derecho aplicable, le ha conferido un carácter constitucional o supraconstitucional. La relevancia que ha adquirido el diálogo entre la Corte Interamericana de Derechos Humanos y el Tribunal Europeo de Derechos Humanos, les ha llevado a compartir muchas de sus decisiones con una cierta frecuencia. En la presente obra, profesores españoles, costarricenses y alemanes escriben sobre la doctrina europea y centroamericana corroborando ese diálogo entre el Tribunal Europeo sobre Derechos Humanos y la Convención Americana sobre Derechos Humanos. Con este primer título'Principios y garantías penales y procesales en la doctrina de la CIDH y el TEDH'y con la voluntad de llevar esta obra al mayor nivel de difusión posible, se ha materializado un acuerdo de colaboración entre Editorial Jurídica Continental de Costa Rica, 1997 y J.M. Bosch Editor de España -cuyos orígenes se remontan a 1889- para publicar esta obra en ambos países con idéntico contenido, reflejando un esfuerzo de divulgación científica conjunto, sobre una materia que trasciende los marcos del interés jurídico y político criminal nacionales y dando así comienzo a una serie de ediciones jurídicas de calidad, con autores de ambas regiones.

Can we rely solely on statistics when we judge what is true and just? This book takes a holistic approach to addressing this question. It considers the legal trial as its paradigmatic case study before analysing a wide range of different cases, including profiling, the use of algorithms to predict students'grades, and the authorisation of automated cars. The book suggests that when we make judgements about the truth or about justice, approximations are not good enough. Truth and justice are uncompromising. They must be so, because the value that underlies them both is respect; and respect takes no compromise. Thus, in the search for truth as in the search for justice, a body of evidence that imposes a statistical compromise will not do. Only evidence that in principle allows reaching the truth and doing justice is good evidence. Once such evidence has been traced, the burden is on us to make good use of the evidence and reach truth and justice. We might or might not succeed, but once we have done our best on evidence that allows success, our judgements are justified; and as such, they can resolve conflicts over the truth and over justice.

In European Judicial Responses to Security Council Resolutions: A Consequentialist Assessment, Kushtrim Istrefi examines the multiple effects of European courts decisions as regards Security Council targeted sanctions and security detentions interfering with fundamental rights. He elaborates what type of judicial responses ensured real and practical respect for human rights for the petitioners, encouraged Security Council due process reform, clarified Security Council authorisations on security detentions, and tested the primacy and universal character of the UN Charter. Making use of legal and non-legal instruments, Istrefi sheds some light upon what happened to, among others, petitioners, the SC due process reform agenda, and the UN Charter after such cases as Kadi, Al-Jedda, Ahmed, Al-Dulimi.

'In The Right to Appeal in International Criminal Law Dražan Djukić describes appeal proceedings in international criminal law and evaluates them against human rights benchmarks. While international criminal courts and tribunals mainly comply with these benchmarks, they have fallen short in certain important areas. Despite their importance to the legal process, appeal proceedings tend to receive limited attention. On the basis of benchmarks arising from international human rights law, Dražan Djukić systematically assesses the law and practice concerning appeal proceedings in international criminal law'--

This volume considers the way in which the focus on individual rights may constitute an obstacle to ensuring fairness in criminal proceedings. The increasingly cosmopolitan nature of criminal justice, forcing legal systems with different institutional forms and practices to interact with each other as they attempt to combat crime beyond national borders, has accentuated the need for systems to seek legitimacy beyond their domestic traditions. Fairness, expressed in terms of the right to a fair trial in provisions such as Article 6 of the European Convention on Human Rights, has emerged across Europe as the principal means of guaranteeing the legitimacy of criminal proceedings. The consequence of this is that criminal procedure doctrines are framed overwhelmingly in'constitutional'terms – the protection of defence rights is necessary to restrict and legitimate the state's mandate to prosecute crime. Yet there are various problems with relying solely or predominantly on defence rights as a means of ensuring that proceedings are'fair'or legitimate and these issues are rarely discussed in the academic literature. In this volume, scholars from the disciplines of law, philosophy and sociology challenge various normative assumptions underpinning our understanding of fairness in criminal proceedings.

Der Sicherheitsrat der Vereinten Nationen beschloss im Februar 1993 die Errichtung des Internationalen Strafgerichtshofs für das ehemalige Jugoslawien. Art. 15 des Statuts übertrug den Richtern die Ausformung der Prozeßordnung. Art. 20 Abs. 1 verpflichtet die Richter zur Gewährleistung eines fairen Verfahrens. Vor diesem Hintergrund ist Gegenstand der vorliegenden Arbeit eine Untersuchung der Umsetzung dieser Vorgaben bei der Konstituierung und Zusammensetzung der Richterschaft des Tribunals, seiner Vorgehensweise bei der Ausformung des Prozessrechts sowie der geschaffenen Prozessordnung.
