Given the crises shattering the European Union since several years, from the financial crisis up to the refugee crisis and the vote on Brexit, Euro-scepticism and rejection are growing; a pending crisis of legitimacy compels us to analyse not only causes but also the potentials of enhancing legitimacy. This volume originates from contributions and discussions of two conferences held by the European Constitutional Law Network (ECLN). It reaches from foundational questions of democracy theory, an analysis of the causes of the crises and of the role of the judiciary in coping with the crisis, the protection of fundamental rights of the Union citizens and their better inclusion and participation through digitization, up to concrete reform proposals. A dialogical epilogue of Joseph Weiler with some of the authors strives to stimulate further discussion and reflection, as needed in the coming years if the EU is to overcome the crises and develop further as a democratic Union of citizens. Angesichts der Krisen, die die Europäische Union seit einigen Jahren erschüttern, von der Finanzkrise bis hin zur Flüchtlingskrise und zum Brexit-Votum verstärken sich Skepsis und Ablehnung; eine drohende Legitimationskrise zwingt zur Analyse nicht nur der Ursachen sondern auch der Potentiale einer Stärkung der Legitimation. Dieser Band beruht auf den Beiträgen und Diskussionen zweier Konferenzen des European Constitutional Law Network (ECLN) über demokratietheoretische Grundlagen, eine Analyse der Ursachen der Finanzkrise und der Rolle der Gerichte bei ihrer Bewältigung, den Schutz der Grundrechte der Unionsbürger und die Stärkung von Bürgernähe und Partizipation durch Digitalisierung bis hin zu konkreten Reformvorschlägen. This volume brings together experienced Professors and PhD researchers from all over Europe to summarise the crucial dilemmas that the European Union has to confront during its current multilevel crisis. The chapters are organized into four parts. The first section deals with constitutional issues of the EU, namely multilevel democratic governance, gender equality, and participatory democracy, and the impact of the crisis on them. The second analyses public governance issues, with reference to urban planning as a new policy for the EU, state aid and privatization of public companies, corporate governance principles for public companies, and EU case law on freedom of establishment of companies. The third part discusses certain issues of the EU internal market and external trade, namely the Europeanisation of labour relations, the relation between EU environmental law and international agreements, the dilemma between regionalism and multilateralism in international trade law, and the Eurasian Economic Union. The fourth section explores the Eurozone crisis from different perspectives and areas, namely political philosophy, economics, political science, administrative science, and law.
