Responsive Legality is an important book about twenty first century justice. It explores the legal and moral values that twenty-first-century public officials use to make their decisions, engaging existing theoretical models of administrative justice and updating them to reflect changed twenty-first-century conditions. Together, these features of twenty-first century public administration are coined ‘responsive legality'. Whereas twentieth-century public officials were generally driven by their concern for bureaucratic rationality, professional treatment, moral judgement and – towards the end of the century – the logics of ‘new managerialism', the twenty-first-century public official embodies greater complexity in their characteristic pursuit of substantive and procedural justice. In responsive legality, government decision makers show a distinct concern for the protective parameters of the rule of law, a purposive pursuit of fair outcomes and a commitment to flexible decision making.

Die Arbeit behandelt die verschiedenen Beteiligungsmöglichkeiten des Staates an Verwaltungsprozessen, insbesondere auf Klägerseite. Anlass und Untersuchungsgegenstand der Arbeit ist die vermögensrechtliche Rechtsprechung des Bundesverwaltungsgerichts, in der es der öffentlichen Hand eine Klagebefugnis aus möglicher Eigentumsrechtsverletzung zuspricht. In der Arbeit wird zunächst allgemein untersucht, ob und inwieweit die Rechtsordnung der öffentlichen Hand Schutz gegen hoheitliche Eingriffe gewährt. Einen Schwerpunkt der Arbeit bildet die nachfolgende Darstellung von Klagemöglichkeiten der öffentlichen Hand anhand von Einzelfällen aus dem Bau-, Fachplanungs- und insbesondere dem Vermögensrecht unter Berücksichtigung der Auffassungen in Rechtsprechung und Lehre.

Diese Arbeit thematisiert, ob ein Zusammenschluss von Verwaltungs- und Sozialgerichtsbarkeit möglich und zweckmäßig ist. Hierzu stellt sie drei zentrale Modelle vor. Auch der Speyrer Entwurf und die darauf aufbauende Verwaltungsprozessordnung finden Berücksichtigung. Untersucht wird der verfassungs- und europarechtliche Rahmen dieser Reformvorhaben. Verwaltungsprozessordnung und Sozialgerichtsgesetz werden auf Unterschiede und Gemeinsamkeiten hin untersucht. Die Arbeit kommt zu dem Ergebnis, dass die Gemeinsamkeiten der Prozessordnungen überwiegen. Dies wird verstärkt durch jüngere Gesetzesnovellen. Der Autor schlägt die bundesweite, institutionelle Verschmelzung der Sozial- und Verwaltungsgerichtsbarkeit und eine Rückbesinnung auf die verbindende, allgemeine Dogmatik von Verwaltungsprozessordnung und Verwaltungsverfahrensgesetz vor.

Frank Vibert examines the fundamental issues involved in attempts to rethink international institutions and their rule making procedures. He analyses the basic problems with the existing system and the main approaches to its reform. The book repudiates the idea that there are any simple institutional `fixes'for current problems, such as relying on the G20 to coordinate global rule making, and also rejects more ambitious attempts to prescribe new general organising principles for world governance. It calls instead for specific remedies for specific problems.
