Con las Sentencias dictadas por el Tribunal General en 2015 y por el Tribunal de Justicia en 2016, el conflicto del Sahara Occidental ha cobrado actualidad ante estos dos órganos jurisdiccionales de ámbito regional europeo. Aunque la valoración jurídica que ofrecen de este conflicto sea un tanto incompleta, imprecisa, ambigua y elusiva –lo cual es más patente en el caso del Tribunal de Justicia-, ambos han reconocido, como era de esperar, que el Sahara Occidental es un territorio no autónomo cuyo pueblo tiene derecho al ejercicio del principio de la libre determinación de los pueblos. Por tanto, los dos tribunales mantienen que el Sahara Occidental no forma parte de Marruecos; por lo que según el Tribunal de Justicia los acuerdos que celebra la Unión Europea con este último Estado no son de aplicación a la antigua colonia española. Con carácter general, esta jurisprudencia puede condicionar las relaciones convencionales y de cooperación entre la Unión Europea y uno de sus socios privilegiados, Marruecos, y asimismo puede tener su influencia en las políticas exteriores –jurídicas- de los Estados miembros, entre ellos España. In general, this jurisprudence can condition contractual and cooperative relations between the European Union and one of its privileged partners, Morocco, and may also have an influence on the foreign -legal- policies of the Member States, including Spain. More specifically, it remains to be seen whether this jurisprudence will be maintained even in the case of fisheries agreements concluded between the European Union and Morocco, which have been applied in the waters of Western Sahara during the last 30 years with the consent of both parties.
