Law can be seen as a motley of different languages deployed in the legal domain. The authors of the chapters share interest in what determines the scope of the vocabulary of these languages as well as in the way they are used. Thus, both the linguistic and pragmatic turns occurring in the philosophy of language are explored as exercising not mere ripple effects on legal scholarship, but rather as having a huge impact on jurisprudence. The chapters in this volume tackle three broad problem areas to offer a coherent picture of languages of the law. The first section is devoted to legal language at large, including reflections on its nature and some distinct functions it performs in the legal domain. The second section of the book focuses on the distinctly legal and pragmatic dimensions of some fragments of vocabulary, used either in legal texts or in legal scholarship. In the third section of the volume, authors research specific questions regarding legal language and legal reasoning.

This book offers the first sustained investigation of the phenomenon of retraction - the “taking back” of the conventional or deontic effects of a previous speech act - bringing together issues and solutions from the semantics of perspectival expressions and from the framework of Speech Act theory. This volume investigates Eric Weil's innovative conceptualization of the place of violence in the philosophical tradition with a focus on violence's relationship to language and to discourse. Weil presents violence as the central philosophical problem. According to this reading, the western philosophical tradition commonly conceptualizes violence as an expression of error or as a consequence of the weakness of will. However, by doing so, it misses something essential about the role that violence plays in our conceptual development as well as the place violence holds in our discursive practices.The author draws comparisons between Weil's work and that of Robert Brandom. Brandom's inferentialism creates a sophisticated program at the junction of pragmatics and semantics, philosophy of language, logic, and philosophy of mind. This volume develops a theory of meaning and a semantics for both mathematical and empirical sentences inspired to Chomsky's internalism, namely to a view of semantics as the study of the relations of language not with external reality but with internal, or mental, reality. In the first part a theoretical notion of justification for a sentence A is defined, by induction on the complexity of A; intuitively, justifications are conceived as cognitive states of a particular kind. Ziel ist es, dass neu zugewanderten Schüler•innen, die u.U. wenig oder kaum Englisch können, aber aufgrund ihres Alters in eher fortgeschrittene Englischlerngruppen eingegliedert werden, dennoch die Möglichkeit haben, sich im Englischunterricht einzubringen und mit der peer group zu lernen. Dabei übernimmt das Easy-to-Read eine Brückenfunktion, bis dem Englischunterricht auf Regelniveau gefolgt werden kann.

This book explores the construction of agreement in the argumentative process, aiming to investigate how the activation of shared knowledge, values and beliefs leads to the creation of a common ground between the speaker and the audience in the pursuit of persuasion. In the first part of the book, the authors examine agreement from a historical and theoretical perspective, setting in relation major ancient and contemporary approaches to argumentation, with special regard for the notions of ethos, objects of agreement, starting points and topoi, all with a focus on their deployment in discourse. This is complemented with a compendium of linguistic resources that can be exploited for the discursive construction of agreement, offering a principled selection of structures across different levels of language description. This monograph offers a comprehensive study of contingent a priori truths. Building onto a theoretical framework developed by the philosopher and logician Saul Kripke, the author also presents a new approach to these truths. The first part of the book details the many theories on contingent a priori truths. The coverage examines the cases of Kripke and David Kaplan, Donnellan and the de re requirement, Evans and weak contingency, as well as Plantinga, Salmon, Soames, and the pseudo a priori. Overall, it provides a systematic discussion and critical review of all these many positions. Next, the author develops an alternative approach. His working hypothesis is that performative verbs must play a central role in Kripke's examples, even if they do not show up at the surface structure of the corresponding sentences. This opens up an entirely new way of looking at Kripke's cases and of treating them by exploring some aspects of the theory of illocutionary acts. His discussion also examines brute facts and institutional facts, indexicals and performatives, as well as Frege's theory of definitions. This book analyzes the role of language in scientific research and develops the semantics of science from different angles. Die Philosophie des Zeichens von Josef Simon bedenkt dagegen den Umstand, dass nicht „das Bezeichnen ein sekundärer Akt ist, sondern die Beurteilung des Bezeichneten als ‚seiend‘“, mithin der Begriff des Seins nicht „der Grundbegriff“ sein kann. Das ist die strengste Form der Aufhebung aller Ontologie. Gegenüber deren Anspruch auf „letzte“ Erkenntnisse ist es „leichter“ geworden zu sagen, „daß alles, auch ‚Sein‘, Zeichen sei“. Das heißt dann aber auch, dass kein Zeichen auf seine Bedeutung festgelegt sein bzw. werden kann, denn die hat es nicht. Ein Zeichen geht in seinem momentanen, temporär befriedigenden Verstanden- bzw. Begriffensein nicht auf, sondern bleibt stehen für weiteres, anderes Verstehen. So werden alte Paradigmen der Philosophie aufgebrochen und durch das einer Philosophie des Zeichens ersetzt: Zeichen sind das Vehikel der Wahrheit, nicht die Substanz, nicht das Wesen, nicht der Begriff. In praktisch-ethischer Hinsicht erweist sich diese Philosophie als eine der absoluten Freiheit.

This book presents a new nominalistic philosophy of mathematics: semantic conventionalism. Its central thesis is that mathematics should be founded on the human ability to create language – and specifically, the ability to institute conventions for the truth conditions of sentences.This philosophical stance leads to an alternative way of practicing mathematics: instead of “building” objects out of sets, a mathematician should introduce new syntactical sentence types, together with their truth conditions, as he or she develops a theory.Semantic conventionalism is justified first through criticism of Cantorian set theory, intuitionism, logicism, and predicativism; then on its own terms; and finally, exemplified by a detailed reconstruction of arithmetic and real analysis.Also included is a simple solution to the liar paradox and the other paradoxes that have traditionally been recognized as semantic. The Hungarian Nominal Functional Sequence combines the methods of syntactic cartography with evidence from compositional semantics in a comprehensive exploration of the structure of Noun Phrases. Proceeding from the lexical core to the top of DP, it uses Hungarian as a window on the underlying universal functional hierarchy of Noun Phrases, but it also regularly complements and supports the analysis with cross-linguistic evidence. The book works out a minimal map of the extended NP in the sense that the proposed hierarchy only has projections which host overt material and it does not draw on semantically empty word order projections. Topics which receive special attention include the syntax of classifiers, demonstratives, proper names, possessive NPs and plural pronouns.

This book suggests that to know how Wittgenstein's post-Tractarian philosophy could have developed from the work of Kant is to know how they relate to each other. The development from the latter to the former is invoked heuristically as a means of interpretation, rather than a historical process or direct influence of Kant on Wittgenstein. Ritter provides a detailed treatment of transcendentalism, idealism, and the concept of illusion in Kant's and Wittgenstein's criticism of metaphysics. Notably, it is through the conceptions of transcendentalism and idealism that Wittgenstein's philosophy can be viewed as a transformation of Kantianism. This transformation involves a deflationary conception of transcendental idealism along with the abandonment of both the idea that there can be a priori'conditions of possibility'logically detachable from what they condition, and the appeal to an original ‘constitution'of experience. The closeness of Kant and post-Tractarian Wittgenstein does not exist between their arguments or the views they upheld, but rather in their affiliation against forms of transcendental realism and empirical idealism. Ritter skilfully challenges several dominant views on the relationship of Kant and Wittgenstein, especially concerning the cogency of Wittgenstein-inspired criticism focusing on the role of language in the first Critique, and Kant's alleged commitment to a representationalist conception of empirical intuition.

This book presents a new approach to semantics based on Kazimierz Ajdukiewicz's Directival Theory of Meaning (DTM), which in effect reduces semantics of the analysed language to the combination of its syntax and pragmatics. The author argues that the DTM was forgotten because for many years philosophers didn't have conceptual tools to appreciate its innovative nature, and that the theory was far ahead of its time.The book shows how a redesigned and modernised version of the DTM can deliver a new solution to the problem of defining linguistic meaning and that the theory can be understood as a new type of functional role semantics. The defining feature of the DTM is that it presents meaning as a product of constraints on the usage of words. According to the DTM meaning is not use, but the avoidance of misuse.Readers will see how the DTM was shelved for reasons that we don't find so dramatic anymore, and how it contains enough original ideas and solutions to warrant developing it into a full-blown contemporary account.
