On the grounds of the comprehensive analysis of the views of scientists, the article explores the principle of the ecosystem approach in environmental law. It is substantiated that in the modern environmental legal doctrine there is no clear and unambiguous understanding of the essence of this principle and its place among other principles of environmental law, because scientists, considering this principle an independent principle, simultaneously recognize it as a sign of rational use of natural resources, identify it with the complex and sustainable use of natural resources or generally see it in the vast majority of principles of environmental law. Given the novelty, extreme intricacy and unconventionality of the principle of the ecosystem approach, it is proposed to consider it as a quintessential principle of environmental law, which, found on the objective conditions of nature’s existence, denoted by the interdependence and interconditionality of all natural processes and phenomena, “permeates” all principles of environmental law and at the same time serves as their backbone, the essence. The article concludes by emphasizing the need to rethink environmental law and its principles on the basis of the ecosystem approach.

The issue of determining the objects of environmental law ofUkrainefrom the very beginning of the formation of this branch of law doesn’t lose its relevance. Numerous monographs, scientific articles, abstracts and other publications appear that study the scientific and methodological aspects of the development of the doctrine of objects of environmental law, analyze the theoretical approaches to their understanding, substantiate the position about the need to highlight new objects of environmental legal regulation etc. Supporting the position expressed by many environmental lawyers about the need to rethink traditional ideas about environmental law and taking into account the latest trends in the development of international environmental law, primarily related to the implementation of the concept of sustainable development and the ecosystem approach, the author believes that the study of environmental law in Ukraine from just that angle view deserves special attention. Given this, the purpose of the article is to analyze the legislative and scientific foundations of understanding the objects of environmental law ofUkrainein the context of the implementation and realization of the ecosystem approach. The ecosystem approach, which is being actively developed under the Convention on Biological Diversity, is defined as a strategy for the integrated management of land, water and living resources that ensures their conservation and sustainable use on an equitable basis. By analogy with the ecologization of law and legislation, which in general terms represents the process of implementation environmental legal principles and norms into all branches of law and the relevant legislation regulating human activities related to environmental impact, the process of implementation the ecosystem approach into the legal regulation of environmental relations it is proposed to call the «ecosystemization» of environmental law and legislation. In the author’s opinion, the necessary condition for the implementation and realization of the ecosystem approach in environmental law and legislation of Ukraine is not so much recognition of the ecosystem as a separate object on an equal basis with others, but understanding of all objects of environmental and legal regulation and the environment as a whole in the ecosystem context. Indeed, it is obvious that the use of natural resources, as a certain useful property of natural objects, on the basis of the ecosystem approach, can be discussed only if the natural objects themselves are «ecosystemized». That is, when designating natural objects in environmental legislation and their study in the environmental legal doctrine, their ecosystem characteristics must be taken into account. Based on a thorough analysis of regulatory legal acts and the views of scientists, a tendency to gradual «ecosystemization» of objects of environmental law of Ukraine was identified and it was assumed that this tendency will continue and intensify, and in the distant, but foreseeable future, all natural objects and the environment as a whole will be studied by scientists and determined in environmental legislation precisely in the ecosystem context. According to the author, this approach will allow to overcome the fragmentation of environmental law ofUkraineand create a holistic legal basis for the qualitative regulation of social environmental relations.

The present paper is devoted to the problems of legal regulation of protecting biological diversity from the harmful effects of invasive alien species (hereinafter, IAS) with regards to climate change. Taking into consideration the fact that one of the main principles of environmental protection is the preservation of spatial and species diversity, legal understanding of the interconnectedness between climate change and harmful biological influences, is of great scientific and practical significance. Notably, the protection of the environment from the adverse effects of IAS and climate change is interconnected with the conservation and sustainable use of biological resources, as stated by the provisions of the Convention on Biological Diversity (Rio de Janeiro, 1992) and its protocols and decisions. Thus, one should acknowledge that climate change and invasive alien species are not only two of the key threats to biodiversity, but are directly interrelated and can act synergistically, presenting additional pressure for conservation and sustainability. Meanwhile, current legal regulation of both, climate change and IAS is relatively new to Ukrainian legislation, mostly done by means of international legal instruments. The existing national legal acts are generally of a strategic nature and address these issues separately with few legal provisions mentioning their interconnection. The paper substantiates the need to acknowledge and legally define the interrelation between climate change and invasive alien species. Thus, the development of appropriate regulatory framework for prevention and control of IAS should be carried out with consideration of climate change issues. In turn, national environmental legislation, in particular national framework law ‘On Environmental Protection’ as well climate change policy and laws should be complemented by provisions incorporating IAS management as a tool for reducing pressure on ecological services and enhancing ecosystem resilience.

Problem setting. In this article it is examined the main conceptual approaches to understanding the legal arrangement for implementing citizens' environmental obligations. It is noted that despite the diversity of approaches to understanding the arrangement for implementing citizens' environmental responsibilities, most scientists include the concepts of: a) a legal implementation arrangement, b) the process of practical implementation, c) the conditions and factors that influence it. It is defined that the legal arrangement for implementing environmental obligations is guaranteed by prohibitions and legal regulations. In this case the regulatory legal act has two main functions: 1) prescribes the need to implement the legal obligation, determines it; 2) prescribes a result of the legal obligation implementation. Recent research and publications analysis. Particular attention is paid to the work of scientists in environmental law, including VI Andryeytseva, G. Anisimova, GI Baluk, AP Hetman M. Krasnov, II Karakash, V. Kostytsky, VV Nosik, M. Shulga, S. Shemshuchenko and others. However, most of them concerning coverage of only certain aspects, is a comprehensive analysis of the legal implementation mechanism is still lacking. It's analyzed the characteristics of the legal enforcement for implementing environmental responsibilities by citizens. It is determined that the legal arrangement for the implementation of environmental responsibilities is a part of a general arrangement of the law implementation. Ecological and legal arrangement for the implementation of environmental obligations is defined as a system of legal norms and legal relations by which the State provides the accomplishment of ecological and legal regulations. Implementation of the constitutional obligations by the citizens is a process that is inherent in environmental responsibilities, in which there are several stages: 1) the ability to execute the obligations which are assigned by the Constitution and the current environmental legislation; 2) the ability to voluntarily adhere to legal prohibitions; 3) in good faith execute obligations in living activities. Paper objective. The main forms of implementing the environmental responsibilities by citizens are analyzed; the factors influencing them are defined. It was studied general theoretical understanding of the stages, as well as forms of the implementation of rules of law. Traditionally among the last there are: compliance and execution. A special form of implementation is application. Whereas the compliance - is the first and foremost (universal) form by which all subjects of public relations execute their obligations (both active and passive). The implementation of environmental responsibilities of citizens in the form of the compliance is a good behavior, which is characterized by passive confinement of persons (or inaction) on the infringement of the rules and bars which are set by regulations of the environmental legislation. The execution is expressed in commission of actions provided for by law by the subject. This is implementation of binding rules, however, the responsibilities are contained not only in the regulatory legal acts, but also in the contracts and individual documents. The application as a special form of the law implementation differs from the compliance and the execution that it is carried out by non-citizens, but only by those public authorities that are entitled to do so by law. The application of the law - it is an action of qualified government authorities or local authorities, which by law is delegated the right to apply ecological and legal regulations in order to implement the relevant environmental requirements, rules and prohibitions and they are provided if necessary (in case of violation) mechanism of state coercion. Paper main body. It is noted that the legal arrangement for implementing environmental responsibilities is to be in: a) the ability to perform environmental responsibility, clearly defined in the legislation; b) establishing eco-legal status for the citizens as they are bearers of the environmental obligations and establishing the specific of juridical personality; c) attaching their actual composition of ecological relationship with clear fixation conditions onset environmental responsibilities of citizens; d) filling gaps in environmental legislation governing these obligations; e) the implementation of the interpretation of the law establishing environmental responsibilities; e) creating the arrangement of application of general and special guarantees for implementation of the environmental responsibilities. Conclusions. Thus, in the present circumstances it is necessary to overcome imperfect and insufficient arrangement for regulation of environmental responsibilities. It is necessary to raise the level of legal culture and consciousness, to eliminate differences between environmental rights and obligations, to deduce clear boundaries for implementing environmental responsibilities, which will contribute to solve the abuse of the environmental rights as well as responsibilities.

This research is dedicated to issues, related to determining the legal principles of management in the sphere of water protection, use and rehabilitation of water resources. It considers the legislative acts, determining competences of the related state authorities. The research provides recommendations on improving appropriate legislation.

The article notes that the globalization of the world and its current development in all areas, including environmental one − these are the real facts. The transformation of the respective roles of the state and, above all, ecological one, takes place under their influence. Its goal should be to subordinate the society to ecological imperative, transformation of the nature of the state with an absolute target and functional orientation of all the activities on the implementation of this imperative.

Gradual development of each formation stage of the legislation in the field of usage of the world of plants was studied, as well as contemporary condition and problems of legislation in this sphere were analyzed.

The author conducted a comprehensive study of the legal categories and the problems associated with the provision of legal ownership on natural resources and systems in paper, manes conclusion that it is necessary to improve the environmental legislation in the field of exercise of the right of ownership of natural resources and systems.
