Abstract

The autonomous bank guarantee is a strong guarantee, which, through its autonomy in relation to the underlying contract and its automatic nature, gives the beneficiary the certainty that he or she will receive payment of a certain amount if he or she so requests from the bank guarantor. The guarantee may be enforced abusively by the beneficiary, which can only be prevented through injunction proceedings.
