Managing intellectual property (IP) costs with technical disclosures is discussed by a product manager and the CEO at IP.com Inc. Because of the rapid pace of innovation, chemical companies are rethinking patent-filing strategies. To keep speed, many companies are filing technical disclosures to protect intellectual property and any technologies that might come from core technologies. Databases for such technical disclosure have been established. Companies discussed include IBM, which has a Technical Disclosure Bulletin, Kenneth Mason Publishing (of the United Kingdom), which has a print journal, Research Disclosure, and IP.com, which maintains an Internet-based service for publishing technical disclosures. Patent law and traditional defensive technical disclosure strategies are discussed. Graph shows rate of increase in new US chemical patents exceeded US GDP growth by 85%, 1995-99, with the molecular biology/microbiology area up by 171%.
