Motivation: The majority of problems in the health care system originate in the limited financial resources, but the efficiency of the system is also — indirectly — affected by the management of these resources, which is sometimes not as effective as it might be. These problems become particularly apparent in the Polish public health care, undergoing constant reforms. This brings into focus the issue relating to restructuring processes, which are determined by relevant legal regulations and the competences of people in charge, who need to maintain the consistency of implementation. Aim: The article aims to analyse legal and economic determinants in the restructuring of health care entities in Poland, with particular emphasis on the possible application of restructuring proceedings to these entities. Further, it identifies key success factors for restructuring processes from the perspective of management. The following legal acts were included in the analysis: the Act of 15 May 2015 the Restructuring Law, the Act of 15 April 2011 on medical activity, the Act of 23 April 1964 the Civil Code, the Act of 28 February 2003 the Bankruptcy Law. The review of good management practices in the research area was presented. Results: Based on the analysis, recommendations concerning the implementation of restructuring processes in health care entities were formulated. The benefits stemming from the application of restructuring proceedings to health care entities were discussed. The key elements of the restructuring plan, accompanied with practical guidelines, were presented.

Motivation: The concept of competitiveness is used to define the ratio of enterprises to competitors and results from many internal features and the ability to deal with an external environment. However, comparing main elements of company competitiveness to each other does not give detailed position in the market sector, which is the main area of competition. Therefore it is necessary to look for a different method of companies comparison in the field of their competitiveness. Aim: The purpose of this paper is to present a assessment method of company competitiveness based on the Company Competitiveness Profile in a market sector. The Company Competitive Profile consists of different variables of a competitive potential, a strategy of competition and a competitive advantage. This method is verified based on results of the Company Competitiveness Barometer conducted in 2021 in 177 Polish companies in the Silesian Region. The Company Competitiveness Barometer is an online research tool for assessing company competitiveness which has been used by the authors since 2012. Results: The questionnaire used in the Company Competitiveness Barometer contains 48 questions. 45 of them are related to the characteristics of the company that are affecting its competitiveness, and 3 questions are metric questions. The questionnaire can be found on http://sensorium24.com. There were 2 hypotheses which were verified in the paper: H1: The configuration of the components of the Company Competitiveness Profile is different in different sectors of the economy. H2: Each company can be characterized in a sector by its individual Company Competitive Profile. The papers presents verification of two hypothesis which concern the Company Competitive Profiles and their use in assessment of company competitiveness in an economic sector. This is also an added value and an original contribution to company research methodology.

Motivation: The health care sector in Poland is undergoing a continuous restructuring process that directly affects the functioning of treatment entities, especially hospitals. One of the key changes is the introduction of a system of basic hospital security of health care services. In this context, the question arises about the competitive management of a public hospital in Poland and the use of entrepreneurial management tools and the possible scope of these processes in the current external conditions. The aim of these efforts is to increase the efficiency of the health care sector, better tailor services to social needs, and improve the management of limited resources. Aim: The aim of the article is to assess the possibility of increasing public hospital competitiveness in Poland in the context of new regulations in the health care sector. These regulations concern the method of contracting health services, the rules for admission to their performance and flat-rate financing. The analysis will be carried out based on the analysis of legal acts and using the elements of the integrated enterprise competitiveness model by G. Glod and O. Flak. Results: Formulating recommendations for public hospital managers in the field of raising competitiveness and indicating the possibility of using appropriately adapted tools to assess the competitiveness in the private sector for entities operating in the public sector.
