O objetivo e apontar os equivocos interpretativos e argumentativos no exame de constitucionalidade de norma legal estadual que excepcionou os cultos e liturgias de origem africana da proibicao de tratamento cruel contra animais. Conclui-se que nao ha norma constitucional e legal que proibe o sacrifico de animais em cultos religiosos, contudo e vedado o tratamento cruel contra animais para todos, inclusive no exercicio de culto. The objective is to point out the interpretative and argumentative misunderstandings in the constitutional examination of a state legal norm that excepted the cults and liturgies of African origin from the prohibition of cruel treatment against animals. It is concluded that there is no constitutional and legal norm that prohibits the sacrificial of animals in religious cults, however, it is forbidden cruel treatment against animals for all, including in the exercise of worship.
