It argues that the Supreme Court is unlikely to adopt the proposition of constitutional personhood in the foreseeable future, and that pro-life advocates should focus on changing public sentiment and persuading elected representatives at the state level. The article examines the historical context of the 14th Amendment and concludes that there is no evidence to suggest that the framers intended to include the unborn child in its protections.
