As disputas discursivas sobre a autonomia do Poder Judiciário e seu envolvimento com as demais instituições políticas marcam o sentido de independência judicial como condição da imparcialidade da jurisdição. No entanto, a observação da historicidade da participação de juristas e juízes, em particular dos ministros do STF, na construção do próprio espaço político-institucional ainda ocupa uma reduzida dimensão nas análises de cientistas sociais sobre o acesso à justiça no Brasil. Ao procurar combinar a análise dos influxos do regime ditatorial sobre as funções do Supremo Tribunal Federal no texto constitucional e as manifestações dos ministros sobre seu próprio papel institucional durante a ditadura, este texto traça alguns aspectos históricos relevantes para a compreensão da complexa articulação entre política e direito, na qual foram desenhadas as disputas por autonomia da Suprema Corte no período da ditadura civil-militar no país. Argumentative disputes regarding the autonomy of the Judicial Power and its engagement with other political institutions mark the notion of judicial independence as a condition for judicial impartiality. It is also important to stress that a historical inquiry concerning the participation of legal experts and judges, in particular Brazilian Supreme Court magistrates, on the process of constructing their own political-institutional space, unfortunately, still occupies a mitigated importance in social scientist’s findings when dealing with the access to justice in Brazil. This paper seeks to combine the analysis of the influxes from the dictatorship period, concerning the Supreme Court’s functions under the Constitutional commands, and the magistrates' declarations about their own institutional role during the dictatorial regime. It also aims to bring some relevant historical aspects to a better understanding of the complex relationship between politics and law, in which disputes for the Supreme Court’s autonomy were drawn in the period of civil-military dictatorship in Brazil. Les disputes discursives au sujet de l’autonomie du pouvoir judiciaire et son implication auprès des autres institutions politiques marquent le sens de l’indépendance judiciaire en tant que condition de l’impartialité de la juridiction. Néanmoins, l’observation de l’historicité de la participation des juristes et de juges, en particulier les magistrats de la Cour Suprême Brésilienne, dans la construction de leur propre espace politico-institutionnel occupe encore une dimension réduite dans l’analyse des chercheurs en sciences sociales sur l’accès à la justice au Brésil. En essayant de combiner l’analyse des affluences de la dictature sur des fonctions de la Cour suprême dans le texte constitutionnel et les manifestations des magistrats sur leur propre rôle institutionnel pendant la dictature, cet article trace quelques aspects historiques marquants pour comprendre l’articulation complexe entre la politique et le droit, dans laquelle ont été tracées les disputes pour l’autonomie de la Cour dans la période de la dictature civile-militaire au Brésil.

O sistema político representativo tornou-se praticamente sinônimo de democracias modernas. O presente artigo tem como objetivo estudar o desenvolvimento do conceito de representação, de forma associada ao processo de institucionalização do parlamento, a partir de análise sociogenética, que destaca elementos distintivos e definidores dos processos de transformação social. Verifica-se o movimento pendular da concessão da representação pela monarquia, como forma de ampliação e garantia de legitimidade, à incorporação da representação como direito e mecanismo impulsionador do processo de institucionalização do Poder Legislativo. The representative political system has become synonymous of modern democracy. The paper analyzes the development of the concept of representation, in association with the process of institutionalization of the parliament, by means of a sociogenetic approach that highlights some distinctive and defining elements of the concerned processes of social change. The results point to a pendular movement of concession of representation by the Crown, as a way of enforcing and ensuring legitimacy, to the incorporation of representation as a right and as an impeller mechanism in the process of institutionalization of the Legislative Power. Le système politique représentatif est devenu pratiquement un synonyme des démocraties modernes. Cet article a pour but l’étude du développement de la notion de représentation associée au processus d’institutionnalisation du Parlement. Il a été développé à partir de l’analyse sociogénétique qui met en évidence des éléments distinctifs et définisseurs des processus de transformation sociale. Les résultats indiquent un mouvement oscillatoire de la concession de la représentation par la monarchie en tant que forme d’expansion et de garantie de sa légitimité, à l’incorporation de la représentation comme droit et mécanisme du processus d’institutionnalisation du pouvoir Législatif.

Analisa-se o manual da Campanha da Fraternidade da CNBB de 2008, contextualizando a atuação da Igreja Católica na esfera pública. O tema "Fraternidade e defesa da vida" foi criado como reação não só ao esforço do Ministério da Saúde e da Secretaria Especial de Políticas para as Mulheres para recolocar o aborto como problema de saúde pública, e alterar a legislação, como também à geração de embriões na reprodução assistida e uso de excedentes para produzir célulastronco. A pesquisa com células-tronco e o debate sobre a legalização do aborto são processos independentes liderados por atores sociais distintos (comunidade científica e movimento de mulheres). A Igreja é ator fundamental, aglutinando as controvérsias. O conceito de "vida"é chave na retórica que desliza entre o discurso científico e o religioso. The paper analyzes the handbook of the 2008 Fraternity Campaign, promoted by the National Conference of Brazilian Bishops (CNBB), and contextualizes the Catholic Church's action in the public sphere. The theme "Fraternity and defense of life" has emerged as a reaction to not only the effort by the Health Ministry and the Special Office of Women Policy to redefine abortion as a public health problem, and change legislation accordingly, but also to in vitro fertilization and the use of supernumerary embryos for stem cell generation. Stem cell research and the debate on abortion legalization are independent processes led by different social actors (the scientific community and women's movement). The Church is a leading and aggregating actor in this controversy. The concept of "life" is key to this debate, sliding between religious and scientific discourses. Cet article propose une analyse du manuel de la Campagne de la Fraternité de la CNBB (Conférence Nationale des Archevêques du Brésil) 2008, en contextualisant l'action de l'Église Catholique dans la sphère publique. Le thème "Fraternité et défense de la vie" a été créé comme une réaction non seulement à l'effort du Ministère de la Santé et du Secrétariat Spécial de Politiques pour les Femmes, pour remettre l'avortement comme un problème de santé publique et modifier la législation, ainsi que la génération des embryons dans la reproduction assistée et l'utilisation des excédents pour produire des cellules souches. La recherche avec des cellules souches et le débat sur la légalisation de l'avortement sont des processus indépendants menés par des acteurs sociaux distincts (la communauté scientifique et le mouvement de femmes). L'église est l'acteur fondamental, agglutinant les controverses. Le concept de «vie» est fondamental dans la rhétorique qui existe entre le discours scientifique et le discours religieux.

Neste trabalho tratamos dos problemas de coordenação intergovernamental emergentes na formação das redes assistenciais regionalizadas e hierarquizadas, estabelecidas no âmbito do Sistema Único de Saúde (SUS), de modo a articular municípios "exportadores" e "importadores" de serviços de saúde com maior complexidade tecnológica sob a coordenação dos governos estaduais. Com base numa avaliação crítica acerca dos efeitos, produzidos pelas regras institucionais que lhe dão amparo, sobre a disposição dos agentes governamentais à cooperação, apresentamos uma reflexão prospectiva em torno das possibilidades de que o Pacto de Gestão do SUS, firmado entre as três esferas de governo no ano de 2006 e atualmente em desenvolvimento, venha a consumar a almejada regionalização solidária e cooperativa. In this paper we deal with emerging inter-govern coordination problems when forming the regionalized and hierarchical assisting nets, established in the National Health System (SUS) in a way to articulate the "export" and "import" health service municipalities with a greater technology complexity under the coordination of the state governments. Based on a critical assessment about the effect produced by the institutional rules that supports them, we present a prospective reflection about the possibilities that the Management Pact of SUS, entered among the three ranges of government in the year of 2006 and currently under development, comes to consummate the so desired understanding and cooperative regionalization. Le sujet de ce travail est d'étudier les problèmes de coordination intergouvernementale qui émergent de la formation des réseaux d'assistance régionalisés et hiérarchisés, établis dans le sein du Système Unique de Santé (SUS), de façon à articuler les municipalités "exportatrices" et "importatrices" de services de santé ayant une plus grande complexité technologique, sous la coordination des gouvernements de chaque état. A partir d'une évaluation critique à propos des effets produits, des règles institutionnelles qui les sous-tendent, de la disposition des agents gouvernementaux à la coopération, nous présentons une réflexion prospective sur les possibilités que le Pacte de Gestion du SUS, accordé entre les trois sphères de gouvernement à l'an 2006, et qui se développe en ce moment, vienne à réaliser la régionalisation solidaire et coopérative souhaitée.

Enfatizando as relações entre política e burocracia na recente experiência democrática no Brasil, o artigo analisa os critérios de escolha dos ministros e da alta burocracia do Ministério da Fazenda no primeiro governo de Fernando Henrique Cardoso. A escolha desse ministério justifica-se não só por sua posição de relevo no interior do governo, nesta era de estabilização monetária e ajuste fiscal, mas igualmente porque ele sempre foi visto como um ministério mais técnico e imune às pressões do restante do sistema político. The present paper is aimed at understanding the political appointments for high-level governmental posts in our recent democratic experience. By examining the connections between politics and bureaucracy in the Brazilian presidential system, we focus specifically on the first Cardoso term (1995-1998) and within this, on the case of the Ministry of Finance. The choice of this ministry can be justified due to its high profile in the current hard times of monetary stabilization and fiscal constraints, and because it is deemed to be a mainly technical government department and "immune" to political interference. Cet article analyse les différents critères de sélection des ministres et des cadres de la haute fonction publique dans la récente expérience démocratique au Brésil. En mettant en relief les rapports entre politique et bureaucratie au sein du présidentialisme brésilien, il examine, en particulier, le cas du gouvernement Cardoso (1995-1998) et la sélection des hauts fonctionnaires du Ministère des Finances. Le choix de ce ministère se justifie parce qu'il est un des plus importants dans cette période de stabilisation monétaire et d'ajustement fiscal et également parce qu'il est censé être le plus technique et immune aux pressions politiques.

This paper analyzes the decentralization process of the Brazilian System of Social Protection, identifying its extension and variation, as well as the determining factors of its current state. The object of analysis is the decentralization of five social policies - public health, education, sanitation, housing and social welfare - in six Brazilian States: Rio Grande do Sul, Parana, Sao Paulo, Bahia, Pernambuco and Ceara. The work considers the importance of the following factors in determining the extension and the variation of decentralization: (a) the structural characteristics of local governments - economic, fiscal and administrative capabilities -; (b) the institutional characteristics of the policies - constitutional rules, operational mechanisms of service delivery and the legacy of earlier policies - and, (c) variables related to political action -State and society relations and intergovernmental relations.
