Objetivo: O presente artigo tem como objetivo analisar os conflitos socioambientais oriundos das relações entre o direito fundamental ao meio ambiente ecologicamente equilibrado e o direito fundamental à moradia através da regulamentação proposta pela lei de regularização fundiária urbana. O problema a ser discutido consiste em analisar se o instituto da regularização fundiária concede preponderância ao direito à moradia em detrimento do direito ao meio ambiente. A hipótese é que o conflito deve ser solucionado através da ponderação e da proporcionalidade, com base na apreciação das nuances do caso concreto.Metodologia: Para análise e desenvolvimento da pesquisa foi utilizado método qualitativo, baseado em fontes bibliográficas e informativas, tais como sites de notícias nacionais e internacionais, artigos acadêmicos, ensaios, normas e doutrinas sobre o tema.Resultados: A conciliação entre o direito fundamental à moradia e o direito fundamental ao meio ambiente ecologicamente sustentável pode ser alcançado através do instituto da Reurb desde que observados rigorosamente todos os critérios previsto na legislação de regência através da elaboração de estudos técnicos de qualidade que baseiem todo o procedimento.Contribuições: Discussão das bases normativas do direito à moradia no âmbito internacional e no âmbito interno; exposição da evolução do instituto da Reurb ao longo do tempo; discussão das possibilidades de sua implantação em áreas ambientalmente protegidas, com enfoque nas áreas de preservação permanente.Palavras-chave: Moradia; Meio ambiente; Colisão; Regularização fundiária urbana. ABSTRACTObjective: This article aims to analyze the socio-environmental conflicts arising from the relationship between the fundamental right to an ecologically balanced environment and the fundamental right to housing through the regulation proposed by the urban land regularization law. The problem to be discussed is to analyze whether the institute of land regularization grants preponderance to the right to housing to the detriment of the right to the environment. The hypothesis is that the conflict must be resolved through weighting and proportionality, based on the appreciation of the nuances of the concrete case.Methodology: For the analysis and development of the research, a qualitative method was used, based on bibliographic and informative sources, such as national and international news sites, academic articles, essays, norms and doctrines on the subject.Results: The conciliation between the fundamental right to housing and the fundamental right to an ecologically sustainable environment can be achieved through the institute of Reurb provided that all the criteria provided for in the governing legislation are strictly observed through the elaboration of quality technical studies that base the entire the procedure.Contributions: Discussion of the normative bases of the right to housing at the international and domestic levels; exposition of the evolution of the institute of the Reurb over time; discussion of the possibilities of its implementation in environmentally protected areas, with a focus on permanent preservation areas.Keywords: Housing; Environment; Collision; Urban land regularization.

RESUMO Objetivo: Esta pesquisa tem como objetivo demonstrar que o processo não é um fim em si mesmo, mas um instrumento necessário para a realização do Direito e que o julgamento sem provas não pode ser considerado como julgamento de mérito. Metodologia: A metodologia utilizada quanto aos meios, é o método dedutivo através de uma pesquisa crítica-dogmática por meio da análise doutrinária, bibliográfica, normativa e jurisprudencial.Resultado: A conclusão a que se chegou é de que somente haverá julgamento de mérito e efetivação do direito com a análise processual das provas. Assim, quando o juiz extingue o processo por ausência ou insuficiência de prova, não haverá julgamento de mérito e nem a existência de coisa julgada material. Contribuições: O artigo aborda um tema inovador que se revela em um viés teóricoprático, na medida em que impõe um novo olhar ao processo, de forma especial sobre a necessidade de o julgador analisar as provas para chegar ao mérito da ação, alcançando a segurança jurídica através da coisa julgada material. ABSTRACT Objective: This research aims to demonstrate the process is not an end in itself, however a necessary instrument for the realization of the Law and the trial without evidence cannot be considered as a judgment of merit. Methodology: The methodology used as to the means, is the deductive method through a critical-dogmatic research by doctrinal, bibliographical, normative and jurisprudential analysis.Result: The conclusion reached is there will only be a judgment on the merits and enforcement of the right with the procedural evidence analysis. Thus, when the judge extinguishes the process due to absent or insufficient evidence, there will be no judgment on the merits nor the existence of a material res judicata. Contributions: The article addresses an innovative theme which reveals itself in a theoretical-practical bias, in so far as it imposes a new look at the process, especially about the need for the judge to analyze the evidence to come to the merit of the action, reaching the legal certainty through the material res judicata.
