江苏省张家港市东山村崧泽文化早中期大墓的发现, 证明长江下游在距今 五千七、八百年以前已存在明显的社会分化, 初级王权已经产生, 社会已进入“古 国”1阶段。在中国古代文明演进过程中, 率先开始社会重大转型的不是黄河中游的 中原地区, 也不是以古长城地带为中心的北方地区, 而是崧泽文化所在的长江下游地 区。该遗址的发现还表明, 在文明化进程中, 中国古代最早出现的 “古国” 的性质和 表现形式并不完全一样, 有的是神权至上, 有的是王权至上, 从而导致其发展方向和 发展前途的不同。 1 “古国” (guguo), a concept put forward by Su Bingqi, literally means “ancient state.” This literal translation is adopted in this paper. However, the author believes that in Su’s theory, guguo is roughly equivalent to “chiefdom” in the West. 关键词: 崧泽文化 社会分化 王权 The discovery of large burial sites belonging to the early and middle stages of Songze Culture at Dongshan Village, Zhangjiagang, Jiangsu Province, shows that distinct social polarization had already emerged in the lower reaches of the Yangtze River 5,700 or 5,800 years ago, when the initial stage of kingly power had taken shape and society had entered the stage of the “ancient states.” In the course of the evolution of ancient Chinese civilization, this area—rather than the Central Plains in the middle reaches of the Yellow River or the northern area centered around the ancient Great Wall—was the first to experience significant social transformation. This discovery also indicates that when the “ancient states” first appeared, they varied in form and character: some took the form of theocracies while others were dominated by kingly power. In order to further promote the reform of the procuratorial system and mechanism, it is necessary to first clarify the nature and developmental laws of procuratorial power. By its nature, China's procuratorial power originates from the Marxist theory of state. Under the joint influence of historical logic, the political system and actual national conditions, it demonstrates both universality and Chinese characteristics. On the basis of constitutional norms, we can discover the general laws of the evolution of procuratorial power in China; that is, on the premise of maintaining its basic attribute as legal supervisory power, its extension and operational mode are constantly readjusted in line with the changing times to realize the synchronous development of procuratorial power and national governance. In recent years, the development of Chinese procuratorial power has shown new features in actively responding to the needs of the times. This is the joint outcome of changes in the main social contradictions, the adjustment of the state power structure, the reform of the judicial system and mechanisms, etc. In constructing a socialist procuratorial system with Chinese characteristics, we should adhere to the nature of procuratorial power as legal oversight, and respect the general laws of its development. In accordance with social demands and judicial practice, we should further expand the extension of procuratorial power, innovate and enrich its operational mechanisms and realize its dynamic adjustment in tune with the times. Existing research on grassroots rural governance in China adopts a network perspective to explore the role of traditional social vehicles including clans, clan clusters and popular beliefs in improving village governance. However, most of this research has concentrated on analyzing the way in which horizontal network relationships lead to effective village governance. It has thus to some extent neglected the basic reality of the overlapping interconnections between the “top-down” administrative system and the informal structure of village governance. In fact, an analysis that proceeds from the features of the government’s own organizational network, the social structure of the village itself and the position of its elites in order to focus on modes of interaction within the village under the intermixture of (formal) system design and (informal) social relations, shows that differences in the composition of the government’s promotional networks resulting from the traits of key officials affect the speed of policy dissemination as well as the government’s mode of interaction with the village elites. Moreover, differences in these modes of interaction further influence the subsequent operation of self-organization based on social traditions (“filial piety” or “morality”). At the same time, structural elements, including the economic and social relations of the village itself, determine whether self-organization will improve the quality of governance in the long term. This finding can serve as a reflection on and critique of the theories of “strong government” and “tradition” current in academia. [ABSTRACT FROM AUTHOR]

The social reforms in China since the late 1970s represent an arduous process in which the Chinese nation, in its own way, has reflected upon the many disadvantages of the “civilization of modernity,” and has explored, created and practiced “Chinese values,” pursuing and shaping new spiritual convictions and new (rational) value beliefs for its national culture. In a deeper sense, “Chinese values” are endowed with a marked orientation toward practice and follow the logic of genuinely implementing society's “public values” on the basis of the intrinsic and organic integration of the personal and public and the national and cosmopolitan. This manifests the pursuit of a noble belief in justice and a commitment to a universal and genuine good life for the Chinese populace today. What “Chinese values” seek to forge is an image of “the Chinese” that manifests not only the disposition and breadth of vision of a contemporary “citizen of the world,” but also the fine traits of tolerance, benevolence, responsibility, and courage, as well as self-esteem, self-improvement, confidence, and self-reliance. 所谓酋邦分布的绝对普遍性问题并不是当代国际学术界的公论, 明确这点对于我 们准确把握酋邦概念和理论的本来意义有积极价值。通过对古希腊等个案的分析而开 展的关于酋邦形态在欧洲和世界更多地区分布情况的进一步研究, 并不会改变关于中 国个案适用酋邦模式的基本认识, 也不会对中国国家起源的研究产生新的重大难题。 在对中国国家起源问题的理论研究中, 对国外学者成果的借鉴无疑非常重要。而这需 要研究者对有关国外资料做切实深入的了解, 从而准确理解和概括有关成果的真实意 义。目前国内有些研究虽然提出对于国外研究成果的某种概括, 但实际上并没有经过 对有关原始资料本身的认真研究, 所谓的概括性意见是不准确的。这是在当前研究中 需要注意的一个问题。 关键词: 酋邦 部落联盟 国家起源 There is no consensus in international academia on the absolutely universal appearance of chiefdom in all parts of the world. Making this point clear has positive significance for the correct understanding of the original meaning of the concept and theory of chiefdom. Further researches on the distribution of chiefdoms in Europe and other parts of the world, based on studies of ancient Greek and early medieval Germanic cases, will not change our basic understanding of the chiefdom model’s applicability to the case of China, nor will it pose a serious challenge to the ongoing researches on state emergence in China. It is undoubtedly very helpful if we diligently apply foreign academic findings to our own studies in this subject, but genuine and in-depth understanding is necessary, if researchers are to accurately interpret and sum up the real implications of these foreign materials. At present, some Chinese scholars have produced various generalizations based on their own understanding of foreign research results. However, since they are not based on careful study of the original literary sources and other materials, those “generalized” views are often inaccurate. 腐败案件的高发案率是中国当前所处的社会转型期的突出特点。为了适应治理腐 败犯罪的需要, 中国刑事司法形成了一整套独具特色的侦查体制、办案原则, 并且注 重依靠群众查办腐败案件, 注重打击重点的随时调整。中国刑事司法注重提高腐败案 件的侦查能力和加强反腐败刑事司法的规范化建设等, 这是中国反腐败策略在刑事司 法领域的具体体现。同时, 中国在反腐败刑事程序如何与国际公约对接等方面面临着 一些挑战, 这也指引着中国刑事司法改进的方向。 关键词: 反腐败 社会转型 刑事司法 司法改革 A high incidence of corruption cases is a conspicuous feature of China’s present stage of social transition. Responding to the demands of combating corruption, Chinese criminal justice has developed a unique set of investigative methods and principles for handling of such cases, placing a high value on relying on the masses to find and act on cases of corruption and promptly adjusting its focus to the key areas of such crimes. It concentrates on enhancing investigative capacity and strengthening the standardization of anti-corruption criminal justice. These practices represent the concrete embodiment in the field of criminal justice of the government’s anti-corruption strategies. At the same time, China also faces some challenges in adjusting these procedures to accord with international practice. This is one of the aims of the judicial reform in China. A basic issue reflecting precisely these two perspectives is that of the formation of the social psychology mechanism of individual-group relations, namely the formation of the concept of “us” in Chinese society and culture, as well as the possibility and conditions for the transformation of this mechanism. Exploring this issue will not only help us to understand social cohesion and the logic of group behavior and to discuss the relationship between the state and the individual, society and the individual, and the category and the individual; it will also help cultivate social psychology resources and support systems at a time of social transition, and thus promote social cooperation.. Unlike previous analytical studies that focused on a unitary mechanism, this study uses the discussion of two cases to put forward a new framework for analysis: that is, the Chinese concept of “us” comes into being through the mingling of “guanxilization” and “categorization” under the influence of social context priming, value orientation and other factors. 通过对河北省保定市郊区农村的深入访谈和问卷调查，本文研究了有两个以上已婚儿子的老年夫妻去世前的生活状况。研究发现，儿子成年之后的独立门户，是这类老年夫妇“空巢”的前提，而“空巢”又是“轮养”契约得以建立的条件。市场化、社会结构转型、儿媳妇在家庭决策中作用的增强等，使老年人失去了家庭决策权。故“轮养”在生命过程中，实际是被安排的结果，而不是老年父母自己的选择。 Through in-depth interviews and questionnaire surveys of rural residents on the periphery of the city of Baoding, Hebei Province, this study examines the living conditions of old couples with two or more married sons in the last years of their lives. This study indicates that adult sons' setting up their own homes is a precondition for elderly couples' becoming “empty nesters,” a situation which in turn leads to contracts for “care rotation.” Many factors, including marketization, the transformation of social structure and the rising status of daughters-in-law in family decision-making are responsible for elderly people's loss of their role in such decision-making. Therefore, during the life course of the elderly, “care rotation” is in fact an arrangement imposed on elderly parents rather than their own choice. [ABSTRACT FROM AUTHOR]
