The article discusses the book "The Sharif Sultan: The Religious and Political Roots of the Makhnaz State in Morocco" by historian Mohamed Nabil Malin, in which he reviews the historical and political aspects of the Saadian state in Morocco. The book addresses three main themes: the ideological means used by Ahmad al-Mansur to justify his political legitimacy, the institutional means that contributed to the construction of the Saadian state, and the foreign policy of the state during his reign. It also highlights the challenges faced by the state, including internal competition for power and relations with external forces, reflecting the complexities of Moroccan political history during that period. The research deals with a very important topic, which is the topic of government legitimacy in constitutional and international law, although we cannot determine its form and nature due to the changes and developments that have occurred to it over time, but in this research we can determine it through the standards of constitutional law to indicate the legitimacy of the government, and as It requires the intervention of the international community in determining the nature and legitimacy of governments, in terms of the means of attaining power and how to exercise it, in order to move the state towards stability and organize its political, economic and social affairs, to achieve the establishment of working bodies to achieve the goals of society. يعيد الباراديغم التداولي الاعتبار إلى فكرة الدِّيمُقراطِيّة بعيدًا من اختزالها في تمثيل دوري يُمَكِّنُ نُخبةً صغيرةً من احتكار القول والفعل باسم الشّعبِ ويُسدل عليها وسما أوليغارشياً، وفي هذا تأثر بالأطروحة الماركسية في الديمقراطية وتطوير لها في الآن عينه. لقد كف، في ظل الديمقراطية التداولية المجتمع المَدَنِيّ عن التفويض المُطلق للمجتمع السياسي في اتخاذ القرارات وسنّ ما يُقرّر صلاحيته من تشريعات؛ فبدلا من هذا، نقلت الديمقراطية التداولية المبادرة إلى المجتمع المَدَنِيّ، بما يحتازه من سُلطَة تواصلية، لكي يبلور قضاياه ومشكلاته في رأي عام، قبل صيرورتها تشريعات وقراراتٍ مُماسَسةٍ ومُلزمةٍ. مع التداولية، تعود إلى الديمقراطيّة معانيها المُغتربة عنها في صيغها الحديثة، من دون إسقاط فكرة التمثيل. تمزج التداولية، إذن، محاسن ديمقراطية القدامى المباشرة، وديمقراطية المحدثين التمثيلية؛ فلا هي براديكالية تقف على أنقاض مؤسسات التمثيل، ولا هي بنُخبوية لا يُسأَلُ فيها عن المُمَثْلِ إلا بعد انقضاء ولاية المُمَثَل. لا يُلغي النموذج التداولي التمثيل السياسي ومؤسساته، التي تصيرُ صدى لمشكلات الشعب؛ فتحقّق، فعلا، فكرة التمثيل من دون مصادرة المشاركة، ويُمسي، بالتالي، المجتمع السّياسيّ رهن إشارة المجتمع المدني بدل من العكس. This research paper analyzes the political regimes in the Arab world since independence and their legitimacy. It examines three styles of government: hereditary, republican, and military. Hereditary regimes pass power within ruling families based on historical or religious legitimacy. Republican regimes derive legitimacy from political pluralism and elections. The woman represents half of the society and that the creative text or language does not favor anyone, whether it is male or female, but rather the language biases the creator. Language is not racist or exclusionary, but rather it is the entity of freedom and the source of inspiration, or the house of existence. The man tried to conquer the woman when he was in the primitive life that is based on the survival instinct, and the strongest is the one who bears its risks based on a previous conviction that the physical structure of the man is stronger than what it is in the woman. The male dominance has become expanding in the social space, and that the virile culture is a state of recognition and legitimacy that has turned into class discrimination, and away from psychological analysis. Cultural criticism played its role in this research in revealing the implications of the presence of the maternity pattern in Al-Hutay’a’s poetry, as it is a strange paradox that Al-Hutay’a’s dealings with the presence of women in his poetry were a special case in terms of satire or degrading the dignity of those he spelled, so he satirized his mother and described her with bad descriptions. This study deals with the political legitimacy of the Muslim ruler, through the prophetic Sunnah to determine the controls and determinants which makes the Muslim ruler legitimate, people must obey him, because his obey -In that case- derived from the obedience of Allah Almighty. The study came in a preamble and three topics: In the first topic, the political legitimacy of the ruler was linked to his eligibility to rule, and in the second topic, his legitimacy was linked to the way he reached power, and in the third it related to his method of governance. The scientific research methods used in this research are: the inductive approach and the descriptive approach. The study concluded that the description of political legitimacy is taken away from the Muslim ruler if he does not have the qualities that should be available in the Muslim ruler and that qualify him to rule, as well as if he reached the judgment without the advice of the ummah, as well as if he was not committed to the rule according to the rules of Islam. Constitutions usually regulate the relationship between religious references and the state authorities. They may establish a relationship between the state and a specific religion or religions, that Constitutions recognize a religion or grant its laws or institutions a distinct position in the legal-political system, while other constitutions openly denounce the state's secularism. However, for many people in the world, the religious identity is an integral part of their societal or national identity, which sometimes requires to be expressed through constitutional recognition. If we discussed the Islamic heritage, we will find that the Islamic state in the Prophet’s era had a constitution or a constitutional document, and that document could have been a strong beginning for developing Islamic jurisprudence, but that It has not happened over the past 14 centuries. Today, along the map of the Arab countries, the religious issue has formed one of the main axes in the discussions on the organized philosophy of the new constitutional documents, especially after the Arab Spring, so we find this clear in Tunisia, Egypt, Morocco, and to some extent in Jordan, Yemen and Bahrain. Other countries are still waiting to build new constitutions, as is the case in Algeria, Libya and Syria. We find that most countries of the world support religion in one way or another, but the motives of states' support for religion are different, including sincere conviction in religion, searching for political legitimacy, or seeking to control religion. Motivation is often a combination of all of this. Regardless of these motives, this general support for religion indicates its strength and entrenchment in contemporary societies, contrary to what secularism theory predicts the decline of religion in the contemporary world. However, constitutional texts need good practices, on the one hand preserving the spirit of constitutions, on the other hand, accumulating a culture that helps in awareness of the necessary distance between religion and politics in the state and its institutions. Otherwise, the relationship between the two ends, in which politics often prevails at the religion. For the Islamic civilization to overcome its constitutional crisis, the restrictions must be removed in order for this civilization to resume its path again, and the beginning of its fruitful contribution to the human march after half-heartedness and retreat for a few centuries. Perhaps the most important thing that aspiring Muslims need to cross into the future is realizing the historical moment in their hands, and clinging to the threads of dawn away from any discouragement.
