Denne oppgaven undersøker hvordan bruksordninger ved jordskifte faktisk fungerer. Utgangspunktet er at jordskifterettens befatning med saker er over i det saken avsluttes. Dermed er det behov for å undersøke hvordan bruksordninger fungerer i tiden etter at saken avsluttes hos jordskifteretten. Hovedproblemstillingen er: Hvordan fungerer bruksordninger fastsatt ved jordskifte? Dette belyses gjennom en rekke underproblemstillinger. Jeg fant at jordskiftedommerne har et relativt varig perspektiv på sine bruksordninger der nye spørsmål skal kunne løses ved hjelp av det styringsverktøyet en bruksordning er. Dette ser ut til å samsvare med lovens mening. Videre fant jeg at i flertallet av sakene så løste bruksordningen de problemer som utløste krav om ordning. De fleste partene mener at det er nødvendig å ha en instans som kan tvinge igjennom løsninger og organisere parter, to parter var mot dette. I tre saker har partene tilpasset ordningen ved å endre vedtekter o.l som tyder på at partene klarer å tilpasse ordningen til sine behov. Det ser ut til at hvis bruksordningen løser problemene, så vil også saken fortsette å fungere over tid. Det er èn sak som er unntak fra dette. Da jeg sammenlignet sakene, fant jeg at saker som ligner, fungerer svært ulikt. Det ser ut til at det er menneskelige faktorer som hindrer at problemer løses og ordninger fungerer over tid. Grunnen ser ut til å være alt fra ulike filosofier for drift av eiendom til skepsis mot jordskifteretten. Kort oppsummert, det har ikke blitt krevd ny bruksordning i noen av de undersøkte sakene. Det ser ut til at hvis en bruksordning løser problemene så vil ordningen fortsette å fungere over tid. Til slutt ser flertallet av de undersøkte bruksordningssakene ut til å ha fungert bra over tid Etter dette konkluderer jeg med at bruksordninger ved jordskifte fungerer bra i flertallet av de undersøkte sakene. The Land Consolidation Court organizes joint and independent land use in a number of cases each year. This thesis examines how the organizing functions as time passes. The study consists of 12 cases with a total of 22 parties interviewed. I found that judges in the Land Consolidation Court organize land use with a lasting perspective. Furthermore, the organizing solves the land use problems in a majority of the cases. In three cases the parties have made formal changes to the land use rules, indicating flexibility. It seems that if the organization solves the problems, it will continue to function over time. In summary, organization of joint and independent land use seem to function well in a majority of the cases examined in this thesis.
