Thesis title: Criminal offense and investigation of stalking Abstract The presented rigorous thesis analyses a criminal offense of stalking in §354 provision and selected investigation issues of this type of criminal activity. This work consists of an introduction, four main chapters, and a summary. The first chapter defines the concept of stalking and its genesis. Then, the particular signs of stalking and basic views on the classification of the perpetrators are described. The case interpretation of some real cases of stalking follows. The second chapter is focused on the criminal offense of stalking. Firstly, from the point of view of its adoption in the legal order of the Czech Republic and its position in the system of the Criminal Code of the Czech republic. Stalking - Dangerous Pursuing Abstract This thesis deals with the issue of stalking, which is viewed comprehensively with the aim of summarizing and evaluating its criminological and criminal law aspects and assessing whether Czech legislation allows for an effective response to cases of stalking, timely assistance to its victims and appropriate punishment of the stalker. The thesis points to findings based on foreign research and studies dealing with the person of the stalker, his manifestations, and the person of the victim of stalking and the related effects on him. Surveys show an alarming number of cases of stalking in society with an overall lifetime prevalence ranging from 4.5% to 23.4%, and even from 6.1% to 32.4% for women, depending on the strictness of the definition used. The stalker does not choose his victim at random and the victim usually knows his stalker. The most typical case of stalking being a man stalking his current or former intimate partner, the danger in these cases being precisely the stalker's knowledge of his victim, the sophistication of his actions and his propensity for physical violence. Crime of Stalking and Protection of its Victims This diploma thesis focuses on the issue of stalking, or more precisely on its individual aspects and its legislation in the Czech Republic. As for the structure of this thesis, it is divided into five main sections. The first section deals with stalking in general. The individual chapters are devoted to the definition of this term, the historical development of this phenomenon and common forms of stalking, including two specific types of stalking, which are cyberstalking and stalking in the workplace. The second section deals with the characteristics of stalkers and their motives. The third section concerns the victims of stalking. The individual chapters successively analyse the typologies of victims, the impact of stalking on victims, including post-traumatic stress disorder, as well as the main strategies oriented towards helping the victims of stalking and, finally, the issue of false victims. "The issue of stalking in modern times" Stalking is not a new phenomenon, but modern times, and especially the very dynamic development of modern technologies that have gradually become part of our lives, are taking this type of crime to a completely different dimension. This rigorous thesis deals mainly with the criminal offense of dangerous stalking according to § 354 of the Criminal Code and the related issue of misuse of modern technologies for the persecution of the victim, it also focuses on the motivation of the perpetrator and the behavior of the victim. Title Criminal and criminological aspects of stalking Abstract Submitted rigorous thesis deals with the modern phenomenom of stalking. The aim of this academic paper is to present this issue comprehensively from both criminal and criminological aspects. This rigorous thesis consists of 16 chapters. These chapters can be divided into two large parts - criminal and criminological. Research of the problematics of stalking have got a rich tradition in foreign professional literature, we can find there also some empirical research studies. Furthermore, there are countries that haveissued relevant anti- stalking regulations already in the 90's of the 20th Century. On the contrary, in the Czech Republic, stalking was included as a part of Force of New Offence under the Czech Criminal Code no. 40/2009only in 2010. In criminological part of this rigorous thesis I apply general knowledge from forensic psychology, psychiatry, sociology and other social sciences. The theoretical part of the thesis provides the characteristics of stalking and its types. It shows the approach of the Czech legislation. It also discusses its status, intensity, structure and dynamics in the Czech Republic, as well as the etiology. That is followed by describing the impact the stalking has on a victim. The conclusion includes recommendations for the stalking victims. The aim of the thesis was to find out, how does stalking affect everyday life and free time activities of the victims in their eyes, in connection with the type of stalking the stalker performed. At the same time, the goal was to find out, whom did the victim approach for help and whether or not they trusted that the police could help. It was determined that the stalkers most often used intrusive contact and lingering close to the victim's home or workplace. The respondents agree on the impact on their mental state, which further affects their overall health. It can be concluded that stalking affected the work/study life of the respondents and their relationship. More than half of the respondents also observed financial and material consequences. The way they spent their free time was affected by the mental state of the respondent and by the direct intrusion of the stalker. All respondents approached their family or friends for help. The level of trust in the police can be viewed as above average. However, the outcome of the police help was not rated as fully satisfactory by none of the respondents that decided to contact the police. The results showing the trust and satisfaction with police can be very valuable in the terms of introspection regarding the handling of stalking victims. The knowledge regarding the impact of stalking is important in order to understand what is the victim going through. The text can serve as a source for students that may encounter stalking victims in their future career path.

Resumé v anglickém jazyce The issue of this thesis is the crime of dangerous stalking, which is set out in section 354 of the Act No 40/2009 Coll., Criminal Code and which criminalizes behavior commonly known under the term of stalking. The thesis aims not only at clarification of the criminal-law aspects of this crime, but also at its presentation in a more complex approach. This thesis deals with the crime of dangerous stalking under s. 354 of the Criminal Code and also with the phenomenon called stalking, which is directly linked with the merits. In introduction of the thesis is described a relationships between the concepts - crime of dangerous stalking and stalking. This dissertation deals with today still actual phenomenon called stalking, not only with it's more serious form known as a dangerous stalking but even its less serious forms. The work is systematically divided into three key parts - the first one focuses on a term definition followed by the part dealing with criminal points of view and the last one concentrates on criminological aspects. The introductory chapter contains some of the most famous definitions trying to define a difference between a stalking and a dangerous stalking. The readers are as well informed about the history of stalking and its possible forms to make it easy to understand the problem on a common level. The second part is dedicated to a criminal level of stalking. The topic of this diploma thesis is "Criminal Law and Criminological Aspects of Stalking." This phenomenon is well known in history, nevertheless it was only few years ago, that it became a criminal offence. This thesis is focusing on the topic of the crime of stalking under section 354 of the Czech Criminal Code (Act. no. 40/2009). The offence of stalking captures in its merit the harmful psychological and social phenomenon known under the name stalking. A Abstract of the thesis "The Issue of an Offender's Personality in Criminology" Offender's personality is a summary of various aspects influencing one's behaviour in regards of a set offence. This paper focuses mainly on criminological and psychological aspects of people who commit violent crimes. It summarizes different typologies of offenders, schools of criminal causes, various aspects of personalities, and discusses prevention of criminality in the Czech Republic. In addition, it focuses greatly on stalking from theoretical as well as practical point of view through an extensive case study. The main foundation for this case study is a court case from early 2008, further anonymous due to request of the Municipal Court in Prague. Even though this case took place before stalking was recognised as a criminal offense in the Czech Republic, it served greatly as a foundation for its recognition, and thus plays a vital role. The bachelor thesis focuses on modern electronic communication and its use by high school youth. It is aimed primarily at the possible risks connected with the use of electronic communication. The main goal of the thesis is to point out the sociopathological occurences connected with the IT communication. The theoretical part of the thesis is mainly concerned with the sociopathological occurences connected with the usage of IT communication, such as cyberbullying, stalking, sexting, cyber grooming, social engineering and manipulative communication. The practical section of the thesis explores the frequency of the use of electronic communication by high school youth, the extent in which they are acquianted with sociopathological occurences connected with electronic communication, and whether the students themselves have personally experienced cyberbullying.

As Meloy (1998: 4) says: "Stalking is an old behavior, but a new crime. Postmodern society which is evolving not only in real environment but also in multimedia cyber-space brings much more instruments and trends where stalking can be realized. I focus my bachelor work on celebrity stalking, a specific type of stalking in which celebrities are the victims. Scholarly research on stalking exists and focuses on domestic violence, working environment, or other kinds of harassment. Celebrity stalking cases, however become public through the media especially from particular cases, mainly those of foreign celebrities, presented as tabloid articles. Because of the lack of formal research on celebrity stalking, I analyze the common forms and connections in celebrity stalking. My research is based on 5 qualitative interviews with celebrities who are victims of stalking. I try to define relationship between respondents and their fans where I am focusing on break point of change from common fan into chaser. Domestic violence The present thesis deals with the phenomenon of domestic violence, from the substantive, procedural and criminological aspects. The first part defines the specifics of domestic violence, its signs and forms. It shows a typology of victims and perpetrators. It analyzes in detail the basic facts of the crimes that are the most commonly perpetrated forms of domestic violence. It also describes the sanctions and some of the treatment programs that are available for perpetrators of domestic violence. It maps the treatment of domestic violence in criminal procedural law and describes the reporting institution. The paper analyzes the status of the victim and also deals with the planned law to protect victims of crime. The conclusion summarizes the treatment of domestic violence abroad and briefly mentions the organizations providing assistance to victims of domestic violence and protection.

This work is focused on domestic violence and its impact on the development of children affected by domestic violence. The theoretical part deals with definition of domestic violence, its symptoms and causes, personality of the oppressor and the victim, as well as the current regulations of the phenomenon in the Czech law. The practical part focuses on finding the links between childhood with an unstable family backgrounds, where domestic violence occurs and subsequent relations of individuals in adulthood.

v anglickém jazyce Criminal aspects of domestic violence The subject-matter of this thesis are criminal law aspects of domestic violence that is why the focal point of my work is in an analysis of criminal law regulation of domestic violence and criminal offences committed in connection with it. Beside that I have tried to provide a general review of a phenomenon called domestic violence, of its character, basic attributes, types, effects and controversial issues. One chapter is about the regulation of criminal procedure, particularly about a victim's right of disposition and the new Victims of criminal offences Act. The main objective of this work is to analyze the negative influences on children in schools and at home through a questionnaire survey Another task of the work is made presentations on the most commonly occurring adverse effects on the Internet, which appeal to children. Presentations will include demonstrations of this issue. Next the survey results visualization, statistical processing and analysis of collected data, the formulation and verification of hypotheses.

This Bachelor´s thesis concentrates on attitude of the professional public about danger chase, or stalking. Permanent stalking is quite serious crime. Danger stalking is penalized from 1st January, 2010 in the Czech Republic. Moreover in accordance with the principle ?ULTIMA RACIO? the Stalking was established as the facts of the case in the Penal code nr. 40/2009. The theoretical part of thesis has an interdisciplinary character. Point of view is considered in two levels. There is a sociological and a juridical level. In this part is described current state and short history of phenomenon stalking; furthermore sorts of stalking and typology of offenders. There is also described the impact of stalking for victim, and the ways how to face up to danger stalking. The conclusion describes legislation and statistical data of stalking. The main goal of this thesis was ascertain, whether there is a public requirement to stalker is being penalized. Consequently, I determined partial aims. Is danger stalking frequent phenomenon and is the stalking so serious crime that it is necessary to punishe stalker in accordance with the criminal code. I used the qualitative method in this research. I chose technique of half-structured interview for collecting of information. Collected notes were recorded by word-for-word transcription. There was used the method of open coding for data analysis. There were nine respondents in my thesis. These respondents are experts for issue of danger stalking. The research showed, that there is an agreement among experts that stalking is serious, however not frequent crime. There was also consensus about necessity to classify stalking as the crime. Moreover most of them agree with present criminal sanction. There was not any respondent with other opinion. The result of the research corresponds with my conviction. The thesis refers to requirement of Czech legislation. It could be contribution for non-professional, or charity organization that concern on stalking. Results of thesis should be used as the feedback for specialized public, or professionals.

in English My thesis is focused on the criminal offence of "nebezpečné pronásledování" (dangerous harrasement as literally translated into English) under the section 354 of Czech Criminal Code. The offence was added to the Criminal Code recently, in order to allow criminal prosecution of stalking. In the past, the absence of special antistalking law has caused serious problems because of insufficient protection of victims. As the criminal prosecution of stalking has been possible for 3 years, I was convinced that the effectiveness of the provision should be evaluated and suggestions for de lege ferenda should be made. The thesis is divided into three major parts and each of them is further subdivided into chapters and subchapters. The diploma thesis on the theme ?Factors influencing adolescents´ opinion on issues of the domestic violence? deals in the theoretical part with all important aspects of the domestic violence and stalking. The research part has been focused on adolescents aged 17 to 19 years living in Vysočina region, the research sample has consisted of 858 respondents. The aim of the thesis was to find out, by statistical methods on a statistically significant sample of adolescents, key factors influencing the adolescents´ opinion on the issue of the domestic violence. In relation to the aim of the thesis there were determined following hypotheses, which were tested on 5% significance level with six survey questions. Hypothesis 1: ?Statistically significant factor for the domestic violence among adolescents is their personal experience? was confirmed in four areas. Respondents having the personal experience with the domestic violence differ from the respondents without such experience in the following: they are more aware of a possibility of a partner´s violence at their age, they more refuse to tolerate the domestic violence, they better recognize a definition of the domestic violence and they are often aware of a possibility of a trans-generation transmission of the violence. In connection with this hypothesis it is important the finding, that 57 respondents (7%) have their personal experience with the domestic violence; 49 girls and 8 boys. Hypothesis 2: ?Statistically significant factor for the domestic violence among adolescents is the education? was not confirmed due to a low variability of responses and insufficient data to evaluate the hypothesis. Hypothesis 3: ?Statistically significant factor for the domestic violence among adolescents is the gender (women)? was confirmed in two areas. Girls differ from boys in the following: they are more aware of a possibility of the partner´s violence at their age and they more refuse to tolerate the domestic violence. The diploma thesis can serve as a source of current information related to the issue of the domestic violence, it provides an up-to-date data on the prevalence of the domestic violence in the adolescence and it presents information and opinions of adolescents on the domestic violence or partner relationship. The thesis can be used by professionals as well as lay public interested in the domestic violence and it can be a basis or a comparison for other studies and researches.

This thesis deals with crime of dangerous harassement (stalking) in Czech Republic. It focuses on current legislation and possible future legislation changes. It deals with the most common types of harassement and its specific relationship to domestic violence. It focuses not just on the personality of offender but also on status of the victims and its possibilities of protection against stalking. It also deals with the penalties imposed for this crime under Czech law and performs comparative study of Czech and international regulations, especially of Austria, German and the United States of America.

Resumé The aim of this final thesis is to evaluate stalking - the phenomenon which gained infamy over the last few decades - and its legal definition. Stalking or "dangerous pursuit" (literal translation name of the Czech criminal offence of stalking) is also a new offence under Czech Criminal Code no. 40/2009 which was entered into force on the 1st of January 2010. The main goal of this newly introduced criminal offence is to cover the psychological and social phenomenon of the same name, stalking, and the main goal of this thesis is to critically assess whether this criminal offence, "dangerous pursuit", is successful in criminalizing the stalking phenomenon and whether its form is an effective instrument in fighting stalking. The thesis begins with a short overview which aims to unveil the main ratio behind the call for a legal regulation of stalking. Then a psychological and social peek into the depths of this phenomenon follows (encompassing some of the most widely used typologies and even some clinical opinions on punishing and treating stalkers), which allows to critically evaluate the efficiency of that new criminal offence later on. This thesis deals with the current issue of discrimination in the workplace, especially focuses on discrimination based on age and sex, sexual harassment and bullying in the workplace, legislation that regulates the area of discrimination in labor relations. The theoretical section includes explanations of terms and connections to a given focus and the practical part includes a probe into five large companies examining whether the effects mentioned in the theoretical part actually occur in practice, or how these problems are solved. This probe was in the form of semi-structured interview respondents in their workplaces. The results confirmed the claim that one of the most vulnerable group are women. Larger companies are trying to provide them a variety of advantages as for example flexible-time work, etc. Some companies have confirmed that there were some cases of bullying or sexual harassment in their firm, but these situations have not been solved other than by the dismissal of one of the participants. However, the occurrence of age discrimination was in the surveyed companies not confirmed - despite the theoretical claims and personal experience. The thesis ?Help to the Victims of Stalking? deals with the problem of the dangerous pursuit or stalking. The main goal of my work lies especially in publicizing this kind of stalking and the ways how to solve the situations of the victims of stalking. i divided my work into two main parts. The first chapter of the theoretical part defines stalking as a specific form of relational violence. Another chapter tries to judge the level of stalking on the basis of collected and evaluated data about both offender and victim, and to assess situational factors and the dynamics of stalking. The next chapter focuses on legislation of stalking in the Czech Republic and institutions which offers help to victims and education for public. The last chapter of theory is about assistance to the victims of stalking and interventions. The practical part of the thesis brings the quantitative survey with the use of the method of questionnaire with interrogation. i set the following goals of the research: to realize the level of awareness of stalking in České Budějovice and whether the general public in this town can specify the way how to help the victims of stalking. After evaluation of survey outputs i can say that the first hypothesis was verified, but the second one was not confirmed.

I am pointing out especially the typology that can predict potential violence, and those that show means that limit, respectively stop stalker's conduct, such as effect of legal sanction or comply with medical care. I also examine, in detail, some legislations of Common law countries and the legislation of the Czech Republic. I focuse on civil, administrative and criminal means of legal protection against stalking.

The theoretical part of the bachelor?s thesis deals mainly with clarifying the term of ?stalking? as a dangerous harassment of a victim by offenders. This part will provide the reader with a detailed professional explanation and other background to the given issue. The thesis copes with the methods of stalking; forms and ways stalkers use; it tells who is the perpetrator and who is the victim. Also, it observes stalking from the perspective of its impact on the victim. Being a danger to society, it is described as a socio-pathological phenomenon with possible health, social, and mental impacts on the victim. The practical part of the bachelor?s thesis comprises of a quantitative research, which used the method of questionnaire and that was distributed to selected respondents in target groups of people, see target group. The practical part focused on finding out the level of awareness of stalking among selected respondents in Jindřichův Hradec, occurrence of this phenomenon in the given region, forms and ways stalkers use, and possible preventive measures against stalking.

Stalking or a dangerous pursuit is considered to be a specific form of violence. Its main feature is that an offender clamps to a known or unknown person who he persecutes by an unsolicited and unwanted attention. Currently, stalking is a current issue of policy and legislation. The bachelor thesis deals with problems of stalking and domestic violence. Key findings and current information on stalking and domestic violence are summarized in the theoretical part. In the practical part there is presented an awareness of these issues, which students from Faculty of Health and Social Studies of South Bohemian University have. An aim of the bachelor thesis is to find out the awareness of students from Faculty of Health and Social Studies of South Bohemian University on stalking and domestic violence. This hypothesis was determined in accordance with the goal: ?Students of higher grades will be better informed on stalking than students of lower grades.? This hypothesis was disproved. The research was carried out quantitatively, a method of interviewing was used, a technique of a survey. The research sample consisted of students from Faculty of Health and Social Studies of South Bohemian University in České Budějovice. The research showed that students from Faculty of Health and Social Studies of South Bohemian University were informed on stalking and domestic violence. Despite this predication, however, I believe, that the general public is not sufficiently informed on these issues. It is possible to increase the public awareness by an enlightenment, which should be oriented above all to pupils of elementary and secondary schools. A benefit of this thesis I see especially in a better awareness of students on these current topics. Furthermore, even in a possibility of using the obtained data of the research part and also in gaining a greater insight into stalking and domestic violence issues among the general public and people interested in the given issue.

This thesis would like to inform the reader of a new crime in the Czech republic which is dangerous pursuit (stalking) and it aims at analysis of current legislation. It attemps to define dangerous pursuit, the emergence of this phenomenon from a historical point of view as well as its current interpretation. It also covers the penalties that can be imposed on the criminals. Moreover, it also looks at victims of dangerous pursuit and effective ways of helping the victims as well as the criminals.

This diploma thesis analyzes the phenomenon known as stalking. The psychological part is deals with the studies of two target groups of stalking - stalkers and their victims. The bachelor work deals with domestic violence as a modern sociological topic. In the framework of this question it is aimed at offender of domestic violence in its chosen points of view. The bachelor work also maps over the present possibilities for offenders of to their voluntary reparation in view of the České Budějovice region.

Graduation theses define a discrimination in labour relations with a view to the diskrimination in approach to employment and to various types molestations (mobbing, bossing and stalking). Graduation theses define also the loom of legitimate subserviences fight against diskrimination upon acceptance the antidiskrimination act. The final theses might be a specific manual, how to act in defence against different diskrimination practices.

The border between common and vexation matter of person behaviour we are accustomed to is very slight. The topic of my diploma paper "Vexation at the workplace" becomes very actual and constantly the bigger problem in the contemporary modern society. Everyday mentally terror at the workplace, vexation among the colleagues, systematically made malignancies through which the superiors attack their inferiors (or vice-versa) is a problem that belongs serious incoveniences both to its victims and the company. My diploma paper is above all focused on the sophisticated and malicious area of work-vexation that is called the mobbing. Marginally I mention other forms of vexation and the bossing. I made my exploration at the public service environment as the work-vexation is usually put together with it. Primarily I point the legal and moral side of the mobbing and its psychological and social aspects. Secondarily I mark the mobbing as a job-psychological phenomenon, its influence to the company itself and consequences between it and some modern society trends (teamwork, power, burn-out syndrome, internet technologies). Supposing to become the managers we should make effort to eliminate the mobbing. As only the workplace without the vexation brings the satisfaction that can results in higher level of the work productivity, economic profit and the the incapacity of work decreasement. Thereby the mobbing affects the whole life of its victim and also that anyone of us can become the victim it is necessary to solve this problem urgently and constantly.
