The grounds for administrative expulsion Abstract This thesis focuses on an important instrument of migration policy, which is administrative expulsion, or more precisely the grounds for which a decision on administrative expulsion may be issued to a foreign national. The Act on the Residence of Foreign Nationals exhaustively covers the individual grounds for administrative expulsion, but their content is not always clear at first glance. Although administrative expulsion is a specific instrument of immigration control, and not a tool for punishing the foreign national for violation of the established obligations, it has a tangible impact on the foreign national's life. The main purpose of this thesis is to define and characterize the individual facts of the grounds for administrative expulsion and to organize them according to common features systematically. For these purposes, it is important to examine the individual facts using the terminology of the doctrine of criminal law i.e., in particular the definition of the typical features of the facts - object, objective aspect, subject and subjective aspect. This bachelor thesis deals with administrative decisions as one of the most important outputs of the practice of the administrative body. The aim of this thesis is to describe administrative decisions with regard to legal theory as well as legal regulation. The first part of this thesis deals with the theoretical background, such as the elements of a decision or defects of a decision, the legal regulation of administrative proceedings and the methods of review and redress of administrative decisions. The second part of the thesis focuses on the practical aspects of administrative decision-making. It analyses nature and landscape protection decisions issued by the Czech Environmental Inspectorate in 2016-2020 with regard to the frequency of appeals and the way the Ministry of the Environment decides on appeals, in order to test eight hypotheses. The statistical results obtained from the decision analysis are presented in graphs and tables. The thesis concludes with a discussion of four problems occurring in practice in relation to decision-making on nature and landscape protection and possible ways of solving them.

Inaction in Proceedings before the Administrative Authorities - abstract The dissertation thesis deals with the issue of inactivity of administrative authorities in proceedings before them, which from the point of view of legal doctrine and application practice represents the most widespread form of inactivity in public administration. It can be considered as one of the most serious negative phenomena in public administration and its execution. Public administration is primarily seen as an executive (active) activity aimed at fulfilling its tasks set by or based on the legal order and carried out within its limits. As a rule, both legislation and scholarly literature contain material concerning public administration activities and their forms. The issue of inactivity often remains neglected, while in application practice it is a relatively common undesirable phenomenon, which the addressees of public administration encounter relatively often. Selected Issues of the Civil Service Act - Abstract The thesis "Selected Issues of the Civil Service Act" deals with legislative development of Civil Service Act and its practical implementation with focus on civil service proceedings. The first chapter of the thesis follows the legislative development of the Civil Service Act that is used not only to demonstrate dynamic development of the law but through the descriptions of its novelisations it also introduces the law to reader. Hence, in the first chapter, the thesis evaluates and explains legislative changes and highlights issues that may arise with certain novelized provisions during practical application of the Act. The second chapter is dedicated to the civil service proceedings. It examines course of the proceedings and is focused on their individual stages. Administrativě Expulsion Proceeding Abstract The diploma thesis entitled "Administrativě Expulsion Proceeding" deals with a detailed analysis of the applicable legislation on the institute of the administrativě expulsion including its related aspects. The content of the entire thesis is divided into six chapters. The first chapter defines the institute of the administrative expulsion as such with the emphasis on its non- punitive character. The second chapter emphasizes the analysis of the individual situations which the act on the residence of aliens defines as reasons leading to the delivery of administrative expulsion decision. These reasons are analysed considering the fact whether the alien is a national of an E U member state or the alien is a third-country national as well as whether the alien stays on the territory of the Czech Republic on the basis of the temporary, long-term, or permanent residence. Diploma thesis "Planning Permission Procedure" deals with one of the key sectors of special public law, the valid legal regulation of planning permission procedure, a part of the legal regulation of building law. Planning permission procedure is a special type of administrative procedure and can be possibly seen as a main connection between zoning and building permission. A planning permission can result in most influential and interventional changes in the territory. During this proceedings, personal and public interests usually clash. The thesis analyses decisions of the Supreme Administrative Court, a court with key impact on some parts of the planning permission procedure. 1 ADMINISTRATIVE EXPULSION PROCEEDINGS ABSTRACT The diploma thesis entitled as "Administrative expulsion proceedings" deals with the institute of administrative expulsion, especially its procedural side. The thesis aims to define and analyse chosen aspects of administrative expulsion proceedings from their beginning to deciding on remedies against administrative expulsion decisions. Within these, the work focuses mainly on examining the issue of the proportionality of administrative expulsion in relation existing family or private life of the expelled alien. The work is divided into four chapters. The first chapter defines the fundamental terms and clarifies the institute of administrative expulsion. First, the concept of expulsion is generally defined and then, a distinction between administrative expulsion and the penalty of expulsion is made. Furthermore, the term alien is defined because only alien can be subject of expulsion. The main part of the thesis is devoted to the institute of remediation belonging to remedies with its own specifics. The institute can be defended against the decision of the central administrative authority, the minister or the head of another central administration issued in the first instance. The purpose of this bachelor thesis is to identify the means of disintegration in connection with the remaining remedies and to incorporate it into the process of administrative proceedings not only in the background of the current legal system in force, but also in the context of public administration and changes made as part of territorial reform. This thesis deals with the topic of privilege against self-incrimination of legal entity in administrative proceedings and in offence proceedings. The following reasons led me to the choice of this topic. First of all, it is a multidisciplinary topic involving criminal law, criminal administrative law, constitutional law, and private law, especially the regulation of legal entities. Principles of administrative procedure The diploma thesis deals with the analysis of principles of administrative proceedings. The aim of the thesis is a detailed analysis of individual principles of administrative proceedings, which form the basic model of all administrative proceedings. In the first chapter I use the historically comparative method to analyze origins of the individual principles and transformations of these principles which occured as part of the development of a codified regulations of the administrative procedure. 1 Abstract As a topic of the diploma thesis I have chosen the issue of electronic signature in relation to administrative proceedings. The field of electronic communication is incredibly diverse and it is growing very dynamically. For this reason, I found the topic interesting and usable in the future. There have not been many theses on this topic yet, so I did not have to solve the problem that it was not original. I have always had a positive attitude towards digital technology. At the same time, I was fortunate that I could have always been informed about information technologies by someone who was interested in the issue much earlier. The aim of the thesis is to answer the questions regarding the subjects authorized to take a sound or audiovisual record, and to assess the legality of using such records as evidence in administrative proceedings. The thesis is formally divided into three chapters. The first one addresses the basic concepts emerging throughout the thesis, and the admissibility of other evidence not expressly mentioned by law. The second part of the thesis offers an insight to obtaining of sound and audiovisual records, and their further use as evidence pursuant to the basic human right documents. It describes and analyses the assessment of permissibility of such evidence that is applied by the European Court of Human Rights. The thesis deals with the nature of the decision-making of the Office for the Protection of Competition (hereinafter "the OPP") in the area of public procurement. The theoretical part describes the various methods used, the legislative framework for the decision-making processes of the OPP (from the point of view of the currently effective legislation and the new Act on public procurement), and summarizes theoretical assumptions. In the analytical part, selected decisions of the OPP from the years 2005-2015 are analysed, using descriptive and interferential statistical methods. In terms of the subject matter, the OPP most often conducts proceedings in relation to complaints against alleged violation of the prohibition of discriminatory practices. Decisions of the OPP are challenged before administrative courts in only 4% of cases, in spite of the fact that contracting authorities are found guilty of committing an administrative offense in almost 80% of the cases. Commonly imposed penalties are fines. The trend of decisions on guilt, as well as the imposition of fines, is growing, however, the level of fines remains unchanged. Due to great importance of real estate for each single economics the leadership and administration of the Real Estate Cadastre (Cadastre) was entrusted to the state, i. e. to particular government bodies, in the Czech Republic. This public list is so subject to public inspection all the time. Registered and provided details must be of highest quality, proceedings should be as quick as possible and this list should also provide the highest protection of those details. That is why the author decided to pay attention to the role of state in the evidence and dispose of real estate. This thesis focuses so on conclusion and further specification of the most important administrative proceedings in the field of Cadastre. Remonstrance Proceedings The thesis is focused on the remonstrance and the following special administrative proceedings. The remosntrance represents an ordinary appeal, which can be used to challenge the first instance decision that has not already become enforceable and has been issued by the central administrative office, by the minister or by the director of other central administrative office eventually by the state secretary. Whereas there is no existence of the superior administrative authoritites in the organizational structure of the state administration, the same body that issued challenged decision decides on it. A cross through the history of hunting legislation and assessment of the development of the relationship to the land owners with hunting management was recorded in my thesis. Main focus of the thesis was to identify and analyze problems arising in the process of recognition of hunting areas, respectively creation of hunting areas. To do so I used structural analysis of selected hunting areas. Appropriate measurements, for simplifying, price reduction and speeding up the process of recognition of hunting areas, were proposed upon collected information.

This bachelor thesis deals with clarification of the land register function, especially according the new law forms, that came into force on 1 January 2014. In particular -- law no. 256/2013 Sb., land register, regulations 357,358 and 359/2013 Sb., which adjust function of the land register, providing data upload and sample form and Civil code no. 89/2012 Sb. And also current law 359/1992 Sb., about geodetical and cadastral organs. In addition a new law 90/2012 Sb., have came into effect this year. It deals with bussiness corporations, which adjust conditions for admission of property as a substantive contribution to the company registered capital. A heated debate was going on during the past few years among Czech lawyers concerning punishment of legal entities. It culminated as the law on criminal liability of legal entities and proceedings against them was passed. However, this has not solved all the problems of legal regulation of delicts committed by legal entities. The question of reform of administrative punishment remains relevant, although not urgent. The current legislation suffers certain defects, in particular its incompleteness, which has to be addressed in legal practice by using laws whose primary field of application lies elsewhere; those laws do not address all peculiarities of administrative punishment of legal entities. Thesis on the topic: The procedures of public administration in the area of state aid Author: Martina Koutná The main aim of this thesis on the topic "The procedures of public administration in the area of state aid" is to analyze the issue of investment incentives in the Czech Republic from the perspective of the state aid rules and the reasons for this regulation. The main attention is paid to the system of investment incentives based on Act on Investment Incentives in the context of the general problems of state aid. The work focuses on the application of the Administrative Code on the investment incentives and analyzes the process of public administration in providing subsidies on the basis of budget rules. The aim is to analyze the diametrically different approaches and to point out key differences. In particular, that the Administrative Code is applicable to the process of providing investment incentives and the process is subject to judicial review. Number of photovoltaic power plants increased rapidly in the Czech Republic in the years 2009 and 2010. The aim of this bachelor thesis is to review the legal limits of the construction in the studied area, the ratio of permitted buildings in Třeboňsko Natural Protected Area and outside this area. Then to find out the decisive kriteria of the stakeholders who participate on the permition procedure or to determine other factors that could influence the results of the permition procedure. The construction of photovoltaic power plants affects the landscape character in Třeboňsko protected area. Třeboňsko protected area was compared with Trhosvinensko, Lipnicko and Stráž nad Nežárkou areas. The number of the planned plant buildings in both areas, the issued number of positive and negative statements with the justification included, the functional utilization of the area for the construction of the photovoltaic power plant, the number of the issued decisions in the individual years and the comparison of realized photovoltaic power plants in the monitored areas was monitored. It was found during the evaluation that the positive decisions were issued for the areas where the landscape has been already disrupted by the other constructions in the past. The negative decisions were issued for construction of the photovoltaic power plant in the open landscape. Only the intentions in former industrial or agricultural sites and in the urban areas were implemented.

The process of the environmental impact assessment is an important means of the preventive protection of environmental law. This process can be seen from two plains that are represented by the distinct means of legislation relating to the environmental impact assessment. The first plain is a strategic environmental assessment (SEA), the subject of which is constituted by the assessed documents, plans and other conceptual tools. The second plain is an assessment of projects (EIA), the subject of which are already particular plans of buildings, technology and other projects with a significant impact on the environment. For this reason, it is trying to make a complete picture of administrative set of rules. It deals with the explanation of basic terms used in an administrative management. For understanding the current principles, which are valid in this area of law, there is very shortly sketched the development of the administrative set of rules in the Czech countries. The aim of the thesis is to describe in details and define the valid law legislation of the administrative set of rules with the specialization for the remedies of administrative proceeding, including the possibility to use the judicial review. Therefore, in case of breach of individual rights stemming from the legal system of the Czech Republic, every person is guaranteed a strict legal procedure with corresponding legal mechanisms, which aim to remedy the status caused by unlawful action or inaction of the public administration. The object of this dissertation focuses, in particular, on analysis of individual means of protection of rights in public administration (i.e. the issue of the protection of public subjective rights) and their mutual relationships between them at level of legal regulation de lege lata. However, certain space had to be dedicated also to the procedures of public administration in matters related to private subjective rights as even the public administration decides on certain matters of private law. The topic of this thesis is "Proceedings for administrative transgressions against the safety and smooth highway traffic". Although there is no such special type of proceedings, it is an issue which deserves an attention. Every one of us is a part of highway traffic every day. Therefore it is important not only to know the rules by of it but also the rules and principles of the proceedings in which are transgressions against safety and smooth highway traffic heard. The aim of this thesis is to provide the complex summary of the proceedings for administrative transgressions against the safety and smooth highway traffic and to give notice of its unusualness from the basic proceedings for administrative transgressions. This thesis also points out the inaccuracies, wrongness and ambiguities of the proceedings' rules and also reflects and comments the latest amendments to relevant acts. Thesis deals with the position and proceedings of the Czech Trade Inspection (CTI). The introductory chapter discusses the theoretical and general bases associated with the role and activities of the CTI in public administration as a public authority, forms of administrative activities and administrative supervision. Afterwards, the work describes the history of consumer's protection legislation and freely moves in a special section dealing with on the above mentioned theoretical aspects in a practical context. First, it discusses the status of the CTI in public administration and organizational structure including the structure of the particular inspectorates and then powers and authority under applicable law. The following section is devoted to an inspection process systematically as the main activity of the CTI, including the description of the rights and duties of inspectors in its exercise. During the inspection inspectors determine the facts that are recorded in the inspection report, which serves as the main basis for eventual administrative proceedings. Annotation The Roles of Citizen's Initiative by the Protection of Historical Scenery of the Village in the Condition of Local Community The goal is to find out what status, role and influence can be achieved by a civil initiative aimed at protecting historical and landscape character of a village in terms of a local community.

The diploma thesis deals with the rights and obligations of the public administration in the protection of nature and landscape. It contains an introduction to the legal norms as a foundation for the activity of the public administration - the self-government and the municipal government. It gives the fundamental information about administrative law, administrative regulations and the principles of its activities. It describes the organizational structure of the public administration in the environmental protection, competences of the public administration institutions in protection of nature and landscape in detail. Further the diploma thesis deals with the responsibility of the environmental damage, especially harm to the environment. Five administrative procedures in protection of natura and landscape are contained in the analytical part of the thesis. Two of them deals with the projects intervening to a significant landscape element and the rest of them attends to the intentions which affect landscape character. The purpose of the diploma thesis is is analysis of the process of public administration in particular administrative procedures and to provide possible concepts of the procedure improvement as well.

The topic of my bachelor thesis is Unemployment benefits and initiation of administrative proceedings in specific conditions of the Labour Office Town Třebíč. This work deals with provision of employment, payments of unemployment benefits and management of the Labour Office Třebíč in the years 2007-2009. The goal of the theoretical part is to get acquainted with the conditions of employment mediation and unemployment benefits, with terms such as active and passive policies of unemployment. The practical part deals with the budget office work Třebíč and its drawing. I deal with spending on active and then passive employment policy.

This work has focused on rights of children placed in childrenś homes. It deals with use of available legislation for protection of children who for various reasons cannot be brought up in primary family. Theoretical part of the work charakterizes available binding legal standards in the Czech Republic which ensure protection of childrenś rights and safety of minors and reenagers who are subject to institutional care. It further describes aforementioned types of institutions, it deals with options of children who pass through the process of decision about placement and entry to institutional upbringing. Practical part of this work presents the structure of the Childrenś home ine Lety.
