This paper explores intersectionality of oppression and social agency in refugee narratives of four female teachers from Yugoslavia who immigrated to Ontario and Quebec between 1994 and 1998. These narratives reveal a number of systemic barriers participants encountered in their new country, such as lack of coordination between immigration and settlement services, lack of information about the teacher recertification process, systemic ignorance towards international teaching credentials and experiences, and a number of settlement practices that pushed the participating women teachers to the margins of the Canadian educational system. In addition to reporting a number of systemic barriers to teaching, these women also revealed self-imposed psychological and culturally constructed barriers to settlement such as personal perceptions of having limited language competencies, of being "too old" to continue education, and of remaining permanent outsiders to Canadian ways of being. Women also discussed their choices and priorities in terms of their personal and professional lives and the ways in which these preferences facilitated and/or hindered their integration in the Canadian education system and society. The paper challenges the master narrative of refugeehood in Canada by exposing the ways in which race, class, gender, age, ethnicity, and professional identity, in addition to refugeehood, shape the oppression and the privilege of refugee women in the Canadian context. Refugees are the least educated migrants upon arrival to Canada. Yet, they invest in Canadian higher education at lower rates than other newcomers. Why might this be? This paper enters this emergent conversation through a review of the Canadian-based empirical literature on the structural factors associated with refugees' tertiary education access. Research indicates that as part of the low-income population, refugees are likely to misperceive the cost and benefits of higher education and be deterred by high tuition costs. Academic preparedness and tracking in high schools also pose additional constraints. The gap in the literature exposes a need for inquiry into the ways in which pre-arrival experiences influence refugees' participation in Canada's post-secondary institutions. The paper concludes by underscoring the need for qualitative research that discerns the lived experiences of refugees outside of the aggregate immigrant gro uping typical in education research. The author examines the burden on refugee claimants at the Immigration and Refugee Board in Canada to provide evidence that their home state cannot protect them. In particular, the paper discusses the growing trend of adjudicators taking de facto judicial notice of the fact that a country is democratic to make the finding that there is state protection for claimants. The author argues that the practice of labelling countries as democratic and making state protection findings upon the finding is a biased and unhelpful practice when evaluating the issue of whether state protection exists. The paper discusses what "democracy" means and the problems associated with defining it. It will discuss how judicial notice of whether a state is democratic can affect an analysis of state protection in the example of claimants fleeing domestic abuse in Mexico. [ABSTRACT FROM AUTHOR]

Propelled by fear of violence and flight from stigma, impelled by desire for connection and belonging, the movements of people whose sexualities or genders defy and offend norms cover a complex spatial, social, and psychological terrain. This paper presents partial findings of a critical qualitative inquiry conducted in partnership with Rainbow Refugee Committee, a community organization that supports and advocates with Queer, Lesbian, Gay, Bisexual, Trans (LGBTQ) and HIV-positive refugee claimants/migrants. This inquiry into how queer refugees engage in settlement comprised participation in Rainbow Refugee Committee and narrative interviews with LGBTQ refugee claimants and refugees, as well as interviews with service providers, community organizers, and lawyers. This paper explores how pre-settlement experiences conditioned possibilities for safety and belonging through refugee protection. While seeking refugee protection, queer refugees are evaluated against expected narratives of refugee flight and of LGBT identity. This paper reflects on the unconventionality of queer refugees' accounts in relation to these expectations. Queer refugees settling in Canada recounted surviving persecution by dis/avowing their desires, distancing/taking on available identities, avoiding/seeking out others, and conforming/escaping. They pursued mixed, often precarious, migration trajectories constrained by tightening migration controls and the relative obscurity of refugee protection for sexual or gender-based persecution. In their hearings, they struggled with and against Western cultural narratives of sexual and gender identities, coming out, and gender dysphoria. Access to affordable and adequate housing is a key step in the successful integration of newcomers. While some immigrants are able to transition into home ownership quite rapidly, other newcomers are finding it increasing difficult to access basic shelter. There is little systematic knowledge about the extent of homelessness among immigrants and refugees in Greater Vancouver. This paper details the findings of a 2005 study entitled The Profile of Absolute and Relative Homelessness among Immigrants, Refugees, and Refugee Claimants in the GVRD. We highlight the extent to which some newcomers are increasingly at risk of "hidden homelessness," a term that describes precarious and unstable housing experiences. This paper also details the unique housing experiences of refugee claimants. Given their temporary legal status, claimants often face the most tenuous experiences in the housing market. The housing patterns of newcomers mark a primary indicator for their successful integration. However, different groups of people have varied access to the stock of housing in Canada. The purpose of this paper is to examine the role that social capital plays in housing trajectories of immigrants with particular attention to the experiences of refugee claimants. In this paper we draw upon the results of a 2004-2005 study on the profile of absolute and relative homelessness among immigrants, refugees, and refugee claimants in the Greater Vancouver Regional District (GVRD). We highlight the importance of social networks in the housing careers of newcomers, and argue that access to social networks varies according to the mode of entry for immigrants (e.g., skilled immigrants vs. refugees). We find that refugee claimants are particularly vulnerable, given their combination of uncertain legal status, lack of official language ability, and unfamiliarity with Canadian society. They are the most likely of all newcomers to "fall between the cracks" of the housing system. We discuss the benefits of social capital for immigrants and refugees, especially the key role that social capital plays in the integration process. [ABSTRACT FROM AUTHOR]

This paper is designed to provide a preliminary understanding of the barriers facing refugees in legal limbo in Canada. In particular, it will focus on the economic implications, for both protected persons and Canadian society at large, of maintaining tens of thousands of individuals in this difficult situation for extended periods of time. The findings are preliminary, and designed to indicate future avenues of research, as well as potential roadblocks to research in this area. The paper also includes some of the results of a survey of Convention refugees and the refugee-supporting organizations, conducted by the Public Justice Resource Centre. The initial conclusions indicate that the costs of limbo are large enough to warrant serious reconsideration of this stage of Canada's refugee determination policy. This paper addresses the gap in research on the social dimensions of refugee resettlement. This is accomplished by examining refugee belonging and definitions of "integration" through a case study of Acehnese refugees resettled in Vancouver, British Columbia, between 2004 and 2006. We analyze findings based on a survey and in-depth interviews conducted five years after resettlement. Our findings suggest that recently resettled groups like the Acehnese, who are "new and few," face specific integration challenges. Importantly, the lengthy timelines to enact sponsorship of a spouse and/or family reunification from Aceh unwittingly inhibit the social integration of the sponsors waiting in Canada. Since the early 1990s Canada has become a primary destination for individuals who make refugee claims on the basis of sexual orientation persecution. However, until recently, there was little research focusing on this growing component of Canadian urban queer communities and their experiences of the refugee claim process, and their integration and adaptation to Canadian society. Th is paper, based on interviews with lesbian, gay, bisexual and transgender (LGBT) refugee claimants and participation in LGBT newcomer support groups in Toronto, explores the formal and informal processes, spaces and practices through which LGBT refugee claimants learn about the Canadian nation-state, citizenship and queer identities and communities, and in so doing enter a space/moment of becoming a 'becoming' refugee as they learn the social, cultural, and bureaucratic processes and norms of the Canadian refugee apparatus. This paper reflects on the origins and development of the Student Refugee Program of the World University Service of Canada (WUSC) and its significance as a "transformational" force in the lives of individuals and communities. The WUSC Student Refugee Program is a unique effort involving students, faculty and staff at universities and colleges across Canada who work together to mobilize material and human resources in order to enable student refugees to resettle and complete their post-secondary studies in Canada. The author, who has worked closely with the Student Refugee Program at the University of British Columbia since the mid-1990s, first describes the operation of the Student Refugee Program, and then considers its significance in relation to issues of resettlement, gender equality, "brain drain" and transnationalism. This paper offers a comparative analysis of official discourse surrounding three incidents of asylum seekers arriving in Canada by boat: the Komagata Maru in 1914; the Sri Lankans who arrived in Newfoundland on lifeboats in 1986; and the Ocean Lady in 2009. The objective is to assess Canada's commitment to protecting refugees at these three points in history and evaluate academic contentions that the concept of the refugee is being eroded. The selected incidents trace the emergence and decline of the notion of the refugee in Canadian official discourse. Even during the peak of Canada's commitment to refugees in the 1980s, the discourse reveals blurriness between the ideas of the "refugee" and the "illegal migrant." However, the characterization of asylum seekers as "illegals" is more intense now than in the earlier periods. This shift in the discourse warrants attention as we face the prospect of what Audrey Macklin describes as the "discursive disappearance of the refugee." [ABSTRACT FROM AUTHOR]

In this paper, the author examines the role of international law on the development of Canada's security certificate regime. On the one hand, international law has had a perceptible impact on judicial reasoning, contributing to judges' increased willingness to recognize the rights of non-citizens named in certificates and to envision better ways of balancing national security and human rights. On the other hand, the judiciary's attitudes towards international law as non-binding sources of insight akin to foreign law has reinforced disparities in levels of rights afforded by the Canadian Charter of Rights and Freedoms and those afforded by international human rights. Viewed skeptically, one might argue that the judiciary's selective result-oriented use of international law and foreign law helped it spread a veneer of legality over an otherwise unaltered and discriminatory certificate regime. Reviewing Charkaoui I and II in international context, the author suggests an alternative account. He suggests that the judiciary's use of international law and foreign law, although highly ambiguous and ambivalent, both was principled and has progressively brought named persons' Charter rights more closely in step with their international human rights. Although the current balance between national security and human rights is imperfect, the way in which aspects of Canada's certificate regime have been improved suggests that international law is a valuable resource for protecting the rights of non-citizens in Canada. In August 1968, the Soviet Union sent troops into Czechoslovakia to crush the burgeoning spirit of reform known as the "Prague Spring. " The Soviet invasion and the return of oppressive government measures triggered the flight of twenty-seven thousand people, eleven thousand of whom came to Canada. Using newly released archival records, this paper explores how the Canadian government approached the refugee crisis and argues that confident officials, buoyed by a charismatic leader and operating in an era of improved East-West relations, manipulated the conventional definition of a refugee and consciously adopted policies that enabled large numbers of Czechoslovakian refugees to resettle in Canada. This paper examines church sanctuary incidents in Canada involving unsuccessful refugee claimants seeking to avoid deportation. The author contends that when faith-based communities develop formal screening mechanisms to determine who among the many that request it is accorded sanctuary, they apply similar norms and procedures as those found in Canada's official refugee determination process. The author argues that although sanctuary practices are often criticized as a form of civil disobedience that poses a threat to the rule of law, it is also possible to understand sanctuary practices as a means through which faith-based communities prevent the state from violating both Canadian and international refugee law, thereby upholding rule-of-law norms. This paper presents a critical overview of the Guideline on Vulnerable Persons, adopted by Canada's Immigration and Refugee Board (IRB) in December 2006 with the goal of providing procedural accommodations for vulnerable individuals appearing before the Board so that they are not disadvantaged in presenting their cases. Although the Guideline is a step in the right direction, it has several serious shortcomings, notably the fact that it is purely procedural in scope, applies only to persons whose ability to present their case is severely impaired, and does not give sufficient weight to expert opinions by mental health professionals. The refugee status determination (RSD) process in Canada, like the RSD processes of other states, currently rejects one in fifteen refugee claims based upon the non-compliance of refugee claimants with the rules of the process. Most commonly this is due to a claimant's failure to provide requested information or his or her failure to attend a scheduled hearing. These "abandonment" decisions result in the expedited removal of claimants without access to further review. Despite the drastic consequences of such decisions, the framework within which they are made neither has been comprehensively outlined nor has its application been catalogued, which is the aim of this paper. It argues that while the formal provisions of the domestic framework are both inconsistent with international law and in excess of the delegated authority through which it is constructed, the Court's application of the framework has been generous to refugee claimants. While a fairly large body of empirical research and policy documents exists on immigrant integration in Canada, studies on refugee integration are scarce. This paper attempts to fill this gap. It summarizes what is known about refugees' economic and socio-cultural integration patterns in Canada and what integration services are available to them in order to identify empirical knowledge gaps and service gaps. This study focused on the effects of precarious status on the well-being of fifteen participants with particular attention to their attempts to claim services, their feelings of belonging and sense of social support, and the effects of parents' status on children. It investigates ways in which the status of one family member can affect the well-being of the entire family. Those who had children reported that the family's status disadvantaged their children, whether they were Canadian or foreign-born, as parents' status was used to justify denying children rights to which they are entitled by international, national, and provincial laws. This paper fills information gaps with regard to unaccompanied/ separated minors in Canada. By the means of reviewing Citizenship and Immigration Canada administrative databases, it investigates how many unaccompanied/separated refugee minors exist, who they are, and how they are received in Canada. We found that there were fewer truly unaccompanied minors than previously reported. In the asylum stream, only 0.63 per cent (or 1,087) of the total claimant population were found to be unaccompanied by adults in the past five years. In the resettlement stream only two truly unaccompanied minors were resettled during 2003 and 2004. Regarding their socio-demographic characteristics, we found that unaccompanied minors compose a highly heterogeneous group from many different countries. Regarding how they were received in Canada, very little evidence existed. Our study found that unaccompanied and separated asylum-seeking minors showed a higher acceptance rate and quicker processing times than the adult population, but details about the minors' actual reception into Canada remains to be further explored. This study recommends that Citizenship and Immigration Canada review its administrative databases with a view toward improving the data about separated/unaccompanied children. Consistent and detailed definitions are required to develop a comprehensive policy framework for unaccompanied/separated minor refugees in Canada. [ABSTRACT FROM AUTHOR]

Using comparisons with international policies and practices, this paper highlights the ambiguities in the identification, case processing, care, and protection of separated children in Canada. It calls for systemic studies of government policies and institutional practices that impact separated children, so that Canadians can take more principled positions towards them.
