The Golden Age of Atlantic piracy (circa 1713-1730) is a theme already studied by historiography, in particular by Anglo-Saxon historians, and the details of the violence committed by pirates are of course related by most publications. However, this violence is rarely analyzed in context and questioned, while it provides the opportunity to better understand this maritime crime, as well as its complexity. Thus, even if physical violence is not an immediate objective of piracy, it is used to achieve specific purposes: it is then “controlled” violence. Moreover, life aboard a pirate ship can lead to a brutalization of individual and collective behavior which sometimes results in “eruptive” violence, which has no practical purposes. Amplified and recounted in eighteenth-century publications, this violence ends up becoming one of the characteristics of the pirate.

He lost a considerable sum because of a court case and because of a theft due to his negligence. His fortune consisted mainly of lifetime possessions and depended on imperial fortune which he did not retain until the end of his life. The thriller tells daily explosive facts which take place, in most of the time, in a urban space. The authors describe, as the critics have observed, the most serious troubles in today's society. Crimes, racism, trafficking, terrorism, theft, etc., all these crimes become the mark of an unbalanced world, a world in crisis. The "suburban" thriller, like suburban literature in general, circumscribes the scene in which the modern "misérables" clash. HLM, dangerous neighborhoods suffer because of urban disintegration, their inhabitants become victims of spatial and social dissolution. Rachid Santaki portrays in his novels young people who have lost their bearings, actors in a society where money is the only value, where violence is commonplace. In our contribution, we propose to see what are the different aspects of the French social malaise that Santaki denounces in the novels Flic ou Caillera (2013) and Les Princes du bitume (2017). The analysis of these data shows that, althought many legal persons are investigated for such criminal offences, the percetange of the ones sent in front of the court is actually low. The majority of the legal persons who are being judged perpetrated a type of fraud, but other criminal offences are also encountered.

Child-soldiering is one of the most painful topics to analyse. These children, who are not authors of the war, are protagonists of the postcolonial novels, dragging the reader into the sad events of the civil wars in Africa. The main objective of this study is to demonstrate how war steals childhoods by turning children into killing machines. It is all about looking at how the writer represents the effects of war on children. Inspired by the theory of trauma and the illocutionary force propounded by Maria Pia Lara, this article examines how the war transforms the life of the child-soldier in Charly en guerre written by Florent Couao-Zotti1 and La Petite fille à la kalachnikov written by China Keitetsi2. Introduced in 1816 by Dr. Matthey, the concept of kleptomania has developed multiple evolutions during the 19th Century. Whereas this concept has been hardly recognized by magistrates and alienists of the first 19th century, it still manages to maintain itself and it's been strengthened in the courts under the Third Republic. Meanwhile, its characteristics evolved sensitively because of the new clinical findings about insanity and also because of the appearance of the figure of « department store's thieves » often composed by rich women. As their thefts create surprises and incomprehension, they lead us to look for an explanation of this disturbing phenomenon in a pathological way .To better understand the relationships between justice and madness, this contribution focuses on the historical evolution of kleptomania, essentially based on printed resources: specialists publications and medical textbooks from those days.

The paper sets out to analyze and interpret the etiological narratives about the nails of Christ in which Gypsies are portrayed. There are indeed several versions, each of which with a very large number of variants, of the role played by one or even several Gypsies at the time of the crucifixion and the consequences of their acts and behavior on the destiny of their people, according to a gradation of moral reactions ranging from the most heavy stigmatization of Gypsies to the celebration of their true divine election. At one end, we find the old legend (15th century), violently hostile to the Gypsies, according to which the four nails would have been made by a Gypsy blacksmith, who would have boasted to the Virgin to have added a fifth nail to pierce the heart of Jesus. The Virgin then pronounced a curse formula, condemning the Gypsy and all his descendants to a life of wandering, misery and opprobrium. At the other end, we find stories where Gypsies are blessed and filled with divine favors, because one of them (most often a woman) stole a nail, that is, this fifth nail that would have compromised the resurrection, or – most commonly – one of the four nails, thus explaining the usual iconographic representation of the crucifixion with three nails. It would be utterly simplistic and wrong to consider the versions that highlight the curse of the Gypsies an exclusive expression of Gadje’s anti-Gypsyism and those that talk about blessing, a counter-legends promoted by Gypsies themselves. Instead, we observe that most of these narratives, in their very transmission, testify to the constant interactions between Gypsies and non-Gypsies, and indeed talk about their difficult and complicate relations. It is true that the balance tilts strongly towards the naturalization of discrimination and even persecution of Gypsies by the Gadjé, thus justified by the attribution of an original fault. Even the apparently positive version of the theft of the nail serves first to emphasize that the Gypsies are a people of thieves. Yet despite the deeply-rooted prejudices it serves to convey, the legend of the Christ’s nails also allows, thanks to its malleability, the celebration of an alternative form of existence inaccessible to the censorship and vindictiveness of the Gadjé., L’essai se propose de procéder à l’analyse et à l’interprétation des récits étiologiques sur les clous du Christ où les Tsiganes sont mis en scène. Il existe en effet plusieurs versions, connaissant elles-mêmes un très grand nombre de variantes, du rôle joué par un, une, voire plusieurs Tsiganes au moment de la crucifixion et des conséquences de leurs actes sur le destin de leur peuple, selon une gradation des réactions morales allant de la stigmatisation la plus radicale des Tsiganes à la célébration d’une véritable élection divine de ceux-ci. À un bout, nous trouvons le récit, ancien (XVe siècle), violemment hostile aux Tsiganes, selon lequel les quatre clous auraient été fabriqués par un forgeron tsigane, qui se serait vanté auprès de la Vierge d’en avoir ajouté un cinquième pour percer le cœur de Jésus. La Vierge prononça alors une formule de malédiction, condamnant le Tsigane et toute sa descendance à une vie d’errance, de misère et d’opprobre. À l’autre bout, nous trouvons des récits où les Tsiganes se voient bénis et comblés de faveurs divines parce que l’un d’entre eux (souvent une femme) à volé un clou, soit ce cinquième clou qui aurait compromis la résurrection, soit – le plus couramment – l’un des quatre clous, expliquant ainsi la représentation iconographique de la crucifixion à trois clous. Il serait tout à fait simpliste et erroné de faire des récits de malédiction l’expression exclusive de l’antitsiganisme des Gadjé et des récits de bénédiction, une contre-légende portée par les Tsiganes eux-mêmes. Ces récits au contraire témoignent pour la plupart, dans leur transmission même, des interactions constantes entre Tsiganes et non-Tsiganes, et parlent d’ailleurs, justement, des relations difficiles mais non certes univoques entre les uns et les autres. Il est vrai que la balance penche fortement du côté de la naturalisation des discriminations, voire des persécutions des Tsiganes par les Gadjé, justifiées par l’imputation d’une faute originelle. Même la version, apparemment positive, du vol du clou, sert d’abord à souligner que les Tsiganes sont un peuple de voleurs. Pourtant malgré les préjugés indestructibles qu’elle sert à convoyer, la légende des clous permet aussi, grâce à sa malléabilité, la célébration d’une forme alternative d’existence inaccessible à la censure et à la vindicte des Gadjé.

At the time old books enjoyed special moral appreciation, they were transmitted from one generation to another and represented a spatial and a temporal bridge among people. The examination of notes written over the time on books highlights that their most frequent protection was of spiritual nature, namely the curse, as they were expensive, written with efforts or gained in exchange of great sums of money. The imprecation was often targeted towards the inappropriate possession of books: the tear and the theft of the metal and precious stoned engraved bindings, the tearing off of their pages or even the ugly handwriting on their margins. The notes help the researchers find out the categories of rogues which appropriated the books or only their beautiful ornaments. Knowing well the basic law principles, the authors of the notes made the distinction between the simple deed, done on a foolish impulse, and the deed done on a purpose. [ABSTRACT FROM AUTHOR]

Over the two decades post-Revolution, the evolution of juvenile delinquency in Romania was influenced both by the emergence of new "risk" factors, such as: lack of jobs, poverty of the population, increasing families with 'problems' and the number of abandoned children, intensification of destructuring of traditional families, changing family model promoted by society, decresing the role of social institutions involved in the formation of young personality, and as well the ineffective system for reintegrating juvenile offenders, through the abolition of institutions included in this system. In this paper, we intend to make a diagnosis of the phenomenon of juvenile delinquency, in the county Caras-Severin, focused mainly on crimes of theft, and identifying the most effective measures for the prevention of this phenomenon. In this sense, after we make a brief review of the main explanatory paradigm of juvenile delinquency, we first identify criminogenic individual factors, family and relational involved in juvenile delinquency identified in the county Caras-Severin, then based on analyzes and statistical correlations, we establish relations between criminal elements identified, and then finally we try to develop a predictive model of risk factors in committing acts of theft. Based on the findings, we identify several intervention measures that can be applied in the county Caras-Severin, to prevent and reduce juvenile delinquency.

At the beginning of the 19th century, justice had to deal with many cases of theft. Covering a wide variety of individual cases and paths, this major criminal phenomenon challenged one of the values of the bourgeois order on which post-revolutionary society was based: property. It was therefore strongly condemned by criminal legislation which ignored the socio-economic reasons that may have caused an individual to take property from others. Its exemplary severity, however, was not enough to stem the phenomenon of theft and ensure total respect for property. In the first part of the 19th century, on the contrary, crime figures recorded a worrying increase in the number of thefts dealt with by the courts. Nonetheless, the system of criminal repression gradually softened: the penalties imposed on thieves were less and less severe. This seemingly contradictory dual movement leads to questions and confronts the evolution of practices, collective representations and social and judicial perceptions of theft. While this criminal phenomenon has been most often apprehended by studying the situation in Paris or of large conurbations, this thesis proposes to participate in the writing of its history by focussing on a territory that was then predominantly rural: Auvergne. Based in particular on the archives of the Riom Court of Appeal and the local press of the time, this work raises the question of the links and distortions that may have existed between the judicial "reality", the lived experience and the social representations of theft. To better identify the world of thieves and the logics of the act, to understand how the population and state and local authorities understood and managed this protean offence at a time when the "social issue" was becoming a priority political issue: such are the two main objectives of this work, which thus aims to participate in a better understanding of the mechanisms for changing reactions to crime and, more generally, the state of mentalities and social universes of the first part of the 19th century., Au début du XIXe siècle, la justice est occupée par un nombre considérable d’affaires de vols. Recouvrant une grande diversité de cas de figure et de parcours individuels, ce phénomène criminel majeur se pose en défi à l’une des valeurs socles de l’ordre bourgeois sur lequel repose la société post-révolutionnaire : la propriété. Aussi est-il fermement condamné par la législation pénale qui fait fi des raisons socio-économiques pouvant pousser un individu à soustraire le bien d’autrui. Sa sévérité exemplaire ne suffit toutefois pas à endiguer le phénomène du vol et à assurer le respect total de la propriété. Au cours du premier XIXe siècle, les chiffres de la criminalité enregistrent, au contraire, une augmentation jugée inquiétante du nombre d’actes de vol traités par la justice. Pour autant, le système de la répression pénale s’adoucit progressivement : les sanctions prononcées contre les voleurs sont de moins en moins sévères. Ce double mouvement – en apparence contradictoire – amène à questionner et à confronter l’évolution des pratiques, des représentations collectives et des perceptions sociales et judiciaires du vol. Alors que ce phénomène criminel a été le plus souvent appréhendé à travers le cas parisien ou celui des grandes agglomérations, cette thèse propose de participer à l’écriture de son histoire en resserrant la focale sur un territoire alors majoritairement rural : l’Auvergne. À partir notamment des archives de la cour d’appel de Riom et de la presse locale de l’époque, ce travail pose la question des liens et des distorsions pouvant exister entre la « réalité » judiciaire, l’expérience vécue et les représentations sociales du vol. Mieux cerner le monde des voleurs et les logiques du passage à l’acte, comprendre comment la population et les autorités étatiques et locales pensent et gèrent cette infraction protéiforme à l’heure où la « question sociale » devient un enjeu politique prioritaire : tels sont les deux principaux objectifs de cette thèse qui entend ainsi participer à une meilleure compréhension des mécanismes d’évolution des sensibilités au crime et, plus globalement, de l’état des mentalités et des univers sociaux du premier XIXe siècle.

Abstract: Social withdrawal is a pathognomonic behaviour that is consistently associated with mental illnesses. Compulsive hoarding can also be interpreted as a pathological behaviour, even when it does not involve kleptomania. Diogenes syndrome (DS) was first described in 1975, and is characterized by both behaviours – social withdrawal and compulsive hoarding. Even though it is often the manifestation of a psychiatric condition, its aetiology is diverse. The most frequent ones are however: dementia, schizophrenia and mental retardation. In this study, we describe an atypical case presenting with DS. Il consists of a young man, seen in a forensic setting, who had been diagnosed with kleptomania in the past, presents with compulsive hoarding, and whose recent thefts were fuelled by revenge. Finally, to our knowledge, the way social withdrawal is viewed is seldom taken into account. We analyse its implication on social withdrawal. [Copyright &y& Elsevier]

On September 26, 1599, the Duke of Lorraine, Charles III, promulgated an order against presumed bandits hidden in the Vosges at the end of the 16th century. Then, on October 24, 1599, he sent a letter to the three main provosts of the Vosges asking them to « purge the paths ». The Vosges, that are at the same time a particular geographical area and a legal entity of Lorraine, allow to observe the repression of theft between the end of the 16th century and the beginning of the 17th century. In fact, since the 1570s, Charles III initiated a whole series of legislative measures aimed at making Lorraine, that had become autonomous in 1542, a modern and centralized State. With the resurgence of plagues that marked the end of the « beautiful 16th century European, the Duke strived to protect the economic health of the country by demanding from his justice a firm repression of all forms of economic delinquency. In total, between 1548 and 1634, 568 people were arrested for theft. The judicial treatment of these defendants revealed the establishment of a modernized ducal justice, which seeks to compete with the old seigneurial prerogatives in matters of highjustice by imposing the use of the written word in the investigation of criminal trials. The study of these trials makes it possible to analyse the different forms of perception of theft, and the power relations that are woven around its repression between the duke, the seigneurial justices and the communities., Le 26 septembre 1599, le duc de Lorraine Charles III promulgue une ordonnance contre « plusieurs vagabonds & personnes inconnues […] se logeant aux bois, lieux couverts & inconnus, avec armes offensives ». Puis, le 24 octobre 1599, il envoie une missive aux trois principaux prévôts vosgiens pour leur demander de « purger les chemins ». Les Vosges, qui correspondent à la fois à un ensemble juridique de la Lorraine (le bailliage de Vosges) et à un espace géographique particulier (la périphérie montagneuse et frontalière du duché), deviennent alors un théâtre privilégié en matière de répression du vol entre la fin du XVIème siècle et le début du XVIIème siècle. En effet, depuis les années 1570, Charles III a enclenché une série de mesures législatives visant à faire de la Lorraine un État moderne et centralisé. Face à la recrudescence des fléaux qui marque la fin du beau XVIème siècle européen, le duc s’efforce de protéger la santé économique du pays en réclamant à sa justice une répression ferme de toutes les formes de délinquance économique. Au total, entre 1548 et 1634, 568 personnes sont arrêtées pour vol. Le traitement judiciaire de ces prévenu·e·s pour vol révèle la mise en place d’une justice ducale modernisée, qui cherche à concurrencer les anciennes prérogatives seigneuriales en matière de haute-justice en imposant l’usage de l’écrit dans l’instruction des procès criminels. L’étude de ces derniers permet d’apercevoir les différentes formes de perception du vol et les rapports de force qui se nouent autour de sa répression entre le duc, les justices seigneuriales et les communautés d’habitants.

The main objective of this study was to estimate prevalence on the liberal general practitioners. The secondary objectives are to identify the possible brakes with the declaration in the monitoring observatory for security of the doctors as well as to determine if the feminization of the profession was associated with the situations violence.A questionnaire in 5 parts was submitted by telephone to 146 drawn lots liberal general practitioners. It approached the undergone physical and verbal attacks, the infringements on the properties arisen during their career, and the proven feeling of insecurity.The rate of participation was 63% (93/146). In all 171 incidents were reported among which 96 physical and verbal attacks (56%), and 75 infringements on the properties (44%) without difference according to the sex. The main motive for the attacks was the refusal of prescription (44%). Practically, no concerned doctor made declaration for the monitoring observatory for the security of the doctors, for lack of interest for 5 of them or the ignorance of its existence for 10 on 32 practitioners having undergone an aggression after the creation of the monitoring observatory.We observed an under-reporting of the attacks or of the infringements on the properties by the doctors victims. Our study did not highlight difference between men and women.

Adulterous Women, Thieving Men? “Justice indigène” in French Guinea. – Using archival archives, this paper analyses the impact of judiciary policy from a gender perspective. It studies the differencies in treatment of men and women when in front of the courts created by colonial powers (with the case-study of French Guinea); the typology of litigation; but also the reasons why colonizers, both men and women, used the courts as well as they resorted to this new means in case of conflict or social transgression.

Mobilisant tous les hommes actifs, le vol fut une ressource que les chefs guiziga et les intermédiaires de l’administration instrumentalisèrent chacun selon leurs intérêts. Aux plans politique et administratif, la guérilla des Guiziga leur permit d’obtenir leur affranchissement vis-à-vis de la tutelle peule. Au plan économique, les Peuls perdirent une part considérable de leur bétail, au profit des groupes guiziga et durent quitter des zones prioritaires d’élevage. Tout cela laisse, des Guiziga, une image de voleurs invétérés très tenace encore de nos jours. Theft and Fulani-Guiziga Relations on the Diamare Plain (North Cameroon). – Being at the same time a form of resistance to Fulani domination and a pathway of wealth accumulation, theft was in the core of the relations between the Fulani and the Guiziga communities in the plain of the Diamaré region before and during the European colonization. Mobilizing all the active people, the theft was a resource that the Guiziga leaders and the intermediaries of the administration instrumentalised each according to the interests. In the political and administrative plans, the guerrilla warfare of the Guiziga allowed them to free themselves from the Fulani aristocrats. Economically speaking, the Fulani lost consequently a considerable part of their cattle, in aid of the Guiziga ethnic groups and had to leave valuable grazing lands. All this leaves the Guiziga a notorious image, which is very firm even nowadays.

The Alfred-Danicourt museum is located in the town hall of Péronne, a small sub-prefecture of the Somme department. Founded in 1877, and thus one of the oldest museums in Picardy, it was the creation of the wealthy collector Alfred Danicourt, who was also mayor of the town. The collection includes some exceptional archaeological ensembles, some antique cameos and some gallo-roman coins. When he died in 1887, Danicourt bequeathed his collection to the town along with an important sum of money for the upkeep of the museum. During the First World War the museum was destroyed by German troops and its collections plundered. But thanks to the courage of succeeding curators at the museum, a part of the collection was saved in 1914 and again in 1941. Through the dramas of twentieth-century history, the story of Danicourt’s collections is a remarkable one.

Electromagnetic anti-theft devices in shops comprise large diameter magnetic induction coils between which the shoppers pass. This study was undertaken with a simulator to assess the behaviour of different models of single and double-chamber pacemakers when exposed to 6 stereotyped and repetitive situations of 4 different electromagnetic anti-theft devices. Of the 35 pacemakers tested, 25 developed serious dysfunctions: 14 long-lasting inhibitions (over 3 seconds), 2 stimulations at maximal frequency, 2 electrical bradycardias and 2 permanent reprogramming. These dysfunctions due to electromagnetic interference are observed in old or modern, monopolar or bipolar pacemakers, and seem to be influenced by the amplitude and complexity of the signals emitted by the detectors. These observations justify a clear signalization warning pacemaker patients of a potential danger.
