Ecosystems services include the collection, concentration, and storage of solar energy as fossil fuels (e.g., coal, petroleum, and natural gas). These concentrated forms of energy were produced by ancient ecosystem services. However, our legal and economic systems fail to recognise the value of the ecosystem service subsidies embedded in fossil fuels. This ecosystem services price subsidy causes overuse and waste of fossil fuels in the free market: fossil fuels are consumed more quickly than they can be replaced by ecosystem services and in far larger quantities than they would be if the price of fossil fuels included the cost of solar energy collection, concentration and manufacturing of raw fossil fuels. Moreover, burning fossil fuels produces enormous environmental, human health and welfare costs and damage. Virtually no legal literature on ecosystem services, sustainable development, or sustainable energy, considers fossil fuels in this context. Without understanding stored energy as an ecosystem service, we cannot reasonably expect to manage our fossil fuel energy resources sustainably. International and domestic energy law and policy systems generally ignore this feature of fossil fuel energy, a blind spot that explains why reducing greenhouse gas emissions from fossil fuels is fundamentally a political challenge. This paper will use new understandings emerging from the field of complex systems to critique existing legal decision-making models that do not adequately account for energy ecosystem services in policy design, resource allocation and project approvals. The paper proposes a new "least-social-cost" decision-making legal structure that includes ecosystem energy services.

Ground-mounted photovoltaic systems have the potential to become one of the central elements of the coming energy system. The German federal government is now planning a significant and rapid expansion. However, the extent to which appropriate planning and measures take place in regions and municipalities will also depend on the spatial planning regulations of the federal and state governments. This paper explains that considerable support and control options are available to accompany expansion efforts. Cross-references to the Renewable Energy Sources Act and the Building Code are also shown and it is explained that the different types of ground-mounted photovoltaic systems may partially require a differentiated approach.

Im Zuge des anstehenden weiteren Umbaus des Energiesystems in Deutschland wird es erforderlich werden, sukzessive weitere Flächen für die Windenergienutzung an Land bereitzustellen. Der derzeitige regulative Rahmen weist jedoch Defizite aus, welche die entsprechenden Planungen erheblich erschweren und verzögern. Daher werden in diesem Beitrag zur Problemlösung gesetzliche Änderungen vorgeschlagen. Der resultierende neue dynamische Steuerungsansatz setzt auf stufenförmige, optimierte Ausbauwerte im Erneuerbare-Energien-Gesetz, auf denen Grundsatzvorgaben im Raumordnungsgesetzaufbauen. Letztere beinhalten Mindestvorgaben für regionalplanerische Vorranggebiete - auf der Basis einzuführender regelmäßiger Analysen des Bundesamtes für Bauwesen und Raumordnung. Bei Einhaltung dieser Werte würde eine angeregte Teilentprivilegierung im Baugesetzbuch greifen, mittels welcher in entsprechenden Regionen auf eine aufwendige und fehleranfällige Konzentrationszonenplanung verzichtet werden kann. Flankierend wird zur Beschleunigung eine Änderung vorgeschlagen, auf deren Grundlage inVorranggebieten eine Genehmigung von Windenergieanlagen rechtssicher auch bei gegenläufigen, noch nicht angepassten kommunalen Konzentrationszonenplanungen erfolgen kann. In the course of the upcoming further restructuring of the energy system in Germany, it will be necessary to gradually provide additional areas for the use of wind energy on land. However, the current regulatory framework shows deficits which make the corresponding planning considerably more difficult and delay. Therefore, legislative changes are proposed in this paper to solve the problem. The resulting new dynamic control approach relies on gradual, optimized expansion values in the Renewable Energy Sources Act, on which the basic requirements in the Spatial Planning Act are based. The latter contain minimum requirements for regional planning priority areas - based on regular analyses to be introduced by the Bundesamt für Bauwesen und Raumordnung. If these values are adhered to, an encouraged partial deprivation of privilege in the building code would take effect, bymeans of which complex and error-prone concentration zone planning can be dispensed with in corresponding regions. At the same time, a change is proposed to accelerate the process, on the basis of which a permit for wind turbines in priority areas can be carried out in a legally secure manner, even in the case of opposing, as yet unadjusted municipal concentration zone plans.

"Klimawandel und Energiewende geht alle an. Die Raumordnung muss dabei im Sinne des Gemeinwohls eine rahmengebende und koordinierende Rolle spielen. Unter der Prämisse einer 'klimagerechten Verantwortung' müssen die raumrelevanten Aspekte in den Vordergrund gerückt und eine auf Akzeptanz und Partizipation ausgerichtete strategische Landes- und Regionalplanung gestärkt werden. Gesamträumliche Konzepte wie z.B. regionale Energiekonzepte stellen dabei wichtige Bausteine für eine erfolgreiche Umsetzung der Energiewende dar. Die zahlreichen Instrumente der Raumordnung sollten zwar einer Neubewertung bezüglich der neuen Herausforderungen (Klimawandel, Energiewende) unterzogen werden, können aber - allerdings nur bei konsequenter Anwendung - wichtige Weichen stellen (z.B. zu einer klimagerechten Siedlungsentwicklung). In diesem Sinne werden von den einzelnen Autoren in diesem Band umsetzungsorientierte Handlungsempfehlungen gegeben und konkrete Vorschläge zur Weiterentwicklung der Raumordnung und zu ihren Instrumenten aufgezeigt (z.B. Schaffung einer Koordinierungsstelle, Erweiterung von Instrumenten der Freiraumsicherung, 'Klima- Check' in Raumordnungsverfahren). Die Zielsetzung der Arbeitsgruppe war es, über die einzelnen in schriftlicher Form niedergelegten Beiträge hinaus, auf allen Planungs- und Entscheidungsebenen weitere Diskussionen und klimagerechtes Handeln anzuregen. Nur im Schulterschluss der Kommunen und Verbände, der Gesellschaft und des Staates sowie mit einer Verknüpfung formeller und informeller Instrumente wird es gelingen, dem Klimawandel zu begegnen und eine erfolgreiche Umsetzung der Energiewende zu bewirken." Spatial planning therefore has to play a mayor role in providing a framework and coordination on behalf of the common good. Under the premise of climate-optimized responsibility space-relevant aspects has to be promoted und strategic regional planning based on acceptance and participation has to be enforced. Spatially holistic concepts, like regional energy concepts, are important components for a successful replacement of fossil fuels. Numerous instruments for spatial planning has to be re-evaluated facing new challenges, but providing consistent application they could set the right course (f.e. climate-conscious settlement development). In this sense, the authors in this book give implementation-orientated recommendations for action and present concrete proposals developing spatial planning as well as its instruments (f.e. creation of coordination office, expansion of instruments for securing open spaces, climate-check for regional planning procedures). Besides working out the papers, it was the objective of the working group to encourage discussion on all planning and decision-making levels and to inspire climate-optimized acting. Dealing with climate change and a successful substitution of fossil energy will only come about if there exists a united front between municipalities, associations, society and state as well as a combination of formal and informal instruments." "Jeder Einzelne muss sich seiner klimagerechten Verantwortung stellen. In besonderem Maße sind hierbei die Akteure der räumlichen Planung auf allen Planungsebenen gefordert. Denn dem bereits stattfindenden Klimawandel kann nur mit vorsorgeorientierten Planungen und konkreten Maßnahmen zum Klimaschutz und zur Anpassung an die Folgen des Klimawandels begegnet werden. Die Zielsetzung der Arbeitsgruppe 'Klimawandel und Nutzung von regenerativen Energien als Herausforderungen für die Raumordnung' der Landesarbeitsgemeinschaft Bayern ist es, Teilaspekte des Themenkomplexes 'Klimawandel und Nutzung von regenerativen Energien' in diversen Einzelbeiträgen möglichst praxisnah und umsetzungsorientiert zu beleuchten. Die von Mitgliedern und Gästen der Arbeitsgruppe aufgestellten 'Zugspitz- Thesen' fassen diesbezüglich die wichtigsten raumrelevanten 'Botschaften' zusammen. Damit soll die Rolle der Raumordnung betont und eine Debatte auf allen Planungs- und Entscheidungsebenen angestoßen werden." The 'Zugspitz theses' put together by the members and guests of the working group summarise the most important spatially relevant 'messages' on this topic.
