„Legitimität und Legalität im Völkerrecht“ wurde 2009 von der Juristischen Fakultät der Eberhard-Karls-Universität als Dissertation angenommen. Hauptgegenstand dieser Arbeit ist die Darstellung der völkerrechtlichen Diskussion über Legalität und Legitimität angesichts der Entstehung supranationaler Organisationen und des mit ihnen einhergehenden Phänomens der global governance. Im ersten Kapitel wird der historische und philosophische Prozess beschrieben, in dem die Differenzierung von beiden Größen stattfand und zwar als Begleiterscheinung der Etablierung des Rechtsstaates im Europa. Im Zweiten Kapitel wird der völkerrechtliche Legalitätsbegriff thematisiert, welcher die wichtigsten Züge der rechtstaatlichen Legalität angenommen hat. Im drittel Kapitel wird die völkerrechtliche Debatte über Legalität und Legitimität dargestellt. Zwei Konstellationen sind hierfür maßgeblich: das Phänomen der global governance und die Relativierung des Legalitätsbegriffs anhand Legitimitätsüberlegungen, wie bei dem Kosovo-Krieg. In den Schlussfolgerungen der Arbeit werden Gründen für die strikte Achtung der völkerrechtlichen Legalität angeführt. „Legitimacy and Rule of Law in Public International Law“ was accepted as a doctoral dissertation in 2009 by the Eberhard Karls University Tübingen. The primary aim of this thesis is to present the discussion on legality and legitimacy in public international law in the light of the emergence of supranational organisations and the phenomenon of global governance. The first chapter deals with the historic and philosophical process that gave way to the differentiation of both concepts as a corollary of the establishment of the rule of law in Europe. The second chapter deals with the concept of legality within public international law. This concept has adopted the most important features of the notion of legality that is based on the rule of law. The third chapter presents the debate on legality and legitimacy within public international law. Two constellations are relevant in this regard: the phenomenon of global governance and the relativisation of the concept of legality in the light of arguments related to legitimacy such as in the case of the Kosovo War. The conclusions of this thesis offer reasons for the strict observance of legality in public international law."
