Este artigo parte da epistemologiafeminista, tomando como marco teórico àformulação de Michel Foucault sobre os saberes,a busca da verdade em torno da sexualidadehumana e o exercício de poder e controlesociais aí implicados, valendo-se aindada metodologia proposta por Alda Facio paraanálise do fenômeno jurídico. Procuramosdesvendar, a partir daí, no âmbito da filosofiado direito, os reflexos produzidos pelapostura androcêntrica sobre a ciência jurídica,que historicamente conduziu à segregaçãonão só das mulheres como sujeitos dedireito, como também excluiu a expressãohomoerótica da esfera protetiva que o modernoestado de direito propôs.This paper studies up from thefeminist epistemology, since its theoreticallimit is Michel Foucault principles on universalknowledge, the search for the truthregarding human sexuality and power useas well as social control, which are part ofthis universe, it also regards the methodologydefended by Alda Facio, the juridical phenomenonanalysis. It was observed so, throughthe law philosophy, the reflects produced byandrocentrical behavior about juridicalscience, that by the time has conducted, notonly females segregation as subjects of rights,but also excluded the homoerotic expressionfrom the protective environment that themodern state has proposed.
