Conclusion. | (Abstract) Negotiations concerning the accession of the European Union (EU) to the European Convention on Human Rights (ECHR) have resumed following the Court of Justice of the European Union’s delivery of Opinion 2/13, resulting in a new Draft Accession Agreement in 2023. This Article focuses on the co-respondent mechanism provided for in the 2023 draft accession instruments. The application of the co-respondent mechanism shall result in the EU and its Member State(s) being held jointly responsible for ECHR violations owing to EU law, a key aim of the mechanism being to prevent the European Court of Human Rights (ECtHR) from allocating responsibility between the EU and its Member States. This Article briefly explores whether the co-respondent mechanism is solid enough to achieve its goals. The Article identifies three types of possible “loopholes” in the co-respondent mechanism and examines whether they could prompt the ECtHR to consider alternative avenues for holding the involved actors responsible or even refrain from exercising (full) scrutiny either through the so-called Bosphorus doctrine of equivalent protection or by devising a new test for this purpose. Thus, the Article also delves into the future application of the Bosphorus doctrine post-accession. During the Second World War, hundreds of thousands of American soldiers of Italian origin were enrolled in the US Armed Forces. Among those who fought in the Italian Campaign (1943-1945), many used their leaves to visit the country and its natural and artistic sights, but foremost to travel to their places of origin. Their visits home, often lasting some days, established stable and continuous contacts in the post-war period as part of root tourism or war tourism. This essay analyzes the visits home of these Italian-American soldiers as a particular form of diaspora tourism, focusing on the way which homecoming engraved on their sense of identity and ethnic-cultural belonging.

O presente artigo discute o crescente interesse pelos textos proféticos da Bíblia Hebraica como fontes para uma reflexão ética e religiosa relevante para o contexto contemporâneo. Para descrever esses desenvolvimentos, nosso trabalho parte de uma breve discussão sobre o uso metafórico do conceito de profecia, seguida por um breve panorama da pesquisa contemporânea sobre a ética nos profetas bíblicos. Observamos em particular a proposta da existência de uma concepção análoga ao conceito de “Lei Natural” no livro de Isaías e sua influência sobre novos estudos sobre profecia e ética ambiental. Por fim, oferecemos uma avaliação geral das implicações hermenêuticas dessas novas propostas. O foco do nosso trabalho se concentra principalmente no contexto anglo-saxônico, onde essa abordagem tem tido maior repercussão. A presente análise buscou mostrar que, para além do uso metafórico do conceito de “profecia”, diversos segmentos da academia têm demonstrado maior interesse em integrar o elemento ético dos profetas e o pensamento ético contemporâneo a partir do resgate exegético de temas e conceitos efetivamente oriundos da literatura profética. Esse resgate tem o potencial de fomentar novas linhas de reflexão e ação.

This paper explores the development of scholarship examining invasive alien species and their impacts from an environmental justice perspective. As the scope of the environmental justice field grows to encompass considerations of ecological integrity, invasive alien species should be part and parcel of this discourse, because they have the potential to harm human health directly and interfere with ecosystem services upon which vulnerable groups sometimes rely. Further, invasive alien species might cause environmental justice issues at the international level, as developing countries are likely at greater risk from their impacts. We propose that research should investigate the distribution of direct impacts from invasive alien species, as well as those via changes of ecosystem functioning and services, across different socioeconomic populations. We highlight the need for a holistic approach to understanding these impacts that includes environmental justice concerns and recommend the development of a framework that would enable consideration of cultural, ecological, economic, and social issues involved in the management of invasive alien species.

This article discusses the relevance and applicability of the 'post-religional paradigm' as proposed by EATWOT (Ecumenical Association of Third World Theologians) in the Asian contexts. It also inquires on how the Asian phenomenon and its interpretations relate to the crisis of religions in Western societies. It attempts to answer this problematic through four steps: a summary of the theological proposal and its relationship with the Western sociologies of religion; a search for a viable framework with which to understand religions in post-secular societies; discussion on the "discourses of Asia" and the corresponding view on religion; an elaboration of my preferred framework with some examples from the Asian situation. I argue that a viable theological proposal on post-religional paradigm should start from the analysis of how religious discourses and practices navigate with concrete socio-historical forces on the ground. Consequent to this view is the assertion that there is no universal sociology/theology of religion's development but multiple and complex religious discourses in specific contexts.

O autor centra-se em três cadeiras e cinco estofos soltos das colecções do poeta Guerra Junqueiro, actualmente na Casa-Museu e Fundação com o seu nome; o couro lavrado apresenta particularidades estéticas que o fazem integrar na arte mudéjar de linhagem omíada que permaneceu no ocidente peninsular depois da Reconquista. As relações que estes motivos permitem considerar salientam Portugal como depósito de continuidades e adaptações de estéticas arcaicas; ficaram na arte do couro da elite c.1500-1600, antes dos padrões renascentistas se terem tornado dominantes.The author analyses three chairs and five upholstery pieces of the collection of the poet Guerra Junqueiro, nowadays at the House-Museum and Foundation bearing his name; these leather carvings show aesthetical peculiarities that turn them part of Mudejar art of Umayyad lineage that remained in the West of Iberia Peninsula after the Reconquest. The connections that such motives allow highlight Portugal as a deposit of continuities and adaptations of archaic aesthetics; they have remained in the elite’s leather art c. 1500-1600 before the Renaissance motives becoming dominant.

The chronicle known as the Liber Pontificalis was redacted in Rome in the papal entourage. Begun in the middle of the 6th century, it was brought up to date for the next several centuries by several, largely anonymous compilers. Its central concerns were the papacy, and the city over which the bishop of Rome exercised his authority, whose monuments and physical development are charted in great detail. My paper examines a unique version of the Liber pontificalis, redacted in 1142 not in Rome, but in France, by Petrus Gulielmus, the librarian of the Abbey of Saint-Gilles (Nîmes). Using a Roman exemplar, composed in the 1130’s and now lost, Petrus Gulielmus revised the papal chronicle by inserting key episodes of his own abbey’s history within the ancient framework. In some cases, an imagined Rome and the papal court provide the setting in which the affairs of Saint-Gîlles are discussed and decided; in other cases, the abbey and its neighborhood are inserted within the itinerary of papal tours in France, creating a new ecclesiastical geography into which the pope’s person and its ceremonies are transferred from Rome and adapted to the local topographies. My paper explores these layered textual and geographical transformations, as a document of Rome and about the sites of Rome becomes a vehicle for the political and religious interests of a distant place.

Educar é mais do que transmitir informação. É formar: refletir sobre o que informa nossas escolhas, idéias, visões de mundo, valores, atitudes. Ou seja, na teia dos significados individuais tecer uma rede de significados coletivos, onde haja ressonância e solidariedade, no âmbito de projetos existenciais mais complexos. Numa abordagem sistêmica, a informação, a educação e a comunicação em saúde precisam ser contextualizadas num mundo em aceleradas e profundas mudanças. Não basta disponibilizar informações em avalanches quantitativas, sem que haja uma reflexão contextualizada sobre os objetivos a que se destinam. As novas tecnologias de informação e comunicação (NTIC) podem apresentar-se como potentes ferramentas para democratização de oportunidades de aprendizado, num contexto de escolhas éticas definidas. Educar e comunicar pressupõem uma ética identitária, um percurso a seguir, uma responsabilização, com clareza de objetivos. Precisamos responder a questões básicas, como: o que desejamos comunicar? Para que e para quem? O que pode ser facilitado com o uso de NTIC? Quando e com que propósito utilizá-las? Também é necessário aprender a se comunicar mais efetiva e afetivamente. Somos semi-analfabetos, quando o assunto é comunicação afetiva. Mal conseguimos reconhecer nossos sentimentos. A formação do profissional de saúde no século XXI exige uma visão sistêmica, que dê conta da complexidade e transdisciplinaridade do conhecimento. Dele será exigida grande habilidade de comunicação afetiva e atualização permanente, além de competência para lidar com a subjetividade, a alteridade, as inter-relações e o conflito, pois estão sempre presentes nas equipes multidisciplinares, nas famílias, nos grupos e redes sociais.

O presente texto procura acompanhar alguns aspectos da reconstrução sartreana das relações entre indivíduo e história, tentando mostrar que a fenomenologia e o materialismo dialético comparecem nessa proposta de conhecimento e que é a convergência das duas perspectivas que permite, contemplando adequadamente a universalidade e a singularidade, descrever e compreender dialeticamente o modo histórico de produção da identidade individual.The paper intends to explain some views of the sartrian reconstruction of relations between individual and history, in order to understand how phenomenology and dialectical materialism go together in a certain conception of knowledge, converging to describe and understand the dialectical production of historical identity, by an appropriate vision of the relations between universality an singularity.

A questão que se tenta construir neste texto é a da convergência entre filosofia, história da filosofia e formação. Tal pergunta se desdobra primeiramente na elucidação das relações entre história e historicidade da filosofia, que remonta à constatação óbvia, mas nem sempre lembrada, de que o fundamento da história da filosofia é o caráter histórico da própria filosofia. A idéia de formação está presente em toda filosofia, já que, antes de ser sistema ou concepção cristalizada da realidade, cada filosofia é sempre um exercício de síntese das possibilidades e das circunstâncias da vida humana, inclusive sob o aspecto do trabalho da reflexão. Nesse sentido, o texto remete a algumas idéias de Bergson acerca de formação e processo, e à noção sartriana de práxis como formação e superação contínua dos momentos estruturais do curso da história. Assim compreendida, a relação entre história da filosofia e filosofia contém inevitavelmente o compromisso com a atualidade, isto é, com a formação atual do pensamento.The text intends to examine the question about the relationship between history of philosophy, philosophy and formation as a liberation of conscience. The starting point is an obvious idea, thought not always remembered: history of philosophy founds its legitimation on philosophy as historical cultural fact. The idea of formation is implicated in every system, which, before being a specific conception of reality, is a synthesis of real conditions that have influenced all aspects of human life, includingly reflexive work. Some of Bergson's and Sartre's ideas about process, form and praxis can help us to elucidate the engagement in the present included in the relationship between philosophy and history of philosophy.

O presente artigo tem como objetivo a análise da teoria da responsabilidade civil pela perda de uma chance, que vem ganhando destaque no Brasil, em razão das crescentes demandas que abordam o tema. Analisa-se a natureza jurídica do dano decorrente desse tipo de responsabilidade, que, embora não haja uma concordância nos âmbitos doutrinário e jurisprudencial, observa-se uma tendência a considerá-lo como uma espécie autônoma de dano, desconectado dos danos materiais (danos emergentes e lucros cessantes) e morais. Pretende-se analisar, ainda, sua incidência na jurisprudência pátria, em especial na esfera trabalhista, em que, apesar de não haver uma legislação específica que trate do tema, aplicando-se as normas civilistas que dispõe sobre a responsabilidade civil, o tema não passa despercebido, havendo inúmeras ações que tem por objeto a indenização em comento. Desta feita, considerando que a aplicação da teoria depende da análise do caso concreto, pretende-se fazer uma pesquisa sobre os posicionamentos dos Tribunais pátrios sobre a questão, tomando-se como fonte alguns precedentes das principais Cortes Regionais Trabalhistas do país.

“The trade of gilt leather/guadameci between Córdoba and Lisbon: a contract from 1525” deals with a document of imports between a gilt leather maker from Lisbon, working for the court, and a painter from Córdoba; the list includes altar fronts, wall hangings and cushions. Besides commenting such contract, the author refers the uses of gilt leather in both Iberian countries coming out of the Reconquest as part of the mudejar fashions of the 15th-16th centuries.
