The purpose of this article is to discuss the territorial implications of rural settlements resulting from the new land regularization within the context of expanding mining over these territories. To understand the spatiality of this process, we conducted a discussion about the production of space within the logic of capitalist accumulation, as well as the notions of primitive accumulation and accumulation by spoliation. We also used data from the Instituto Nacional de Colonização e Reforma Agrária (INCRA) and the Agência Nacional de Mineração - ANM to identify how mineral titles are spatialized over Paraíba's settlement areas. The results show that in this 21st century there is a mining expansion process over the peasant territories that has been legitimized by the action of the State, this fact drives the increase of territorial conflicts in the field and puts the maintenance of these territories at risk.
