An ethical and juridical analysis on the protection of the right of life in Brazil is provided foregrounded on the jurisprudential construction of the Supreme Federal Court, especially on the juridical bases used in decisions following the Unconstitutional Act 3510, Argument of Non-Compliance of the Fundamental Precept n. 54 and of the Habeas Corpus n. 124,306. Qualitative research has been developed through a bibliographical and documental survey in books and scientific articles on the theme and through jurisprudential research. No agreement occurs on the beginning of life and it is important to have a dialogue with advances in biotechnology for the process of the construction of ethical and juridical precepts on the protection of the embryo and human nature, with special reference to human dignity.
