The transportation of radioactive material involves a set of procedures as varied as they are complex, justifying its strong standardization. This article aims to demonstrate that the collaborative effort between two Brazilian licensing agencies, which resulted in the elaboration of a Joint Technical Note, was justified considering the legislative process. By consolidating various norms and procedures – from the configurations of packages containing radioactive material to the training program for drivers responsible for transportation, including environmental safety of routes – it proves to be a facilitator of the work for everyone involved in this activity. In conclusion, it is shown that there is strong standardization of this activity in Brazil and that the legislative process is dynamic, reflecting natural improvements in technical and legal aspects inherent to the nature of the material involved.

3. Environmental compensation to recover damages to permanent preserved areas caused by the occupation of continental fish farms: a case study in Santa Catarina, Brazil

ABSTRACT: The environmental regulation of continental fish farming in Brazil is closely linked to land occupation and use. Areas used for this activity are mostly located in permanent preservation areas (PPA), close to rivers and springs, demonstrating the necessity of regulating this activity for its compliance with public policy. Santa Catarina is a leading state in fish farming and one of the first to regulate the use of PPAs. The feasibility of a proposal for environmental compensation to regularize the use of PPAs in Santa Catarina for fish farming; was therefore, assessed. The results showed that 74% of the fish farms analyzed need to regularize the occupation of production structures in PPAs. Regarding the proposed index of compensation for use in PPAs, the environmental compensation factor (ECF), through evaluation of the individual maps and subsequent integrated evaluation, all the fish farms identified with environmental liabilities in occupation had ratios of 1:2 and 1:3, and this index is a viable alternative for environmental regularization of the activity. It was further proposed that ECF be applied to small fish farms of up to four fiscal modules and that they have a standard minimum occupancy profile in relation to the total area of the property, as assessed in the present study.

Abstract The integrated management paradigm proposes dealing with a resource, such as water, considering its interrelationships with other environmental components. This vision has been adopted as a policy in several countries, including Colombia, but its results have not been satisfactory. This article studies the “integrative” approach in previous regulatory arrangements, making a historical review of them to understand how the perception and management of the environment by societies in Colombia have evolved. We show how the notion of a complex and integrated environment is not exclusive from current policies but has been present in the laws for several centuries, so its consideration does not guarantee success. Strategies are proposed to improve the results of recent regulatory arrangements.

Abstract The article reviews Brazilian environmental policy, observing its central mechanisms, arguing that these are based on a conception of shared responsibility in the care for nature that has recently been undermined. From three approaches of political theory that discuss the problems of coordination of action, deliberation, and environmental justice, we analyze the institutional mechanisms of responsibility as protection, participation, and control, observing their relevance and justification for environmental policy. The article uses empirical documentary data to reflect on the potentials of the environmental policy model in the face of the possible implications of its deformation, concluding that the shared character of responsibility in environmental policy is the central focus of the changes that have been occurring, which puts an important democratic dimension at risk

Abstract Environmental risk communication comprises an essential step in contaminated sites management, being one of its basic principles. However, there are few studies and technical guidelines on how to perform risk communication. This research aimed to identify the main factors that can contribute to efficient risk communication from the stakeholders’ perspective: those affected or potentially affected by the risks, representatives of institutions responsible for risk communication, environmental agencies, and consultants. To achieve that, the Q technique, a methodology specialized in the study of people and their subjectivities, was applied to 24 individuals. Five factors representing the stakeholders’ perspectives were identified: 1 - Trust; 2 - Secure communication; 3 - Dialogue; 4 - Partnership; and 5 - Health, in addition to a set of consensual information between all groups. Concern for the health of those involved was the most important point of view for most participants.

Water is essential for the existence of life and has various applications such as use for human consumption, commercial, agricultural and industrial purposes. As one of the most important constituents in any organism, water needs to be within physical, chemical, microbiological, organoleptic and radiological quality standards to be used, whether for drinking, irrigation or recreation. Thus, this work investigated the presence of possible contaminants in the surface water of the Criminoso Stream, which belongs to the Paraguay River basin in the municipality of Coxim-MS, through the analysis of physical-chemical parameters, pH, Dissolved Oxygen (DO), Turbidity, True Color, Total Hardness, Electrical Conductivity (EC), Total Chlorides, Alkalinity, Total Dissolved Solids (TDS) and the influence of potentially contaminating metals: Copper (Cu), Iron (Fe), Nickel (Ni), Cadmium (Cd) and Lead (Pb). From the results obtained, we observed that some physicochemical parameters (pH, turbidity and chlorides) and the metals Cu, Ni Cd and Pd evaluated were in accordance with the legislation 357/05 in all points in the periods analyzed. Values above the allowed values were found for Color and Fe in 4 points, for Dissolved Oxygen only in points 2 and 3, and for Electrical Conductivity and Total Dissolved Solids only in point 2. The change in these values may be due to environmental impacts caused by unplanned urbanization near the stream that affects water quality. [ABSTRACT FROM AUTHOR]

Abstract The parameter for delimiting Areas of Permanent Preservation (APPs) in the 2012 Forest Code is the edge of the regular stream bed, not its highest level. The objective of this study is to evaluate the loss of protected areas, framed the category of water APPs in the 2012 Forest Code, in the Cabaçal River. By means of spatial technologies, maps of vegetation cover and land use from 2012 and 2018 were prepared. The change in the Forest Code in 2012 caused the loss of 90% of the area previously protected by the 1965 Code, corresponding to the major waterbed of the Cabaçal River, especially in the lower course, located in the Pantanal plain of Mato Grosso. It was concluded that the vegetation cover in the Areas of Permanent Preservation was suppressed so that urban and agricultural uses could be implanted, characterizing them as conflict areas due to the flexibilization of the environmental legislation.

Due to the great concern regarding ecosystem environments and the loss of biodiversity, there is an increasing need to transform small or large areas into preservation sites. Federal Law No. 9,985 of 2000, which establishes the National System of Nature Conservation Units (SNUC), aims to direct criteria and standards for the creation, implementation, and management of Conservation Units. The Municipality of Guarulhos includes ten Conservation Units (CUs) in its territory, five of which are Municipal UCs, one of which is in the process of being created; four State UCs and one Federal UC, all located in the Atlantic Forest. Aiming to protect the natural resources of these areas, a Management Plan must be drawn up for each UC, a document in which the zoning and rules that will govern the use of the area and the management of natural resources will be established, including the implementation of physical structures necessary for the management of the unit. The study sought to analyze and discuss management plans rather than guidance manuals. Three Management Plans for the following UCs were analyzed: the Environmental Protection Area of the Cantareira System, the Itaberaba State Park, and the Guarulhos State Forest, all of which are Statewide UCs. Even though they are very important, few UCs present Management Plans. Among the UCs analyzed, the Environmental Protection Area of the Cantareira System is the oldest, created in 1998, with the Management Plan, approved only 22 years later, in 2020. The Itaberaba State Park was created in 2009 and the Guarulhos State Forest in 2010, but only 2017 were created. All Management Plan documents comply with Federal Law No. 9985/2000 and manuals consulted, but their practical application must be analyzed to better assess the suitability and preservation of ecosystems and quality and environmental comfort to the municipality. There has been a lot of discussions on environmental issues in cemeteries during the last decades. Older cemeteries, prior to 1820, were planned with no specific norms for place and establishment. Environmental aspects and impacts were not taken into account and, consequently, they became potential sources for environmental contamination. Current paper identifies the environmental impacts in a cemetery in a municipality in the state of Rio Grande do Sul, Brazil. Data are important for the town since the study provides the current environmental situation of the only municipal cemetery. They may be of great help for decision taking on the environmental risks involved and may be used for fitting within the environmental norms. Methodology comprised bibliographic research on the issue and research-activity comprising four stages: historical analysis of documents on the municipal cemetery, mapping of the area, analysis on legislation and on environmental impacts. One of the issues consists in the impossibility of enlargement of the fixed area within the town's perimeter hailing from the 20s. It has also been verified that out of the 19 items in legal criteria, only one is wholly complied with, 5 items are partially complied with and 13 are contrary to current legislation. Attendance to environmental issues and the management of residues generated should be undertaken for a decrease in environmental, social and economical impacts. [ABSTRACT FROM AUTHOR]

Hydrographic network maps produced by government institutions have been used to delimit Permanent Preservation Areas (PPAs) in Brazil. However, problems arising from discrepancies between those maps and field survey are frequent. To characterize and quantify such discrepancies, whether methodological or due to the scale of the maps or temporal changes, we mapped the springs and watercourses in five rural properties (adding up to 10,860 ha, in the municipalities of Brotas and Ribeirão Bonito, SP). Those maps were then compared with the regional hydrographic network mapped by IBGE and IGC. We verified, for the study area, an oversizing of 157% in the number of springs and 83% in the length of watercourses by IBGE, and 209% in the number of springs and 84% in the length of watercourses by IGC. Consequently, there was an oversizing of PPAs. We therefore consider that such maps can be used as an approximate reference for the hydrographic network, although they cannot provide a basis for legal decisions or environmental planning if they are not duly corrected by field verification. ABSTRACT This study aimed to diagnose the environmental infractions that occurred in the northern region of Santa Catarina State (Southern Brazil). The environmental infractions were classified by category and by violation activities concerning the hydrographic regions of Canoinhas Plateau and Baixada Norte from 2014 to 2018 to assess the growth and causes of a diagnosis regarding the environmental damages occurrences. Results indicated that the major illegal environmental practices registered in both region are related to environmental violations regarding the damage caused in native vegetation, and these damages are caused without authorization of the competent environmental authority. In addition, it was also important to note the activity of maintaining birds in captivity and of functioning of potentially pollutant activities or establishments that do not have a license of the competent regional environmental agencies. Therefore, efforts from the Environmental Policy should be directed to implement a forest monitoring system using remote sensing technology apart from starting a stronger cooperation with municipal authorities from Santa Catarina State by promoting Environmental Monitoring Programs (EMP).

Environmental licensing can be considered a management tool for organizations, which must be carried out according to norms and principles in order to make it a tool capable of monitoring whether the property is in compliance with the current environmental legislation. It must be performed at appropriate intervals and carefully analyzed to intensify the objectives, always seeking improvements of the productive processes in order to minimize environmental damage. Thus, this article aims to analyze the importance of environmental licensing for sustainable rural development. The method used for this study was the bibliographical research, where several bibliographic sources will be used, to give theoretical foundation to the research. Thus, the article will demonstrate the phases of environmental licensing as well as the themes related to sustainable rural development, in order to identify how environmental licensing has a great relation with sustainability, since it conditions limits and restrictions for the development of potentially polluting activities that, in practice, take into account and is based on the importance of not attacking the environment. The aim of this article is to characterize the environmental licensing process of the mining sector in the Goias State. Among the most relevant characteristics identified is the absence of legal criteria for the classification of mining activities for the environmental licensing. The research consisted in a review of the environmental legislation applied to the mining sector and analysis of information on environmental licensing processes before the environmental authority of the Goias State between 2011-2014. Although the Brazilian Constitution stipulates the need for the preservation of natural resources, current Forest Code (Federal Law 12,651/2012) provides means to make flexible the size and use of protected areas, causing negative impacts on the environment. A study case of the municipality of Lavras MG Brazil analyzes changes related to Permanent Preservation Areas (PPA) on the banks of rivers and in the neighborhood of artificial reservoirs built for the generation of energy or water supply, and the Legal Reserve (LR) of farms on the banks of the Rio Grande. Based on data of the National Rural Environment Registration and on the System of Geographic Information, several scenarios compared the effects of more restrictive measures and flexibility measures with consolidated anthropic use. Flexibility may cause a 79.4% reduction in the area studied in PPAs on the banks of rivers, 67.7% in PPAs around artificial reservoirs for the generation of energy or water supply and 7% in Legal reserve. Reduction affects negatively the ecological functions of PPAs and LRs. [ABSTRACT FROM AUTHOR]

Abstract Environmental services provided by forests are essential to the social reproduction of populations in rural areas. Perceptions about the services provided by forests play an important role in the planning of landscapes; however, few studies have investigated this issue. This study aimed at understanding how farmers perceive the role of forests in maintaining environmental services. One hundred farmers from the Chapecó Ecological Corridor - SC were interviewed. Provisioning and regulating services were mentioned most often. Water availability ranked first (65%), followed by the maintenance of habitat for biodiversity (34%) and firewood (23%). Income and local use of forest resources were the variables that best explained farmers' perceptions of forest benefits. Nevertheless, the use of forest resources has been limited by restrictions imposed by environmental legislation, which is affecting the perception of farmers about the wide range of environmental services provided by forests.

ABSTRACT This study sought to evaluate the environmental awareness of small rural producers in the municipality of Divinópolis, MG, Brazil, regarding Legal Reserves – LR and Permanent Preservation Areas – PPA, referencing the state’s current forest legislation, known as the Forest Code of Minas Gerais (Law 20.922/2013). For this purpose, a qualitative study was conducted using semi-structured interviews, with the sample defined by the saturation criterion, and issues considered using Bardin content analysis. The results showed that, in general, rural landowners define both evaluated terms incorrectly and/or incompletely. All of them reported not having knowledge of the environmental legislation and the majority declared not having been informed about the question and presented no record of LR notarization or registration at the Rural Environmental Registry - RER. This finding showed the need for the involvement of public and social institutions, and companies operating in the region to create guidance and training programs for landowners regarding environmental legislation, as well as encouraging the creation and maintenance of protected areas and supporting the environmental compliance of the properties.

This work aims to analyze the Brazilian environmental legislation regarding environmental licensing from the critical view of environmental justice, seeking to understand its role as a formal space for disputes for environmental justice, and as a mechanism for legitimizing environmental justice or injustice. For this purpose, federal and state legal instruments, issued by the Legislative and Executive Powers and, at the administrative level, by the environmental agencies, were analyzed. Data were processed using the IRaMuTeQ software, using the Descending Hierarchical Classification and Word Cloud analyses. The results showed, in all analyzed classes, elements that indicate environmental injustice. Thus, within the scope of the analyzed legal instruments, a hegemonic utilitarian discourse was observed, which reproduces the environment from an economic perspective, devoid of sociocultural meanings. In this sense, it is concluded that the Brazilian legislation regarding environmental licensing, in addition to not adequately exercising its role in the construction of environmentally fair results in the context of environmental conflicts, can be transmuted into mechanisms for the reproduction and legitimization of environmental injustices. Este trabalho tem por objetivo analisar a legislação ambiental brasileira referente ao licenciamento ambiental a partir da visão crítica da justiça ambiental, procurando compreender seu papel enquanto espaço formal de disputas por justiça ambiental. Para tanto, foram analisados instrumentos legais federais e estaduais, emanados pelos Poderes Legislativo, Executivo e, na esfera administrativa, pelos órgãos ambientais. Os dados foram processados por meio do software IRaMuTeQ, sendo empregadas as análises de Classificação Hierárquica Descendente e Nuvem de Palavras. Os resultados apontaram, em todas as classes analisadas, elementos sinalizadores de injustiça ambiental. Assim, observou-se, no âmbito dos instrumentos legais analisados, um discurso hegemônico utilitarista, que reproduz o meio ambiente a partir do viés econômico, destituído de sentidos socioculturais. Neste sentido, conclui-se que a legislação brasileira referente ao licenciamento ambiental, além de não exercer seu papel na construção de resultados ambientalmente justos no âmbito dos conflitos ambientais, podem se transmudar em mecanismos legais de reprodução e legitimação de injustiças ambientais.

37. IMPACTOS CUMULATIVOS NÃO SÃO ANALISADOS EM ESTUDOS DE IMPACTOS AMBIENTAIS NO ESTADO DE MINAS GERAIS.

In Brazil, the Cumulative Impact Assessment (CIA) is an Environmental Impact Assessment (EIA) project, an important environmental management tool applied to activities that have the potential to cause significant environmental degradation. According to CONAMA Resolution No. 01/86, the Environmental Impact Statements (EISs) of these activities should analyze the environmental impacts of the project and its alternatives, including their cumulative properties. Cumulative impacts accumulate in time or space, resulting from a combination of effects arising from one or several actions. The objective of this study was to evaluate if the CIA is systematically addressed in EISs in the state of Minas Gerais. We analyzed 70 statements, elaborated between the years of 2002 and 2015, of several types of licensed activities. It was found that only 9 EISs mentioned the term "cumulative effects / impacts". However, no study has considered cumulative effects in impact assessments. The results indicate the non-application of CIA in the State, therefore, not considered in the decision-making processes for the environmental licensing of projects. This unsatisfactory result can be explained by the lack of technical instructions that would reduce the complexity inherent to this evaluation. In order to have an effective application of CIA, it will be necessary to extend the Integrated Environmental Assessment (IEA) guidelines for other types of activities in addition to the hydroelectric sector, according to the current requirement of Minas Gerais state legislation. Urban forest refers to the set of trees in urban public and private areas. Urban forests constitute a public patrimony that must be known, valued and expanded so they can be passed on to future generations. Their protection is responsibility of the public administration. In this context, practices are adopted based on legal norms and provisions described in the present study, whose aim is to demonstrate the current situation in the municipality of São José dos Pinhais-PR. Our study also shows that federal environmental legislation addresses urban afforestation in general terms and that state laws and environmental standards are the most used when authorization is granted to suppress urban vegetation. The preservation of the environment is essential for safeguarding water resources, geological stability and the biodiversity of municipal territory, in accordance with the federal environmental legislation. By harnessing the Geographic Information System (SIG), the purpose of this work was to delineate and to review the Permanent Preservation Areas on the basis of legal parameters (Federal Law nº. 12,651/12) in the urban area of the municipality of Canoinhas. The digital cartographic base of the municipality of Canoinhas, the Secretary of State for Sustainable Development (SDS) and EPAGRI/IBGE was used specifically for this purpose, making it possible to manipulate geographical data on altimetry and water resources. On account of hydrographic discrepancies in the digital databases, a hydrological model had to be generated in order to rebuild the drainage system of the urban area. In lieu of other structures and in accordance with existing environmental legislation, feasible PPAs include areas associated with watercourses, springs and slopes. The present study identifies a total surface area of 7.3 km² - 22.5% of the urban area of the municipality of Canoinhas - of environmental constraints. The main operations were carried out in watercourses, chiefly by correcting and laying down channels. Nevertheless, in areas marked by wide floodplains on the main watercourses, the riparian forest was successfully preserved during the initial and middle regeneration phases. [ABSTRACT FROM AUTHOR]

The disorganized growth of urban centers, added to the lack of public policies and targeted investments, cause irreparable damage to the environment as a whole and to the health of populations due to failures in the basic sanitation system. The objective of this work was to evaluate the impacts caused by the discharge of untreated effluents into the Rio Negro river; carry out microbiological analyzes of water samples from various points on the edge of Manaus, as well as streams (small tributaries of the Rio Negro), in order to assess the health of these water bodies, and the progress of their pollution today, comparing the results obtained within the limits permitted by current legislation; to analyze the possibility of dumping untreated wastewater directly into the Rio Negro river, mainly from the use of the subfluvial outfall, from the perspective of the aforementioned having a supposed capacity for self-purification. Another goal of this study is to propose the updating of the Municipal Basic Sanitation Plan of the city of Manaus, mainly with regard to the establishment of a maximum period to reach a satisfactory percentage in the population's access to sewage collection and treatment in the municipal network. For that, water samples were collected from five points of the city coast and microbiological characterization analyzes were carried out. It was possible to infer from the results that the pollution in the creeks on the edge of Manaus is evident, considering that in all five points evaluated the presence of microorganisms harmful to human health was found, largely due to the receipt of disorderly effluent discharge. El crecimiento desorganizado de los centros urbanos, sumado a la falta de políticas públicas e inversiones focalizadas, provocan daños irreparables al medio ambiente en su conjunto ya la salud de las poblaciones por fallas en el sistema de saneamiento básico. El objetivo fue evaluar los impactos causados por la descarga de efluentes sin tratar al Río Negro; realizar análisis microbiológicos de muestras de agua de varios puntos en el borde de Manaus, así como de arroyos (pequeños afluentes del Río Negro), con el fin de evaluar la salud de estos cuerpos de agua y el progreso de su contaminación en la actualidad, comparando los resultados obtenidos dentro de los límites permitidos por la legislación vigente; analizar la posibilidad de verter aguas residuales sin tratar directamente al río Negro, provenientes principalmente del aprovechamiento del emisario subfluvial, desde la perspectiva de que las mencionadas tengan una supuesta capacidad de autodepuración. Otro objetivo de este estudio es proponer la actualización del Plan Municipal de Saneamiento Básico de la ciudad de Manaus, principalmente en lo que respecta al establecimiento de un período máximo para alcanzar un porcentaje satisfactorio en el acceso de la población a la recolección y tratamiento de aguas residuales en la red municipal. Para ello, se recolectaron muestras de agua en cinco puntos de la ciudad y se realizaron análisis de caracterización microbiológica. De los resultados fue posible inferir que la contaminación en los arroyos de la periferia de Manaus es evidente, considerando que en los cinco puntos evaluados se constató la presencia de microorganismos nocivos para la salud humana, en gran parte por la recepción de descargas desordenadas de efluentes. O crescimento desorganizado dos centros urbanos, somado à falta de políticas públicas e investimentos direcionados, causam danos irreparáveis no meio ambiente como um todo e na saúde das populações devido às falhas no sistema de saneamento básico. Objetivou-se avaliar os impactos causados pelo despejo de efluentes não tratados no rio Negro; proceder a análises microbiológicas de amostras de água de vários pontos da orla de Manaus, bem como de igarapés (pequenos afluentes do Rio Negro), a fim de avaliar a saúde desses corpos hídricos, e o avanço de sua poluição atualmente, comparando os resultados obtidos com os limites permitidos na legislação vigente; analisar a possibilidade do despejo de águas residuais não tratadas diretamente no rio Negro, principalmente do uso do emissário subfluvial, sob a ótica de o referido possuir suposta capacidade de autopurificação. Outra meta deste estudo é propor a atualização do Plano Municipal de Saneamento Básico da cidade de Manaus, principalmente no que diz respeito ao estabelecimento de prazo máximo para que se atinja uma porcentagem satisfatória no acesso da população à coleta e tratamento de esgoto na rede municipal. Para tanto, foram coletadas amostras de água de cinco pontos da cidade e realizadas análises de caracterização microbiológica. Foi possível depreender com os resultados, que é evidente a poluição nos igarapés na orla de Manaus, considerando que em todos os cinco pontos avaliados foi constatada a presença de microrganismos prejudiciais à saúde humana, muito em razão do recebimento de despejo desordenado de efluentes.

48. O CÓDIGO FLORESTAL E A SUA FLEXIBILIZAÇÃO EM ÁREAS DE PRESERVAÇÃO: O CASO DA REGIÃO METROPOLITANA DE GOIÂNIA, GOIÁS

This study aims to analyze the implications of the current Forest Code of the state of Goiás, with regard to the use of Permanent Preservation Areas (APPs) in the Metropolitan Region of Goiânia (RMG). The flexibilities provided in the current legislation, such as inclusion of the concept of Consolidated Rural Area (ARC) and the extension of the criteria for the use of APPs in Consolidated Urban Area (AUC), regularized the occupation of APPs, generating setback in environmental legislation. From the last mapping developed in this research, referring to land use of metropolitan APPs, associated with the National Rural Environmental Registry System, it was possible to identify in the RMG that the ARC represents more than 60% of the properties rural areas, covering a significant part of APPs, which, in turn, have reduced their protection metrics. In the urban area, the problem is repeated in the AUC, with emphasis on the municipalities of Aparecida de Goiânia and Goiânia, with 67.99% and 60.39% of their APPs located in the AUC, respectively. In this regard, conflicts are observed in the APPs, reinforced by legal instruments, such as the Forest Code, which, instead of penalizing lawbreakers, brings ambiguous interpretations, regularizing occupation in preservation areas. Este artigo propõe analisar as implicações do atual Código Florestal Goiano, quanto ao uso das Áreas de Preservação Permanente (APPs), da Região Metropolitana de Goiânia (RMG). As flexibilizações previstas na lei vigente, como a inclusão do conceito de Área Rural Consolidada (ARC) e a extensão dos critérios para utilização das APPs em Área Urbana Consolidada (AUC), regularizaram a ocupação das APPs, gerando um retrocesso na legislação ambiental. A partir do mapeamento desenvolvido nesta pesquisa, sobre o uso e a cobertura das APPs metropolitanas, associado aos dados do Sistema Nacional de Cadastro Ambiental Rural, foi possível identificar que na RMG as ARC representam mais de 60% da área total dos imóveis rurais, contemplando parte significativa das APPs, as quais, por sua vez, passam a ter métricas de proteção reduzidas. Na área urbana, a problemática se repete nas AUC, com destaque para os municípios de Aparecida de Goiânia e Goiânia, com 67,99% e 60,39% das suas APPs localizadas em AUC, respectivamente. Nesse sentido, observam-se conflitos nas APPs da RMG, reforçados por instrumentos legais como o Código Florestal, que, ao invés de penalizar infratores, concede brechas para dúbias interpretações, regularizando a ocupação em áreas de preservação.

The legal instruments provided in Brazilian legislation are essential for environmental preservation. Therefore, it is proposed to identify protected areas according to the Law of Native Vegetation Protection (LNVP) for the interconnection of the Ipanema National Forest to the Natural Municipal Park of Biodiversity Corridors, with the aid of the ArcGIS 10.6 software, to compare the results of land use and occupation of 2008 before the amendment of the Forest Code by LNVP in 2019, to identify granted amnesties areas, and the Permanent Preservation Areas (PPA). For the establishment of legally protected areas in rural properties, data from the Rural Environmental Registry (RER) were used, being subtracted as consolidated areas pre-existing on 2008, within the limits of PPA. It was verified that there were no areas with amnesty to be considered within the PPA. There was an increase in urban expansion of 12 km2 and a reduction in the grazing area in the years studied. It was also found that of the total study area of 406 km2, disregarding areas of Conservation Units only 47.95 km2 are legally protected. It is also noted that 57% of protected areas must be recovered because they are not in accordance with the law. Os instrumentos legais previstos na legislação brasileira são essenciais para a preservação ambiental. Portanto, propõem-se a identificação das áreas protegidas de acordo com a Lei de Proteção da Vegetação Nativa (LPVN) para a interligação da Floresta Nacional de Ipanema ao Parque Natural Municipal Corredores de Biodiversidade, com auxílio do software ArcGIS 10.6, para comparação dos resultados de uso e ocupação do solo de 2008 antes da alteração do Código Florestal pela LPVN em 2019, a fim de identificar as áreas em que foram concedidas anistias, e estabelecidas as Áreas de Preservação Permanente (APP). Para estabelecimento das áreas em imóveis rurais protegidas legalmente foram utilizados os dados do Cadastro Ambiental Rural (CAR), sendo subtraídas as áreas consolidadas preexistentes a 2008 localizadas nos limites das APPs. Foram verificados que não houve áreas com anistia a serem consideradas dentro das APPs. Observou-se um aumento na expansão urbana de 12 km2 e uma redução da área de pastagem nos anos estudados. Verificou-se ainda que do total da área de estudo de 406 km2, desconsiderando as áreas das Unidades de Conservação somente 47,95 km2 estão protegidos legalmente. Verifica-se ainda que 57% das áreas protegidas devem ser recuperadas por estarem em desacordo com a Lei.

50. La eliminación de residuos de medicamentos en Brasil: Una análisis regulatoria

Brazil is one of the largest drug consumers in the world, and studies show that a large part of the population disposes of these drugs in the common waste, negatively impacting the environment. This article aims to analyze normative aspects of the management of household drug waste in Brazil, through the analysis of federal legislation on the subject, pointing out its strengths and weaknesses. It was observed that Brazil already had a legal apparatus that dealt with drug residues from health services, and more recently it took a leap in order to solve the gap that existed when starting the implementation of the reverse logistics system for home medicines, still in progress. This seems to be a promising alternative to the problem of disposal of this type of waste in Brazil. The system provides for shared responsibility among all agents responsible for the life cycle of household medicines and their packaging, in line with the National Solid Waste Policy, but leaves out cities with less than 100,000 inhabitants, and urgent action needs to be taken of education of the population so that this system can be effectively implemented. Brasil es uno de los mayores consumidores de drogas del mundo, y estudios muestran que gran parte de la población desecha estas drogas en la basura común, impactando el medio ambiente. Existe legislación vigente para la correcta disposición minimizando los impactos ambientales, sin embargo, con debilidades en su composición y aplicación. Este artículo tiene como objetivo analizar aspectos normativos de la gestión de residuos domiciliarios de medicamentos en Brasil, a través del análisis de la legislación federal sobre el tema, señalando sus fortalezas y debilidades. Se observó que Brasil ya contaba con un aparato legal que se ocupaba de los residuos de medicamentos de los servicios de salud, y más recientemente dio un salto para solventar el vacío que existía, al iniciar la implementación del sistema de logística inversa para medicamentos domiciliarios. en progreso. El sistema prevé la responsabilidad compartida entre todos los agentes responsables del ciclo de vida de los medicamentos de uso doméstico y sus envases, en línea con la Política Nacional de Residuos Sólidos. Esta parece ser una alternativa promisoria para el problema de disposición de este tipo de residuos en Brasil, pero de manera incompleta, ya que excluye ciudades con menos de 100.000 habitantes, requiriendo complementación en la legislación vigente, así como acciones de educación de la población para que este sistema se puede implementar con éxito. Há legislação vigente para o correto descarte minimizando os impactos ambientais, porém, com fragilidades em sua composição e aplicação. Este artigo tem como objetivo analisar aspectos normativos do gerenciamento de resíduos de medicamentos domiciliares no Brasil, por meio da análise da legislação federal sobre o tema, apontando seus pontos fortes e fragilidades. Observou-se que o Brasil já dispunha de aparato legal que versava sobre os resíduos de medicamentos dos serviços de saúde, e mais recentemente deu um salto a fim de solucionar a lacuna que existia, ao iniciar a implantação do sistema de logística reversa para medicamentos domiciliares, ainda em andamento. O sistema prevê a responsabilidade compartilhada entre todos os agentes responsáveis pelo ciclo de vida dos medicamentos domiciliares e suas embalagens, em consonância com a Política Nacional de Resíduos Sólidos. Esta parece ser uma alternativa promissora para o problema do descarte desse tipo de resíduo no Brasil, porém de forma incompleta, pois exclui as cidades com menos de 100.000 habitantes, necessitando complementações na legislação vigente, bem como, de ações de educação da população para que esse sistema possa ser de fato efetivado com sucesso.
