Coordenação de Aperfeiçoamento de Pessoal de Nível Superior - CAPES The present dissertation aims to understand the influence of the media on judicial decisions in times of network society. To make this possible, the work is divided into three main sections. It begins by investigating the relationship established between social appeal, mediatization of cases and discretionary decision-making in law, dealing with how the media appeal, fostered by popular concerns, corroborates the subjectivity-ridden judicial decision-making and the strenghtening of the paradigm of philosophy of consciousness in field of procedural jurisdiction. The second chapter verifies the importance of talking about and ontological-linguistic turn to jurisdiction contemporaneously, in the sphere of judicial decisions, dealing with the need for an invasion of language in philosophy in the process as a condition of possibility for the removal of philosophy of consciousness and its consequent subjectivity on judicial decisions. Finally, the third section studies the (im)possibility of having a procedural jurisdiction hostage to the uncontrollability of judicial decisions present in the discretion in the strong sense under the mantle of Ronald Dworkin’s theory, establishing bases with a contemporary constitutionalism, from the need to understand the judicial process constitutionally and hermeneutically. Allied to this, it verifies the thesis of the correct answer in this context, resorting to the duties of coherence and integrity to judicial answers given in the scenario of the network society and, more than that, of a hermeneutically adequate answer to the Constitution, as a fundamnetally enshrined right. Thus, the question is: how does the media, as an instrument for reproducing the social clamor, influences judicial decision-makings in times of a network society? So, what is the place occupied by the philosophy of language in this scenario? To solve the research problem raised, the phenomenological-hermeneutic approach is used, since the essay is anchored in language as a space for the happening of Being. As the basis theory, the work has the hermeneutic theory, specifically with regard to the hermeneutic critique of law, with the structural pillars fixed in the theories of hermeneutic philosophy, of Martin Heidegger, of philosophical hermeneutics, of Hans-Georg Gadamer and in the anti-relativism of Ronald Dworkin. At the end of the research, it is possible to conclude that the influence of the media on judicial decision-making in times of a network society is affirmed by the symbiotic relationship established between social appeal and media, as a powerful mechanism to pressure the Judiciary, mainly through communicational technologie. From the media appeal, the judicial process becomes spetacular and can activate subjectivities in the decision-making act, which leads to judicial decisions that are based on elements that do not legally and constitutionally serve a democratic State of law. Responses based on moral convictions, social appeals, past experiences and personal feelings can emerge from this complex phenomenon, bringing (or maintaining) to the terrain of contemporary jurisdiction the rancidity of the philosoplhy of conscience paradigm, in the form of discretionary decisions. The place occupied by the philosophy of language in this scenario, in turn, is in the very function of language, which, in procedural jurisdiction, consists of providing the demonstration that judicial responser are the result of demonstrative expositions, and not deductive reasoning. Answers must be hermeneutically constructed and, decisively, the subjectivity of judgements is no tone of the pillars of this construction. Language enables the pré-understanding and comprehension of the judge, in addition to being indispensable for the establishment of the correct relationship between subject and object. Furthermore, it is a condition of possibility for the subject to know the world and, also, for the world itself to exist. A presente dissertação objetiva compreender a influência da mídia nas decisões judiciais em tempos de sociedade em rede. Para que isso seja possível, o trabalho é dividido em três seções principais. Inicia-se pela investigação da relação estabelecida entre apelo social, midiatização de casos e a tomada de decisões discricionárias em direito, tratando sobre como o apelo midiático, fomentado pelos anseios populares, corrobora para a tomada de decisões judiciais eivadas de subjetividade e para o fortalecimento do paradigma da filosofia da consciência no campo da jurisdição processual. O segundo capítulo verifica a importância de se falar em giro ontológico-linguístico à jurisdição contemporaneamente, na esfera das decisões judiciais, tratando da necessidade de uma invasão da linguagem na filosofia no processo como condição de possibilidade para o afastamento da filosofia da consciência e de sua consequente subjetividade assujeitadora nas decisões judiciais. Além disso, compreende a incompatibilidade do paradigma da consciência com o panorama atual do direito a partir de uma perspectiva filosófico-hermenêutica. Por fim, a terceira seção estuda a (im)possibilidade de haver uma jurisdição processual refém da incontrolabilidade de decisões judiciais presentes na discricionariedade no sentido forte sob o manto da teoria de Ronald Dworkin, estabelecendo bases com um constitucionalismo contemporâneo, a partir da necessidade de se compreender constitucional e hermeneuticamente o processo judicial. Aliado a isso, verifica a tese da resposta correta nesse contexto, recorrendo aos deveres de coerência e integridade às respostas judiciais proferidas no cenário da sociedade em rede e, mais que isso, de uma resposta hermeneuticamente adequada à Constituição, enquanto direito fundamentalmente consagrado. Assim, questiona-se: como a mídia, enquanto instrumento de reprodução do clamor social, influencia na tomada de decisões judiciais em tempos de sociedade em rede? Destarte, qual o local ocupado pela filosofia da linguagem nesse cenário? Para solucionar o problema de pesquisa levantado, utiliza-se a abordagem fenomenológico-hermenêutica, já que o ensaio ancora-se na liguagem como espaço de acontecimento do Ser. Como teoria de base, o trabalho tem a teoria hermenêutica, especificamente no que diz respeito à crítica hermenêutica do direito, com os pilares estruturais fixados nas teorias da filosofia hermenêutica, de Martin Heidegger, da hermenêutica filosófica, de Hans-Georg Gadamer e no anti-relativismo de Ronald Dworkin. Ao final da pesquisa, é possível concluir que a influência da mídia na tomada de decisões judiciais em tempos de sociedade em rede é afirmada pela relação simbiótica estabelecida entre apelo social e mídias, enquanto mecanismo poderoso para pressionar o Poder Judiciário, principalmente por meio das tecnologias comunicacionais. A partir do apelo midiático o processo judicial se espetaculariza e pode ativar subjetividades no ato decisório, o que desagua em decisões judiciais que se fundamentem em elementos que não que servem legal e constitucionalmente a um Estado democrático de direito. Respostas com base em convicções morais, apelos sociais, experiências passadas e sentimentos pessoais podem eclodir desse complexo fenômeno, trazendo (ou mantendo) ao terreno da jurisdição contemporânea o ranço do paradigma da filosofia da consciência, na forma de decisões discricionárias. O local ocupado pela filosofia da linguagem nesse cenário, por sua vez, está na própria função da linguagem, que, na jurisdição processual, consiste em proporcionar a demonstração de que respostas judiciais são frutos de exposições demonstrativas, e não de fundamentações dedutivas. Respostas devem ser hermeneuticamente construídas e, decisivamente, a subjetividade dos julgados não é um dos pilares dessa construção. A linguagem possibilita a pré-compreensão e compreensão do julgador, além de ser indispensável para o estabelecimento da correta relação entre sujeito e objeto. Ademais, é condição de possibilidade para que o sujeito conheça o mundo e, também, para que o próprio mundo exista.

The aim of this essay is to discuss, drawing from a perspective considering both religious liberty as such and the foundations of freedom of belief, how judges decide in Brazil. I therefore present how religious liberty develops in German law along with brief reflections on conscientious objection in Brazil, in order to discuss the negative impacts of judicial activism in Brazil. The research was based on a phenomenological method, investigating the several layers underlying the investigated phenomena and the linguistic soil in which it is founded. Desde la perspectiva relacionada con la libertad religiosa, dada la fundamentalidad del derecho a la libertad de creencia, se propone discutir cómo decidir en Brasil. Para ello, se presentará el tratamiento del derecho alemán sobre el tema de la libertad religiosa, breves notas sobre la objeción de conciencia en Brasil, y luego discutiremos el tema del impacto negativo de las decisiones judiciales y el activismo judicial en suelo brasileño. En este estudio se utilizó el método fenomenológico hermenéutico, desvelando las distintas capas del fenómeno, dando vueltas al terreno lingüístico en el que se sustenta el presente tema. A partir da perspectiva relacionada a liberdade religiosa, dada fundamentabilidade do direito de liberdade de credo, propugna-se discutir de que forma se decide no Basil. Para tanto, será apresentado o tratamento do Direito alemão sobre o tema da liberdade religiosa, breves apontamentos sobre a objeção de consciência no Brasil, para então discutirmos a questão do impacto negativo de decisões judiciais e o ativismo judicial em solo brasileiro. Utilizou-se nesse estudo o método fenomenológico hermenêutico desvendando as várias camadas do fenômeno, revolvendo o chão linguístico sob o qual se assenta a presente temática

The present essay seeks to reflect on the judicial discretion, inherent to the jurisdictional activity, and on possible mechanisms to mitigate undesirable consequences of the dissimilarity on the judges’ understandings. Starting from the analysis of concrete cases linked to a common and repetitive hypothesis – moral damages due to canceled flights – it advances to analyze the effects of the individual analysis model in each docket. In contrast, there is a trend towards standardization through binding precedents. The example is the possibility of flight cancelation by the airline without the client agreement to further the opportunities of proft in behalf of the company and at the expenses of the client. The proposed hypothesis reveals both advantages of standardization, as it has been established the need for compensation due to cancellation of flights and the average damages amount, as well as the problem of the absence of incentives for airlines to change their behavior in face of low damages or indemnities., O presente artigo busca reflexão acerca da discricionariedade inerente à atividade jurisdicional e de possíveis mecanismos para mitigar consequências indesejáveis da variação de entendimentos do julgador. Analisa a técnica de respeito aos precedentes e busca pontos em comum com o modelo continental de subsunção à lei. Partindo da análise de casos concretos vinculados a hipótese corriqueira e repetitiva – a fxação de reparação quando de descumprimento de contrato de transporte aéreo – o trabalho analisa efeitos do modelo de análise individual das demandas propostas. O exemplo abordado é a alteração ou cancelamentos de voos de maneira unilateral de modo a propiciar à empresa aérea fornecedora do serviço de transporte maiores oportunidades de lucro em detrimento do contrato frmado com o consumidor. A hipótese proposta revela tanto vantagens da uniformização, eis que julgados estabelecem a necessidade de indenização por cancelamento de voo e indicam valores da reparação, quanto o problema da ausência de repressão ao comportamento das empresas sucumbentes ante os valores insufcientes da indenização para estimular modifcação da conduta.

Costuma-se associar de maneira virtuosa a expansão do Poder Judiciário, a constitucionalização de direitos e a efetividade do Estado Democrático de Direito, premissa contestada nesse artigo. O estudo bibliográfico qualitativo realizado analisa as características e a trajetória do constitucionalismo liberal, alguns traços de teorias constitucionais contemporâneas que explicam a expansão do papel do intérprete e da discricionariedade judicial, e a construção de Ran Hirschl sobre juristocracia, com o objetivo de sustentar a hipótese contrária: a de que o tipo de regime político da juristocracia que tem se fortalecido em democracias ocidentais é incompatível com o constitucionalismo liberal e fragiliza as Constituições desses Estados, tornando-as disfuncionais e incapazes de assegurar o equilíbrio de poderes, a defesa de direitos e conter o abuso do poder estatal. Inicia-se com uma abordagem teórico dedutiva com a qual explica-se cenários da juristocracia no estado democrático de Direito para, em seguida, analisar-se as especificidades da emergência da juristocracia no Brasil A conclusão é de que a juristocracia torna as constituições liberais disfuncionais e é um risco para o Estado Democrático de Direito no mundo e também no Brasil. We commonly associate in a virtuous way the expansion of the judiciary, the constitutionalisation of rights and the effectiveness of the democratic rule of law, a premise that is contested in this article. The qualitative bibliographic study carried out analyzes the characteristics and trajectory of liberal constitutionalism, some features of contemporary constitutional theories that explain the expansion of the role of the interpreter and judicial discretion, and the construction of Ran Hirschl on juristocracy, in order to sustain an opposite hypothesis: that the type of political regime of the juristocracy that has been strengthened in western democracies is incompatible with the liberal constitutionalism and weakens their constitutions, making them dysfunctional and incapable of ensuring the balance of powers, the defense of rights and to contain the abuse of state power. The paper starts with a theoretical deductive approach used to analyze some scenarios of juristocracy, then followed by the the exam of some specificities of the emergence of juristocracy in Brazil. The conclusion is that juristocracy makes constitutions dysfunctional and represents a risk for the democratic rule of law in the word and also in Brazil. Se suele asociar de manera virtuosa la expansión del Poder Judicial, la constitucionalización de derechos y la efectividad del Estado Democrático de Derecho, premisa contestada en este artículo. El estudio bibliográfico qualitativo realizado analiza las características y la trayectoria del constitucionalismo liberal, características de teorías constitucionales contemporáneas que explican la expansión del papel del intérprete y de la discrecionalidad judicial, y la construcción de Ran Hirschl sobre la juristocracia, con el objetivo de sostener la hipótesis contraria: la de que el tipo de régimen político de la juristocracia que se ha fortalecido en democracias occidentales es incompatible con el constitucionalismo liberal y fragiliza las Constituciones de esos Estados, haciéndolas disfuncionales e incapaces de asegurar el equilibrio de poderes, la defensa de derechos y contener el abuso del poder estatal. Se partió de un enfoque teórico deductivo con el que se explican escenarios de la juristocracia para luego analizar especificidades de la emergencia de la juristocracia en Brasil. La conclusión es que la juristocracia hace las constituciones disfuncionales y es un riesgo para el Estado Democrático de Derecho en el mundo y también en Brasil.

Admitir essa ligação não significa dizer que as decisões judiciais devam ser pautadas por juízos morais teleológicos ou que seja possível corrigir o Direito pela moral, pois assim estaríamos atentando contra a democracia; contudo, não podemos negar o elemento valorativo que sustenta as respostas corretas. A partir dessa premissa, buscamos no presente trabalho analisar o potencial democrático dos contrapúblicos interpretativos direcionados à concretização dos direitos das mulheres e ao controle dos desvios no discurso de fundamentação das decisões judiciais que, mesmo oriundas de questões de princípio, acabam reproduzindo discursos implícitos estigmatizantes. O principal problema que motiva a pesquisa consiste no seguinte questionamento: de que forma a atuação dinâmica dos movimentos sociais contribui para a renovação reflexiva da tradição na busca de respostas corretas para questões jurídicas, para a desconstrução de assimetrias da esfera pública maior e, por fim, para o controle da fundamentação linguístico-discursiva das decisões judiciais que efetivam direitos das mulheres levando em conta a interseccionalidade? A partir do emprego do método de abordagem fenomenológico-hermenêutico, pretende-se sustentar a seguinte hipótese: o romance em cadeia proposto por Dworkin deve ser desvelado hermeneuticamente na tradição pelos impulsos interpretativos de minorias vulneráveis que se estabelecem de forma dinâmica nos contrapúblicos interpretativos. De modo que sua melhor construção se daria não só a partir do esforço interpretativo dos juízes em criarem discursos fundamentados, mas também quando validam a diminuição das assimetrias sociais, especialmente no tocante às reivindicações interseccionais. Sendo, portanto, os contrapúblicos interpretativos, ao possibilitarem a renovação contínua e democrática da tradição, limites a juízos particularistas e capazes de desconstruir um conjunto de discursos implícitos ínsitos a determinadas decisões judiciais que, apesar de pautadas no dispositivo por argumentos de princípio, de modo a efetivarem direitos, resgatam, em sua maioria, a fundamentação discursiva marcada pelo emprego de argumentos puramente políticos. Para tanto a técnica de pesquisa empregada envolveu a documentação indireta, por meio da pesquisa bibliográfica em livros, em artigos científicos e em capítulos de livros que contemplam o marco teórico de Ronald Dworkin, de Nancy Fraser e de doutrinadores que compõem o movimento acadêmico denominado como Constitucionalismo Democrático, com a finalidade de adotar como marco teórico as contribuições do Constitucionalismo Democrático-Paritário de Bunchaft. Finalmente, a fim de demonstrar a aplicabilidade da contrapublicidade interpretativa, usamos como exemplo privilegiado a análise crítica da argumentação empregada pelos Ministros Luis Roberto Barroso e Rosa Weber no HC 124.306. We can’t deny the political face of the law. Admitting this connection doesn’t mean saying that judicial decisions must be guided by moral theological judgements or that is possible to correct the law by moral, because this way we would be attacking the democracy. However, we can’t deny the value element that sustains the correct answers. From this premise, we seek in this paper to analyze the democratic potential of interpretive counterpublics aimed at the realization of the women’s rights and the control of deviations on substantiation speeches of judicial decisions that, even from principle matters, end up reproducing implicit stigmatizing discourses. The main problem that motivates the research consists in the following questioning: how the dynamic action of social movements contributes to the reflexive renovation/renewal of tradition in the search for correct answers to juridical questions, to the deconstruction of asymmetries in the larger public sphere and, finally, to the control of the linguistic-discursive basis of judicial decisions that enforce women’s rights taking into account intersectionality? From the use of the phenomenological-hermeneutic method, the intention is to sustain the following hypothesis: the chain-novel proposed by Dworkin must be hermeneutically unveiled in the tradition by the interpretative impulses of vulnerable minorities that are established dynamically in the interpretative counterpublics. So that his best construction would be given not only from the interpretative effort of the judges in create sustained speeches, but also when they validate the decline of social asymmetries, especially regarding intersectional claims. Therefore, the interpretive counterpublics, by making possible the continuous and democratic renewal of tradition, are limits to particularist judgements and capable of deconstructing a set of implicit discourses inherent to certain judicial decisions that, although based by principal arguments, in order to enforce rights, mostly recover the discursive foundation marked by the use of purely political arguments. To that end, the research technique employed involved indirect documentation, through bibliographic research in books, scientific articles and book chapters that contemplate the theoretical framework of Ronald Dworkin, Nancy Fraser and of indoctrinators that compose the academic movement denominated as Democratic Constitutionalism, with the purpose of adopting the theoretical framework the contributions of Bunchaft’s Democratic-Parity Constitutionalism. Finally, in order to demonstrate the applicability of interpretive counter-publicity, we use as prime example the critical analysis of the arguments used by Ministers Luís Roberto Barroso and Rosa Weber in HC 124.306.

In a phenomenon that is recognized as a world trend, there is an increasingly pronounced intervention of the Judiciary in the formatting of State directives. In Brazil it is no different. The brazilian Judiciary, especially its supreme court, the Federal Supreme Court, has gradually increased its importance in the national institutional setting, from a power erased in the authoritarian period of the military regime, to a position of centrality in the current Brazilian institutional life, after redemocratization, and almost three decades of the Federal Constitution of 1988. The present study has as its object the current role of the Brazilian Judiciary, which does not only subsume the notion of the "negative legislator", acting as active coparticipant in the construction / creation of the right, the legitimacy and possibility of rationalization of this new function, which is not adequate to the classic tripartition of Powers idealized by the exegetical positivism. In order to do so, we analyzed the factors that allowed the expansion of Judiciary power, as well as the existence or not of judicial discretion in law, admitting that there are situations in which the order does not provide a precise answer, the law is " unfinished, "narrowing the boundaries between the creation and interpretation of the standard and making the interpreter an active participant in the process of building the legal response. Therefore, recognizing that in certain situations it is not acceptable that there is a penalization of society due to the dysfunctional context of the political system, this paper aims to propose criteria of legitimacy to avoid that the exercise of the representative function of the Judiciary Power promotes openness to decisions endowed with arbiters and personal preferences of the judges, the decisionism, with deleterious effects to the democratic regime and to the Law itself. In order to do so, he carried out a bibliographical research on the thematic "judicial decision theories" in Brazilian and foreign authors, confronting them with decisions selected by the Federal Supreme Court in the last decade. Nenhuma Em um fenômeno que se reconhece como tendência mundial, verifica-se a intervenção, cada vez mais acentuada, do Poder Judiciário na formatação dos direcionamentos do Estado. No Brasil não é diferente. O Judiciário brasileiro, em especial seu órgão de cúpula, o Supremo Tribunal Federal, vem gradualmente aumentando sua importância no cenário institucional nacional, de um Poder apagado no período autoritário do regime militar, para uma posição de centralidade na vida institucional brasileira atual, após a redemocratização e quase três décadas da Constituição Federal de 1988. O presente estudo tem por objeto o atual papel do Judiciário brasileiro, que não se subsome apenas à noção do “legislador negativo”, atuando como coparticipante ativo na construção/criação do direito, perquirindo-se a legitimidade e possibilidade de racionalização dessa nova função, que não se adequa à clássica tripartição de Poderes idealizada pelo positivismo exegético. Para tanto, foram analisados os fatores que possibilitaram a expansão de poder do Judiciário, bem como a existência ou não de uma discricionariedade judicial no direito, admitindo que há situações nas quais o ordenamento posto não fornece uma resposta precisa, o direito encontra-se “inacabado”, diluindo-se as fronteiras entre criação e interpretação da norma e tornando o intérprete um participante ativo no processo de construção da resposta jurídica. Sendo assim, reconhecendo que em certas situações não é aceitável que haja uma penalização da sociedade em razão do contexto de disfuncionalidade do sistema político, o presente trabalho visa propor critérios de legitimidade para evitar que o exercício da função representativa do Poder Judiciário promova abertura a decisões dotadas de arbítrio e preferências pessoais dos juízes, o decisionismo, com efeitos deletérios ao regime democrático e ao próprio Direito. Para tanto, realizou pesquisa bibliográfica acerca da temática “teorias da decisão judicial” em autores brasileiros e estrangeiros, confrontando-as com decisões selecionadas do Supremo Tribunal Federal na última década.

As the only American attorneys charged with seeking justice, prosecutors play an important role and carry a unique burden in the justice system. In the United States, prosecutors are administrators of justice, representing a sovereign whose interest “is not that it shall win a case, but that justice shall be done.” This article describes the discretion afforded to American prosecutors--which includes deciding whether to initiate cases against defendants, dismiss charges, enter into plea agreements, or go to trial--and outlines the ethical rules and cases that guide and govern the exercise of that discretion.

The partial import of the north-american precedents system by the new Code of Civil Procedure brought important consequences in the model of interpretation and application of the rules in the Brazilian legal system. Based on legal and doctrinal examination of the matter in comparative law, this research seeks to present a historical overview of the common law and Roman-Germanic family, examine the precedent system in Brazilian law and criticize the simple import of those tolls, identifying the parameters of the Scandinavian and North American legal realism, as well as the risks of decisionism and judicial arbitrariness ., A importação parcial do sistema de precedentes norte-americano pelo novo Código de Processo Civil trouxe consequências importantes no modelo de interpretação e aplicação das normas no ordenamento jurídico brasileiro. Com base em exame legal e doutrinário sobre a matéria no direito comparado, a pesquisa apresentar uma visão histórica do common law e da família romano-germânica, examinar o sistema de precedentes no direito brasileiro e criticar a importação pura e simples do instrumento, identificando-se os parâmetros do realismo jurídico escandinavo e norte-americano, bem como os riscos decorrentes do decisionismo e da arbitrariedade judiciais.

This article discusses the problem of femicide, emphasizing its bond with the cycle of domestic violence against women. The denial and underuse of the institutes stated in the Law Maria da Penha is the consequence of a traditional legal culture that deals this problem as a private issue and faces this kind of violence with a consensual paradigm of justice. In this essay, we will analyze the judgments by the Brazilian Supreme Court in ADC nº 19/DF and ADI nº 4424/DF, and the resistances of courts in following this settled jurisprudence., Este artigo aborda o problema do feminicídio íntimo, destacando sua relação com o ciclo de violência doméstica e familiar contra a mulher. Identifica-se a negação ou subutilização dos institutos previstos na Lei Maria da Penha, em razão da cultura jurídica tradicional de tratamento da matéria sob a ótica privada e de aplicação do paradigma de justiça consensual a essa forma de violência. Serão analisados os acórdãos da Ação Declaratória de Constitucionalidade nº. 19/DF e da Ação Direta de Inconstitucionalidade nº. 4424/DF, bem como a resistência dos magistrados em observar o entendimento proferido nas referidas ações de controle concentrado de constitucionalidade.

The study aims to screen, in tracing the horizon in "Measure for Measure" by Shakespeare, develop a critique of legal positivism and judicial discretion, with the case study basis, consistent in the reasons released by the Court of Rio Grande do Sul if referring to the son in law that kills the father and want the right to sharecropping inheritance. The theoretical framework of the paper is the hermeneutical philosophy and philosophical hermeneutics (Heidegger/Gadamer), the Law as Integrity (Dworkin) and Critical Hermeneutics of law (Streck), in a (required) approach between Law and Literature for production constitutionally appropriate decisions., O estudo em tela pretende, no horizonte traçado em Medida por Medida, de Shakespeare, desenvolver uma crítica ao positivismo jurídico e à discricionariedade judicial, tendo por base estudo de caso, consistente na fundamentação lançada pelo Tribunal de Justiça do Rio Grande do Sul em caso referente ao genro que mata o sogro e que pretende o direito à meação da herança. O referencial teórico do artigo consiste na filosofia hermenêutica e na hermenêutica filosófica (Heidegger/Gadamer), no Direito como Integridade (Dworkin) e na Crítica Hermenêutica do Direito (Streck), em uma (necessária) aproximação entre o Direito e a Literatura para a produção de decisões constitucionalmente adequadas.

Portanto, não deve o juiz, ao tomar suas decisões, intuir de forma parcial ou discricionária, já que não se trata puramente de um ato de escolha: decidir exige verdadeiro compromisso constitucional. Todavia, hodiernamente no Brasil, o que se constata é a recepção de teorias estrangeiras cujos elementos e técnicas enfatizam a discricionariedade judicial - dentre as quais, a teoria da argumentação jurídica de Robert Alexy e sua técnica da ponderação em caso de colisão entre direitos fundamentais. Faz-se necessário então analisar as origens de tal princípio em seu ambiente jusfilosófico de formação - qual seja, a jurisprudência dos valores - para enfim verificar os principais elementos que a constituem. Ademais, se apura a incorporação da teoria no Direito brasileiro por sua constante presença nas mais diversas obras jurídicas nacionais - sobretudo em sede de Direito Constitucional - observando a menção recorrente aos elementos alexyanos nos julgados do Supremo Tribunal Federal (STF). Em razão da alta carga de discricionariedade vinculada à teoria, tais posturas doutrinárias e jurisprudências devem ser combatidas. Como instrumento para o enfrentamento do problema da discricionariedade judicial, escolheu-se a proposta a Teoria da Decisão Judicial, de Lenio Luiz Streck. The importance about decide in a Law Democratic State are associated with the perfect notion about difference between choosing and deciding, according to Lenio Streck. Torendertheir decisions the judge can’t actpartially, discretion. Because judgingisnotan actof choice, to deciderequires a real constitutional commitment. However, at present, there is in Brasil the introductionof international theory that whose elementsand techniques highlights the judicial discretion.Including the “teoria da Argumentação Jurídica” os Robert Alexy, and the technique of weighting, when happen the collision between fundamental rights.It’s necessary to analyze the origin of this theory in their legal and philosophical environment, namely, the jurisprudence of values in Germany, and and their evidence to conclude it was inadequate to Brazilian law.It is possible to observe the incorporation of this theoryin Brazilian Law for his constant presencein several national legal works, especially inconstitutional lawbooks, and the jurisprudence of the Supreme Court. Because of the high burden of discretion linked to this theorythis attitudemust be fought. Like a way ofcopingagainstjudicial discretion it is proposed the “theory ofjudicial decision” of Lenio Luiz Streck.
