В статье рассматриваются формы исламской государственности в ХХ веке, их становление и развитие. Государственно-правовая система исламских государств сталкивается с новыми вызовами и проблемами, вытекающими из процесса стремительного освоения международного пространства. Конечно, как правительства всех стран должны быть готовы ответить на подобные вызовы, так и исламские государства должны действовать в этом направлении в соответствии с современными требованиями. The subject. The article investigates historical legal, theoretical-methodological and constitutional-legal problems of the formation and functioning of the institute of the head of state.The purpose of the study is to show how the constitutional functions of the head of state concretize his powers.The study is based on the use of methods of analysis and synthesis, historical legal, formal legal, comparative legal methods, scientific abstraction.The main scientific results. The authors summarize that the historical and legal analysis shows the key role of the head of state in the mechanism of ensuring state unity and law and order. Reality testifies the fact that the role of the President of the Russian Federation creates sufficient constitutional and legal grounds and conditions for the consolidated work of all state authorities, including law enforcement agencies, in the direction of ensuring the unity of state power and constitutional law and order. The indicated directions are in many ways identical, organically interrelated and interdependent, systematically define the main lines of activity of the head of state, contributing to the improvement of the constitutional and legal mechanism for ensuring the rule of law in general. Firstly, the Constitution of the Russian Federation contains only the basic powers of the President of the Russian Federation, which are substantially expanded by the legislator and presidential decrees. Secondly, the President has so-called “hidden”, discretionary powers that are not directly enshrined in the Constitution of the Russian Federation, implicit in it and stem from the sense of presidential functions that manifest themselves in unforeseen extraordinary circumstances. Thus, the constitutional design of a strong presidential power allows the President of the Russian Federation to ensure the unity of the executive power and the exercise of the powers of the federal government throughout the territory of Russia (pt. 4 of Art. 78 of the Constitution of the Russian Federation). Such presidential power is carried out through the issuance of its decrees and orders, the adoption of operational and administrative decisions.Conclusions. The authors noted that the effectiveness of the work of the head of state is especially evident in the state unity and the constitutional and legal mechanism for ensuring the rule of law, which is developed in the constitutional doctrine.

This paper is devoted to the study of political regime types, their classification criteria and development prospects. Tasks that were solved in the course of the study: 7. Consider the concept of a political regime. 8. Study the criteria for classifying political regimes. 9. Investigate the classification of political regimes. 10. Analyze the history and types of hybrid political regimes. 11. To reveal the prospects of hybrid political regimes in the political system. 12. Based on the methodology of the “Cambridge School of the History of Concepts” presented by Kv. Skinner and J. Pocock, investigate in detail the “linguistic” contexts of Russian political culture. In conclusion, the author, based on the analysis of communicative spheres, comes to the conclusion about the possible absence in Shishkov’s works of reception of European glossaries on the forms of government (Aristotle and C.-L. Выпускная квалификационная работа посвящена изучению вопроса развития монархической формы правления в XXI-ом веке. Объектом изучения служит влияние монархической формы правления как способа организации государственной власти на общественные отношения в современных странах мира. Предметом исследования являются тенденции развития монархической формы правления в XXI-го веке. Цель дипломной работы – обозначить основные тенденции изменения правовой сущности монархии в условиях глобализации. Для достижения поставленной цели необходимо было выполнить следующие задачи исследования: конкретизировать правовой смысл понятия «монархия», выявить в исторически сложившихся монархиях правовой аспект, провести ретроспективный анализ по итогу XX-го века, выявить геополитические пределы современных монархий. Методологическую базу исследования составляют синтез, анализ, сравнительно-правовой метод, статистический метод, а также эмпирические способы познания. The object of study is the influence of the monarchical form of government as a way of organizing state power on public relations in modern countries of the world. The subject of the research is the trends in the development of the monarchical form of government in the XXI century. The purpose of the thesis is to identify the main trends in changing the legal essence of the monarchy in the context of globalization. To achieve this goal, it was necessary to perform the following research tasks: to specify the legal meaning of the concept of "monarchy", to identify the legal aspect in historically established monarchies, to conduct a retrospective analysis of the results of the XX century, to identify the geopolitical limits of modern monarchies. The methodological basis of the research consists of synthesis, analysis, comparative legal method, statistical method, as well as empirical methods of knowledge. In the course of writing the work, the concept of monarchy was defined, the stages of historical and legal development of this form of government were identified, and a retrospective analysis of the development of the monarchy was conducted on the example of the XX century. The author studies the issue of the geopolitical limits of the monarchy, defines the stages of changing the form of government and the contradictory nature of the monarchy in the context of globalization processes.

Автор статьи анализирует философское наследие Ш.Л. де Монтескье, останавливаясь на характеристике права собственности, законах о торговле, экономических правах граждан государства, раскрывая их особенности в зависимости от принципа и природы правления. При этом в тексте научной статьи обосновывается особое значение общественного договора, который, по мнению французского мыслителя, представляет собой соглашение, которое заключается не между членами общества для создания государства, а представляет собой основанную на духе народа договоренность о создании положительных законов, регулирующих взаимных права и обязанности между обществом и правителем. Заслуживает пристального внимания тезис просветителя о том, что значение торговли заключается в том, что она влияет на развитие промышленности в государстве, имея целью достижение роскоши, а для создания предметов роскоши в необходимом количестве для ведения торговой деятельности необходимо для развития сначала ремесленного, а затем и промышленного производства. At the same time the special value of the public contract which, according to the French thinker, represents the agreement which is concluded not between members of society for creation of the state is proved in the text of the scientific article, and represents the arrangement on creation of the positive laws regulating mutual the rights and duties between society and the governor based on spirit of the people. The thesis of the educator that the value of trade is that it influences development of the industry in the state deserves close attention, aiming at achievement of luxury, and for creation of luxury goods in necessary quantity for conducting trade activity it is necessary for development at first of craft, and then and industrial production. Montesquieus reasonings on essence of money and their value in development of the states with various nature and the principles of board have the special importance, the philosopher allocates three types of cost, paying special attention to the bill right. Введение. Актуальность статьи обусловлена существованием пробела в исследовании собственности и государства как единого системного отношения. Цель. Автор ставит перед собой цель показать, что каждый способ организации собственности частный, смешанный (корпоративный), общий (коллективный) потенциально стимулирует существование определённой структуры государства. Методология. Используется авторская методология исследования государства нормативный структурализм, где собственность как основная системообразующая цель существования государства генетически предопределяет принципы нормирования его структуры. Каждый способ организации собственности в условиях конкретного социального времени может приобретать качество основного системообразующего в организации структуры государства. Каждый способ организации собственности осуществляет соответствующую социальную функцию: частный способ организации собственности функцию социального развития смешанный (корпоративный) функцию социального компромисса (конвергенции) общий (коллективный) функцию социального обеспечения в самом широком смысле. Если частный способ организации собственности генетически запрограммирован на производство и воспроизводство социальной конкуренции, то смешанный (корпоративный) и общий (коллективный) детерминированы идеей её ограничения и нивелирования. Частный способ организации собственности, приобретая значение основного системообразующего, начинает всемерно стимулировать существование демократической структуры организации государства. В свою очередь, смешанный (корпоративный) и общий (коллективный) способы организации собственности, приобретая качество основных системообразующих, стимулируют существование широкого структурного диапазона функционирования государства: от различных режимов демократической ориентации до конкретных недемократических режимов. Результаты. Позиционируется теоретическая концепция авторской методологии нормативного структурализма, исследующая собственность как основную системообразующую цель существования государства. Заключение. Исследование собственности как основной системообразующей цели существования государства под углом зрения нормативного структурализма позволяет расширить спектр инструментальных средств изучения российской государственности с проведения её первой капиталистической индустриализации., Introduction. The purpose of the article is to show that each way of organizing property private, mixed (corporate), common (collective) potentially stimulates the existence of a certain structure of the state. Methodology. The author uses his own research methodology of the state normative structuralism, where property as the main systemforming goal of the state existence genetically predetermines principles of rationing its structure. Each way of organizing property in a particular social time period can acquire the quality of the main backbone in the organization structure of the state. Each way of organizing property provides a proper social function: private way of organizing property performs the function of social development mixed (corporate) way performs the function of social compromise (convergence) general (collective) way performs the function of social security in its broadest sense. If private way of organizing property is genetically programmed for the production and reproduction of social competition, mixed (corporate) and common (collective) ways of organizing property are determined by the idea of its limitation and leveling. Private way of organizing property, acquiring the value of the main systemforming one, begins to fully stimulate the existence of a democratic structure of state organization. In turn, mixed (corporate) and common (collective) ways of organizing property, acquiring the quality of the main systemforming ones, stimulate the existence of a wide structural range of state functioning: from various regimes of democratic orientation to specific nondemocratic regimes. Results. The article presents the theoretical concept of the authors methodology normative structuralism, it explores property as the main systemforming goal of the state existence. Conclusion. В статье проанализированы основные идеи по классификации форм государственного правления. Из эпохи Древней Греции приведены правовые учения Платона и Аристотеля. Юридическая мысль XVI–XIX вв. о проблематике классификации формы правления представлена работами Ж. Бодена, Ш. Л. Монтескьё и Т. Пейна. Кроме того, проанализированы наиболее интересные концепции разграничения форм правления российских исследователей, таких как И. А. Ильин, С. В. Пушкарев, А. И. Черкасов, Д. А. Авдеев. В заключение статьи сделан вывод о необходимости отказа от бинарного подхода в делении форм государственного правления и необходимости дальнейшего изучения монократии и поликратии., In this article, the main ideas on the classification of forms of state government are analyzed. В данной работе рассматривается федеративное устройство России, какие практические и теоретические проблемы возникали в ходе становления российского государства. Федерация как форма государственного устройства - представляет собой сложное, составное, состоящее из нескольких государств или государственно подобных образований, обладающими признаками государственности, суверенное государство, власть которого исходит от отдельных его членов, связанных в одно государственное целое. В ходе работы была рассмотрена история создания федеративного государства в России. Раскрыты конституционные принципы федеративного устройства Российской Федерации. Рассмотрены коллизии между центральными органами государственной власти и органами государственной власти на местах. И ко всему прочему рассмотрены ряд проблем и споров, существующих по поводу федеративного устройства России на различных исторических этапах. Необходимо отметить, что федерализм выступает как единственно возможная форма демократического управления столь обширным государством. Можно сделать выводы, что особенностью России на ее нынешнем этапе развития является то, что федерализм переживает переходный период, обретая демократические формы в сложных экономических и политических условиях, и прежде всего обострения этнических отношений. Также в работе дано определение и признаки федерации, как формы государственного устройства. During work the history of creation of a federal state in Russia has been considered. The constitutional principles of the federal device of the Russian Federation are opened. Collisions between the central public authorities and public authorities on places are considered. And to all other a number of the problems and disputes existing concerning the federal device of Russia at various historical stages are considered. It should be noted that the federalism acts as the unique form of democratic management of so extensive state. It is possible to draw conclusions that feature of Russia at her present stage of development is that the federalism endures a transition period, taking democratic shape in difficult economic and political conditions, and first of all aggravations of the ethnic relations. Also in work definition and signs of federation as forms of government is given. Depending on understanding of federation as forms of the state idea of the state and appointment him in society in general is also formed.

The article deals with the issue of the exclusive social status, which was granted to the Russian nobility in the 18th century, in the context of transformations of Russian elite’s perception of the state and society. The adaptation of the European glossary of forms of rule in 18th century Russia contributed to the formation of a secular vision, in which the power of the state was determined by a set of social factors. Thus, the contribution of the nobility as a social group to the power of monarchy, the ‘common good’, became the key argument in favor of the nobility’s exclusive status since the mid-18th century. However, the analysis of the debates in the Legislative Commission of 1767–1768 allows the author to conclude that such a transformation was experienced mostly by the narrow group of administrative and court elite. Therefore, the exclusive status of the nobility was not a result of pressure from the consolidate noble social group, but a result of a transformation in the Russian elite’s vision of the role and place of the nobility in the Russian Empire., В статье рассматривается вопрос о наделении российского дворянства XVIII в. исключительным социальным статусом в контексте изменения представлений российской элиты о государстве и обществе. Адаптация европейского глоссария форм правления сформировала в XVIII в. секулярную перспективу, в которой мощь государства определялась набором социальных факторов. В данной связи ключевым аргументом в пользу исключительного статуса дворянства с середины XVIII в. стал вклад данной социальной группы в поддержание могущества монархии – дворянское «усердие» в службе на «общее благо». При этом анализ дебатов в Уложенной комиссии 1767–1768 гг. позволяет утверждать, что трансформация представлений о роли и месте дворянства в государстве коснулась относительно узкого слоя административно-придворной элиты. Таким образом, наделение дворянства исключительным статусом оказалось не итогом давления со стороны консолидированного дворянства, но результатом изменений в представлениях российской элиты о роли и месте дворянства в Российской империи.

В статье подробно исследуется форма правления Республики Южная Осетия. Автор относит Южную Осетию к категории «спорных государств». Путем анализа положений Конституции делается вывод о том, что форма правления данного государства является атипичной. Кроме того, форма правления Южной Осетии сравнивается с формой правления «патрона» данного государства – Российской Федерации. Делается вывод о схожести форм правления двух государств., This article explores in detail the form of government of the Republic of South Ossetia. В статье рассматривается вопрос о наделении российского дворянства XVIII в. исключительным социальным статусом в контексте изменения представлений российской элиты о государстве и обществе. Адаптация европейского глоссария форм правления сформировала в XVIII в. секулярную перспективу, в которой мощь государства определялась набором социальных факторов. В данной связи ключевым аргументом в пользу исключительного статуса дворянства с середины XVIII в. стал вклад данной социальной группы в поддержание могущества монархии — дворянское «усердие» в службе на «общее благо». При этом анализ дебатов в Уложенной комиссии 1767–1768 гг. позволяет утверждать, что трансформация представлений о роли и месте дворянства в государстве коснулась относительно узкого слоя административно-придворной элиты. Таким образом, наделение дворянства исключительным статусом оказалось не итогом давления со стороны консолидированного дворянства, но результатом изменений в представлениях российской элиты о роли и месте дворянства в Российской империи. The article deals with the issue of the exclusive social status, which was granted to the Russian nobility in the 18th century, in the context of transformations of Russian elite’s perception of the state and society. The adaptation of the European glossary of forms of rule in 18th century Russia contributed to the formation of a secular vision, in which the power of the state was determined by a set of social factors. Thus, the contribution of the nobility as a social group to the power of monarchy, the ‘common good’, became the key argument in favor of the nobility’s exclusive status since the mid-18th century. However, the analysis of the debates in the Legislative Commission of 1767–1768 allows the author to conclude that such a transformation was experienced mostly by the narrow group of administrative and court elite. Therefore, the exclusive status of the nobility was not a result of pressure from the consolidate noble social group, but a result of a transformation in the Russian elite’s vision of the role and place of the nobility in the Russian Empire. На основе сравнительно-правового анализа Конституции России и Казахстана, нормативных правовых актов, регулирующих конституционно-правовые отношения и исследования, взглядов ученых по данной теме рассмотрено влияние формы государственного устройства на конституционное законодательство государства, сделан вывод о значении конституции в формировании конституционного законодательства., On the basis of comparative legal analysis of the Kazakhstan Constitution, the Constitutions and charters of subjects of the Russian Federation, normative legal acts regulating the constitutional-legal relations and research of the views of scientists on this topic, the impact of government form on the constitutional law of a state was examine; a conclusion was made about the significance of the Constitution in shaping the constitutional law.

В данной научной статье освещаются вопросы типологии государства. В результате анализа научной литературы определено значение «государства» и его типы – формационный и цивилизационный, проведена классификация типологии государства по различным признакам. Статья раскрывает и подчеркивает важность дальнейшего изучения данного вопроса, так как от степени познания указанной темы зависит эффективность функционирования городов, регионов, областей и всего государства. This scientific article highlights the questions of typology of the state. The world today is comprised of many types of states. The contemporary security environment features many more state actors than it did a century ago. Not only are there more states, but there are also many more types of states, many of which can be classified. An analysis of the scientific literature value defined "state" and its types - formation and civilization, the classification of the typology of the state on various grounds. Governments can be classified into several types. The author considers some of the more common types of governments in this paper. The article reveals and emphasizes the importance of further study of this issue because the degree of cognition the specified theme depends on efficiency of functioning of cities, regions, provinces and the entire state.
