Law 12/2012, of 26 December, recently implemented by Royal Decree 33/2014, of 24 January, has included in the Spanish legal system a contracting mechanism between Governments in the field of defence. It is a mechanism by which a foreign Government can entrust the Spanish Government, through the Ministry of Defence, to carry out all the necessary actions or measures in order to be supplied or provided with certain equipment or technology of defence by enterprises with Spanish basis. The Draft Law on contracts of the Public Sector in the fields of Defence and Security which transposes Directive 2009/81/EC of the European Parliament and of the Council of 13 July 2009 on the coordination of procedures for the award of certain works contracts, supply contracts and service contracts by contracting authorities or entities in the fields of defence and security, and amending Directives 2004/17/EC and 2004/18/EC, brings the Defence Package, partially, into national Law. The basic new features introduced by the Directive and included in the draft law (in its current version) are linked to the singularity of the Defence and Security sectors, and referred to the requirement of some undertakings in relation to security of information, security of supply and transparency in the subcontracting process; it further provides some flexibility in the procurement process, as well as in some of the consequences of nullity.
