Rationalist natural law brought a new philosophy to the ethical, political and legal thought of the seventeenth and eighteenth centuries. In this paper I examine the incidence of iusrationalism in coding. The principles and methods of natural law, taken from the natural sciences, will mark the new science of legislation. Attention shifts from medieval political voluntarism to enlightened legal individualism. I review the contributions of the main representatives of the school of natural law to the elaboration of the codes. The meeting between natural law, based on faith in human reason to know, and the political program of the Enlightenment bequeathed a way of doing and thinking about the law of which we are still heirs today. After selecting some key theses from Finnis's Natural Law and Natural Rights, the author's acceptance of «Hume's law» is critically analyzed, and also the resulting separation between practical reason and speculative reason and the lack of distinction between the speculative level proper to moral philosophy and the practical level proper to individual decision, the thesis of knowledge of human nature from the principles of practical reason, and the attempt to reduce human nature to rationality, as the foundation of natural law; the insufficient explanation of moral obligation by the demands of the common good, and of the existence of intrinsically evil acts, the denial of a single ultimate end for all men, the denial of the moral character of the first principle of practical reason, and the reduction of the thesis of the divine foundation of moral obligation to mere voluntarism. The present article tries to show and to demonstrate the influence of the late-medieval voluntarism -both in its escotic version and mainly in the ockhamist- in the modern political and juridical philosophy. Part exposing in synthetic form the fundamental principles of Ockham's philosophy to later analyze some of its consequences, among which the contingentism of law and methodological individualism stand out. The author analyses how the protagonists of the French Revolution reflected on the events of 1789, and finds that this revolutionary philosophy is fraught with tension. For instance, it expresses contrary judgments about the previous contributions of the "philosophes." In addition, the impetus of events and the compulsion to carry forward the revolution call for an examination of the conflict between law and customs, the relationship between leaders and the populace, the appeal to violence, and the justification of the revolutionary act. This article studies the assimilation, in the cosmology of Thomas Aquinas, of the necessitarianism of Aristotle's physics. It analyzes the rejection of determinism by Aquinas regarding the mode of action of the first principle, and his acceptance of the Aristotelian theory of natural regularity and necessary causal concatenation of second agents as a sufficient explanation of physical dynamism. It also highlights Aquinas' defense of the autonomous character of nature with regard to its procedural aspects, as it is capable of self-preservation due to the formal structure with which it has been created, and his limitation of divine intervention and tutelage regarding the maintenance of the physical order. This article provides a comprehensive study of the works of Francisco de Vitoria in order to indicate the intermediate position of the author between voluntarism and intellectualism, as well as, highlight the originality of his thought.
