The article discloses topical issues of state’s military policy formation and implementation with the goal of ensuring law and order as well as administration of justice in the field of defence as components of the general system of ensuring national security in this area. An analysis, which is based on the experience of NATO member states and relevant international standards, provides grounds for the conclusion about the integrated connection and systemic interaction of military policy with law enforcement activities, maintenance of law and order, and administration of justice in the Armed Forces and other military formations formed in accordance with the laws of Ukraine, which is due to the common goal of ensuring military security. Both legal and institutional solution to the problem of development of the military justice system of Ukraine is proposed, in the context of state’s military policy formation and implementation with the definition of the relevant tasks and authority of the Ministry of Defence of Ukraine., У статті розкрито актуальні питання формування та реалізації воєнної політики держави в напрямі забезпечення правопорядку, здійснення правосуддя у сфері оборони як складових загальної системи забезпечення національної безпеки в цій сфері. Проведений на основі використання досвіду держав – членів НАТО і відповідних міжнародних стандартів аналіз дає підстави для висновку про органічний зв’язок та системну взаємодію воєнної політики з правоохоронною діяльністю, підтриманням правопорядку, здійсненням правосуддя у Збройних Силах, інших утворених відповідно до законів України військових формуваннях, що зумовлено спільною метою забезпечення воєнної безпеки. Запропоновано нормативно-правове та інституційне розв’язання проблеми створення системи військової юстиції України в контексті формування та реалізації воєнної політики держави з визначенням відповідних завдань і повноважень Міністерства оборони України.

Актуальність дослідження зумовлена важливістю вирішення питань стосовно захисту прав , свобод та інтересів військовослужбовців, прав та інтересів військових частин, установ і організацій ЗСУ та інших, утворених відповідно до закону військових формувань компетентним судом. Крім того її важливість викликана необхідністю систематизувати раніше набутий досвід, а також здобутки діяльності поспішно ліквідованих військових судів в Україні й використати їх можливості для правового захисту осіб, котрі проходять військову службу. Військові суди здійснюють правосуддя не тільки у Збройних Силах, а й в інших військових формуваннях – Службі безпеки, Державній прикордонній службі, Нацгвардії, МНС України, Державній службі охорони.

This chapter takes a close look into the United States’ 9/11 military commission trials in the light of the ‘Decaux Principles’ of 2006 concerning the legal framework for the proper administration of justice by military tribunals. The first section presents the legal framework of the military commissions, and the second section discusses the procedure of the 9/11 trial and its actual functioning. One of the lessons that can be learnt from this more than 18 year long Guantanamo Bay experiment is that justice and military operations are two distinct matters: the two involve different sets of goals, actors, and modes of operation. Attempting to hybridize them is therefore not desirable. Opting for ordinary civilian courts as the prevailing jurisdiction responsible for the prosecution of persons accused of terrorism is, in most cases, the better option – maybe only option – for handling justice.

The African Commission on Human and Peoples' Rights was established to protect and promote human and peoples' rights on the African continent. This mandate extends to protecting and promoting human rights in the administration of justice by all organs that exercise judicial power, including military courts. In the execution of its mandate the African Commission has developed important jurisprudence on different aspects concerning the administration of justice by military courts. In this jurisprudence, the African Commission has expounded on what constitutes a violation of the African Charter on Human and Peoples' Rights and how military courts should administer justice in a manner that conforms to internationally-agreed standards, especially those relating to the right to a fair trial. Through desk review, the contribution appraises this jurisprudence. In analysing this jurisprudence, the article tries to draw a comparison, especially with the jurisprudence of the Human Rights Committee and other UN-established initiatives. It is argued that although the African Commission has done fairly well in interpreting the relevant provisions of the African Charter and in laying down principles and rules that should be followed by military courts in administering justice, there is still much the Commission can do to improve the administration of justice through military courts in Africa.

This paper analyzes the role of military courts in the strategy of repression, the planning and implementation of a policy of extermination, which was carried out by the military coup and the dictatorship of Franco. Still pending is the full legal rehabilitation of all victims of the dictatorship. The response of the Spanish State should proclaim the legal annulment of all the varied sentences dictated via the penal processes of Franco’s courts, and imposed upon Spanish Republicans and Democrats; i.e. the reparation demanded of Spanish State by International Treaties. Este trabajo analiza el papel de la jurisdicción militar en la estrategia de represión, de planificación y ejecución de una política de exterminio, llevada a cabo por el golpe militar y la dictadura de Franco. Aún está pendiente la plena rehabilitación jurídica de todas las víctimas del franquismo. La respuesta del Estado debe consistir en proclamar legalmente la anulación de las sentencias dictadas en los procesos penales de los tribunales franquistas a través de los que se impusieron condenas de toda clase a los republicanos y demócratas españoles. En definitiva, la reparación que los Tratados internacionales exigen al Estado español.

CHDS State/Local The advancement and access of technology by terrorism subjects who plan and operate from under-governed or lawless lands has forced the U.S. to consider the demands the international threat environment places upon its security. More importantly is how the U.S. will adapt to meet these threats, prevent attacks and convict those who mean to do the nation harm. This thesis contends the modern day terrorism threat falls within the seams of the military, intelligence and law enforcement disciplines. The threat requires the fusion of these elements of national power to prevent attacks, collect vital intelligence and facilitate the use of key evidence to achieve substantive convictions. In order to achieve convictions the need for damming evidence is essential. However, with the fusion of the military, intelligence and law enforcement disciplines comes the problem of utilizing classified information as evidence to achieve end game convictions of capture terrorist subjects.
