La legge della fiducia. Alle radici del diritto, constituye una propuesta de comprensión del Derecho y, al mismo tiempo, una invitación a la reflexión sobre su significado y sentido. En estas breves reflexiones se abordan algunas de las cuestiones sobre las que el libro te invita a reflexionar y se plantean algunas dudas que suscita la propuesta de Tommaso Greco.

El presente trabajo da cuenta del significado de los ajustes de procedimiento, mencionados en el artículo 13 de la Convención sobre los Derechos de Las Personas con Discapacidad. Se trata de uno de los contenidos del debido proceso y que se incluyen dentro del derecho a la accesibilidad. Como se puede realizar una transicion ecologica justa? ?Como se puede pasar a una economia verde sin perjudicar a los trabajadores? Para mitigar el aumento de las temperaturas, ?es suficiente con descarbonizar la produccion o hay que plantearse nuevas formas de entender viejos procesos, como el transporte privado, y transformarlos o incluso eliminarlos? ?Es el sistema fiscal espanol adecuado para financiar los gastos de estos procesos?

The philosophy that stands behind a significant number of the regulatory changes underwent by disabilities in the last years is the one duly depicted by the social model of disability. Despite the relevance and appropriateness of the social model approach, when it comes to dealing with disabilities it is not a widely accepted model and it is not without its criticism. The criticism can be divided into two large groups. The first group unfolds from an approach foreign to rights; the second group comes from the inside of the rights discourse. On the other hand, the referents of the social, diversity and identity models, thoroughly discussed in specialized forums and duly embedded in different rules and regulations, have not found yet their application to society. The medical-care approach is mainstream in society. In this paper expose some of the criticisms of the social model and some of the reasons for this limited success

Although there are different theories of human rights, it is possible to point out a series of features present in each and every one of them and that serve to speak of a standard theory of rights. In this paper I describe two different types of challenges that arise to this standard theory of rights. One of them moves into the interior of the theory and questions some of its features. At this point I will refer to the issues of the guarantor, of the freedom-security tension and of universality. The other great challenge questions the validity of human rights as a guide for the treatment of certain problems. At this point I will refer to the movements of people and new technologies. Both challenges, which are a sign of the historical character of human rights, force the discourse of rights to react and try to resolve them, even modifying some of the references that have characterized it., Aunque existen diferentes teorías de los derechos humanos, es posible señalar una serie de rasgos presentes en todas y cada una de ellas y que sirven para hablar de una teoría estándar de los derechos. En este trabajo describo dos tipos de retos diferentes que se plantean a esta teoría estándar de los derechos. Uno de ellos se mueve hacia el interior de la teoría y cuestiona algunos de sus rasgos. En este punto me referiré a las cuestiones del garante, de la tensión libertad-seguridad y de la universalidad. El otro gran reto cuestiona la validez de los derechos humanos como guía para el tratamiento de ciertos problemas. En este punto me referiré a los movimientos de personas y a las nuevas tecnologías. Ambos desafíos, que son una nueva muestra del carácter histórico que poseen los derechos humanos, obligan al discurso de los derechos a reaccionar e intentar resolverlos, aunque sea modificando alguno de los referentes que lo han caracterizado.

Background: The Convention on the Rights of Persons with Disabilities (the CRPD) is the first human rights treaty of the 21st century and the first binding instrument specifically focused on protecting persons with disabilities within the framework of the UN's universal system of human rights. The CRPD came into force on May 3, 2008, and as of December 3, 2016 it has been ratified by 168 states. The CRPD developed the Committee on the Rights of Persons with Disabilities (Article 34) to monitor compliance with the Convention by States Parties. The main role of the Committee is to review the reports (both the initial and the periodic reports) submitted by States Parties pursuant to Article 35 of the CRPD. In accordance with the CRPD Article 35, States Parties are required to submit to the Committee “a comprehensive report on measures taken to give effect to its obligations [under the CRPD] … and on the progress made in that regard” within two years after the entry into force of the present Convention for the State Party concerned, and subsequently they must submit periodic reports every four years “and further whenever the Committee so requests.” Qatar ratified the UNCRPD in May 2008 and is obliged as a signatory nation to implement a number of social and legal measures to become fully compliant. Aim: The aim of this paper is to identify Qatar»s degree of compliance with the CRPD as per the last available CRPD reports. Subsequently, we list recommended actions toward Qatar's compliance with the Convention. Findings and recommendations: On June 19, 2012 Qatar submitted its report to the Committee on its compliance with the Convention. Following review of the Qatar report, the committee made six concluding observations. The six observations made by the Committee on the Rights of Persons with Disabilities on Qatar's compliance with the Convention: The legislation revolves around a medical (treatment) model of disability, in contrast to the convention's call for a social model and the human rights approach. It is necessary to safeguard non-discrimination, adopting the inclusive social model. Accommodation and accessibility are not in line with the Convention. There is an absence of specific legal and policy frameworks to ensure accessibility for persons with disabilities on an equal basis with others, and reasonable accommodation is not sufficiently guaranteed. Lack of consultation and participation of persons with disabilities in the drafting of regulatory policies that affect them. Lack of systematic information. There is no independent internal mechanism to coordinate policy on the rights of persons with disabilities and monitor the implementation of the Convention. The Committee's six concluding observations on the rights of persons with disabilities indicate that Qatar, similar to many other countries, has a long way to go before reaching compliance with the convention. As a first step towards compliance with the Convention, Qatar action regarding the six issues highlighted here is key, and can be as follows: Adopt a social model whereby the state moves beyond the assistance-based approach to the development of actual individual rights enforceable in a court of law, considers disability rights as validity standards, and regards the field of conflict of rights as other rights or fundamental legal interests. Prevent discrimination by adopting an inclusive social model, as well as via adapting both the situation strategy (equality focused on the situation) and the identity strategy (acknowledging the rights of specific persons or groups). Provide accessibility through universal design and reasonable accommodation. Consult and include persons with disabilities in the drafting of regulatory policies that affect them. Collect systematic (research and statistical) data on persons with disability for use in the development and implementation of policies. Put in place an independent internal mechanism to coordinate policy on the rights of persons with disabilities and monitor the implementation of the Convention. It can thus be seen that human rights try to protect autonomy, favor the exercise of independent acts and the disappearance of dependency not consented to. Autonomy and independence, to a greater or letter extent, form part of the content of these rights. However, it is also possible to construct an individual human right to autonomy of a general character. The recognition of such a general right to autonomy or independence must clear the obstacle of the confusion between the field of justification and that of legal technicality. Such a right must not be enunciated with such a high degree of indeterminacy and abstraction as to make practically impossible the guaranteeing or establishing of its essential content.

The question that I will deal with here is whether the interpretation of the constitution in a multicultural society has special characteristics. Put another way, the issue is whether being in a multicultural society is relevant when it comes to interpreting the Constitution.This is a question conditioned not only by the importance that may be given to cultural pluralism but also by three problems. First, there is the concept of interpretation, second, the concept of the constitution and third, the position taken as regards the specificity or not of constitutional interpretation as opposed to legal interpretation in general.

A la teoría de los derechos humanos, entendida como aquella rama que se ocupa de cuestiones relativas al concepto y al fundamento de los derechos, a su teoría jurídica y a su historia, se le presenta una serie de desafíos. En este trabajo, se analizará dos: el tratamiento de la inmigración y la gestión de la diversidad cultural.
