Immediately after the Athens Convention relating to the Carriage of Passengers and Their Luggage by Sea was passed in 2002 the discussion on implementation and extension of the Convention on national carriages (cabotage) and on carriage of passengers in inland navigation started within the European Community, which some states criticized indicating numerous legal and economic effects that will emerge when the Athens Convention of 2002 comes into force. Taking the fact into consideration that the provisions of the Croatian Maritime Code have been applied to the carriage of passengers in inland navigation this paper aims at warning that in case of possible ratification of the Athens Convention of 2002 by the Republic of Croatia and introduction of its provisions into the Croatian Maritime Code result in automatic implementation of provisions of the Athen Convention of 2002 to inland navigation regardless of the fact that this is not the obligation by the EU Regulation. For this reason it would be advisable to regulate by a separate law passengers carriage in inland navigation as to avoid the situation that in the Republic of Croatia the Athens Conventions of 2002 is implemented to inland navigation before the agreement has been reached on its obligatory implementation in the EU states.
