¿Qué hacer frente a la actual crisis socio-ecológica? Este artículo propone la noción de responsabilidad relacional como respuesta a esta pregunta, por tratarse de un principio ético idóneo para orientar la acción ante el tipo de situaciones implicadas en esta crisis; al mismo tiempo que brinda un marco analítico que enriquece las lecturas sobre las partes y fuerzas involucradas en dichas situaciones. Este artículo se vale de la integración y síntesis de reflexiones provenientes de múltiples disciplinas, tales como la filosofía, antropología, economía y psicología, para poner esta noción en contexto y mostrar su potencialidad. El cuerpo del artículo se divide en tres secciones. Las dos primeras tienen el propósito de situar la discusión en el contraste entre las dos formas de concebir el mundo que confluyen cuando la crisis socio-ecológica se aborda desde la responsabilidad relacional. Así, mientras la primera sección, examina los fundamentos ideológicos que alimentan esta crisis; la segunda, reflexiona sobre la relacionalidad, una forma alternativa de entender el mundo que, en el último tiempo, ha ido encontrando lugar en distintas disciplinas académicas. Luego, la tercera sección aborda la responsabilidad relacional en el contexto de la ética relacional y de las distintas formas en que se suele entender la responsabilidad. El artículo concluye con algunas notas finales sobre el valor de la responsabilidad relacional, en el contexto de la actual crisis socio-ecológica, así como de los desafíos que implica su adopción en la situación actual.

El texto examina los problemas de la moralización de la política a partir de la categoría “incapacidad moral permanente”, la cual se ha utilizado en el Perú para deponer a tres presidentes en los últimos años. Se interpreta dicha categoría en dos momentos: primero, como la evaluación ética de la conducta del mandatario, y, segundo, como la ausencia o daño de alguna capacidad constitutiva de la agencia moral. En el primer caso, se exponen tres posibles contenidos de la moral desde la cual evaluar el accionar del gobernante. En el segundo caso, acudiendo a tres tradiciones éticas, se presentan tres capacidades -cognitiva, volitiva y empática- que pudieran ser esenciales para considerar un sujeto como moralmente responsable. Luego, se revisan algunas aporías a las que conlleva el uso indiscriminado de la “incapacidad moral permanente”, cuya solución supondría una reforma constitucional.

In this paper, I first argue that sometimes freely and knowingly manipulating oneself does not fully preserve moral responsibility ---- namely, in cases of practically distinct self-manipulation. However, I argue that practically distinct self-manipulation preserves moral responsibility to some extent because such a self-manipulated person is more morally responsibility than an other-manipulated person. This is an important result: manipulating oneself doesn't always fully preserve one's moral responsibility for one's actions. But in what sense is the self-manipulated person more morally responsible? I argue the self-manipulated person is not a fitting target of the reactive attitudes but continues to have wrongdoing-incurred reparative obligations. This explains the intuitive judgement about the self-manipulated person, provides a better explanation of "tracing" cases, and reveals important requirements for a plausible theory of moral responsibility. The philosophical tradition has assumed the existence of a close relationship between moral responsibility and freedom. Freedom can be understood as a capacity of control over our decisions and actions. On this traditional perspective, freedom (control) is necessary for moral responsibility. However, the question of moral responsibility has recently acquired an increasing independence from the problem of freedom. Some important steps in this direction have been taken by Peter Strawson and Robert Adams. The development of this alternative point of view has given rise to what is sometimes called "attributionism", according to which one can be morally responsible for actions, and even for attitudes, without having control over them. What makes someone responsible for such things is not that they are had or performed freely, but rather that they are expressions of certain mental features of the agent. On this approach, the truth or falsity of determinism becomes almost irrelevant to moral responsibility. In this paper, I present these two views of moral responsibility as well as a way of reconciling them in a unitary conception that retains advantages of both approaches while hopefully avoiding their main difficulties. The intuition that one can only be responsible for one's own actions is extraordinarily strong. And this intuition seems to establish a link between personal identity and moral responsibility. Neo-Lockean theories of personal identity get part of their appeal thanks to their ability to account for this link. In this article I analyse what consequences fission cases have to the neo-Lockean theories' ability to account for that link between personal identity and moral responsibility. En el primer capítulo de Adscripción y reacción, Sebastián Figueroa intenta desambiguar distintos usos de la idea de responsabilidad, las relaciones entre ellos y los problemas que de allí surgen. En este comentario se ofrecen observaciones y preguntas sobre dicha organización y una reflexión sobre la distinción entre responsabilidad jurídica y moral, donde la primera aparecería como una práctica más impersonal que la segunda. En contra de esta aproximación, sostengo que toda responsabilidad es un ejercicio de simplificación y sometimiento a un marco de significado humano pero externo. Toda forma de responsabilidad se configura y expresa a través del lenguaje y este no es un instrumento de expresión del individuo, sino un espacio que éste debe habitar a pesar suyo. Toda interacción en la que hay una interpelación normativa a través del lenguaje es entonces impersonal y la idea de que habría algunas más impersonales que otras resulta misteriosa.

La ética ambiental nació como justa contestación a los excesos del antropocentrismo. Sin embargo, un énfasis obsesivo en lo ético y en lo ambiental, con el consiguiente olvido de lo antropológico, puede estar dañando la vida humana, la libertad de las personas y la vida en general. Abogamos aquí por la construcción de una ecología humana que vaya más allá y más al fondo que las éticas ambientales al uso. Defendemos que el humanismo es perfectamente compatible con el reconocimiento del valor inherente de todos los seres naturales. Lo hacemos basándonos principalmente en algunas ideas de Hans Jonas, aunque rechazamos su heurística catastrofista. De él retomamos la idea de que existe una responsabilidad moral hacia los demás seres vivos, empezando por los más próximos en el tiempo y en el espacio, y hacia el libre florecimiento de las personas actuales. Con ello, también, se rebaja el peso de lo ético sobre nuestra acción ecológica. Esta ha de atender principalmente a criterios experienciales, antropológicos, científicos y de sentido común. Por último, defendemos que la política, la educación y la comunicación ambiental deben orientarse directamente hacia la libertad y el desarrollo virtuoso de las personas actuales, y no hacia el control de las mismas por culpabilización. El tránsito desde la ética ambiental hacia la ecología humana —concluimos— puede ser beneficioso tanto para las personas como para la naturaleza.

The present article is the second of a three-series collection of articles that analyze the power of language to introduce a new set of concepts in contexts where societies can foster peacebuilding in post-conflict scenarios. I build up on Hannah Arendt's moral responsibility work to understand the need to analyze responsibility in transitional justice frameworks while landing it on peacebuilding discussions. The article advances in how this concept can contribute to fostering recognition, the role it plays in [re]building civic trust and, ultimately, promoting reconciliation. This study is motivated to find a way to engage civil society in the process where social grounds are rethought on respect as a basis. I present a proposal to use the concept of responsibility while suggesting a definition circumscribed to the context of peacebuilding during transition processes. [ABSTRACT FROM AUTHOR]

Este artículo presenta una clave de lectura del fenómeno de conformación del nosotros y exclusión de los otros, ofreciendo una comprensión pragmatista de la dimensión social de la responsabilidad moral. El aporte significativo de este texto está en que analiza las sociodinámicas de estigmatización como acciones resultantes de las actitudes del grupo al que pertenecen los individuos; en tal sentido, se persuade para que dichas acciones no se sigan explicando como una serie de conductas que los individuos desarrollan a título personal, debido a que esto impide diferenciar la estigmatización y segregación social del mero prejuicio individual.

Whit the aim of clariflying what exactly is the human phenomenon of akrasía or incontinence in the fullest sense (namely, that caused by epithymia or appetite), in Nicomachean Ethics VII.4-10 Aristotle introduces a type of incontinence by analogy, that is, incontinence due to thymós or courage. Despite his intentions, the explanation of the latter only complicates understanding the former, and the reader ends up without a clear understanding of either. The purpose of this article is to shed some light on the subject of akrasía due to thymós, trying, specifically, to answer three questions: (1) what exactly is this passion? (2) Who are worse, those who get carried away by their appetites (such as those who misbehave out of lust or gluttony) or those who get carried away by their anger (such as those who misbehave out of anger or jealousy), and why? If the condemnation and crucifixion of Christ is interpreted in the key of Lutheran divine omniscience and absence of alternative possibilities, an apparent contradiction regarding the moral responsibility and duties of the Israelite executioners of Christ would arise. This contradiction would be the following: How can we sustain the moral responsibility of the executioners if they did not have alternative possibilities and, according to Christ's first Saying on the cross, they did not know what they were doing? How could it be possible to attribute duties to the executioners if they were not able to fulfill them? These problems can be addressed from a semicompatibilistic perspective of moral responsibility. It could be argued that: 1) the absence of alternative possibilities does not exclude the fact that the executioners could be considered morally responsible for Christ's crucifixion, and that 2) the impossibility of fulfilling certain duties does not imply that the executioners would not have had these duties and cannot be considered morally responsible for their breach. Este artículo de revisión tiene como objetivo analizar la responsabilidad moral en relación con el daño ambiental, generado por el uso de los recursos tecnológicos durante el desarrollo del conflicto armado colombiano. Para ello, en primer lugar, se configuraron y describieron los conceptos correlacionados al principio de la autonomía, la voluntad y la moral, desde el precepto de la responsabilidad del agente moral a través de los elementos teóricos kantianos. Posteriormente, se determinó la función del agente moral derivado de la agencia, teniendo como propósito la determinación de los elementos conceptuales definitorios, para la comprensión e interpretación de los orígenes del agente moral como elemento influyente y dinamizador de la problemática expuesta. Por último, se procedió a realizar una comparación de los criterios existentes entre la responsabilidad del agente moral y los pronunciamientos jurisprudenciales de Colombia referentes al daño ambiental, con el objetivo de identificar los elementos jurídicos que convierten al agente moral en un responsable social de la alteración de los diferentes ecosistemas y entornos ambientales. Para consolidar el fin propuesto, se desarrolló un marco metodológico de enfoque cualitativo, cuya herramienta de investigación yacía en la acción funcional de la revisión comparativa de la literatura disponible. Finalmente, los resultados obtenidos: definición, descripción y análisis de la situación problémica, estaban articulados a la objetividad general propuesta por el investigador.

In this paper we show that being blameworthy for not blaming and being blameworthy for victim blaming are structurally similar. Each involve the two traditional contours of moral responsibility: a knowledge condition and a control condition. But interestingly, in these cases knowledge and control are importantly interrelated. Being in a relationship with another person affords us varying degrees of knowledge about them. This knowledge in turn affords agents in relationships varying degrees of influence over one another. Cases where an agent is especially blameworthy for failing to blame a friend, a close colleague, or a spouse highlight this. The interdependence of these two conditions in interpersonal relationships sheds (partial) light on why victim blaming is morally wrong. We argue that victim blamers suffer from a kind of moral myopia by only focusing on what the victim could do, in virtue of their being in a relationship of some sort with their abuser, to avoid abuse. We focus specifically on cases where such moral myopia is fueled by misogynistic and hierarchical gender schema and scripts. [ABSTRACT FROM AUTHOR]

Juan Luis Vives (Valencia 1492, Bruges 1540) reflected upon the matter of poverty as a problem of personal and social justice. As the number of poor was increasing all through the 16th century, their abandonment laid out not only social order problems, but also moral and religious ones. The fact of reflecting upon such a matter provides Vives with the opportunity to fulfill a strong criticism of those who hold the political and religious power, as well as to demand a change in the attitude, at an individual and institutional level, and a reflection on the own essence of Christianity. Therefore, Vives offers both a set of specific measures to try to face such a problem and a wide range of moral and religious reasons so as to complicate the possibility of refusing our responsibility towards the poor, while the author exhorts us to face poverty together.

The Polluter Pays Principle (PPP) states that polluters should bear the burdens associated with their pollution. This principle has been highly contested because of the putative impossibility of considering individuals morally responsible for an important amount of their emissions. For the PPP faces the so-called excusable ignorance objection, which states that polluters were for a long time non-negligently ignorant about the negative consequences of greenhouse gas emissions and, thus, cannot be considered morally responsible for their negative consequences. This paper focuses on the concept of moral responsibility as it appears in the excusable ignorance objection. I claim that this objection stems from a narrow notion of moral responsibility and that a more fundamental notion of moral responsibility would pave the way to overcome it. I show that it should be out of the question whether historical polluters should bear some burdens associated with climate change because of their historical emissions. The relevant question is which kind of burdens they can legitimately be asked to bear. I argue that this notion of moral responsibility allows us to assign burdens of symbolic reparation, which are at the core of 'Loss and Damage' policies. [ABSTRACT FROM AUTHOR]

El objetivo del presente trabajo es analizar la dificultad y los límites para comprender el significado ético de las decisiones profesionales. Éstas denotan tensiones dialécticas entre lo que el individuo considera su responsabilidad directa y las condiciones en las cuales se ve obligado a actuar y no puede controlar. En otras palabras, se cree actuar con buenas intenciones y razones legítimas y termina determinado por una cadena de acciones que lo llevan a un colapso del significado moral, tanto de sí mismo y del valor del acto en sí, lo cual se convierte en un argumento para justificar la violencia de sus actos. Proponemos que la ética puede comprender estas tensiones si se toman en cuenta las problemáticas existenciales internas de la persona que decide, como son la angustia y la desesperación en conjunto con las aportaciones de las teorías del comportamiento y la comunicación organizacional. Para ello se analiza el caso de las decisiones del fraude financiero llevado a cabo por Bernard Madoff.

Through chronological analysis of his works, the thought of zygmunt Bauman is discussed in relation to the subject of migration in liquid modernity. According to the author, the process of modernization has transformed the social dynamic, now that is has acquired the property of producing "wasted lives." C.S. Peirce defendió una visión pragmatista de la aserción en términos de su efecto normativo. El presente artículo tiene dos objetivos. El primero es reconstruir y evaluar el argumento de Peirce a favor de la tesis de que aseverar una proposición es hacerse responsable de su verdad. El segundo es argumentar que Peirce interpretó “responsabilidad por la verdad” como la adquisición de un compromiso dialógico, a saber, el deber de defender la proposición aseverada dando razones ante desafío.

This paper addresses a comparative analysis between the message of the media and official statements on the crisis of Volkswagen. The study focuses on Bowen & Zheng (2015) framework strategy applied on the auto industry through a descriptive non-experimental design of qualitative approach. The findings show that the volitional attribution of responsibility is a response to the problematization issued by the media and not by the existence of a moral code that informs decision-making in crisis management. En este artículo, me opongo a la idea de que toda acción debe ser moralmente evaluada exclusivamente por el motivo o intención por el que el agente la realizó o intentó realizarla. En particular, se presentan casos con los que se discute el contraste entre voluntad o intención y consecuencias; entre negligencia y decisiones en condiciones de incertidumbre, y resultados; entre actos deliberados e inadvertidos; y entre intención y acción; con la meta de mostrar el papel adicional que el segundo elemento de cada par desempeña en la determinación del juicio moral merecido.

Este artículo presenta los resultados de una investigación sobre los estilos de aprendizaje de los estudiantes de primer semestre de ingeniería de la Universidad El Bosque - UNIBOSQUE y de la Universidad Pedagógica y Tecnológica de Colombia - UPTC, a quienes se aplicó el test de Kolb, con muestreo estratificado. Ante la diversidad de estilos de aprendizaje encontrados, se propone que los docentes sean conscientes del principio de justicia en el aula y de su responsabilidad moral para procurar un diseño y ejecución de curso, que ofrezcan condiciones equitativas y propicien ambientes adecuados para el aprendizaje de la totalidad de los estudiantes.

El texto da cuenta sucintamente del viejo problema de la responsabilidad moral de los ricos frente a las calamidades del hambre y la pobreza absoluta. Para ello, se presentan las propuestas de Ernesto Garzón y Peter Singer sobre el nivel de responsabilidad exigible y se señalan algunas críticas plausibles a las mismas. A continuación, se explica la última iniciativa de Singer para promover el fin de la pobreza absoluta y las tensiones que la misma entraña para su propia teoría. Finalmente, se aboga por considerar el asunto desde el punto de vista de la ética de las virtudes.ABSTRACTThe text briefly approaches the old problem of moral responsibility of the rich over the calamities of hunger and absolute poverty. To this end, it presents Ernesto Garzón and Peter Singer’s proposals about the level of accountability and it identifies some plausible critiques to them. Then, it explains Singer’s latest initiative to promote an end to absolute poverty and the tensions it poses to his own theory. Finally, it advocates for considering the matter from the point of view of virtue ethics.

En este artículo se argumenta que los esfuerzos políticos hacia la erradicación de la pobreza en los países en vías de desarrollo deberían ser preferentes frente a los esfuerzos dirigidos a ampliar el número de personas pobres y oprimidas admitidas en nuestras sociedades ricas. Ambos tipos de esfuerzos son objetivos morales, pero el primero parece ser más efectivo que el segundo.

El artículo plantea las conexiones entre la tesis de la banalidad del mal y la historia de la voluntad presente en La vida del espíritu. Interpreta Eichmann en Jerusalén como una obra sobre el mal burocrático, pero sobre todo como estudio acerca de la responsabilidad, tanto jurídica como moral. De la historia de la voluntad resalta tres aspectos que pueden ser puestos en conexión con el problema de la responsabilidad: la ontología de la contingencia, la idea de individualidad vinculada a la voluntad y la capacidad de trascendencia y resistencia subyacentes en la teoría de Duns Escoto de la libertad como indiferencia. Por último, sugiere una vinculación entre la banalidad del mal y la ontología del bien desarrolladas en “Algunas cuestiones de filosofía moral”, de 1965-1966, la lucha contra el gnosticismo y la defensa de una relación entre moralidad e inteligibilidad del mal.

En contra de la posición de ciertos filósofos, como Thomas Nagel, defiendo la creencia del sentido común según la cual las personas no son moralmente responsables de aquello que hacen o producen inadvertidamente. Considero qué respuesta podríamos esperar razonablemente de una persona que inadvertidamente hace o produce un evento o condición que es manifiestamente indeseable o malo; y sugiero que podríamos esperar razonablemente que dicha persona no se sienta culpable, sino más bien apenada por su inhabilidad para prevenir o evitar esa condición o evento.

He defendido anteriormente que no somos libres en el sentido requerido para la responsabilidad moral y, a la vez, que la concepción de la vida sin este tipo de libertad no sería devastadora para la moralidad o para nuestra noción de significado en la vida; más aún, hasta puede ser beneficiosa en ciertos respectos (cf. Pereboom 2001). En este artículo exploro qué clases de actitudes emocionales son consistentes con la negación del tipo de libertad requerido para la responsabilidad moral y si estas pueden fundamentar una vida significativa. En el proceso respondo a una reciente crítica de Shaun Nichols a mi posición (cf. Nichols 2007).

El objetivo del presente trabajo es defender el Principio de posibilidades alternativas (ppa) frente a dos recientes supuestos contraejemplos a éste, inspirados en el que diseñó, hace ya cuarenta años, Harry Frankfurt. Las tres primeras secciones resumen el estado de la cuestión. A partir de la cuarta, se presentan y discuten, sucesivamente, los contraejemplos al ppa de Widerker ("Disfunción cerebral-W") y de Pereboom ("Evasión de impuestos"). Sostenemos que ambos ejemplos violan al menos una de dos condiciones necesarias para refutar el ppa: (1) que el agente sea moralmente responsable de su decisión y (2) que carezca de alternativas moralmente significativas ("robustas") a ésta. Con respecto a (1), los ejemplos presentan distintos problemas en relación con la "capacidad de respuesta a razones" del mecanismo de deliberación y decisión del agente, lo que cuestiona su responsabilidad moral. Con respecto a (2), tratamos de mostrar que los agentes, en los casos respectivos, tienen a su alcance alternativas robustas. Concluimos, pues, que el ppa no es refutado por estos ejemplos.

La mayoría de las teorías sobre la responsabilidad parten de uno de dos puntos prominentes: la idea de que el agente debe tener alguna conexión caracterológica o expresiva con la acción o, alternativamente, la idea de que el agente debe responder en algún sentido a razones. Defenderé que la relación entre estos dos caminos hacia la responsabilidad moral es mucho más complicada de lo que se asume normalmente, y que hay razones para pensar que uno de estos caminos puede terminar colapsando en el otro o, si no, que de todas maneras hay razones para pensar que uno de estos puntos de vista ha identificado incorrectamente las características de la agencia relevantes para la responsabilidad moral. El punto de vista que sigue es uno que puede ser llamado la primacía de las razones. En la segunda mitad del artículo examino si el trabajo experimental reciente habla a favor de la alternativa a la primacía de las razones: sus proponentes dicen que lo hace, yo defiendo que no.

El semicompatibilismo respecto de la responsabilidad es la posición según la cual el determinismo es compatible con la responsabilidad moral, independientemente de si aquel excluye el tipo de libertad que requiere acceso a posibilidades alternativas. Sugiero que la respuesta a la pregunta acerca de si el semicompatibilismo es o no viable, descansa en si una variedad de principios normativos -atractivos prima facie- es verdadera o falsa. Presento un subconjunto de estos principios y, luego, rastreo algunas posiciones con respecto a la sostenibilidad del semicompatibilismo, dependiendo de cuál de estos principios, si acaso alguno, es verdadero. Concluyo que para muchos el precio de mantener el semicompatibilismo es demasiado alto porque hacerlo requiere abandonar uno o más principios de este subconjunto.

Este artículo explora el llamado fenómeno de la suerte moral, centrándose en el planteamiento seminal de Thomas Nagel y Bernard Williams. Se pretende clarificar los diversos aspectos envueltos en la cuestión y remarcar las divergencias entre ambos. Asimismo, se caracterizan las diferentes cuestiones a las que han de dar razón tanto quienes mantienen que el fenómeno es ilusorio, como quines lo consideran real. La meta no es otra que alcanzar una comprensión crítica de la naturaleza de dicho fenómeno y de los diferentes elementos involucrados en él.

Una de las objeciones más fuertes contra la responsabilidad moral en filosofía de la acción sería el Argumento Básico de Galen Strawson, que plantea la necesidad de que uno sea responsable de ser quien es para poder ser responsable moralmente de sus acciones, exigencia ésta harto difícil o imposible de cumplir por lo que, en consecuencia, nadie sería nunca responsable. Los diversas respuestas ortodoxas al reto escéptico de Strawson comparten con el Argumento Básico una misma noción teológica heredada de agente-mónada y, según trato de mostrar en mi artículo, sería necesaria una nueva concepción del sujeto para dar cuenta correctamente de este Argumento.

The Strawson’s Basic Argument is the stronger against moral responsibility in Philosophy of action. One should be responsible of his identity to be moral responsible of his actions, but then nobody could be never responsible. In this article I criticize orthodox solutions to Strawson’s sceptical challenge and show how they share with the Argument the same theological notion of monadical agent. Critics of Wolf's "asymmetry thesis" argue that it is counterintuitive to praise agents for performing right actions, even if this is something these agents were "psychologically determined" to do, while at the same time not blaming such agents for acting wrongly. I defend Wolf by exploring what it means "to do the right thing for the right reasons." Acting rightly for the right reasons amounts to having subjected oneself to certain deliberative procedures. The right reasons, that one chooses and acts upon, express a capacity for self-determination, the normative features of which are themselves constitutive parts of the True and the Good. La inclusión de las Prácticas en los profesorados universitarios ha dado lugar a intensas polémicas sobre la perspectiva “dependiente-aplicacionista” de la Práctica que no compartimos: primero debe aprenderse la Teoría, luego (en el último año) se hacen las Prácticas para transferir la teoría. El objetivo de este trabajo es presentar un modelo de Formación Docente Articulada (FODA) seguido por Investigación Acción en las dos últimas décadas y que incorpora las Prácticas como eje epistemológico, ético, político y didáctico de la transformación. ¿Qué aprenden los estudiantes en la Práctica, que es la realidad situada del aula? En las interacciones aprenden a emplear el razonamiento práctico ante una realidad conflictiva, que exige sopesar posibilidades, deliberar, emitir juicio y tomar decisiones responsables. Además aprenden, tal como señala Arendt, a vivir juntos, los unos y los otros de los diversos, y construir en el “entre” su formación para el ejercicio de una democracia crítica, la formación política, que no es más que el aprendizaje de la participación genuina en la lucha contra la injusticia.

El presente trabajo aborda una organización sistemática de las principales posiciones filosóficas sobre la relación entre libre albedrío y determinismo. La sistematización se basa en diversas combinaciones de la aceptación y/o negación de cuatro premisas fundamentales. De esta forma es posible visualizar la dicotomía compatibilismo/incompatibilismo desde una perspectiva global, si bien existen posiciones que rompen con dicha dicotomía y que también son presentadas aquí.

This article discusses the importance of the legal system in the judicial protection of social, civil, and human rights. The author comments on the ethical and legal responsibilities associated with these protections and describes the differences and similarities between social and human (fundamental) rights.

A critique presented by David Widerker on Frankfurt-counterexamples and known as the "W-defense" has persisted for years and has been considered one of the most difficult challenges these counterexamples have to face. This paper aims to defend Frankfurt counterexamples against Widerker's attack. For doing this, the paper presents a dilemma addressed to the main premise of Widerker's attack: The Principle of Alternative Expectations. The dilemma states: either this principle rests on the Kant's maxim, "ought" implies "can", and then this makes redundant and unnecessary the principle and Widerker's whole argument; or the principle does not rest on such maxim and then there is no good reason to accept it as valid [ABSTRACT FROM AUTHOR]

Nowadays, the majority of the discussions with regards to moral responsibility are focused towards the debate between freedom and determinism. However, it is common that the same debate presupposes at least the possibility of attributing responsibility to the agent in terms of the result occurred. In fact, it is rare the discussion about the validity of the ends of the relation studied, these are: on one side, the volitional aspect of the agent (will, dolus, etc.); and on the other, the result occurred in the "exterior world" (reality, context, society, etc.). With this paper, the purpose is also to study the debate between determinism and indeterminism in the light of moral responsibility of the agent. Nevertheless, the focus is very sharp and will be given in a vast part by the debate between moral responsibility of actions or results. Basically, it is pretended to revaluate the discussion regarding determinism, when faced to the incongruence in the judge of imputation of results. It will defend the thesis according to which, be as it may the position adopted in the debate between determinism and indeterminism, the question for moral responsibility must be referred to the action, never to the result. I present here three main difficulties for Bennett's account. First, it seems that retributivism is in a worse position if we admit (as Bennett does) that that for which we are morally responsible, and blameable, is to some extent subject to luck. Second, our moral practices include reactions to wrongdoing in which no vindictive element seems to be present, and we still regard them as appropriate and often admirable. Finally, there are important differences between blame and punishment that make problematic the aim of understanding and justifying legal punishment as a mere projection of blame. After a detailed reconstruction of the global case against moral luck in all its kinds, which distinguishes two main argumentative strategies, the moderate strategy and the radical strategy; a twofold counter-argument is presented. It is argued that (i) whereas the former turns out to be insufficient, (ii) the latter becomes impractical and eventually incoherent. The fundamental aim is to show that a final argument against moral luck necessarily depends on the impossible notion of unconditional desert--or true desert understood, in a especially strong sense, as the strict function of (or strictly proportional to) the agent's control.
