In theory, Bankruptcy Code Section 503(b)(9) was meant to provide enhanced protection for goods suppliers against an unfair run-up of their unsecured claim exposure and to encourage extending credit to the financially distressed pre-bankruptcy debtor. In practice, Section 503(b)(9) has become but a minor roadblock that retail debtors have strategically learned to traverse to the detriment of trade vendor suppliers. The authors of this article discuss the issue and suggest that vendors consider the involuntary bankruptcy petition, which may be used to level the playing field and preserve Section 503(b)(9) claims.
