2. Comparable Worth: Is It Anything More Than 'The Latest' Discrimination Issue?

Abstract

The comparable worth issue has become heated in the 1980s and is especially important to minorities and women. The debate, explored in this eighth chapter of a book on school law, concerns the causes of and cures for the earning gap between employed men and women. One major cause of the gap is occupational segregation. Comparable worth advocates offer three approaches to cure wage inequities--broadening the Equal Pay Act's equal-pay-for-equal-work concept, requiring that wages be proportionate to the worth of a job, and using statistical techniques to isolate that portion of a wage differential attributable to sex discrimination. Basic comparable worth theory has not yet found judicial approval. However, the recent Supreme Court decision in "Gunther v. County of Washington" allows plaintiffs to press comparable worth under Title VII of the Civil Rights Act of 1964 and raises the possibility that employers cannot simply rely on the labor market in setting wages. School boards need to prepare for possible legal battles with those in positions held predominately by females by reviewing wage structures and justifying wage differentials. (Author/WD)

Abstract

This manual focuses on legal issues confronting schools in the area of substance abuse and provides practical policy guidance to public school managers in enforcing a substance abuse policy. After a brief introduction, section 2 examines barriers to action, commenting on several myths affecting drug abuse policy. Section 3 deals with substance abuse by school employees, addressing these topics: (1) establishing substance abuse policies; (2) testing employees for drug or alcohol use, commenting on types of testing and matters of privacy; (3) disciplining employees for the use of, impairment from, or possession of drugs or alcohol and citing pertinent laws and the Federal Rehabilitation Act; and (4) assisting employees with substance abuse problems. Section 4, on substance abuse by students, addresses these topics: (1) establishing a substance abuse policy for students; (2) prohibitions; (3) methods and procedures of enforcement, commenting on reasonable suspicion and reasonable scope of search; (4) due process requirements; (5) discipline; (6) voluntary drug testing; (7) mandatory testing of student athletes; and (8) the need for a reasoned and personalized approach. Civil Rights Act was a turning point in the decades-long struggle against segregation and discrimination. When U.S. President Lyndon B. Johnson signed the legislation into law on July 2, 1964, America took one step closer to becoming a country which truly judges not by the color of skin but by the content of character. However, the Civil Rights Act was not something that simply happened, nor was it something that happened simply. It was one step in a long and difficult Civil Rights Movement, one stained with the blood and built upon the sweat of those Americans whose dedication to liberty and equality was stronger than that to their own self-preservation. America celebrates 40th anniversary of the Act in 2004.
