Abstract

The article discusses the contentions on the constitutionality of warrantless seizures of deoxyribonucleic acid (DNA) from U.S. individuals and the lawsuits related to the issue as of 2011. Appellate courts had dissenting opinions on the legality of mandatory extraction of DNA samples from suspects who were not convicted. It cites the ruling of the California Court of Appeals in the case People versus Buza in August. Courts are urged to consider privacy issue and the efficacy of DNA collection.
