The majority decision in Roe v. Wade in 1973, written by Justice Harry Blackmun, included an expansive account of the history of abortion in the U.S. The justice Department made its own appeal to tradition, citing the book "Abortion in America," by James Mohr, to buttress the claim that the history of both legislation and belief on the subject supports the prohibition of abortion. That was the only historical work the government mentioned. Ironically, Mohr, a professor of history at the University of Maryland and one of the country's preeminent scholars on abortion, signed the pro-choice brief.
