Transracial adoption was legalized in South Africa through legislative reform as South Africa moved into a post‐apartheid era of non‐racialism. Transracial adoption offers one option of placement for Black children in need of alternative care. However, adoption continues to face obstacles to implementation, including cultural obstacles which impact on placement of Black African children. This paper reports on adoption statistics on national adoption in the period 2013–2021 and a documentary analysis of the current legal and policy framework governing transracial adoption. We cover international instruments, local laws, including the Children's Act of 2005, and relevant policy documents designed to facilitate the implementation of adoption. We show that the law is supportive of transracial adoption, but that policy documents offer a somewhat contradictory stance to the practice. The lack of success of transracial adoption as a child protection strategy does not lie within the legal framework but may lie in the difficulties in interpreting and implementing the range of different policies by those implementing these policies. More research into the implementation practice of these bureaucrats is required to understand the underutilization of transracial adoption as a placement option for Black children in South Africa. The direct crediting of book allowances to student accounts was, among other reasons, underpinned by the belief that students would be able to substitute prescribed study material with online content. The article attempts to understand if the local open educational resources (OER) funding policy environment was prepared for this significant transformation. The paper applied a critical theory paradigm and a documentary research strategy to identify policy-level documents on OER funding in the South African higher education sector. Content analysis was then applied to review what they said about OER funding. These outcomes were then measured against the National Policy Development Framework 2020, which also dominated the study's conceptual framework. The study's significant findings were that the OER funding policy did not meet the policymaking principles of the framework, and this exposed Higher Education to a poorly funded OER environment. The study recommended hastening the finalization of OER policy and the flexible application of current policy terms to include OER as a fundable higher education cause. [ABSTRACT FROM AUTHOR]

Housing delivery in South Africa continues to dominate conversations on human rights and social development. Using a social development lens, this paper presents the findings of a qualitative study that aimed at exploring the housing experiences of social rental housing (SRH) beneficiaries and how this interlinked with human rights and social development in South Africa. Using the purposive sampling method, the study selected three social housing institutions (SHIs) in Gauteng and two in the Western Cape province. With each SHI, a focus group discussion was conducted with its tenants to establish if there are any linkages with human rights and social development. Participants shared positive sentiments relating to SRH. The authors of this article note that SRH is implemented from a rights-based perspective, in line with international law and the social development perspective. South Africa's mobile telecommunications industry boasts four major players, namely Vodacom, MTN, CELL C and Telkom. On the face of it, this suggests a diverse market with healthy competition. However, the costs of mobile services, including data and voice calls remains among the highest in the world, suggesting a distorted and uncompetitive market. Despite increasing awareness of this reality, and growing public outcry, change has been slow and piecemeal, with both policymakers and regulatory authorities not taking decisive action. Using institutional policy analysis, document analysis and interviews with sampled actors from the telecommunication industry, civic society and the regulatory authority, this paper argues that a combination of regulatory paralysis, collusive behaviour by oligopolistic operators, indecisive government policy, and to some degree citizen inaction have led to sustained overpricing of mobile data in South Africa. It highlights the corporate dominance in the policing of this sector, which has implications for citizens' capacity to participate in various spheres of life, and hence for democracy. The paper is premised on the public interest theory and theories of universal (internet) access which are germane to understanding access to information as a human rights issue. Background: The Western Cape Government (WCG) has recently implemented its seventh (7th) Provincial Evaluation Plan that is aligned to the National Evaluation Policy Framework adopted by South Africa in November 2011. The National Evaluation System (NES) and its evolution at the provincial level has been aligned to its Province-wide Monitoring and Evaluation System (PWMES). The Department of the Premier in the WCG centrally drives this system. The institutionalisation of a Provincial Evaluation System (PES) serves as a model for any sub-national government to practice government evaluations at provincial, regional or local levels. To date, thirty-three (33) evaluations have been completed and a further eleven (11) are at various stages of implementation. Objectives: Since the initial rollout of the PES in the WCG, the system has developed, strengthened and matured. This comes from a need for better access to, and understanding of, evaluations. Method: The paper has drawn on the recent evaluation of the NES which selected the Western Cape as a case study; and uses the findings to put improvements in place in the areas of policy, methodology, organisation, capacity, participation with other actors, and use. Results: The main value in sharing this work, is the building of an enabling environment to roll out evaluations on a regional level, that are in line with the national evaluation approach, whilst at the same time facilitating integration with provincial strategic priorities. National policy documents are important platforms for the prioritisation of social issues which is likely to spur research into the development of evidence-based practice guidelines that are effective and cost-efficient. In relation to the impact of substance abuse on the family, carefully designed policies that magnify support for the family can help lessen the burden of substance abuse on families. Using the Family Impact Lens (FIL) framework, this paper explored how family issues in relation to substance abuse are addressed within three South African policy and strategic documents: thePrevention of and Treatment for Substance Abuse (PTSA) Act(2008), theNational drug master plan(NDMP; 2013–2017) and theWhite paper on families in South Africa(2012). In keeping with the framework of the FIL, we evaluated whether the policies (1) mention the effects of substance abuse on the family, (2) recognise the importance of the family in the relative’s rehabilitation and (3) address the needs of family members by providing policy directives to support families who are affected by substance abuse (affected family members (AFMs)). Although all three policies recognise that families are negatively impacted by a relative’s substance abuse, the policies are overly focussed on individual approaches to deal with substance abuse and fail to adequately address the support needs of AFMs. Research on the support needs of AFMs is warranted in addition to the evaluation or development of evidence-based strategies to support AFMs. Further implications and recommendations for policy-makers, researchers and practitioners are provided in the paper. The 'White Paper of Families in South Africa' is critically analysed in this article. It is shown that although family diversity is acknowledged in the aforementioned document, certain implications of the document undermine such professed diversity, not all caretakers of children are acknowledged and supported, and financially vulnerable families are not strengthened. Instead, narrow ideals of family life are at times promoted, suggesting middle-class heterosexual values. It is argued here that the realities of family life should be accepted as such and family in different forms should be supported consistently, not subtly pushed to conform to restricted interpretations of what families should be like. INTRODUCTION The health consequences of smoking are serious and have been frequently detailed. A reduction in tobacco-related mortality hinges upon the ability to reduce tobacco usage. There is overwhelming evidence that higher cigarette prices reduce the demand for cigarettes, but little is known about the combined effect of price and non-price policies. This paper seeks to extend the analysis of price elasticities by estimating the combined effect of changes in price and non-price legislations in South Africa. METHODS Annual time-series data from 1961 to 2016 are used, with a policy index constructed to capture the instances of non-price tobacco legislation. We estimate the combined impact of changes in tobacco control policy on cigarette consumption using a vector error correction model (VECM) and a two-stage least squares (2SLS) model. RESULTS The estimated long-run own-price elasticities lie between -0.55 and -0.72, while the income elasticities lie between 0.39 and 0.49. The coefficients of the changing tobacco control policies and the changing market structure show that they contribute to a modest reduction in cigarette consumption. The short-run deviations from the steady state are presented using the error correction term (ECT). CONCLUSIONS Cigarette demand is responsive to cigarette prices and non-pricing policies but failure to control for non-pricing policies overstates the price effect. Abstract This paper reflects on the trajectory of social policy in South Africa (1994–2017) and on which policy levers present opportunities for cross-country policy transfer, in order to address current social development challenges. The current direction of social policy is described as the result of a compromise between two distinct alternative paradigms whereby the statist transformative and market-oriented residual paradigms are held in tension. On the one hand, a transformative policy perspective draws on human rights and views redistribution as a necessary premise for and means of economic growth. On the other hand in the residual framework, redistribution is envisaged as a secondary function that is dependent on economic growth. Several instances are outlined in which this tension is evident, together with the implications for social policy across the policy cycle: in legislation; in social compact formation; in the selection of social programmes and in their implementation; in gender-mainstreaming and in the engagement of the private sector in social policy. Overall we highlight areas of hybrid policy overlap between these bifurcated ideological, political and institutional frameworks, for example around social transfers and corporate social investment. We also describe instances of conflicting and at times unexpected outcomes, such as the National Health Insurance. Several factors are concluded to be of relevance to the Global South more generally: the importance of constitutionally-legislated rights as a basis for advancing socio-economic claims; the emergence of new social compacts in contexts where there are significant levels of informal employment and unemployment and lastly, the influence of fiscal and institutional capability factors in shaping the direction of social policy and its implementation. Background: The strong symbolic value of illicit drug use makes it a contested issue, which attracts mixed public opinion, intense media attention and close political scrutiny. This means that the formulation of plausible, authoritative policies governing illicit drugs must navigate fraught political terrain. In a country like South Africa with its long unique history of institutionalised oppression of the black majority, the issues confronting drug policy are particularly complex and the need for carefully formulated policy responses especially urgent. Yet despite this, the area of drug policy development in South Africa has received little scholarly attention to date.Methods: This paper explores the complexities of policymaking in the South African context by drawing on feminist scholar Carol Bacchi's poststructuralist approach to policy analysis, which focuses on how policy helps to produce the problems it purports to solve. Taking as its empirical focus, South Africa's current drug policy, the third National Drug Master Plan (NDMP), 2013-2017, the paper analyses how the policy constitutes the 'problem of alcohol and other drugs' (AODs).Results: We identify three central policy proposals through which specific problematisations emerge: (1) the proposal that drug use is a global issue requiring a coordinated policy response, (2) appeals to evidence-based policy proposals and (3) the proposal that AOD 'use' and 'abuse' be treated interchangeably. We suggest that these proposals reveal a tendency towards inflating the 'problem of AODs' and thus work to justify punitive policy measures.Conclusions: In an effort to explore the implications of particular problematisations for effecting social change, we clarify the ways in which the policy may work to undermine the interests of those it seeks to aid by reinforcing stigma and marginalisation. Background: Action on the social determinants of health (SDH) is relevant for reducing health inequalities. This is particularly the case for South Africa (SA) with its very high level of income inequality and inequalities in health and health outcomes. This paper provides evidence on the key SDH for reducing health inequalities in the country using a framework initially developed by the World Health Organization. Objective: This paper assesses health inequalities in SA and explains the factors (i.e. SDH and other individual level factors) that account for large disparities in health. The relative contribution of different SDH to health inequality is also assessed. Design: A cross-sectional design is used. Data come from the third wave of the nationally representative National Income Dynamics Study. A subsample of adults (18 years and older) is used. The main variable of interest is dichotomised good versus bad self-assessed health (SAH). Income-related health inequality is assessed using the standard concentration index (CI).ApositiveCI means that the rich report better health than the poor. A negative value signifies the opposite. The paper also decomposes the CI to assess its contributing factors. Results: Good SAH is significantly concentrated among the rich rather than the poor (CI=0.008; pB0.01). Decomposition of this result shows that social protection and employment (contribution=0.012; p>0.01), knowledge and education (0.005; p<0.01), and housing and infrastructure (_0.003; p<0.01) contribute significantly to the disparities in good SAH in SA. After accounting for these other variables, the contribution of income and poverty is negligible. Conclusions: Addressing health inequalities inter alia requires an increased government commitment in terms of budgetary allocations to key sectors (i.e. employment, social protection, education, housing, and other appropriate infrastructure). Attention should also be paid to equity in benefits from government expenditure. This paper explores arguments for and against same-sex marriage as ‘movement advocacy’ in the USA as a backdrop to the proposition that, despite the influence of US discourses on South African debates about same-sex marriage, US discussions are less important to understanding South African responses than controversies about marriage itself in the country. The paper works in two sections. First it sketches legal and critical tensions within the USA around the implications of same-sex marriage activism, drawing on work from Franke, Brandzel, Grossman, Puar and others. Second, it notes arguments on queer homonationalisms, made most forcefully by Puar, concerning the effects and interests of ‘exporting’ US legal ideals to countries elsewhere, especially poorer countries. It then moves to offer suggestions for ways of nuancing this argument through stronger critical attention to context concerning radically shifting notions of marriage within those countries themselves, using South Africa as a case study. The importance of strengthening local governments is widely recognised as local governments face new challenges against the backdrop of global decentralisation processes. Municipal International Cooperation (MIC) contributes strategically to such processes by peer-to-peer learning within existing local institutions, a development process that is both efficient and provides continuity. Empirically, the paper draws upon the findings of an evaluation of the Dutch support programme for MIC called LOGO South. The main conclusion is that partnerships between local authorities do strengthen local governments in the South; the unique approach of the LOGO South programme adds important spillover effects in mutual learning, resulting in both policy transfer and mobility. By creating multilevel governance networks, knowledge circulation was also strengthened. We describe educational experiences of people with disabilities who attended special schools in South Africa. We found significant differences in education between White and Black participants in terms of teaching quality, access to therapy and assistive devices, class sizes, subjects, and grades offered. Additional differences were noted between participants with congenital and early-onset disabilities, and those with degenerative or acquired disabilities who moved from a mainstream school to a special school. Thirty-six percent of participants in this study completed their education after Education White Paper 6 (EWP6), South Africa’s inclusive education policy had been implemented. Despite this, findings suggest that all these participants experienced similar challenges as those who received their education during the apartheid era. Poverty alleviation remains a pressing concern for South African policy-makers. Implementing effective anti-poverty policies requires a clear understanding of the nature and extent of poverty. The extant literature on South African poverty dynamics shows a decline in the headcount ratio over the first decade of the twenty-first century. However, the prior research largely adopts a narrow money-metric approach, or uses multi-dimensional indices that include welfare indicators based on private assets (e.g. television sets) or those that are provided publicly (e.g. access to water). This paper uses multiple correspondence analysis to measure non-income poverty trends for the period 2005–12. The novelty in this undertaking lies in an attempt to include a measure of the perceived quality of public assets and services to complement the standard indices. South Africa has one of the most active civil societies in the world, with more than 85,000 registered civil society organizations (CSOs). However, the growth of CSOs in post-apartheid South Africa does not necessarily imply that the sector is strong. While it is true that the demise of the apartheid regime increased democratic representation within South Africa, CSOs have experienced a series of institutional challenges which have weakened their organizational stability. This has included increased oversight by the state, inefficient and inconsistent funding from government, fickle demands by private donors, and competition from other sectors. Through an in-depth case study of a historically prominent CSO in South Africa, this paper critically analyzes the institutional challenges faced by CSOs in South Africa. Data findings suggest that lack of long-term funding support, ineffective state funding mechanisms, and competition from state programs and new CSOs have resulted in perpetual uncertainty for some CSOs. In all, these institutional problems may have the potential to shrink, destabilize, and limit the viability of South African CSOs. Moreover, this suggests that South African democratization may have simultaneously produced new opportunities for some CSOs, yet reinforced unequal power relations for other CSOs and thus produced a highly polarized CSO landscape. Background: Integration of sexual and reproductive health (SRH) and HIV policies and services delivered by the same provider is prioritised worldwide, especially in sub-Saharan Africa where HIV prevalence is highest. South Africa has the largest antiretroviral treatment (ART) programme in the world, with an estimated 2.7 million people on ART, elevating South Africa's prominence as a global leader in HIV treatment. In 2011, the Southern African HIV Clinicians Society published safer conception guidelines for people living with HIV (PLWH) and in 2013, the South African government published contraceptive guidelines highlighting the importance of SRH and fertility planning services for people living with HIV. Addressing unintended pregnancies, safer conception and maternal health issues is crucial for improving PLWH's SRH and combatting the global HIV epidemic. This paper explores South African policymakers' perspectives on public sector SRH-HIV policy integration, with a special focus on the need for national and regional policies on safer conception for PLWH and contraceptive guidelines implementation. Methods: It draws on 42 in-depth interviews with national, provincial and civil society policymakers conducted between 2008-2009 and 2011-2012, as the number of people on ART escalated. Interviews focused on three key domains: opinions on PLWH's childbearing; the status of SRH-HIV integration policies and services; and thoughts and suggestions on SRH-HIV integration within the restructuring of South African primary care services. Data were coded and analysed according to themes. Results: Participants supported SRH-HIV integrated policy and services. However, integration challenges identified included a lack of policy and guidelines, inadequately trained providers, vertical programming, provider work overload, and a weak health system. Participants acknowledged that SRH-HIV integration policies, particularly for safer conception, contraception and cervical cancer, had been neglected. Policymakers supported public sector adoption of safer conception policy and services. Participants interviewed after expanded ART were more positive about safer conception policies for PLWH than participants interviewed earlier. Conclusion: The past decade's HIV policy changes have increased opportunities for SRH-HIV integration. Studies that provide insight into citizen participation in public services delivery protests in Africa are very few. The paper discusses Citizens participation in public service delivery protests in the Sedibeng district municipality of South Africa. The municipality consists of three local municipalities namely Lesedi, Emfuleni and Midvaal. The sampling procedure was carefully designed, taking into account the spatial distribution of the population in the Sedibeng District Municipality and the three local municipalities. A structured sample of 1,000 respondents was used for the study. Descriptive and inferential statistics approaches were used in the analysis. Overall, the average level of satisfaction with public service delivery is quite low. There are highly significant differences in the mean ranking of satisfaction with public service delivery by age of protesters in respect of water supply, electricity provision and solid waste removal. Also, there are highly significant differences in the mean ranking of satisfaction with public service delivery by district for all service categories. There is a clear link between perception of municipal governance and participation in street protests. It is important for public service delivery in Sedibeng Municipality to improve so that citizens public confidence could rise. Municipal authorities need to explore more avenues for public consultation especially given the cultural impediment that citizens have regarding challenging leaders in public. Prompt action needs to be taken to address development challenges identified by residents as envisioned in the objectives of civic engagement in municipal planning. It is important to improve municipal governance which the protesters are particularly concerned about. Service delivery suggestions made at ward meetings should be provided by the municipality. These include those of improved roads, crime fighting and job creation are also essential to any effort to improve service delivery in Sedibeng municipality. It is also important for politicians to refrain from making empty promises or creating unrealistic expectations. Public services are a key determinant of quality of life that is not measured in per capita income. They are also an important element of any poverty reduction strategy. Improving public service delivery is one of the biggest challenges confronting local administration in Africa. Studies that provide link citizens satisfaction with public services delivery with participation in street protests in Africa are very few. Background: Redressing structural inequality within the South African society in the post-apartheid era became the central focus of the democratic government. Policies on social and economic transformation were guided by the government's blueprint, the Reconstruction and Development Programme. The purpose of this paper is to trace the evolution of non-communicable disease (NCD) policies in South Africa and the extent to which the multi-sectoral approach was utilised, while explicating the underlying rationale for "best buy" interventions adopted to reduce and control NCDs in South Africa. The paper critically engages with the political and ideological factors that influenced design of particular NCD policies.Methods: Through a case study design, policies targeting specific NCD risk factors (tobacco smoking, unhealthy diets, harmful use of alcohol and physical inactivity) were assessed. This involved reviewing documents and interviewing 44 key informants (2014-2016) from the health and non-health sectors. Thematic analysis was used to draw out the key themes that emerged from the key informant interviews and the documents reviewed.Results: South Africa had comprehensive policies covering all the major NCD risk factors starting from the early 1990's, long before the global drive to tackle NCDs. The plethora of NCD policies is attributable to the political climate in post-apartheid South Africa that set a different trajectory for the state that was mandated to tackle entrenched inequalities. However, there has been an increase in prevalence of NCD risk factors within the general population. About 60% of women and 30% of men are overweight or obese. While a multi-sectoral approach is part of public policy discourse, its application in the implementation of NCD policies and programmes is a challenge.Conclusions: NCD prevalence remains high in South Africa.
