This paper will address the enduring paradox of balancing liberty and order in the pursuit of justice faced by constitutional democratic republics. The emphasis of the paper will examine privacy and national security from an historic view to present day. The major question addressed will be, how does government balance civil liberties and the obligation to maintain national security? The topics will include: President Lincoln's executive actions during the Civil War, the creation and development of the National Security Agency (NSA) by the Truman Administration in 1952, the "Church Committee" investigation in 1975, the creation and development of the Foreign Intelligence Surveillance Act (FISA) of 1978 and the FISA Court, the U.S.A. Patriot Act of 2001, satellite surveillance, and data mining techniques and telecoms.
