This paper uses Fligstein and Mc Adam's (2012, 2011) theory of the strategic action field, or ' SAF,' to highlight the ways in which individuals can act within cultural and material constraints to shape social processes. It applies these concepts to the Mercer University heresy trial of 1939, in which a group of students backed by fundamentalists from the conservative Protestant movement accused members of the University's faculty of unbelief. By understanding the organization, the social movement, and the higher education industry as ' SAFs,' the theory explains how the trial reached its unusual outcome, and suggests implications for broader understandings of organizational change. Background: This research outlines important factors in the development of a for-credit internship program by providing a historical context of internship work dating back to the original case of Walling v. Portland Terminal (1947), which outlined acceptable non-paid work of trainees, to more current applications of these labor laws in Wang v. Hearst (2016) and Glatt v. Foxlight Pictures (2016) then connects those legal precedents with current research in best practices. Purpose: The purpose of this research was to examine legal implications on for-credit internship programs and create recommendations based on United States law. Methodology/Approach: This work uses peer-reviewed research to support recommendation in internship development, implementation, and evaluation. Findings/Conclusions: Recommendations for programmatic implementation are made to avoid potential litigation against higher education institutions, faculty, staff, students, and internship placement organizations. Implications: These legal cases inform higher education and considerations in change to organizational policies and practices as it relates to fair labor, program development, and oversight of experiential education. Every year students are physically, mentally, and/or emotionally injured due to hazing. Some injuries are so significant they result in student deaths, yet "hazing is an issue that has been largely overlooked and under studied" (Allan & Madden, 2008, p. 5). Hazing is institutionalized by organizations, clubs, and groups, as well as within campus policy. Student hazing experiences are different for the individual(s) involved, and institutional experiences vary as institutions have their own hazing definitions and policies. This article examines the student career of Dorothy M. Gladish at University College Nottingham from 1910-1915. By drawing on little-studied archives, a range of narratives about Gladish's multiple embodiments of the female student are analysed. In particular, these narratives are situated within the representational contexts of the Gong student magazine, which are marked by rewritings of Victorian literary texts that re-invent the contemporary female student. In the case of Gladish, the symbolic and literal 'trial' was also a feature of her student career. A 'Mock Trial' of Gladish is read alongside accounts of the college council's examination of Professor R. G. F. Dolley, following a complaint by the Gladish family, and their responses to the trial of Oscar Wilde in 1895, contained in a hitherto restricted archive. The platform economy--a marketplace made up of businesses that profit by connecting providers of goods and services with users of those goods and services--challenges us to reevaluate our antidiscrimination laws. This Article considers one such challenge: how should public accommodation laws such as Title II of the Civil Rights Act of 1964 and the Fair Housing Act apply to the housing sector of the platform economy? Such laws, this Article explains, should apply in full to the housing sector. Moreover, legislators should act to remove the current statutory exemption for landlords who rent a small number of housing units and live on the premises from which they rent. While some might raise concerns that closing the exception will infringe upon these smallscale landlords ' First Amendment right tofree association, such concerns have no doctrinal basis. Moreover, closing the exception will in fact have the effect of advancing interests related to both freedom of speech and of association, particularly with respect to the people of color whom public accommodation laws were originally designed to protect. The ideal of diversity so pervades American public life that we now speak of diversity where we once spoke of equality. Yet we seldom pause to consider the costs that have accompanied this shift. In Grutter v. Bollinger, the Supreme Court held that a public university's use of racial preferences in student admissions will not violate equal protection if the challenged admissions policy is narrowly tailored to achieve the university's compelling interest in student body diversity. Rather, however, than quieting public controversies about affirmative action, the decision has been a frequent target of legal and political attack. Grutter and the Court's subsequent decisions in Fisher v. University of Texas at Austin have established the dominant legal conception of diversity, but they have also left many questions unanswered concerning the applicability of Grutter's diversity rationale outside of the educational context. This Article rejects Grutter's rationale, but not the relevance of diversity to the goal of equal opportunity. It demonstrates that Grutter's rationale underserves equal opportunity by deferring to institutional constructions of diversity's benefits, naively equating the achievement of numerical diversity with the accomplishment of those benefits, and failing to distinguish between exploitative and egalitarian uses of diversity. This Article uses the popular conception of diversity found in business settings and managerial literature as a foil for the legal conception. On the one hand, by conceiving of diversity as a business resource, managerial discourse advocates for exploitative uses of diversity, thereby widening the gap between diversity and equal opportunity. On the other hand, because the value of diversity as a business resource turns in part on the professional growth and achievement of individual workers, managerial discourse sometimes invokes the concept of diversity in order to promote new institutional practices that extend professional opportunities to all persons, regardless of social status. Managerial discourse thus reveals important dangers and possibilities inherent within the concept of diversity that have yet to be explored in legal discourse. This Article marshals those lessons to propose a reconstruction of Grutter's diversity rationale to fulfill its potential as an instrument of equal opportunity, even outside of the educational context and even when an institution does not rely on affirmative action.
