The UK Environment Act 2021 presents a valuable case study of the importance and challenges of protecting foundational freedoms in the context of complex and ambiguous environmental legislation. This article argues that the common law principle of legality provides a vital tool for courts to uphold rights imperilled by climate volatility and environmental decline by presuming against rights-infringing interpretations of environmental statutes. Analysing key provisions of the Act and its associated Parliamentary processes, the article focuses on areas such as statutory language clarity, the scope of executive powers, and the framework for public participation. It explores how the principle of legality and other interpretive approaches could help to resolve these issues and ensure the Act is applied in a way that promotes environmental accountability. The article argues that the principle of legality has a crucial role to play in ensuring environmental law delivers on its promise to protect both the environment and foundational freedoms. This paper investigates how pronouns were used by UK government speakers to allocate responsibility to themselves and others in all 92 daily televised COVID-19 briefings that were held between March and June 2020. We identified the referent for every use of the first-person plural pronoun (1PL) as 'inclusive', 'exclusive', or 'ambiguous' and analysed the transitivity patterns in which these pronouns act as Participants. We argue that the UK government uses the inherent ambiguity of this pronoun to strategically mitigate their own responsibility for controlling the spread of the virus, while increasing the amount of responsibility to the general public. In doing so, we propose a transparent and replicable systematic method for identifying the referents of pronouns, which may be useful to other discourse analysts faced with the challenging task of pronoun resolution. Purpose: The authors explore the under-researched area of post-decision evaluation in PPPs (public–private partnerships), focusing upon how and whether Post-decision Project Evaluation (PdPE) is considered and provided for in United Kingdom (UK) public infrastructure projects. Design/methodology/approach: The authors' research design sought insights from overviewing UK PPP planning and more focused exploration of PPP operational practice. The authors combine the extensive analysis of planning documents for operational UK PPP projects with interviews of different stakeholders in PPP projects in one city. Mobilising an open critical perspective, documents were analysed using ethnographic content analysis (ECA) and interviews were analysed using thematic analysis consistent therewith. The authors theorise the absence and ambiguities of PdPE drawing on the sociology of ignorance. Findings: The authors find a long-standing absence and lack of PdPE in PPP projects throughout planning and operational practice, reflecting a dynamic, multi-faceted ignorance. Concerning planning practice, the authors' documentary analysis evidences a trend in PdPE from its absence in the early years (which may indicate some natural or genuine ignorance) to different levels or forms of weak inclusion later. Regarding this inclusion, the authors find strategic ignorance played a substantive role, involving "deliberate engineering" by both public sector and private partners. Interview findings indicate lack of clarity over PdPE and its under-development in PPP practice, deficiencies again suggestive of natural and strategic ignorance. Originality/value: The authors draw from the sociology of ignorance vis-à-vis accounting's absence and ambiguity in the context of PPP, contributing to an under-researched area. While ambiguity is a common feature of international obligations, there is a strong theoretical anticipation that ambiguities may be exploited, and obligations circumvented, under competing interests. This article largely backs this anticipation. The article scrutinises how ambiguous arms export control obligations are handled under strong incentives for arms export. The empirical case explored is the UK government's arms exports to Saudi Arabia during the war in Yemen. Exports continued despite evidence that the Saudi-led coalition was violating international humanitarian law (IHL) in Yemen, and despite obligations not to export if there is a risk that the exported equipment can be used in IHL violations. A resulting legal challenge against the UK government provides valuable information about the role of ambiguity in the implementation of arms export controls. Drawing on primary sources from the legal process, this article argues that the UK government has taken advantage of linguistic ambiguity. The article also argues that the government has engaged in the continuous construction of ambiguity around events in Yemen and around the ideal parameters for arms trade risk assessment. This article draws on the responses of 2,347 football fans (male = 83.4%; female = 16.6%) collected via an online survey from September 2015 to January 2016 regarding the position of women (as fans, coaches, referees, journalists, board members, and administrators) in the gender order in men's professional association football in the United Kingdom. Engaging with the theoretical framework of hegemonic masculinity, the authors addressed two recurring themes emerging from the results: the exclusionary practices of sexism and subordination aimed at women in men's football and the extent to which women are regarded as "authentic" fans, given the gender inequalities and power imbalances they face in their practice of fandom in men's football. The article concludes by suggesting that, although there are emerging "progressive" male attitudes toward women in men's football, hegemonic and complicit masculinities remain a significant feature in the culture of fandom in men's professional football in the United Kingdom. Magnitude-based PDFF (Proton Density Fat Fraction) and R 2 ∗ mapping with resolved water-fat ambiguity is extended to calculate field inhomogeneity (field map) using the phase images. The estimation is formulated in matrix form, resolving the field map in a least-squares sense. PDFF and R 2 ∗ from magnitude fitting may be updated using the estimated field maps. The limits of quantification of our voxel-independent implementation were assessed. Bland-Altman was used to compare PDFF and field maps from our method against a reference complex-based method on 152 UK Biobank subjects (1.5 T Siemens). A separate acquisition (3 T Siemens) presenting field inhomogeneities was also used. The proposed field mapping was accurate beyond double the complex-based limit range. High agreement was obtained between the proposed method and the reference in UK. Robust field mapping was observed at 3 T, for inhomogeneities over 400 Hz including rapid variation across edges. Field mapping following unambiguous magnitude-based water-fat separation was demonstrated in-vivo and showed potential at 3 T. [ABSTRACT FROM AUTHOR]

This is the first comparative empirical study of miscommunication in US police interrogations and UK police interviews with suspects. The research was based on an extensive real-life data consisting of 100 transcripts. The main goal was to detect when and why miscommunication occurs in these two policing contexts, whether and how it gets resolved, and what the consequences of miscommunication may be. Miscommunication arises when speech participants draw opposing inferences from the same communicative exchange. Two main sources of miscommunication were identified: a) inferential ambiguity and b) linguistic complexity. The quantitative and qualitative analyses showed that, while the types of miscommunication are shared in the two jurisdictions, their frequencies and functions differ in some respects. Namely, deliberate miscommunication is more likely to be found in the US context while in the UK miscommunication is more likely to occur inadvertently. On the other hand, linguistic complexity gives rise to miscommunication more often in the UK than in US police communication. We discuss the results with respect to the two different approaches to questioning suspects in the two locales and translate our findings into practical applications for the training of law enforcement and language professionals worldwide. This article considers the Protocol on Ireland/Northern Ireland in the UK–EU Withdrawal Agreement as a 'flexible and imaginative' response to the problems that Brexit has created for the island of Ireland. It looks at the purpose of the Protocol and its origins, noting the reasons why flexibility was required from both sides. It then considers the ways in which precariousness from its conception has been demonstrated in its first year of operation. This focuses upon four main areas: implementation, dynamic alignment, the democratic consent vote, and the UK–EU relationship. Its core argument is the 'flexibility' that the Protocol requires also means a certain degree of ambiguity. In the absence of a stable UK–EU relationship, this precariousness could exacerbate the difficulties of meeting the policy challenges that surround the Protocol for Northern Ireland, the UK, Ireland and the EU. Background: Adolescence is characterized by identity formation, exploration and initiation of intimate relationships. Much of this occurs at school, making schools key sites of sexual harassment. Schools often lack awareness and understanding of the issue, and UK research on the topic is scarce. We explored prevalence and perceptions of sexual harassment in a school-based mixed-methods study of 13–17 year-old Scottish adolescents. Methods: A student survey (N = 638) assessed past 3-months school-based victimization and perpetration prevalence via 17 behavioral items based on the most commonly used school-based sexual harassment measure ('Hostile Hallways'). Eighteen focus groups (N = 119 students) explored which of 10 behaviors were perceived as harassing/unacceptable and why. Results: Two-thirds reported any victimization: 64.7% 'visual/verbal' (e.g. sexual jokes) and 34.3% 'contact/personally-invasive' behaviors (e.g. sexual touching; most of whom also reported experiencing visual/verbal types) in the past 3-months. Data suggested a gateway effect, such that contact/personally-invasive behaviors are more likely to be reported by those also reporting more common visual/verbal behaviors. Some survey participants reported being unsure about whether they had experienced certain behaviors; and in focus groups, participants expressed uncertainty regarding the acceptability of most behaviors. Ambiguities centered on behavioral context and enactment including: degree of pressure, persistence and physicality; degree of familiarity between the instigator-recipient; and perception of the instigator's intent. In attempting to resolve ambiguities, students applied normative schemas underpinned by rights (to dignity, respect and equality) and 'knowingness', usually engendered by friendship. Conclusions: Our study confirms school-based sexual harassment is common but also finds significant nuance in the ways in which students distinguish between acceptable and harassing. This paper explains the background to the notion of the 'geography of discontent' in the context of UK interregional inequalities and political shocks. The paper then examines how the geography of discontent has bound conflicting political and economic narratives together in ways, which makes the correcting for these regional imbalances all the more difficult, and results in ambiguity and a lack of clarity regarding the nature and form which Levelling Up processes should take. Museums' vibrancy and viability are heavily dependent on supporting the development and well-being of talented and dedicated people. Although issues of organisational culture and good management have gained increasing importance for the sector, there is little empirical research on how leadership and day-to-day work conditions in museums shape workers' job satisfaction and organisational commitment. Framed through organisation theory, this paper draws on survey data from UK museum staff and volunteers to examine the role of transformational leadership in driving workforce job satisfaction and organisational commitment outcomes, as mediated by key job resources and demands. Our findings show that where a transformational approach to leadership effectively communicates a shared organisational mission there is a positive impact on worker attitudes. Practical measures are suggested on how museum leaders can achieve such outcomes by inviting worker participation in decision-making, promoting a sense of task significance, highlighting impact on museum beneficiaries and reducing role ambiguity. We compare and contrast the UK and China as maximum variation cases for understanding long energy transitions from the state and the firm perspectives. We present case histories and corpus-based computer-assisted textual analyses on the long energy transitions in both countries. With these, we explore and explain how and why energy supply firms respond the way they do to the institutional ambiguities and complexities that characterize the long energy transitions in each case. Our findings demonstrate that a centrally coordinated and imposed approach by the state can generate institutional clarity in long energy transitions, which is quickly seized on by firms striving to preserve and increase their resources and influence. Such clarity and transition processes lose momentum owing to the perennial trilemma of energy affordability, security and sustainability. Market-based mechanisms to trigger and sustain long energy transitions, complemented with focused and continuous state interventions (e.g. incentives, taxation), provide a more effective and accountable institutional framework for the state and energy firms to deal with the energy trilemma. Irrespective of the logic of the type of economy that manifests the backdrop for any long energy transition process, institutional ambiguity and complexity never disappear completely, owing to both the energy trilemma and the institutional multiplicities. Scholars studying political perceptions find evidence of the presence of projection effects. Yet several questions still need to be explored as to the time frame of the effect and the factors affecting projection. In particular, although the effect of ambiguity on projection has often been assumed and has been tested in a formal model (Jensen, 2009), no empirical evidence supports the idea that ambiguity fosters projection. We analyze an online survey conducted before and after the 2017 UK General Election. In addition to testing for the presence of projection effects on four different policy issues, we show that ambiguity fosters projection. Purpose: The purpose of this paper is to assess whether firms' transparency in supply chain (TISC) statements indicate that substantive action is being taken on modern slavery in UK government supply chains. Design/methodology/approach: The authors analyse 66 of the UK government's strategic suppliers' TISC statements and 20 key documents related to the policy intent of the UK Parliament, 2015 TISC requirements. Qualitative document analysis identifies what suppliers say they are doing and what they are not saying to provide novel insights into how firms employ ambiguity to avoid timely action on modern slavery in their supply chains A set of propositions are developed. Findings: The authors elaborate the concepts of time and change in socially sustainable supply chains and illustrate how firms use ambiguity in TISC statements as a highly strategic form of action to defend the status quo, reduce accountability and delay action for modern slavery within supply chains. The authors identify three ambiguous techniques: defensive reassurance, transfer responsibility and scope reduction that deviate from the policy intention of collaborative action. Social implications: The results illustrates how ambiguity is preventing firms from taking collaborative action to tackle modern slavery in their supply chains. The lack of action as a result of ambiguity protects firms, rather than potential victims of modern slavery. Originality/value: Prior research focuses on technical compliance rather than the content of firms' TISC statements. This qualitative study provides novel insights into the policy-resistant effects of ambiguity and highlights the dynamic and instrumental role of modern slavery reporting. Theoretically, we identify accountability as an essential concept to address the causes of modern slavery in supply chains and for developing collaborative supply chain environments to tackle the issues. Whereas social theorists, qualitative investigators and survey-based analysts suggest advanced economies are increasingly characterized by managerial job insecurity, database and questionnaire researchers propose relatively stable tenure rates for managers. This article aims to make sense of this ambiguity. First, following interviews with managers in Japan, the UK and the USA, the authors offer support for the 'global convergence' thesis, through data reflecting greater job insecurity generated by comparable and recurrent corporate restructuring. Second, considering research suggesting relative stability in managerial tenure rates, the authors argue that their findings – signifying increased insecurity – can be explained in terms of the 'perceptual politics' of US-style shareholder capitalism impinging, hegemonically, upon occupational sensibilities. Third, in conclusion, they suggest that everyday managerial experience can be understood in light of corporations purposively instilling a perceptual 'insecurity message' in managers, essentially as part of a tangible control strategy directed at the inexorable ratcheting-up of management productivity demands globally. The UK's decision to leave the European Union in 2016 threatens to open up a range of territorial management issues that have long remained unexplored. Since 1999, the UK's devolution settlements have allowed divergent constitutional narratives to develop and to co-exist. This 'constructive ambiguity' has led UK territorial governance to take the form of 'Schrodinger's devolution', where Scotland, Wales and Northern Ireland have and have not experienced fundamental constitutional change. However, the technical requirements of Brexit will mandate the need for exact decisions where 'constructive ambiguity' has existed up to now. The UK's unwritten constitution, limited intergovernmental relations and a lack of shared rule mechanisms mean that these technical decisions have the potential to lead to ongoing political instability. Abstract Background In many regions of the world, vaccine hesitancy has become an important concern to public health. A key part of any effective solution to it is to gain an in-depth understanding of the problem: its scope, who holds hesitant views and for which reasons. Methods We adapt the original 10-item Vaccine Hesitancy Scale (VHS), which targets parental attitudes, to a more generic version that captures general attitudes to vaccination. We use this adapted VHS in a sample of 1402 British citizens, selected from a large online panel (N > 1,000,000) based on quota for age, gender, educational attainment and region (response rate 43%). The existence of VHS subscales is evaluated via exploratory and confirmatory factor analysis. We describe the extent of vaccine hesitancy in the sample, and use simple and multiple regression analysis to examine associations between respondent characteristics and vaccine hesitancy. Results Despite ambiguities in defining hesitancy, we found that a substantial part of our sample held hesitant views about vaccination, particularly for those items reflecting aversion to risks of side effects. Four percent responded in a hesitant way to all ten items and ninety to at least one of the ten items. In line with recent studies in other populations, we identified two subscales within the VHS: lack of confidence in the need for vaccines and aversion to the risk of side effects. We found significant associations between hesitancy and various respondent characteristics but the predictive power of these associations remained limited. Conclusion Our study suggests that whereas a substantial percentage of the British population is vaccine hesitant, these views are not clustered in typical demographic features. The small but important adaptation of the VHS to target general attitudes seems to result in highly similar psychometric characteristics as the original scale that exclusively targets parents. Abstract Eye movement modeling examples (EMME) are video modeling examples with the model's eye movements superimposed. Thus far, EMME on problem-solving tasks seem to be effective for guiding students' attention, but this does not translate into higher learning outcomes. We therefore investigated the role of ambiguity of the verbal explanation and prior knowledge in the effectiveness of EMME on geometry problems. In Experiment 1, 57 university students observed EMME or regular video modeling examples (ME) with ambiguous verbal explanations. Eye-tracking data revealed that –as in prior research with unambiguous explanations- EMME successfully guided students' attention but did not improve test performance, possibly due to students' high prior knowledge. Therefore, Experiment 2, was conducted with 108 secondary education students who had less prior knowledge, using a 2 (EMME/ME) x 2 (ambiguous/unambiguous explanations) between-subjects design. Verbal ambiguity did not affect learning, but students in the EMME conditions outperformed those in the ME conditions. Household projections have been a critical tool in establishing top-down hierarchical frameworks through which planning systems impose new housing requirements on localities. This article re-assesses the role of household projections in the context of two recent factors. The first is the emergence of increasingly localised spatial governance arrangements that enhance the scope to challenge household projections data. The second is the gradual emergence of the economy from recession and its impact on interpretation of household projections data. This article examines the modest state of reflective practice in management education despite the increasing need for approaches that challenge the traditional overemphasis on rational tools and techniques. Business communication and business writing in UK management education generally take a very conventional approach to genre. As an antidote, emphasis is laid here on the use of journaling in business education including the lecturers actually doing it themselves routinely. The emerging interdependent world order poses new challenges for States and citizens alike. For States, interdependence has meant a new concern with integration, whilst for citizens and authorities alike, greater mobility has raised new concerns about recognition of competences, qualifications, quality and transparency. The introduction of learning outcomes is one of the principal instruments to achieve this in higher education. This article analyses how the implementation of higher education learning outcomes (HELOs) can be seen as ambiguous governance and management tools, manifested as parts of international policy development and policy trends. These ambiguous tools intertwine with different disciplinary and stakeholder networks. The desire to implement HELOs in a more or less uniform way across as diverse contexts (countries, disciplines, institutions) as possible has led to a design strategy that favours generic definitions of learning outcomes. In the implementation process, these generic HELOs are experienced as ambiguous, meaning that they are characterised by an openness to different interpretations. This opens up a space of discretionary and interpretational latitude, either because HELOs are assimilated to traditional path dependencies, or because they allow institutional agents (such as institutional leaders and others) the space to introduce change. The ambiguity of HELOs simultaneously provides the flexibility for contextually-diverse implementation, ensures less comparability than initially envisaged, and opens up the possibility for change, although change is contingent on structures and processes that are external to the policy process itself. This paper explores the effectiveness of financial management tools in regulating the use of resources by arm's length bodies (ALBs) in a period of fiscal stress. The paper presents research undertaken into the implementation of a new financial management tool for ALBs in the UK since the 2008 financial crisis. Drawing on conflict ambiguity theory, the paper shows how the effectiveness of such tools is affected by deep-rooted tensions implicit within public governance. This gives rise to micro-level conflict over the means of achieving fiscal regulation, underpinned by macro-level ambiguity over the logic of governance pursued by the government. The article discusses the basic concepts of equivocation and ambiguity in late sixteenth-century education in England. Topics covered include the ancient and Renaissance texts used in universities at the time, the possible shaping of attitudes towards ambiguity by university education, and the ways of disagreement from varied interpretations of the same text. Also noted is the moralistic approach to the use of ambiguity in such Renaissance treatments as Melanchthon's "Elementorum rhetorices."

Purpose – The purpose of this paper is to examine the factors that might contribute to the ease with which marketing executives in UK charities who have been promoted to senior general management positions adjust to the occupancy of these roles. Design/methodology/approach – In total, 37 individuals with functional marketing backgrounds currently holding top general management positions in large fundraising charities were interviewed using a frame-worked occupational autobiographic narrative approach. The research was informed by aspects of newcomer adjustment theory, notably uncertainty reduction theory. Findings – Social and personal considerations were much more important determinants of the ease of assimilation into top management positions in charities than were technical job-related matters. Role ambiguity constituted the main barrier to smooth adjustment. Mentoring, planned induction programmes, the nature of a person’s past work experience and the individual’s social status critically affected how readily a marketer fitted into a top management role. Disparate sets of factors influenced different elements of managerial newcomer adjustment (role clarity, self-efficacy, and social acceptance). Research limitations/implications – As the participants in the study needed to satisfy certain narrowly defined criteria and to work in a single sector (large fundraising charities) the sample was necessarily small. It was not possible to explore the effects on operational performance of varying degrees of ease of newcomer adjustment. Practical implications – Individuals promoted to top management posts in charities should try psychologically to break with the past and should not be afraid of projecting a strong functional professional identity to their new peers. These recommendations can be expected to apply to organisations in general which, like large charities, need senior management mentoring and induction programmes to assist recently promoted individuals from function-specific backgrounds; job descriptions for top management posts that are clear and embody realistic expectations; and “shadowing” and training activities for newly appointed senior managers with function-specific backgrounds. Originality/value – The study is the first to apply newcomer adjustment theory to the assimilation of functional managers into more senior general management. It examines a broader range of potential variables affecting managerial newcomer adjustment than has previously been considered. The higher skills policy of the UK New Labour Government emerged from the recommendations of the Leitch Review of Skills, and was implemented in England between 2007 and 2010. The policy aimed to encourage higher education (HE) institutions to engage with employers and employer representative bodies to design and deliver HE provision that reflected the needs of employers. Using key policy documents and evidence submitted to a select committee inquiry, aspects of ambiguity and conflict in the implementation of this policy are explored. This focuses on three specific areas where disagreements amongst parties, or with government, were observed, and ambiguities of policy means and objectives. Although conflict amongst interested parties is evident, this was not extensive within the HE sector as the policy was not seen as relevant to all institutions. The demonstrable ambiguity enables the policy to be absorbed and made appropriate to the norms and culture of the HE sector. Throughout this study, Joe Lampton is examined as a model hero of the "Angry Young Men" movement in the post-war Britain. In the first place, the movement and its basic notions are explained; then, the attention is directed to the patterns of hero of the 1950s' fictions. After the reasons of alienation for those models of hero are posed, the paper deals with Joe Lampton's particular case of disappointment and alienation. For the rest part of the study, Joe Lampton's psyche, which is full of self-created imaginary conceptions, is at the center. Through a comparative stance to his past and present mindset, it is claimed that after a while, the protagonist becomes the victim of his own stereotypical characters. The dilemma between his lower status based on his past and his new identity adopted among the upper classes brings about an ambiguity for both the identity of the protagonist and the end of the story. Speech carries accent information relevant to determining the speaker's linguistic and social background. A series of web-based experiments demonstrate that accent cues can modulate access to word meaning. In Experiments 1-3, British participants were more likely to retrieve the American dominant meaning (e.g., hat meaning of "bonnet") in a word association task if they heard the words in an American than a British accent. In addition, results from a speeded semantic decision task (Experiment 4) and sentence comprehension task (Experiment 5) confirm that accent modulates on-line meaning retrieval such that comprehension of ambiguous words is easier when the relevant word meaning is dominant in the speaker's dialect. Critically, neutral-accent speech items, created by morphing British- and American-accented recordings, were interpreted in a similar way to accented words when embedded in a context of accented words (Experiment 2). This finding indicates that listeners do not use accent to guide meaning retrieval on a word-by-word basis; instead they use accent information to determine the dialectic identity of a speaker and then use their experience of that dialect to guide meaning access for all words spoken by that person. These results motivate a speaker-model account of spoken word recognition in which comprehenders determine key characteristics of their interlocutor and use this knowledge to guide word meaning access., (Copyright © 2017 The Authors.
