16 Nisan 2017’de yapılan halk oylaması ile getirilen en önemli hukuksal araçlardan biri Cumhurbaşkanlığı Kararnamesidir. Cumhurbaşkanlığı Kararnameleri ile Anayasa değişikliği kapsamında yeni hükümet sistemi ile yapılan değişikliklerle en çok öne çıkanlardan biri Cumhurbaşkanına verilen bir yetki olarak TBMM’den bir yetki kanununa dayanmaksızın kararname çıkarılabilmesidir. Kararname çıkarma yetkisi ise genel, soyut ve bir kez kullanmakla etkisi tükenmeyen norm koyma gücünü anlatmaktadır. 16 Nisan 2017’de yapılan değişiklik öncesinde yani Parlamenter hükümet siteminde, kuvvetler ayrılığının bir zorunluluğu olarak norm koyma yetkisi TBMM’ye aittir. Ancak 16 Nisan 2017’de yapılan değişiklik sonrasında Cumhurbaşkanına verilen Cumhurbaşkanlığı Kararnamesi çıkarma yetkisi bu hususa ayrıksı bir düzenleme getirmektedir.Çalışmada yeni anayasal düzen içerisinde ve hukuki rejim çerçevesinde yürütmenin düzenleyici işlemleri olarak nitelenen Cumhurbaşkanlığı Kararnameleri, diğer düzenleyici işlemler ile karşılaştırmalı olarak, yeni düzenleme sınırları gözetilerek irdelenmiştir. Cumhurbaşkanlığı Kararnameleri hem olağan dönem hem de olağan üstü dönem olmak üzere iki farklı hukuki rejimde Anayasa Mahkemesi kararları ışığında tartışılarak normlar hiyerarşisindeki statüleri doktrindeki karşılaştırmalı görüşler etrafında ele alınmaya çalışılmıştır. Özellikle Cumhurbaşkanlığı hükümet sistemi modeli içinde normun irdelenmesi yeni sistemin işlevselliği açısından da önem arz etmektedir.

With the Constitutional amendment dated April 16, 2017, the President, who is the sole executive organ, was given the authority to issue a Presidential decree, which includes the primary and first-hand regulatory authority, similar to the legislative power. Unlike other administrative regulations, the Constitutional Court has the authority and duty to examine the claims of unconstitutionality of presidential decrees. The Constitutional Court has the authority to audit Presidential decrees both in terms of form and substance within the scope of an abstract review of norms, but only in terms of substance within the scope of concrete norm control. Starting from its first decision on January 23, 2020, the Constitutional Court has reviewed 153 separate provisions in 43 decisions and has annulled approximately 40% of them. Another point that draws attention in the decisions given by the court is that the unanimous decisions are less in number than the decisions made by the majority of the votes. In the study, the subjects discussed such as the legal nature and scope of the Presidential decrees, whether they create a protected area, their place in the hierarchy of norms, and the forms and types of supervision by the Constitutional Court, the statistical data of the decisions made by the Court and the important decisions determined are examined. Evaluation of the use of glyphosate and legumes in valencia orange (Citrus sinensis L. Osbeck), in the north of Veracruz: case study. The objective of the case study was to contribute to the knowledge of herbicides (mainly glyphosate) and legumes of valencia orange producers in northern Veracruz. The study was carried out in the year 2021, with producers from three municipalities located in the north of Veracruz: Papantla, Álamo Temapache and Ixhuatlan de Madero. A total of 55 interviews were carried out. The interview that was conducted was structured around three sections: personal information of the interview respondent, information about herbicides, and information about legumes. The characteristics found in this study indicate that the majority of producers continue to use herbicides, 80% do not know the term glyphosate even though it turns out to be the main active ingredient of several of the herbicides that they apply and despite knowing that these can be very dangerous due to various reasons, they continue to use them without any protective equipment, due to how easy, fast and cheap their application is. However, regardless of everything, the producers are in the best disposition to know and cultivate leguminous plants in their plots to observe their characteristics, benefits and advantages in weed control. The new government system of Turkey can be described as hyper-presidentialism, this is because the president then becomes the arbiter of all powers. In another word, the power to enact decrees, appoint bureaucrats and judicial officials into offices, and the power to dissolve a parliament belongs solely to the president. As strong presidency fuse with disciplined party system as well as concurrent elections and 10 percent electoral threshold, the president possibly poses a great danger to the separation of powers. Additionally, with regards to the presidential term, the president constitutionally holds the power to be elected only for two terms in Turkey. However, Erdoğan and his supporters believe that the 2017 constitutional amendments that changed the system of government has reset the agenda. Thus, the 2017 amendments offered Erdoğan a secret opportunity to join the presidential election race for a third, and even a fourth term. [ABSTRACT FROM AUTHOR]

The possession and regulated carrying of weapons is a reality in Ecuador due to all the constitutional antecedents through executive decrees of the last periods of government. Although the use of weapons was not allowed, there were special rules for shrimp and livestock groups. But, that was the case until Executive Decree No. 707, which authorizes the carrying of weapons for civilian use for personal defense. Thus, the draft Organic Law Reforming Various Legal Bodies for the Strengthening of Institutional Capacities and the Security Law was created through the legislative power. This allowed the Comprehensive Organic Criminal Code to be reformed in its article 360, before the new reform to understand it in criminal proceedings, the criminal type must be analyzed, its objective typicity, through a subsumption of the conduct to the objective elements, it is important identify the active subject, (the person) passive subject (the State), governing verb (acquiring and taking with them), the normative element (acquisition of the weapon) descriptive (the legality of acquisition) and evaluative (authorization of the State) of the type. Although the norm allows the use of weapons in cases of legitimate defense, it must be understood from the dogmatic category of illegality, formal and material. In any case, in particular, it must comply with the requirements established by the doctrine and the law that may allege the cause of justification., La tenencia y porte regulado de Armas es una realidad en el Ecuador por todos los antecedentes constitucionales mediante decretos ejecutivos de los últimos periodos de gobierno. Si bien, no se permitía el uso de armas, si existía reglas especiales para los grupos camaroneros y ganaderos. Pero, así fue hasta el Decreto Ejecutivo No. 707 que autoriza el porte de armas de uso civil para defensa personal. Es así, que se crea el proyecto de Ley Orgánica Reformatoria a Varios Cuerpos Legales para el Fortalecimiento de las Capacidades Institucionales y la Ley de Seguridad mediante el poder legislativo. Esto permitió que el Código Orgánico Integral Penal sea reformado en su artículo 360, ante la nueva reforma para entenderla en procesos penales se debe analizar el tipo penal, su tipicidad objetiva, a través de una subsunción de la conducta a los elementos objetivos, es importante identificar al sujeto activo, (la persona) sujeto pasivo (el Estado), verbo rector (adquiriendo y llevar consigo), el elemento normativo (adquisición del arma) descriptivo (la licitud de adquisición) y valorativo (autorización del Estado) del tipo. Si bien la norma permite el uso de armas en casos de legítima defensa, se debe entender desde la categoría dogmática de la antijuricidad, formal y material. En cualquier caso, en particular debe cumplir con los requisitos que establece la doctrina y de la ley que pueda alegar la causa de justificación.

With the adoption of the Turkish Type Presidential System in 2017, Article 104/17 of the Constitution issues a presidential decree on the authority of the president. It's about removing the CBK. It can be used in two ways, CBKs and special cases. It can be designed for the maturation of ordinary CBKs. It is also interspersed with the special selection of the constitution to transform it into CBKs. With the understanding of the Turkish Type Presidential system, a sharp and clear separation between the forces has been adopted. In this respect, the President has been given the authority to issue decrees on his own. The Council of Ministers is described as the Presidential Cabinet. The appointment and dismissal of ministers by the President of the Republic have been accepted, and the individual and collective responsibility of the ministers to the parliament has been abolished. If a member of the parliament is appointed as a minister, their membership in parliament is reduced and their participation in parliamentary work ends. Therefore, the authority of the council of ministers to propose laws has been abolished. The President, elected by the people, has become the sole dominant element of the executive. In addition, the President's coming to power through elections means that he takes his power, support and legitimacy from the people. There was no need for the parliament to be authorized by the President to issue a Presidential decree., 2017 yılında yapılan Anayasa değişikliği ile Türk Tipi Başkanlık sistemi kabul edilmiş ve Anayasanın 104/17. maddesi ile Cumhurbaşkanına, yürütme yetkisine ilişkin konularda Cumhurbaşkanlığı kararnamesi (CBK) çıkarma yetkisi tanınmıştır. Böylelikle Cumhurbaşkanı, yürütme yetkisi alanı içerisinde yer alan tüm konularda CBK çıkarma yetkisi ile donatılmıştır. CBK'lar olağan ve olağanüstü dönemlerde olmak üzere iki şekilde çıkarılabilmektedir. Olağan dönem CBK’ların hukuki rejimi Anayasanın 104/17. maddesinde, olağanüstü dönemlerde çıkarılacak CBK’lar ise Anayasanın 119/6-7. maddelerinde düzenlenmiştir. Ayrıca CBK’lara ilişkin düzenlemeler Anayasanın özel hükümlerine de serpiştirilmiştir. Türk Tipi Başkanlık sistemi anlayışı ile kuvvetler arasında sert ve net ayrılık benimsenmiştir. Bu yönü ile Cumhurbaşkanına tek başına kararname çıkarma yetkisi tanınmıştır. Bakanlar kurulu, Cumhurbaşkanlığı kabinesi olarak nitelendirilmektedir. Bakanların Cumhurbaşkanı tarafından atanması ve görevlerine son verilmesi kabul edilmiş, bakanların parlamentoya karşı bireysel ve kolektif sorumluğu kaldırılmıştır. Parlamento üyesinin bakan olarak atanması halinde parlamento üyeliği düşmekte ve parlamento çalışmalarına katılımları sona ermektedir. Dolayısı ile bakanlar kurulunun kanun önerme yetkisi de kalkmıştır. Halk tarafından seçilen Cumhurbaşkanı, yürütmenin tek hâkim unsuru haline gelmiştir. Ayrıca Cumhurbaşkanın seçim vasıtasıyla işbaşına gelmesi, gücünü, dayanağını ve meşruluğunu halktan alması anlamına da gelmektedir. Cumhurbaşkanının CBK çıkarabilmesi için parlamento tarafından yetkilendirilmesine gerek yoktur.
