Jury trials in bankruptcy court are rare, with an average of 13 per year nationwide over the last five years. However, this article argues that the assumption that bankruptcy jury trials are too difficult to administer is unfounded. The passage of 28 U.S.C. § 157(e) in 1994 settled the question of whether bankruptcy judges can preside over jury trials, as long as all parties give their consent. The article provides guidance on how to successfully plan a bankruptcy jury trial, including considerations of location, statutory guidance, and trial management.
