The Sino – Japanese Peace Treaty signed in April 1952 not only set the basic framework for diplomatic relations between China, Japan, and Taiwan until 1972, but was also significant in substantially determining the legal status of Chinese residents in Japan during the same period. Subsequently, this paper analyzes both the legislative process in Japan leading up to the Sino – Japanese Peace Treaty and the process of diplomatic negotiations between Japan and China and identifies the following points. In the process of legislating the Immigration Control Ordinance, the Japanese government, while recognizing that Chinese mainlanders in Japan were Chinese nationals, considered them to be outside the legal jurisdiction of the Republic of China (R.O.C.) government, and while recognizing the jurisdiction of the R.O.C. government over Formosans in Japan to a certain extent, interpreted "the ultimate nationality of Taiwanese people has not been determined" from the standpoint that the legal status of Taiwan was undetermined. The R.O.C. government was forced to accept the Japanese government's treatment regarding the legal status of Chinese residents in Japan because it was unable to have its sovereignty over Taiwan and the Penghu Islands clearly stated in the articles of the Sino – Japanese Peace Treaty out of consideration for the United States, which acted as an intermediary in the negotiations of the treaty. Examining the coverage in seven major Japanese and Taiwanese daily newspapers of a selection of events involving both societies in the first decade of the twenty-first century, this paper investigates the phenomenon of rhetorical instrumentalization of the past for present ideological purposes. The concerns of this study are the processes of dehistorization in Japanese and Taiwanese news and public debate, and through a critical thematic reading of the sources I argue that a motif of Taiwanese repetition and imitation of Japan runs through all the studied cases as a basic narrative formula. Analyzed cases include news presentations of Taiwanese politicians visiting Japan, controversial statements on Taiwan by a Japanese cabinet minister, infrastructure developments in present-day Taiwan and the controversy surrounding a Japanese guidebook to Taiwanese prostitution. Throughout the material, Taiwan is pictured as ideally progressing along a trajectory marked out by Japan and the two are cast in fixed roles that recall their relative positions in the half-century of Japanese colonization of Taiwan: Japan teaches Taiwan order, unity and modern development and Taiwan studies Japan's past to overcome the challenges of its own present. Or Taiwan spontaneously imitates Japanese precedence as a consequence of its own development. This paper fundamentally challenges the rationale underlying strategic instrumentalization of the past and draws critical attention to the paradoxical fact that the use of the repetition formula positions the covered news events in a thematic field of time-lag and retrospection. The article offers information on the impact of globalization which is supporting transnational mobility of knowledge and talent from Japan to Taiwan. It mentions the Japanese Thin Film Transistor-Liquid Crystal Display (TFT-LCD)industry which is spreading the technical knowledge and Japanese talent drain helping in Taiwan's future economic linkage with China. It also discusses several topics including Transnational Talent Diffusion, absorption of Japanese technologies by Taiwanese firms for technological talent and development of domestic manufacturing technology.

In the 1990s and into the new century, increased Japanese sympathy toward Taiwan and antipathy toward mainland China led to a series of moves to improve treatment of Taiwan, including enhanced transportation links, a higher level and frequency of official contacts, posting of a military attaché, and expressions of support for Taiwan's participation in regional and international organizations. Nevertheless, Japan remains firmly wedded to a One China policy that opposes both the use of force by the mainland and a declaration by Taiwan of independence from China. Japan's willingness to cooperate with the United States to defend Taiwan is increasingly in doubt. The sources of Japan's supportive but restrained policy include the decline of traditional ties with Taiwan, the increasing size of the mainland market, and above all a perception of security risks that ultimately diverges sharply from that of Taiwan.
