Background: To establish national prevalence of child maltreatment, reliable, valid and contextually appropriate measurement is needed. This paper outlines the refinement, adaptation and testing of child maltreatment sections of the Juvenile Victimization Questionnaire (JVQ)-R2 for use in the Australian context., Methods: Three phases were undertaken: 1) Conceptual analysis of the five forms of child maltreatment (physical abuse, sexual abuse, emotional or psychological abuse, neglect, and experience of domestic violence), item mapping and review, item development, and independent expert review; 2) Cognitive testing with members of the general population, and individuals who have experienced maltreatment; and 3) Pilot testing and quantitative psychometric assessment with a random sample of Australians aged 16-65+ years., Results: The final measure included a total of 17 child maltreatment screener items, assessing Physical Abuse (2 items), Sexual abuse (5 items (including 2 non-contact items and 3 contact items), Emotional Abuse (3 items), Neglect (3 items), and Experience of Domestic Violence (4 items). Screener items were also included on corporal punishment (1 item), and internet sexual victimization (2 items). The final 17-item revised JVQ had high face and conceptual validity and good internal reliability (α = 0.86 and Ω = 0.87). Test re-test reliability was moderate to high for individual screeners ranging from k = 0.45 to 0.89., Conclusions: Results indicate the Juvenile Victimization Questionnaire-R2: Adapted Version (Australian Child Maltreatment Study) is a suitable instrument for assessing population-wide prevalence of maltreatment. Background: Forensic evidence collection following sexual assault has an important medico-legal role. Despite the advent of DNA profiling, research into the optimisation of forensic biological specimen collection is limited. This has led to inconsistent and variable guidelines for forensic evidence collection. The guidelines in this jurisdiction (Victoria, Australia) recommends that specimens be collected up to 7 days following sexual assault in some circumstances. The aims of this study were to determine the optimal times post sexual assault for the collection of forensic biological evidence in paediatric cases (aged 0-17 years)., Methods: A retrospective review of paediatric sexual assault cases seen by the Victorian Forensic Paediatric Medical Service (VFPMS) between 1 January 2009, and 1 May 2016, was undertaken. Specimen site and collection times post assault were collated from VFPMS medico-legal reports and compared with the forensic evidence analysis results reported by the Victoria Police, Forensic Services Department. In addition, a survey of recommended forensic specimen collection times post assault in the different Australian jurisdictions was undertaken for comparison., Results: Within the 6 year 5 month period studied there were 122 cases consisting of 562 different forensic specimens that were collected and analysed. 62 (51%) of cases produced one or more positive forensic result and, of the 562 specimens collected, 153 (27%) were positive for one or more of foreign DNA, spermatozoa, semen or saliva. Foreign DNA was more likely to be found if forensic specimens were collected during the first 24 h after the assault as compared with those collected at 25-48 h, (p < 0.005). Similarly, spermatozoa were identified more frequently on swabs collected at 0-24 h compared to 25-48 h (p < 0.002). Foreign DNA was not identified beyond 48 h post assault and spermatozoa were not identified beyond 36 h. Saliva and semen were not identified beyond 24 h. The youngest victims with positive forensic evidence were 2-3 years old. The survey of current forensic specimen collection practice in Australia shows that the guidelines for timing of forensic evidence collection in child sexual assault cases is highly variable between jurisdictions., Conclusions: Our results highlight the importance of collecting forensic specimens as a matter of urgency, regardless of age, within the first 48 h post assault. In Australia and internationally, Indigenous children are seriously overrepresented in the child welfare system. This article provides an overview of literature investigating the needs of Indigenous children in residential care facilities. The provision of culturally safe and trauma-informed therapeutic care to Indigenous children and young people in residential care recognizes that the trauma and violence that they have experienced is exacerbated by their Indigeneity due to the colonial histories presenting. Utilizing a systematic scoping review methodology, the study returned a total of 637 peer-reviewed articles that were identified and reviewed for inclusion. The process of exclusion resulted in the inclusion of eight peer-reviewed studies and 51 reports and discussion papers sourced from gray literature. Findings from this study, though dearth, indicate that trauma-informed and culturally safe interventions play a significant role in Indigenous children's health and well-being while in care. Their experiences of abuse and neglect transcend individual trauma and include intergenerational pain and suffering resulting from long-lasting impacts of colonization, displacement from culture and country, genocidal policies, racism, and the overall systemic disadvantage. As such, a therapeutic response, embedded within Indigenous cultural frameworks and knowledges of trauma, is not only important but absolutely necessary and aims to acknowledge the intersectionality between the needs of Indigenous children in care and the complex systemic disadvantage impacting them. This paper examines whether adolescents can be reliably categorized into subgroups based on their patterns of anxiety levels over time and whether low levels of social support from parents, peers, and their school, and high levels of peer victimization, predict a pattern of increasing anxiety. Participants were 3392 youth from the Longitudinal Study of Australia's Children (LSAC). Youth-reported anxiety was measured at three occasions at ages 12/13 years, 14/15 years, and 16/17 years, with social support and victimization assessed at age 12/13 years. Anxiety trajectories were identified using latent class growth mixture modelling, and predictors of class membership were examined using multinomial logistic regression analyses. Three discrete classes of anxiety trajectories were identified. Most youth fell within a stable-low anxiety symptom class (89.5% males; 78.2% females), with smaller percentages in low-increasing (5.6% males; 14.4% females) or high-decreasing (4.9% males; 7.4% females) classes. Low support from parents and teachers, low sense of school belonging, and high peer victimization predicted membership of the low-increasing anxiety trajectory class, irrespective of gender. Social support did not moderate the effect of peer victimization upon the risk of developing anxiety, with peer victimization remaining a risk factor even when adolescents experienced good social support from parents, peers, and school. The findings highlight the need for screening in early adolescence to identify those who are experiencing low social support and high peer victimization and are thus at increased risk of developing anxiety problems. In 2011, in Australia and Canada, two Aboriginal women – Lynette Daley and Cindy Gladue – died in suspicious circumstances suggestive of sexual homicide. At the time of their deaths, little media attention was given to their cases. However, several years later, as their cases progressed through the criminal justice system, the media would become intensely interested and numerous reports were subsequently published. These news stories, however, demonstrated that when colonialism, racism and sexism intersect they result in victims being to apportioned blame for their subsequent deaths. This paper reports on findings from a research project that examined print and online news media from 2011 to 2018, as these cases traversed the criminal court system. It illustrates that, when taken together the colonialism, racism and sexism prevalent in the news reporting served to characterise the victims as unworthy of the public's sympathy. This paper also provides a reflection on what it might take to reform the media's engagement in cases such as these, to achieve a reimagined justice where Aboriginal women's lives are valued and respected as victims of crime. Previous research highlights that important differences exist between victim groups, but the impact victim status can have on perceptions of police legitimacy remains underexplored. The following paper contributes to this body of literature by utilizing the National Security and Preparedness Survey (NSPS, 2011–2012) to explore the risk/protective factors for victimization and differences between prejudice motivated crime (PMC) victims, non-PMC victims and non-victims in the Australian context, using Multinomial Logit Regression models. The recent Australian Royal Commission into Institutional Responses to Child Sexual Abuse provided some insight into manifestations of child sexual abuse within an ultra-orthodox Jewish community. This paper extends the analysis by the Royal Commission (RC) to another Australian ultra-orthodox community that of Adass Israel, whereby a former school headmistress allegedly abused multiple students and then fled to the State of Israel in 2008. That case is unusual given that both the perpetrator and victims were female. Attention is drawn to a number of components similar to the RC findings pertaining to the particular vulnerability of children within ultra-orthodox communities given the absence of sex education and entrenched patriarchal authority, the reluctance of such communities to report child sexual abuse (CSA) allegations to secular authorities and associated cultural and religious factors, the failure of community leaders within or beyond Australia to support or compensate CSA survivors, and the absence of formal child protection protocols. Additionally, some conclusions are drawn about the key role played by advocacy groups such as Jewish Community Watch in exposing the global travel of child sex offenders, and the problematic legal protection provided to many such offenders by the State of Israel's Law of Return.

In a national survey of witnessing racism, ten per cent of respondents reported an event where they perceived a white Australian had been the target of racism. We discuss the social and political context in which claims of anti-white ‘racism’ have come to the fore. The paper introduces three analytical entry points from which to approach the problem of anti-white ‘racism’: an individual analysis, an analysis of power and its effects, and a historical and structural analysis. These entry points cascade into each other, revealing both divergence in how these reported experiences might be understood and the tensions between different ways of approaching the analytical problem of claims of anti-white ‘racism’. We explore the characteristics of those who report witnessing anti-white ‘racism’ and examine the contexts within which anti-white ‘racism’ is perceived to have occurred. The racialised incidents reported are analysed in their specificities; we attend to the individuals involved and their social positioning, the historical context and how the event relates to structures and histories of domination. The perspectives of the First Peoples of Australia are unravelling the dominant narratives of heroic European pioneers, peaceful settlement and accommodation. The debates about Australia's past as one of invasion and violent conflict, and often referred to as the 'history wars', have become part of a battle for the present. During the late nineteenth and early twentieth centuries, Yamaji, from the mid-west of Western Australia, fought for country and family in a war of resistance against squatters, miners, settlers and police. The emotional responses of Yamaji to colonial violence and dispossession were deeply felt, but rarely acknowledged in what was then described in the press as a 'state of war' between blacks and whites.1 There are, however, numerous accounts of the fears and anxieties felt and expressed by colonial society at this time on the public record. But, although there are historical accounts of the physical impacts of the violence on Yamaji people, their emotional responses were either absent, dismissed, hinted at, or 'lost' in the translations of a form of Aboriginal English. The transgenerational effects of this historical trauma are still felt today by Yamaji. Its impacts on overall health and emotional well-being is now recognised so that processes of acknowledgement and healing may begin.2 This paper explores a history of Yamaji emotions in the context of a historical discourse on race war and the biopolitical and paramilitary responses of government towards Yamaji resistance that involved both discursive and physical violence. Purpose This paper aims to determine the level of online fraud offending within an Australian jurisdiction and how to best apply resources to combat it.Design/methodology/approach Empirical data were provided by an Australian law enforcement agency, and qualitative responses were obtained from the parties involved in the crimes themselves (the victims, the offenders and the nominated law enforcement agency).Findings Although there was variance between the ages of the online fraud victims, there was a slightly higher chance of an older member of the population falling victim to an offender than that of a younger person. The number of a particular gender reporting an instance of cybercrime in a given area can be higher if the total number of participants in that area was also high. Older victims were more likely to lose larger amounts of money to online fraud. Furthermore, it was found that when the non-gender identifiable data were removed, this increased to over 80 per cent.Originality/value Existing literature on online fraud and criminal offending generally focused on the quantitative aspects of measuring offending, which does not give an indication into the “why” component of the study: why are these offences being committed; why do these offenders pick particular victims; and why do the victims fall for such ruses? In this paper, the authors combined the qualitative responses obtained from those parties involved in the crimes themselves (the victims, the offenders and the nominated law enforcement agency) with a quantitative examination of the crime figures provided by an Australian law enforcement agency. The paper examines trends in the policing of right-wing violence in Australia. It describes and assesses the threat of violence from explicit right-wing organizations, and outlines developments in the ‘hate’ crime phenomenon. The paper identifies several of the communities in Australia most vulnerable to such crime, such as the Indigenous community and in recent years members of the Islamic community. The paper explains and critiques national and local legislative and law enforcement responses to crimes of hate and violence based on racist and other discriminatory sentiments. It concludes by advocating a commitment by police services to a human rights enforcement ethic which renders intolerable the victimization of vulnerable communities by crimes motivated through hate. Background: While much attention has been given to the prediction of violent offending behaviour amongst people with psychotic disorders, less attention has been given to the fact that these same individuals are often the victims of violence. In this paper, we examine victimisation amongst participants in a prevalence study of psychosis, and describe demographic and clinical correlates of victimisation. METHOD The study was based on the Australian National Survey of Mental Health and Wellbeing--Low Prevalence (Psychotic) Disorders. The participants were asked if they had been a victim of violence in the previous year. The association between selected demographic and clinical variables and being a victim of violence was examined using logistic regression.Results: Of the 962 individuals with psychosis, 172 reported being a victim of violence in the past 12 months (17.9 %). The odds of being a victim were increased in those who: (a) were female, (b) were homeless, (c) had a lifetime history of substance abuse, (d) had been arrested in the previous 12 months, (e) had poorer social and occupational function, and (f) had higher scores on the disorganisation summary score.Conclusions: Clinicians should remain mindful that one out of every six individuals with a psychotic disorder reports being a victim of violence in the previous year. Models of care that address issues related to symptom relief, accommodation, and exposure to high-crime areas may reduce the rates of victimisation amongst those with psychotic disorders. Crime script analysis was used to analyze intimate partner violence diversity by identifying variables significantly associated with different script tracks. Qualitative thematic analysis using official police administrative data from Queensland, Australia, was used to develop an intimate partner violence protoscript (n = 40), followed by quantitative hierarchical cluster analysis and cross-tabulations to examine diversity within scripts. Four diverse script tracks were identified: "escalating jealousy," "persistently possessive," "controlling victim agency," and "enduring argument." Intimate partner diversity exists with divisions based on statistically significant variables. Implications for situational crime prevention and the use of mixed methods for strengthening crime script analysis are discussed. [ABSTRACT FROM AUTHOR]

Background: This paper investigates gender differences in persistence of intimate partner violence (IPV), for those remaining or leaving an abusive relationship. We followed a sample of males and females to examine whether leaving an abusive partner may alter the continuity of victimization., Methods: Data were taken from the 21 and 30-year follow-ups of the Mater Hospital and University of Queensland Study of Pregnancy (MUSP) in Australia. A cohort of 1265 respondents, including 874 females and 391 males, completed a 21-item version of the Composite Abuse Scale., Results: We found proportionally similar rates of IPV victimization for males and females at both the 21 and 30 year follow-ups. Females who reported they had an abusive partner at the 21 year follow-up were more likely to subsequently change their partner than did males. Harassment and then emotional abuse appeared to have a stronger association for females leaving a partner. For males, a reported history of IPV was not significantly associated with leaving the partner. There was no significant association between leaving (or not) a previous abusive relationship and later victimization, either for male or female respondents., Conclusion: Changing a partner does not interrupt the continuity of victimization either for male or female respondents, and previous IPV victimization remained a determining factor of re-abuse, despite re-partnering.

Online fraud poses a significant problem to society in terms of its monetary losses and the devastating impact on victims. It also poses significant challenges to law enforcement agencies, regarding their ability to investigate crimes which are complex, occur in a virtual environment, incorporate multiple (often international) jurisdictions, and have a very low reporting rate. This paper examines the police response to online fraud. It argues that traditionally, fraud has received little attention and priority from police agencies and this is exacerbated in the online context. In contrast to this, the paper presents the example of Project Sunbird, a partnership between the West Australian Police and the West Australian Department of Commerce which has embraced the use of financial intelligence to proactively contact suspected victims of online fraud. Public perceptions of crime and victimisation can influence an individual's subjective well-being. Research into the impact of the fear of crime and victimisation on subjective well-being, however, has been limited; particularly with respect to the relative contributions of real versus perceived crime towards an individual's self-reported life satisfaction. Improving our understanding of the relationship between crime and well-being is important, as public resources assigned to reducing or controlling crime could be assigned to addressing other social concerns. This paper extends the literature by exploring the contribution of real and perceived crime in an individual's local area to their self-reported life satisfaction. Our results indicate that: (1) individuals' perceptions of crime in their local area are far greater than actual levels of crime; (2) the gap between perceived and real crime is widening as real crime rates fall faster than the perceived rate of crime; (3) real crime rates detract more from an individual's self-reported life satisfaction than perceived rates of crime; however, (4) perceived rates of crime have an adverse impact on life satisfaction beyond those associated with real crime; and (5) there is significant heterogeneity in the life satisfaction effects of real and perceived crime among groups of individuals. These results, together with empirical evidence highlighting successful strategies for moderating perceptions of crime, facilitate the development of more informed public policy that will improve individual life satisfaction and, ultimately, community well-being. Purpose - The purpose of this paper is to provide an outline of the strengths and weaknesses of selected models of police-based victim services. It aims to provide an overview of the current predominant models of police-based victim support in the USA, Canada, UK and Australia. It also aims to advance a typology of police-based victim services as a useful analytic tool for understanding the varying models. Design/methodology/approach - The research was based on extensive documentary analysis supplemented by semi-structured interviews with 17 practitioners in the USA, Canada and Australia. Sites were selected for interview based on documentary research which indicated that they had developed police-based victim services in their organization that were either particularly representative or innovative. Findings - Police-based victim services can be categorized into three broad models: unit services, dedicated liaison officer services, and referral services. Each model has strengths and weaknesses in terms of service delivery and police organization. Unit services may be optimum in delivering services but are also resource-intensive and may be beyond the financial scope of some police organizations. They also potentially risk sequestering victim services within police organizations and reinforcing a view that dealing with victims of crime is not "real policing". Dedicated officer services require significant institutional input to achieve their goals, while referral models necessitate workable mechanisms for inter-agency cooperation. Thus police organizations need a clear perception of their victim services delivery role and how this might best be achieved. Originality/value - The academic literature on police-based victim services remains scant. This paper makes a valuable contribution to the literature by providing a useful typology for the analysis of police-based victim services and the assessment of their strengths and weaknesses. Identity theft restricts victims' lives, even if the stolen identity is not used for criminal purposes, as victims may be unable to obtain documents or benefits until the thief is prosecuted. The issue for regulators and consumers is that with the expansion of digital technologies identity theft is at once easier to perpetrate and harder to detect. This paper reviews the regulation of identity theft in Australia in light of the introduction by the Queensland Government on 7 February 2007 of a specific offence of identity theft. Aligned with this is the introduction on the same day by the Australian Government of the Human Services (Enhanced Service Delivery) Bill 2007 under which a smart `Access Card' will be issued to Australian residents who receive Federal benefits. This paper examines the relationship between police departments and equity agencies in Australia. Previous research has shown marked differences in the performance of police in fulfilling the requirements of equity legislation. Responsibility for ensuring compliance with anti-discrimination and affirmative action legislation rests with equity agencies - which 'police the police'. The paper reports the results from a survey of these agencies to obtain their accounts of factors facilitating or hindering police compliance. These factors are framed in terms of agency powers, resources, regulatory strategies and police responses. The study found that regulatory agencies were highly detached from police departments and that differences in compliance were largely the result of factors independent of regulatory action. A `culture of under-enforcement' remained as the most likely explanation for regulatory failure . The spatial analysis of crime and the current focus on hotspots has pushed the area of crime mapping to the fore, especially in regard to high volume offenses such as vehicle theft and burglary. Hotspots also have a temporal component, yet police recorded crime databases rarely record the actual time of offense as this is seldom known. Police crime data tends, more often than not, to reflect the routine activities of the victims rather than the offense patterns of the offenders. This paper demonstrates a technique that uses police START and END crime times to generate a crime occurrence probability at any given time that can be mapped or visualized graphically. A study in the eastern suburbs of Sydney, Australia, demonstrates that crime hotspots with a geographical proximity can have distinctly different temporal patterns. [ABSTRACT FROM AUTHOR]

Restorative justice (RJ) encompasses a widely diverging set of practices whereby those most affected by crime are encouraged to meet, to discuss the effects of harms caused by one party to another, and to agree upon the best possible redress of harms when appropriate. In its inception in the late 1970s, RJ was conceptualized and developed as an alternative to formal criminal justice practices. Since this time, however, RJ has largely moved from being an alternative to criminal justice practices to an 'alternative' practice within criminal justice systems. This institutionalization has resulted in the significant growth of RJ practices, but has also resulted in RJ being used for criminal justice system goals that are at odds with the needs of victims or offenders. This paper examines the use of the Youth Justice Group Conferencing Program in Victoria, Australia. Drawing from interviews with conference conveners, our research highlights problems related to administrative 'constraints' and 'co-options' in conferencing in terms of referrals, preparation of conference participants, and victim participation. Following presentation of findings, we conclude with a discussion of implications for the use of RJ within a highly institutionalized setting. [ABSTRACT FROM AUTHOR]

The debate about whether genocide took place on the Australian colonial frontier began more than thirty years ago and appears to have reached an intellectual impasse. How then did the debate begin in Australia, how did it gain traction and why does it appear more vigorous in Australia than in other settler societies? To explore these questions, this paper places the debate within a larger context, firstly by comparing the Australian debate with those taking place in other similar British settler societies and then considering the ways European historians have invoked genocide discourse to explore nationalist histories. In taking this approach the paper reveals the different ways genocide discourse has been used to make sense of traumatic pasts in different regions of the world and how it has become part of the discussions about national identity. Finally in an attempt to overcome the intellectual impasse about the genocide debate in Australia, the paper offers a few suggestions that may give historians of the colonial frontier a way forward. Background: Much academic scholarship has explored drug use and 'addiction' in the criminal justice system., Methods: This paper explores what happens when 'addicts' are victims, through an analysis of victims of crime compensation case law within the state of Victoria, Australia., Results: We argue that the law enacts a set of unexamined assumptions about the 'problem' of addiction, including the assumption that it is incompatible to be both addict and victim. However, courts reconcile this 'dilemma' by explaining addiction as an 'effect' of trauma, violence or abuse, a seemingly sympathetic rendering of addiction. Although this appears to represent a less stigmatising approach than found in the criminal law, we argue that these processes actually produce new challenges for people who use drugs and 'addicts', and that these may be counter to the stated aims and objectives of crimes compensation law. We argue that even legal systems with an explicitly remedial rationale have the potential to generate harms, creating those who use drugs and 'addicts' as pathological in certain ways and thereby undermining their claims to citizenship. Our analysis is underpinned by a critical approach to the constitution of social problems based on the work of Carol Bacchi., Conclusion: Although the focus is on Australian law, the arguments we develop in this paper are likely to resonate beyond the specific jurisdiction reviewed here, and raise questions about the mutually interdependent role of law and policy in compounding the stigmatisation and marginalisation of people who use drugs and drug 'addicts'., (Crown Copyright © 2014. Exploring exemplarity in in-prison restorative rehabilitation to recover normativity: The ambiguous status of a prisoner as citizen has implications for rehabilitation and reintegration. Using Mazzucato's (2017) philosophical work on the responsive-restorative model of justice and the potential of exemplarity as a guiding theory, this article explores how prisoners can be incentivised to become fully citizens. Three concepts for action have been identified in Mazzucato's work: the virtuous zone, rules of conduct and exemplarity. These actions are reviewed and used to compare in-prison retributive practices and those exercised in a restorative rehabilitation programme which brings together prisoners and surrogate crime victims. The programme was designed in response to high rates of crime and incarceration associated with drug possession and supply in a regional city in Australia. The article concludes with a summary and findings that show how restorative responses can challenge the consequences of prison segregation, recover agency directed to voluntary compliance and exemplify normative conduct. It also demonstrates that restorative rehabilitation can have a residual effect. Some prisoners on release connected with a peer support service, the same organisation from which surrogate victims were drawn for the programme. Online frauds have become a major problem in many countries with millions of victims from a wide diversity of scams committed in full or part online. This paper explores the extent and nature of this problem. Using data from depth interviews with 15 online fraud victims, 6 focus groups with a further 48 online fraud victims and interviews with 9 professional stakeholders involved in combating this problem. The paper explores why victims fall for online scams. It identifies a range of reasons including: the diversity of frauds, small amounts of money sought, authority and legitimacy displayed by scammers, visceral appeals, embarrassing frauds, pressure and coercion, grooming, fraud at a distance and multiple techniques. Despite the Australian Government's attempts to reduce domestic violence (DV) incidences, impediments within the social and health systems and current interventions designed to identify DV victims may be contributing to female victims' reluctance to disclose DV experiences to their primary healthcare providers. This scoping review aimed to provide the state of evidence regarding reluctance to disclose DV incidents, symptoms and comorbidities that patients present to healthcare providers, current detection systems and interventions in clinical settings, and recommendations to generate more effective responses to DV. Findings revealed that female victims are reluctant to disclose DV because they do not trust or believe that general practitioners can help them to solve their issues, and they do not acknowledge that they are in an abusive relationship, and are unaware that they are in one, or have been victims of DV. The most common symptoms and comorbidities victims present with are sleep difficulties, substance use and anxiety. Not all GPs are equipped with knowledge about comorbidities signalling cases of DV. These DV screening programs are the most prominent intervention types within Australian primary health services and are currently not sufficiently nuanced nor sensitive to screen with accuracy. Finally, this scoping review provides formative evidence that in order for more accurate and reliable data regarding disclosure in healthcare settings to be collected, gender power imbalances in the health workforce should be redressed, and advocacy of gender equality and the change of social structures in both Australia and New Zealand remain the focus for reducing DV in these countries. In the history of the reconciliation movement in Australia over the past 20 years, the involvement of local communities has been a substantial component of the movement. In this paper, I demonstrate the significance of this involvement through exploring a case study in Gippsland, Victoria. I analyse the racist and ignorant attitudes held by many in the wider community in Gippsland concerning Indigenous people. I then explore several examples of the Gippsland community working for reconciliation. I have selected examples to illustrate each of the key components of reconciliation. These key components are outlined in this paper: recognising Indigenous rights; educating the wider community; addressing history; community involvement; and addressing Indigenous socio-economic disadvantage. This article analyses Australia's most recent policy changes in relation to witness protection in cases of trafficking in people, embodied in the Crimes Legislation Amendment (Slavery and Slavery-Like Conditions and People Trafficking) Bill 2012. It draws on an inductive thematic analysis to examine the process of formulating the new bill with two key aims: to analyze the community and professional input in relation to witness protection, and to evaluate Australia's new witness protection regime in view of its compliance standards set in relevant international instruments. In the data analysis we draw on the theoretical framework of critical criminology. We argue that the bill contains no new measures for witness protection and, thus, fails to amend Commonwealth legislation to rectify gaps and discrepancies in the areas of witness privacy and confidentiality, the implementation of victim impact statements, and the granting of visas conditional on the willingness of victims to cooperate with law enforcement. We maintain that Australia's policy discourse continues to be largely consistent with the Criminal Justice model of counter-trafficking and needs reform to align itself with the intended aims of the international human rights instruments. In conclusion, we recommend that the Australian Government respond urgently to community and scholarly feedback, and create provisions for these measures in Commonwealth legislation. Enacting the recommended provisions will provide Australia with a framework that will have the potential to protect victims of trafficking from secondary victimization, whilst ensuring that Australia is meeting its obligations under the international instruments on human trafficking. This paper investigates the attitudes and beliefs that the public hold about criminal behaviour in Japanese and Australian society, with a view to uncovering sources of resistance to, and support for, restorative justice. The study draws on a survey of 1,544 respondents from Japan and 1,967 respondents from Australia. In both societies, restorative justice met with greater acceptance among those who were (1) strong in social capital, (2) believed in offender reintegration and rehabilitation, (3) saw benefits for victims in forgiveness, and (4) were advocates for victims' voices being heard and amends made. The alternative 'just deserts' and deterrence models for dealing with crime were grounded in attitudes of punitiveness and fear of moral decay, and reservations about the value of reintegrating and rehabilitating offenders. Like restorative justice supporters, 'just deserts' and deterrence supporters expressed concern that victims' voices be heard and amends made. Findings -- Immigrants in Australia appear to be less victimised than natives. However, this may be an unwillingness of report victimisations and/or not defining certain events as victimisations. Immigrants are more likely than natives to perceive their victimisations as racially motivated and they experience higher levels of fear of crime. Although Indigenous people continue to experience racism in contemporary Australian society, we know little about the nature of such experiences. The Measure of Indigenous Racism Experiences [MIRE] assesses racism across several dimensions in an urban Indigenous context. This paper presents findings from 312 Indigenous volunteers who responded to the MIRE as part of the Darwin Region Urban Indigenous Diabetes study. Interpersonal racism was reported by 70 per cent of participants, most commonly from service providers and in employment and public settings. A third of respondents had high levels of internalized racism while two-thirds acknowledged the existence of systemic racism. Interpersonal and systemic racism were most commonly reported among older respondents, those of higher socioeconomic position and among those who identified strongly with their culture. Purpose — The purpose of this paper is to articulate a theory which connects social stratification processes to the international problem of human trafficking for sex and labor purposes. Design/methodology/approach — The paper develops a social politics theory to connect concepts from social stratification to the study of human trafficking. It draws on data provided by the US Department of Health and Human Services' Rescue and Restore program for trafficked victims to illustrate how traffickers move victims trans-nationally. It cites sources from Australia and Sweden to show how national laws and policies regarding prostitution can contribute to or discourage human trafficking for sex and labor purposes. Findings — The social politics theory is a theoretical idea based on observations of how social, political, legal, and economic changes within `Weak' and Tailing' states create an environment conducive to human trafficking for sex and labor purposes as well as other forms of injustices. In recent years, the Australian Government has committed significant resources to combating trafficking in persons. Within this larger anti-trafficking effort, the community sector, law enforcement, prosecutors, health professionals and members of the community all have an important role to play. As each sector comes to terms with the reality of trafficking in Australia, it is important that emerging challenges and possible solutions are identified. This paper focuses on the challenges that may confront law enforcement officials in any country in their efforts to detect trafficking, identify victims, investigate offences and contribute to the successful prosecution of offenders. Drawing on international experience, this paper identifies some examples of emerging good practice that can help to overcome these challenges, and contribute to the effectiveness of the larger criminal justice response to trafficking. Building on earlier research undertaken at the Australian Institute of Criminology (Pinto & Wilson 1990), the current research explores the serial murder phenomenon in Australia using data collected as part of the Institute's National Homicide Monitoring Program (NHMP). Results show that between July 1989 and June 2006, there were 11 groupings of serial murders identified in the NHMP, committed by 13 known serial murder offenders, with a total of 52 known victims. This represents one percent of the total number of homicides in Australia over a 17 year period. The paper reports on the characteristics of offenders and victims, including the offenders' modus operandi. The analysis found that the profile of serial murder in Australia is similar to that found in international research. In at least two of the groups of serial murders the victims had been reported as missing to police. It is important to note that the paper reports on known homicides. The paper suggests that further research on the profile of long term missing persons and serial murder victims should be undertaken as well as exploring offenders who commit multiple murders on separate occasions, to identify what prevented them (apart from law enforcement intervention) from committing additional murders. Analysis of US hate crime legislation reveals a significant overall trend involving: (1) the inclusion of a notion of hate motivation on the part of the offender; (2) the provision for enhanced penalties; and (3) the identification of particular victimized groups who are listed in state and federal hate crime statutes. Whether or not a person is recognized as a hate crime victim in US statutes has been shown to be heavily influenced by the strength of social movements based on politicized identities. It is argued that this alignment problematizes the position of victims who are the targets of hate crimes yet who fail to organize on the basis of identity politics, lack political clout, have insufficient moral status, or who see hate crime legislation as an ineffective way of dealing with their particular concerns. This paper examines the barriers to achieving hate crime victim status for persons who are targeted because of their occupations or sexual orientation. The specific examples I will use are doctors and other workers in abortion clinics, sex workers and paedophiles. These widely disparate groups have been selected as examples to highlight some of the moral status, politicized identity and social movement and lobbying strength issues that are currently involved in being recognized as a victim of hate in the US. It is argued that Australia should not proceed down the track of introducing hate crime legislation. Hate crime legislation is the source of serious social disquiet and acrimony in the US. There are inequities built into the alignment between proving hate intent and the enhanced penalty approach that involve giving higher symbolic status to some bodies and not others. As the experience in the US shows, this has a dangerous potential to undermine social cohesion and community faith in equality before the law as well as creating a breeding ground of resentment. Speaking out in the public interest--being a whistleblower--can be risky. Media reports and public inquiries into allegations of misconduct in the public and private sectors regularly recount the negative consequences that those who make reports in the public interest have experienced--despite the presence of legislation that seeks to prevent reprisals and retaliation for disclosing misconduct. Instances in which whistleblowers have lost employment and careers, suffered harassment and intimidation, and experienced threats or acts of violence continue to occur in Australia. This study sought to understand the nature of victimisation experienced by whistleblowers who had reported or attempted to report wrongdoing in their workplace. Information was obtained from in-depth interviews with 36 whistleblowers and 21 people who dealt with their reports in public and private sector organisations. The results confirm the nature of the harms that almost all whistleblowers experience as a consequence of reporting misconduct. The paper concludes by identifying ways in which whistleblowers could better be protected from victimisation and how the procedures and safeguards involved in the whistleblowing process could be strengthened. Archival research into episodes of frontier violence in the Kimberley region of Western Australia indicate that the bodies of Aboriginal victims of massacres were frequently incinerated following the event. This paper presents the results of a scientific investigation of a reported massacre at Sturt Creek where burnt bone fragments were identified in two adjacent sites and documents the archaeological signatures associated with the sites. The methodology used to undertake the project brought together three systems of knowledge: the oral testimonies of the descent group originating from a sole adult survivor of the massacre; archival, historical and scientific research. An archaeological survey defined the two distinct sites containing hundreds of fragile bone fragments; a third site was found to be highly disturbed. Scientific investigations included macroscopic and microscopic examination of selected bone fragments by an anatomical pathologist and a zooarchaeologist and X-ray diffraction analysis of sixteen bone fragments. The anatomical pathologist and zooarchaeologist undertook macroscopic and microscopic examinations of selected bone samples to identify morphological evidence for human origin. It was concluded that three bone fragments examined may have been human, and two of the fragments may have been from the vault of a skull. It was concluded that the likelihood of them being human would be strengthened if it was found that the three samples had been subjected to high temperatures. X-ray diffraction analysis of 16 bone fragments provided this evidence. All fragments showed sharp hydroxylapatite peaks (crystallite sizes 9882nm and 597nm respectively) and all had been subjected to extreme temperatures of either 600°C for more than 80h, 650°C for more than 20h, 700°C for more than 4h or 800°C for more than 1h. XRD analyses were also done on bone samples collected from three cooking hearths at three different archaeological sites. It was found that two of the three samples had been exposed to substantially lower temperatures for a short time period. It was concluded that there was strong pathological and archaeological evidence that the bone fragments were human in origin, but that the evidence was not conclusive. In this article, we explore the act of resistance by nurses and midwives at the nexus of abortion care and gender‐based violence. We commence with a brief overview of a multiphased extended grounded theory doctoral project that analysed the individual, situational and socio‐political experiences of Australian nurses and midwives who provide abortion care to people victimised by gender‐based violence. We then turn to Essex's conceptualisation of resistance in health and healthcare and draw upon these concepts to tell a unifying and cohesive story about how nurses and midwives exercise their politics. Vignettes taken from the three study phases are provided for demonstrative purposes. Finally, we discuss the potential of resistance in health and healthcare as a postmodern feminist research tool to analyse acts by nurses and midwives that could be categorised as political. Juvenile populations face a substantial risk of emotional, physical, and psychological harm as a result of bullying and cyberbullying experiences. As a result, there is a need to assess the situational and individual factors contributing to the risk of bullying victimization. There is, however, little research examining cyberbullying victimization using frequency-based measures of victimization. To address this gap in the literature, this study utilized a sample of over 37,000 youth from South Australia to explore the risk factors associated with cyberbullying victimization through a routine activities framework while controlling for verbal, social, and physical bullying. The findings noted partial support for the routine activities theory framework to account for cyberbullying victimization. Additionally, the study found differences in cyberbullying risk factors relative to the frequency with which it was reported, as well as the role of school support from peers and adults in increasing risks. The objectives of this study are to assess the association between childhood bullying and preference-based health-related quality of life (QoL) in Australian school children and their parents and estimate quality-adjusted life years (QALYs) associated with bullying chronicity. Children aged 8–10 years completed the child health utilities (CHU-9D), while parents completed the Australian quality of life (AQoL-8D). Children were grouped into four categories of bullying involvement (no bullying, victim, perpetrator, or both perpetrator and victim) based on the Revised Olweus Bully/Victim Questionnaire. Parental data were compared across two bullying involvement groups (bullying vs. no bullying). QALYs were calculated for children over two years and comparisons made based on the number of assessments where bullying was reported (baseline, 1- and 2-year follow up). Children who were involved in bullying (victims and/or perpetrators) reported statistically significantly lower mean utility scores compared to children who were not involved in bullying. Parents whose child was involved in bullying had significantly lower mean utility scores compared to parents of children not involved with bullying. There appeared to be a dose–response relationship, with higher QALY losses associated with increasing frequency of reported bullying. Bullying among Australian school children was associated with significantly lower preference-based QoL for themselves and their parents. This study also confirmed the significant burden of disease for bullying among children measured by an incremental decrease in QALY with an increasing chronicity of bullying over time. Intimate partner violence (IPV) is associated with adverse outcomes for both victims and perpetrators, though there is significant heterogeneity in manifestations of relationship violence. A growing amount of research has focused on elucidating predictors of clinical IPV—defined as severe violence involving institutional or medical intervention due to actual or potential injury—so as to better understand potential prevention and intervention targets. Early life adversity (ELA) is associated with IPV in adulthood, yet this literature focuses on discrete, retrospectively reported adversities (e.g., physical abuse and neglect) and has yet to consider clinical IPV as an outcome. Little is known about if and how broadly adverse early environments may confer risk for this specific form of relationship violence. We investigated associations between exposure to ELA prior to age five and clinical IPV victimization and perpetration by age 20 in a longitudinal, community-based sample of men and women in Australia (N = 588). Early life adversity was prospectively indexed by maternal reports of financial hardship, child chronic illness, maternal stressful life events, maternal depressive symptoms, parental discord, and parental separation. Youth interpersonal conflict life events at age 15—an interviewer-rated assessment of episodic stressors involving conflict across relationships in mid-adolescence—was tested as a potential mediator for both victims and perpetrators. Among women, ELA predicted IPV victimization and perpetration, and interpersonal conflict life events partially mediated the link between ELA and victimization, but not perpetration. Neither ELA nor interpersonal conflict life events predicted victimization or perpetration among men. Women exposed to ELA are at-risk for conflictual interpersonal relationships later in life, including violent intimate relationships, and deficits in conflict resolution skills may be one mechanism through which ELA leads to IPV victimization among this subgroup. In a recent Australian homicide, trace soil on the victim's clothing suggested she was initially attacked in her front yard and not the park where her body was buried. However the important issue that emerged during the trial was how soil was transferred to her clothing. This became the catalyst for designing a range of soil transference experiments (STEs) to study, recognise and classify soil patterns transferred onto fabric when a body is dragged across a soil surface. Soil deposits of interest in this murder were on the victim's bra and this paper reports the results of anthropogenic soil transfer to bra-cups and straps caused by dragging. Transfer patterns were recorded by digital photography and photomicroscopy. Eight soil transfer patterns on fabric, specific to dragging as the transfer method, appeared consistently throughout the STEs. The distinctive soil patterns were largely dependent on a wide range of soil features that were measured and identified for each soil tested using X-ray Diffraction and Non-Dispersive Infra-Red analysis. Digital photographs of soil transfer patterns on fabric were analysed using image processing software to provide a soil object-oriented classification of all soil objects with a diameter of 2 pixels and above transferred. Although soil transfer patterns were easily identifiable by naked-eye alone, image processing software provided objective numerical data to support this traditional (but subjective) interpretation. Image software soil colour analysis assigned a range of Munsell colours to identify and compare trace soil on fabric to other trace soil evidence from the same location; without requiring a spectrophotometer. Trace soil from the same location was identified by linking soils with similar dominant and sub-dominant Munsell colour peaks. Image processing numerical data on the quantity of soil transferred to fabric, enabled a relationship to be discovered between soil type, clay mineralogy (smectite), particle size and soil moisture content that would not have been possible otherwise. Soil type (e.g. Anthropogenic, gravelly sandy loam soil or Natural, organic-rich soil), clay mineralogy (smectite) and soil moisture content were the greatest influencing factors in all the dragging soil transference tests (both naked eye and measured properties) to explain the eight categories of soil transference patterns recorded. This study was intended to develop a method for dragging soil transference laboratory experiments and create a baseline of preliminary soil type/property knowledge. Results confirm the need to better understand soil behaviour and properties of clothing fabrics by further testing of a wider range of soil types and clay mineral properties. [ABSTRACT FROM AUTHOR]

In the United States (U.S.) and Australian contexts, the fight to achieve legal and societal recognition of cisgender men's violence against cisgender women operated according to an incident-based victim-offender binary. Those held accountable for the violence were seen as offenders, those who survived the violence were seen as victims. This binary persists across police, court, corrections, intervention, and child protection settings. However, work with cisgender heterosexual women with offenses of abuse and violence demonstrates that the binary does not capture their complex experiences. Instead, they have "offended" in the context of often surviving long-term harm in their families of origin and from their intimate partners. Because their experiences do not align with the binary, they are caught in ineffective and retraumatizing responses. The authors use an intersectional theoretical framework to explore how heterosexual cisgender women's use of force complicates the victim-offender binary. By understanding women who have used force as having both survived and caused harm, rather than "victims" or "offenders," the authors call attention to the limitations of, and harm caused by, binary approaches. The authors also call for a reconceptualization beyond the binary—challenging established legal and intervention frameworks. To demonstrate the need for this reconceptualization, the authors report on U.S. and Australian legal cases, intervention approaches, and discuss socio-legal systems implications. Digital technologies are increasingly being used as tools for the perpetration of domestic violence. Little empirical research to date has explored the nature and impacts of technology-facilitated domestic violence (TFDV), and even less attention has been paid to the experiences of immigrant and refugee women. This article examines the nature and impacts of TFDV as experienced by immigrant and refugee women. Drawing on interviews with 29 victim-survivors and 20 stakeholders, we argue that although immigrant and refugee women may experience TFDV in similar ways to non-immigrant and refugee women, they face unique challenges, such as language barriers, cultural bias from support services, lack of financial resources, lack of trust in state institutions, and additional challenges with justice and migration systems. Immigrant and refugee women also face multiple structural layers of oppression and social inequality. Accordingly, we argue that a multifaceted approach is required to address TFDV that includes culturally sensitive and specific law reform, education, and training. [ABSTRACT FROM AUTHOR]

Most discussions of environmental crime typically refer to environmental degradation at the macro level, such as the large scale pollution of rivers or oceans, where there is no clear victim. This paper reports on a study which examined environmental crime from a more micro, place-based perspective, namely incidents that occur on farms where individual farmers are victims. Almost half of the 1926 respondents to a nation-wide survey of Australian farmers reported experiencing some type of environmental harm over the previous two years. Three case studies then examined whether farmers defined such harms as environmental ‘crime’. Many but not all harms were described as crimes and there was divergence as well as convergence with formal law. In some areas, farmers' appreciations led formal proscriptions. Where farmers ‘lagged’ behind, contextual reasons were provided for the exceptions. All actions leading to harm were considered criminal if intentional, while accidental acts were not. Negligence was also used to define some actions as environmental crimes. The findings add to the growing literature on Green Victimology and the need to understand informal norms and appreciations of law as well as formal impositions and structures. In Australia, protection orders are a key legal response to domestic violence, and are often viewed as a way of providing for victim safety. For instance, recently the joint Australian and New South Wales Law Reform Commissions recommended that a common core purpose of all state and territory domestic violence legislation should be 'to ensure or maximise the safety and protection of persons who fear or experience family violence' (2010:Recommendation 7-4). Drawing and building upon prior research in Australia and the United States ('US'), this paper uses comparative quantitative content analysis to assess the victim safety focus of domestic violence protection order legislation in each Australian state and territory. The findings of this analysis show that the Northern Territory, South Australia and Victoria 'stand out' from the other jurisdictions, having the highest victim safety focus in their legislation. However, there remains sizeable scope for improvement in all Australian jurisdictions, in terms of the victim safety focus of their legislative provisions and considerations of legislative inconsistency between jurisdictions. Bullying in the workplace is a serious concern both because of its high prevalence and the potential harm caused to its targets and withnesses. Reporting is low. There has been little research done that has examined the bullying victims' journeys down the different legal avenues in Australia. We aim to address at least part of that gap in this paper. We do that by first describing briefly the various remedial pathways available to victims, and then we report on our analysis of a sample of relevant legal cases. From the latter, we identify some demographic variables about the complainants and aspects of the bullying background to discover what type of target pursues the matter legally. We also determine if certain types of bullying appear to be more likely to result in upheld complaints, and to identify at least some of the other factors that may affect a complainant's success in disputes that involve bullying. Carjacking literature is limited, and perceptions vary about the level of violence involved, diverse scenarios and the motivations of offenders. The media tends to overrepresent carjackings involving weapons and violence, although these are relatively rare incidents. Motivations range from instrumental triggers (where the car is used in some other crime) to acquisition for onselling the car or its parts. Similarly, methods vary from opportunistic to organised theft involving support. This paper examines carjacking in Australia, the United Kingdom, the United States and South Africa reported through the literature. Victimisation surveys currently may be the most appropriate source for collecting carjacking estimates. Issues related to immigrants as criminals or victims of crime resonate strongly in Australia because it has a relatively larger and more diverse immigrant population than most western countries. Focusing on Sydney, the aim of this article is to explore a number of aspects of immigrant victimology in Australia: immigrants as victims of crime; as victims of the fear of crime; as victims of racial abuse and violence in the aftermath of the 11th of September, 2001; and as victims of media discourses about 'ethnic crime'. To do this the article draws on national and international research into immigrant crime and immigrant victimology and on two sources of primary data: a Sydney survey of 825 youth and adults (eighty per cent of whom were immigrant minorities) and data from a Hotline established in Sydney in the immediate aftermath of 9/11. The paper provides evidence of each dimension of immigrant victimology and concludes that there has been a disproportionate focus on, and fear of, immigrant or 'ethnic' crime in the Sydney media. This discourse of immigrant criminality, exacerbated post 9/11, appears to leave little space for a more sympathetic discourse about immigrant victims of crime and the resulting construction of immigrant cultures of criminality leads to policy responses that ignore issues such as inequality, unemployment, education and neighbourhood renewal. Representations of victims embody the distinctive practices of organizations in and around criminal justice systems. In Australia, the origins of victims’ services are chiefly to be found in the activities of groups established to assist the families of homicide victims and the women victims of domestic violence and rape. The images of victimization engendered by those groups place a heavy emphasis on trauma, and the appropriate response is held to be counseling offered by specially trained practitioners. The outcome has been that the victims of volume crime such as theft, burglary, and malicious damage have been somewhat overlooked, blotted out, and left without substantial relief. To underscore the mediated nature of those representations, I shall conclude by describing a very different set of representations and attendant practices to be found in England and Wales, where victims are generally portrayed as those who have been affected by volume crime, and where services are provided by volunteers deemed not to require expert training in therapeutic support.
