Este trabajo revisa la institución del amparo dentro del Estado constitucional de Derecho, en la cultura jurídica del civil law. Se defiende la tesis de que la institución procesal del amparo no es teóricamente necesaria –en sentido lógico– para la existencia del Estado constitucional; las razones para justificar su implementación son entonces de tipo práctico. Se argumenta también que, con base en el constitucionalismo jurídico y tomándose en serio el proceso de constitucionalización de los ordenamientos, es posible estipular una concepción general del amparo e inferir un modelo óptimo, ajustado a las propiedades del Estado constitucional, que armoniza lo relevante de los actuales modelos europeo y latinoamericano y diluye sus problemas. Este modelo óptimo es el que deben tener presente quienes decidan implementar o mantener (con ajustes) la institución procesal del amparo.

The present study aimed to investigate the spontaneous dynamics of large‐scale brain networks underlying mindfulness as a dispositional trait, through resting‐state electroencephalography (EEG) microstates analysis. Eighteen participants had attended a standardized mindfulness‐based stress reduction training (MBSR), and 18 matched waitlist individuals (CTRL) were recorded at rest while they were passively exposed to auditory stimuli. Participants' mindfulness traits were assessed with the Five Facet Mindfulness Questionnaire (FFMQ). To further explore the relationship between microstate dynamics at rest and mindfulness traits, participants were also asked to rate their experience according to five phenomenal dimensions. After training, MBSR participants showed a highly significant increase in FFMQ score, as well as higher observing and non‐reactivity FFMQ sub‐scores than CTRL participants. Microstate analysis revealed four classes of microstates (A–D) in global clustering across all subjects. The MBSR group showed lower duration, occurrence and coverage of microstate C than the control group. Moreover, these microstate C parameters were negatively correlated to non‐reactivity sub‐scores of FFMQ across participants, whereas the microstate A occurrence was negatively correlated to FFMQ total score. Further analysis of participants' self‐reports suggested that MBSR participants showed a better sensory‐affective integration of auditory interferences. In line with previous studies, our results suggest that temporal dynamics of microstate C underlie specifically the non‐reactivity trait of mindfulness. These findings encourage further research into microstates in the evaluation and monitoring of the impact of mindfulness‐based interventions on the mental health and well‐being of individuals. - Abstract
En este trabajo se realiza lo siguiente: (i) un repaso descriptivo del diseño normativo del control judicial de constitucionalidad en el orden jurídico ecuatoriano; (ii) una sistematización de lo que identifico como los principales argumentos que se han esgrimido para defender, por un lado, la tesis de la vigencia de un control concentrado y concreto, y por otro, la tesis de la vigencia de un control «difuso» que derivaría en un diseño «mixto»; y, (iii) se cuestiona desde un enfoque conceptual algunos de esos argumentos, distinguiendo entre las cuestiones que son necesarias —en sentido lógico— y las contingentes —en sentido «político» de elección de diseño institucional—. Por último, se exponen algunas conclusiones que apuntalan la tesis de la vigencia de un control concentrado y concreto.

Este trabajo revisa la institución del amparo dentro del Estado constitucional de Derecho, en la cultura jurídica del civil law. Se defiende la tesis de que la institución procesal del amparo no es teóricamente necesaria –en sentido lógico– para la existencia del Estado constitucional; las razones para justificar su implementación son entonces de tipo práctico. Se argumenta también que, con base en el constitucionalismo jurídico y tomándose en serio el proceso de constitucionalización de los ordenamientos, es posible estipular una concepción general del amparo e inferir un modelo óptimo, ajustado a las propiedades del Estado constitucional, que armoniza lo relevante de los actuales modelos europeo y latinoamericano y diluye sus problemas. Este modelo óptimo es el que deben tener presente quienes decidan implementar o mantener (con ajustes) la institución procesal del amparo., This research reviews the institution of amparo within the Constitutional Rule of Law, in the civil law culture. It defends the thesis that the procedural institution of amparo is not theoretically necessary –in a logical sense– for the existence of the Constitutional Rule of Law; the reasons to justify its implementation are then of a practical nature. It is also argued that, based on legal constitutionalism and taking the process of constitutionalization of legal systems seriously, it is possible to stipulate a general conception of amparo and to infer an optimal model. This model is adjusted to the properties of the Constitutional Rule of Law, harmonizing the relevant aspects of the current European and Latin American models and dilutes its problems. The countries that decide to implement or maintain (with adjustments) the procedural institution of amparo ought to keep in mind this optimal model.

DFTB+ is a versatile community developed open source software package offering fast and efficient methods for carrying out atomistic quantum mechanical simulations. By implementing various methods approximating density functional theory (DFT), such as the density functional based tight binding (DFTB) and the extended tight binding method, it enables simulations of large systems and long timescales with reasonable accuracy while being considerably faster for typical simulations than the respective ab initio methods. Based on the DFTB framework, it additionally offers approximated versions of various DFT extensions including hybrid functionals, time dependent formalism for treating excited systems, electron transport using non-equilibrium Green's functions, and many more. DFTB+ can be used as a user-friendly standalone application in addition to being embedded into other software packages as a library or acting as a calculation-server accessed by socket communication. We give an overview of the recently developed capabilities of the DFTB+ code, demonstrating with a few use case examples, discuss the strengths and weaknesses of the various features, and also discuss on-going developments and possible future perspectives. - Abstract
Este trabajo intenta establecer el qué (Derecho), el cómo (la metodología) y el para qué (qué fines) de la enseñanza del Derecho dentro del Estado constitucional democrático. Para contestar aquello, primero se realiza una delimitación de las concepciones del Derecho que compiten dentro de este modelo de Estado. Luego se reflexiona sobre dichas preguntas desde los elementos de las concepciones jurídicas más relevantes, y con base en ello se evalúa la capacidad de esas posiciones teóricas para dar cuenta satisfactoriamente –o no– de una metodología adecuada y de su potencial para alcanzar los fines perseguidos por la educación jurídica y por el propio fenómeno jurídico del Estado constitucional de Derecho, como ideal regulativo. Se concluye que el postpositivismo se posiciona como la concepción teórica más adecuada para abordar esos tres componentes en la enseñanza del Derecho actual.

El artículo pretende mostrar cómo muchos de los temas fundamentales del Estado constitucional de derecho en América Latina encuentran su origen en el constitucionalismo alemán. A partir de esta convergencia, que supone la relevancia de la teoría del derecho como reflexión general sobre los problemas jurídicos, se concluye subrayando la importancia de contar con una concepción adecuada del fenómeno jurídico para desarrollar y defender el ideal de Estado constitucional de derecho que compartimos., This article seeks to show how many of the foundations of the constitutional rule of law in Latin America find their origin in German constitutionalism. Based on this convergence, which presumes the relevance of the theory of law as a general reflection on legal problems, the article concludes by emphasizing the importance of having an adequate conception of the legal phenomenon in order to develop and defend the ideal of the constitutional rule of law that we share.

La Ley Federal de Seguridad Aérea de Alemania en su artículo 14.3 autorizaba al Ministro de Defensa ordenar el derribo de una aeronave civil –con pasajeros y tripulación civil a bordo- si la misma era utilizada para atentar contra la vida de personas en objetivos en tierra. Posteriormente se demandó la inconstitucionalidad de aquella norma jurídica por aspectos de forma en su elaboración, pero principalmente por considerarse que atentaba contra el derecho a la vida y la dignidad humana de los pasajeros a bordo. En lo principal, se analiza la sentencia del Tribunal Constitucional Federal alemán evaluando la pertinencia de la argumentación mediante la cual declara la inconstitucionalidad de dicha norma jurídica, profundizando, particularmente, en las razones que da para considerar que una postura utilitarista que sólo mira a su resultado y evalúa la situación a partir de aspectos cuantitativos, atenta al derecho fundamental de la vida y la dignidad humana de las personas inocentes en el avión, no pudiendo permitirse que sea el propio Estado quien asesine de modo premeditado y selectivo a un grupo de ciudadanos inocentes numéricamente menor, para posiblemente así salvar la vida de otro grupo numéricamente mayor de ciudadanos también inocentes. The Air Security Federal Law of Germany in the article 14.3 authorized to the Minister of Defense to order the shooting down of a civil airplane –with passengers and civil crew on board- if it was used for threat against the life of the people on targets on earth. That legal norm was considered unconstitutional because of the way it was developed, but mainly because it was considered to threat against the right of life and human dignity of the passengers on board. In the main, it is analyzed the judgment of the German Constitutional Federal Tribunal and value the pertinence of the argumentation that declares the unconstitutionality of that juridical norm, deepening, particularly, in the reasons that it gives to consider that an utilitarian approach that only looks its results and evaluate the situation based on quantitative aspects, attack to the fundamental right of life and human dignity of the innocent passengers on board, not allowing that the own Government kills on a premeditated and selective way a group of innocent civilians minor in number, to possibly save the life of another group mayor in number of also innocent civilians.

- Abstract
La Ley Federal de Seguridad Aérea de Alemania en su artículo 14.3 autorizaba al Ministro de Defensa ordenar el derribo de una aeronave civil –con pasajeros y tripulación civil a bordo- si la misma era utilizada para atentar contra la vida de personas en objetivos en tierra. Posteriormente se demandó la inconstitucionalidad de aquella norma jurídica por aspectos de forma en su elaboración, pero principalmente por considerarse que atentaba contra el derecho a la vida y la dignidad humana de los pasajeros a bordo. En lo principal, se analiza la sentencia del Tribunal Constitucional Federal alemán evaluando la pertinencia de la argumentación mediante la cual declara la inconstitucionalidad de dicha norma jurídica, profundizando, particularmente, en las razones que da para considerar que una postura utilitarista que sólo mira a su resultado y evalúa la situación a partir de aspectos cuantitativos, atenta al derecho fundamental de la vida y la dignidad humana de las personas inocentes en el avión, no pudiendo permitirse que sea el propio Estado quien asesine de modo premeditado y selectivo a un grupo de ciudadanos inocentes numéricamente menor, para posiblemente así salvar la vida de otro grupo numéricamente mayor de ciudadanos también inocentes., The Air Security Federal Law of Germany in the article 14.3 authorized to the Minister of Defense to order the shooting down of a civil airplane –with passengers and civil crew on board- if it was used for threat against the life of the people on targets on earth. That legal norm was considered unconstitutional because of the way it was developed, but mainly because it was considered to threat against the right of life and human dignity of the passengers on board. In the main, it is analyzed the judgment of the German Constitutional Federal Tribunal and value the pertinence of the argumentation that declares the unconstitutionality of that juridical norm, deepening, particularly, in the reasons that it gives to consider that an utilitarian approach that only looks its results and evaluate the situation based on quantitative aspects, attack to the fundamental right of life and human dignity of the innocent passengers on board, not allowing that the own Government kills on a premeditated and selective way a group of innocent civilians minor in number, to possibly save the life of another group mayor in number of also innocent civilians.

39. Water supply and demand of the hydrographic demarcation of Manabi, Ecuador

- Abstract
Manabi is the only province in Ecuador that does not receive contribution of the runoff coming from the thaw of the snow-covered of the Andes mountain. This situation impacts severely on the agriculture activities. This study presents an estimate of water supply and demand of the Manabi hydrographic demarcation based on the hydro meteorological data and the water needs of the population by 2050. The research topic is very topical since it contributes to providing the necessary inputs for the planning and use of water resources in order to generate projects that tend to cover the current water deficit. The methodology used to estimate the water supply is based on the precipitation-runoff model proposed by the Soil Conservation Service of the United States of America. In fact, in spite of the annual volume of runoff has been estimated at 9658.83 hm3, against 2388.93 hm3, which is the average annual volume of water to meet the demands, from July to November it can be seen that the deficit reach at 330.27 hm3. The results obtained constitute a valuable tool for specialists and governmental and non-governmental institutions responsible for the control, planning and development of water resources in the region.

40. HIV Modulates Osteoblast Differentiation via Upregulation of RANKL and Vitronectin.

- Abstract
Bone loss is a prevalent characteristic among people with HIV (PWH). We focused on mesenchymal stem cells (MSCs) and osteoblasts, examining their susceptibility to different HIV strains (R5- and X4-tropic) and the subsequent effects on bone tissue homeostasis. Our findings suggest that MSCs and osteoblasts are susceptible to R5- and X4-tropic HIV but do not support productive HIV replication. HIV exposure during the osteoblast differentiation process revealed that the virus could not alter mineral and organic matrix deposition. However, the reduction in runt-related transcription factor 2 (RUNX2) transcription, the increase in the transcription of nuclear receptor activator ligand kappa B (RANKL), and the augmentation of vitronectin deposition strongly suggested that X4- and R5-HIV could affect bone homeostasis. This study highlights the HIV ability to alter MSCs' differentiation into osteoblasts, critical for maintaining bone and adipose tissue homeostasis and function.

- Abstract
Coronavirus disease 2019 (COVID-19) might impact disease progression in people living with HIV (PLWH), including those on effective combination antiretroviral therapy (cART). These individuals often experience chronic conditions characterized by proviral latency or low-level viral replication in CD4+ memory T cells and tissue macrophages. Pro-inflammatory cytokines, such as TNF-α, IL-1β, IL-6, and IFN-γ, can reactivate provirus expression in both primary cells and cell lines. These cytokines are often elevated in individuals infected with SARS-CoV-2, the virus causing COVID-19. However, it is still unknown whether SARS-CoV-2 can modulate HIV reactivation in infected cells. Here, we report that exposure of the chronically HIV-1-infected myeloid cell line U1 to two different SARS-CoV-2 viral isolates (ancestral and BA.5) reversed its latent state after 24 h. We also observed that SARS-CoV-2 exposure of human primary monocyte-derived macrophages (MDM) initially drove their polarization towards an M1 phenotype, which shifted towards M2 over time. This effect was associated with soluble factors released during the initial M1 polarization phase that reactivated HIV production in U1 cells, like MDM stimulated with the TLR agonist resiquimod. Our study suggests that SARS-CoV-2-induced systemic inflammation and interaction with macrophages could influence proviral HIV-1 latency in myeloid cells in PLWH.

- Abstract
This study aims to explore the influence of coinfection with HCV and HIV on hepatic fibrosis. A coculture system was set up to actively replicate both viruses, incorporating CD4 T lymphocytes (Jurkat), hepatic stellate cells (LX-2), and hepatocytes (Huh7.5). LX-2 cells' susceptibility to HIV infection was assessed through measurements of HIV receptor expression, exposure to cell-free virus, and cell-to-cell contact with HIV-infected Jurkat cells. The study evaluated profibrotic parameters, including programed cell death, ROS imbalance, cytokines (IL-6, TGF- β , and TNF- α ), and extracellular matrix components (collagen, α -SMA, and MMP-9). The impact of HCV infection on LX-2/HIV-Jurkat was examined using soluble factors released from HCV-infected hepatocytes. Despite LX-2 cells being nonsusceptible to direct HIV infection, bystander effects were observed, leading to increased oxidative stress and dysregulated profibrotic cytokine release. Coculture with HIV-infected Jurkat cells intensified hepatic fibrosis, redox imbalance, expression of profibrotic cytokines, and extracellular matrix production. Conversely, HCV-infected Huh7.5 cells exhibited elevated profibrotic gene transcriptions but without measurable effects on the LX-2/HIV-Jurkat coculture. This study highlights how HIV-infected lymphocytes worsen hepatic fibrosis during HCV/HIV coinfection. They increase oxidative stress, profibrotic cytokine levels, and extracellular matrix production in hepatic stellate cells through direct contact and soluble factors. 44. Leveraging large-scale biobank EHRs to enhance pharmacogenetics of cardiometabolic disease medications.

- Abstract
Electronic health records (EHRs) coupled with large-scale biobanks offer great promises to unravel the genetic underpinnings of treatment efficacy. However, medication-induced biomarker trajectories stemming from such records remain poorly studied. Here, we extract clinical and medication prescription data from EHRs and conduct GWAS and rare variant burden tests in the UK Biobank (discovery) and the All of Us program (replication) on ten cardiometabolic drug response outcomes including lipid response to statins, HbA1c response to metformin and blood pressure response to antihypertensives (N = 740-26,669). Our findings at genome-wide significance level recover previously reported pharmacogenetic signals and also include novel associations for lipid response to statins (N = 26,669) near LDLR and ZNF800 . Importantly, these associations are treatment-specific and not associated with biomarker progression in medication-naive individuals. Furthermore, we demonstrate that individuals with higher genetically determined low-density and total cholesterol baseline levels experience increased absolute, albeit lower relative biomarker reduction following statin treatment. In summary, we systematically investigated the common and rare pharmacogenetic contribution to cardiometabolic drug response phenotypes in over 50,000 UK Biobank and All of Us participants with EHR and identified clinically relevant genetic predictors for improved personalized treatment strategies., Competing Interests: Competing interests The authors declare that they have no competing interests.

- Abstract
The Coronavirus Disease 2019 (COVID-19) pandemic has resulted in the loss of millions of lives, although a majority of those infected have managed to survive. Consequently, a set of outcomes, identified as long COVID, is now emerging. While the primary target of severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) is the respiratory system, the impact of COVID-19 extends to various body parts, including the bone. This study aims to investigate the effects of acute SARS-CoV-2 infection on osteoclastogenesis, utilizing both ancestral and Omicron viral strains. Monocyte-derived macrophages, which serve as precursors to osteoclasts, were exposed to both viral variants. However, the infection proved abortive, even though ACE2 receptor expression increased postinfection, with no significant impact on cellular viability and redox balance. Both SARS-CoV-2 strains heightened osteoclast formation in a dose-dependent manner, as well as CD51/61 expression and bone resorptive ability. Notably, SARS-CoV-2 induced early pro-inflammatory M1 macrophage polarization, shifting toward an M2-like profile. Osteoclastogenesis-related genes (RANK, NFATc1, DC-STAMP, MMP9) were upregulated, and surprisingly, SARS-CoV-2 variants promoted RANKL-independent osteoclast formation. This thorough investigation illuminates the intricate interplay between SARS-CoV-2 and osteoclast precursors, suggesting potential implications for bone homeostasis and opening new avenues for therapeutic exploration in COVID-19., (© 2024 Wiley Periodicals LLC.)

- Abstract
Liver fibrosis is the excessive accumulation of extracellular matrix proteins, primarily collagen, in response to liver injury caused by chronic liver diseases. HIV infection accelerates the progression of liver fibrosis in patients co-infected with HCV or HBV compared to those who are only mono-infected. The early event in the progression of liver fibrosis involves the activation of hepatic stellate cells (HSCs), which entails the loss of lipid droplets (LD) to fuel the production of extracellular matrix components crucial for liver tissue healing. Thus, we are examining the mechanism by which HIV stimulates the progression of liver fibrosis. HIV-R5 tropic infection was unable to induce the expression of TGF-β, collagen deposition, α-smooth muscle actin (α-SMA), and cellular proliferation. However, this infection induced the secretion of the profibrogenic cytokine IL-6 and the loss of LD. This process involved the participation of peroxisome proliferator-activated receptor (PPAR)-α and an increase in lysosomal acid lipase (LAL), along with the involvement of Microtubule-associated protein 1 A/1B-light chain 3 (LC3), strongly suggesting that LD loss could occur through acid lipolysis. These phenomena were mimicked by the gp120 protein from the R5 tropic strain of HIV. Preincubation of HSCs with the CCR5 receptor antagonist, TAK-779, blocked gp120 activity. Additionally, experiments performed with pseudotyped-HIV revealed that HIV replication could also contribute to LD loss. It was found that the Auxivo LiftSuit reduced the load on the back and hip muscles when lifting heavy loads, but its effect on lower body kinematics, joint moments, and self-reported ratings was unclear. The purpose of this study was to assess the effect of this passive lift-exoskeleton design, on lower body kinematics, joint moments, and self-reported ratings during lifting of heavy loads. Twenty healthy subjects performed lifting of heavy loads with and without the exoskeleton under surveillance of a motion capture system. Medium and maximum level adjustments of the exoskeleton, as well as no exoskeleton use were analyzed. Our results indicate significant reduction (p <.01) in pelvis segment tilt and hip flexion ROM with the exoskeleton at maximum level adjustment in males during lifting. Lumbosacral flexion moment ranges were significantly decreased (p <.013) with the exoskeleton at maximum and medium level adjustment in males during lifting. The general user impressions were mostly positive, with participants reporting that it was easier to perform the task with the exoskeleton than without it (p <.0.001), and preferring and recommending the exoskeleton for the task. Although our findings may suggest negative effects of the Auxivo LiftSuit in males and females due to a ROM restriction and loose fit, respectively, it does not mean that the Auxivo LiftSuit is not useful for lifting tasks. - Abstract
We present the case of a 77-year-old male patient with a diagnosis of chronic calculous cholecystitis and choledocholithiasis, with a history of situs inversus totalis. Therefore, a laparoscopic cholecystectomy with common bile duct exploration were performed, using the "french mirror technique", with stone extraction. Patient evolved favorably. The aim of this study is to present this clinical case that is rarely reported in the world literature (only 9 cases). Its importance lies in the fact that it would be the first published clinical case report of a laparoscopic cholecystectomy and bile duct exploration with removal of the common bile duct stones in a patient with situs inversus totalis, performed in Peru.

49. The Prevalence of the Burnout Syndrome and Factors Associated in the Students of Dentistry in Integral Clinic: A Cross-Sectional Study.

- Abstract
Background: Burnout syndrome (BS) is composed of three interrelated dimensions (emotional exhaustion, depersonalization, and personal fulfillment), and it has been documented that it affects health professionals from an early age., Aims: Determine the prevalence of BS and associated factors in the integral clinic of the Dentistry Pilot School. Material and Methods . Two instruments were applied: (1) Maslach Burnout Inventory, which measures the degree of professional burnout through 22 items that describe the professional's attitudes and feelings toward work, as well as symptoms associated with this phenomenon; (2) the second questionnaire determines the possible symptoms of BS and consists of 14 questions that describe tiredness, sleep problems, digestive problems, respiratory problems and headaches, temporomandibular joint (TMJ), neck pain, back pain, and upper and lower extremity pain. The instruments were answered anonymously by a total of 300 students who participated in the study., Results: The emotional exhaustion of the participants was 48.3% at a higher level, the depersonalization was 46.7% at a higher level, and the low perception of personal fulfillment was 73%. In addition, it was shown that BS is significantly related to marital status ( p < 0.001

50. Viable SARS-CoV-2 Omicron sub-variants isolated from autopsy tissues.

- Abstract
Introduction: Pulmonary and extrapulmonary manifestations have been described after infection with SARS-CoV-2, the causative agent of coronavirus disease 2019 (COVID-19). The virus is known to persist in multiple organs due to its tropism for several tissues. However, previous reports were unable to provide definitive information about whether the virus is viable and transmissible. It has been hypothesized that the persisting reservoirs of SARS-CoV-2 in tissues could be one of the multiple potentially overlapping causes of long COVID., Methods: In the present study, we investigated autopsy materials obtained from 21 cadaveric donors with documented first infection or reinfection at the time of death. The cases studied included recipients of different formulations of COVID-19 vaccines. The aim was to find the presence of SARS-CoV-2 in the lungs, heart, liver, kidneys, and intestines. We used two technical approaches: the detection and quantification of viral genomic RNA using RT-qPCR, and virus infectivity using permissive in vitro Vero E6 culture., Results: All tissues analyzed showed the presence of SARS-CoV-2 genomic RNA but at dissimilar levels ranging from 1.01 × 10
2 copies/mL to 1.14 × 108 copies/mL, even among those cases who had been COVID-19 vaccinated. Importantly, different amounts of replication-competent virus were detected in the culture media from the studied tissues. The highest viral load were measured in the lung (≈1.4 × 106 copies/mL) and heart (≈1.9 × 106 copies/mL) samples.
