The rapid urbanization of the Williamson Road area of Roanoke during the late 1940's and early l950's brought about the plugging of the natural passageways for the escape of surface waters and the ponding of the urban runoff became a problem. In order to solve this, the city drilled several drainage wells. These wells gave the author I an opportunity to study: the effect of the geology on the ground-water, the ground-water quality, and the direction of flow of the ground-water. In order to study these, the author constructed a water-surface contour map, analyzed water samples after five minutes of pumping of four wells periodically during a two week period, analyzed ground-water samples, and performed a dye test. In conclusion, the water table is controlled by the geology and topography of the district. The reaction of the urban runoff and the ground-water is one of dilution with loads of pollutants going into the aquifer after each rain. The over-all quality of the ground-water is effected greatly by the rock in the aquifer. The flow of the ground-water seems to be toward Tinker Creek where it is discharged at large springs corresponding to major fault systems. Master of Science

In the Texas Court of Civil Appeals case Kunkel v. Bohuslav. Rule 386 of the Texas Rules of Civil Procedure (TRCP) requires an appellate record be filed with the appellate court—then the Texas Court of Civil Appeals—within 60 days from final judgment. Rule 386 also provides for a 60 day extension if an appellant can show good cause; a showing of why the record was not timely filed is not adequate. The Court in Kunkel held that because of Rule 386, only a written request could be considered in deciding whether or not the appellate record has been requested promptly. The author comments, that Kunkel is unique because no prior decision had looked to form to determine promptness of filing. Further, the author claims making the form, a written-request, the requirement for appeal confuses policy considerations and frustrates the objective of civil practice.

The Texas Supreme Court held in Schwing v. Bluebonnet Express, Inc. that the contributory negligence of a surviving spouse does not bar recovery by other statutory beneficiaries of the deceased spouse in an action under the Texas Wrongful Death Act. In sum, the effect of Schwing is to permit judgments which were previously precluded by operation of the community property defense. The author argues that Schwing provides some measure of financial protection to dependent children and parents of a deceased spouse because their claims are no longer barred by the community property defense. The author suggests courts should allow contribution between the third party tortfeasor and the offending spouse by abolishing the doctrine of interspousal immunity in wrongful death actions.

Excerpts from the report: This report examines nonprice specifications of loads of interior Florida fresh citrus fruit shipped to retail and wholesale buyers during the 1958-59, 1961-62, and 1966-67 seasons. Load specifications are compared as indicators of buyers’ requirements. Important shipment characteristics, buyer-shipper relationships, and changing shipping patterns are examined in detail. Farmer Cooperative Service (FCS) made this study to provide Florida citrus growers, their cooperatives, and others in the industry an opportunity to examine these characteristics and to consider their implications for fresh fruit sales and shipping operations. Study findings are based on data provided by the Citrus and Vegetable Inspection Division of the Florida Department of Agriculture.
