4. Criminal Justice Policy and Victim-Survivor Empowerment: A Case Study of Domestic Violence Disclosure Schemes in England and Wales

Abstract

Empowering victim-survivors has long been recognised as one key strategy in reducing domestic abuse. This article explores whether Domestic Violence Disclosure Schemes as a criminal justice response to preventing domestic abuse in the United Kingdom are experienced as empowering in practice. Centralising victim-survivor voices, this article argues that variability in experiences of feeling empowered or disempowered pivoted upon whether those who deliver the scheme adopted an incident or process focussed approach. It concludes that while such schemes can be empowering when concomitant support is forthcoming, ultimately the victim-survivors in this study were left feeling disillusioned because of the disparities between what was expected and the limits of what was delivered in practice.

Abstract

This article reports data from interviews with 66 professionals working across safeguarding, health, criminal justice and specialist domestic abuse services exploring their views about older victims' experiences of domestic abuse. The findings reveal that older victims, despite embodying many of the criteria of Christie's ideal victim, are not ideal enough as they fail to conform to the stereotype of the young, female victim of intimate-partner abuse. Similarly, their perpetrators, whether older partners or younger sons/other family members, fall short of the necessary criteria to be seen as legitimate offenders—they are not quite ideal—meaning domestic abuse against older adults is frequently repackaged as a health issue, with significant implications for professional practice. The article discusses domestic violence disclosure schemes in Australia and their effectiveness in improving safety for victim-survivors of intimate partner violence. These schemes allow people to check if someone has a documented history of domestic violence. However, research suggests that these schemes may not actually improve safety for victim-survivors. Many applicants already separated from their abusive partners before accessing the scheme, indicating that it confirms decisions made after violence has occurred rather than preventing it. Additionally, the timely sharing of information and the reliability of data are concerns, and follow-up support for applicants is often lacking.
